<section id="HDA0B1636F28A4C198DFB39122FE78889" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Multiple Substance Impaired Driving Prevention Act of 2021</short-title></quote>.</text></section> <section id="HE47BEED947FC4FA09515F48A9AAFAF1B"><enum>2.</enum><header>Findings; sense of congress; purpose</header> <subsection id="H7C22AFBBC0654E96BAC68C241FC3BDC0"><enum>(a)</enum><header>Sense of congress</header><text>It is the sense of Congress that—</text>
<paragraph id="H95B72F1400E14BD895AFBC803D26EEAF"><enum>(1)</enum><text>a priority should be placed on creating State systems, programs, and processes that improve impaired driving detection in cases in which alcohol, drugs, and especially multiple substances are involved;</text></paragraph> <paragraph id="H6D47F67382184D8A8D664A4E25804863"><enum>(2)</enum><text>States and communities should have access to a broader range of countermeasures, technologies, and resources to address multiple substance impaired driving; and</text></paragraph>
<paragraph id="HB54EFDF731AD4960B6CA27703A2D6F42"><enum>(3)</enum><text>increased Federal funding should be made available for efforts to improve public safety through the approaches described in paragraphs (1) and (2).</text></paragraph></subsection> <subsection id="HC3CC0E916220488F86BA2428AB822BCF"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to increase national investment in, and maximize the use of, innovative programs and technologies to eliminate multiple substance impaired driving.</text></subsection></section>
<section id="H21CB3AED19D9493D933274B0A0532F5D"><enum>3.</enum><header>Impaired driving prevention and reporting</header>
<subsection id="HB030CBD6C9E64EA493D4AF563AC199BC"><enum>(a)</enum><header>Use of funds for multiple substance impaired driving</header><text>Section 164(b)(1) of title 23, United States Code, is amended—</text> <paragraph id="H1E126FF5D17B47D6ABB96D98824E1FB0"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>for alcohol-impaired</quote> and inserting the following: </text>
<quoted-block id="H1620BB26A5904224963A2C6AB1ECCC80" style="OLC" display-inline="yes-display-inline"><text>for—</text> <clause id="HB1A2AF35E7A44B13B440E649399BD5DF"><enum>(i)</enum><text>alcohol-impaired driving countermeasures; or</text></clause>
<clause id="HF15B550EF84C4D5F897B57774BD91155"><enum>(ii)</enum><text>single or multiple substance impaired</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HA253D2A8BCD747BE8FD8AF29A0F73257"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>intoxicated</quote> and all that follows through the period at the end and inserting the following: </text>
<quoted-block style="OLC" id="H50E3EB495A3D4B8AA30878D6BC53EC45" display-inline="yes-display-inline"><text display-inline="yes-display-inline">intoxicated, driving under the influence, driving while multiple substance impaired, or other related laws (including regulations), including for—</text> <clause id="H59598B3AF1DD43A0874203A550277C48"><enum>(i)</enum><text>the purchase of equipment dedicated to the enforcement of those laws;</text></clause>
<clause id="H996462F110E64C539A324A1E0FD2281F"><enum>(ii)</enum><text>the training of officers dedicated to the enforcement of those laws; and</text></clause> <clause id="H28413E621E1E4EF7948097A9189C42BB"><enum>(iii)</enum><text>the use of additional personnel for specific—</text>
<subclause id="H8501A1C767CA4F1A95E1EE620BC6BD47"><enum>(I)</enum><text>alcohol-impaired driving countermeasures; or</text></subclause> <subclause id="H265B0F966F2A495FA0A61912451BA11C"><enum>(II)</enum><text>single or multiple substance impaired driving countermeasures.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H139183EEC9CC46C4A94483073AB401A4"><enum>(b)</enum><header>Impaired driving countermeasures</header><text>Section 405(d) of title 23, United States Code, is amended—</text> <paragraph id="HA6FF974D483F41CE8B7A8E95318BC0ED"><enum>(1)</enum><text>in paragraph (4)—</text>
<subparagraph id="H24302C5D41F242F4ACE2EA106E9B5352"><enum>(A)</enum><text>in subparagraph (B)—</text> <clause id="H3395ABC2C7914D6EADBB76E9C03DD617"><enum>(i)</enum><text>by striking clause (iii) and inserting the following:</text>

<clause id="H5F258F89462E4387B1DE92691BFC25C0"><enum>(iii)</enum>
<subclause commented="no" display-inline="yes-display-inline" id="HD10D65490BEB4D02BB215C1436EBB73F"><enum>(I)</enum><text>court support of high-visibility enforcement efforts;</text></subclause> <subclause id="H5C06238C7F5A4A248DCCEEB5F33246A4" indent="up1"><enum>(II)</enum><text>hiring criminal justice professionals, including law enforcement officers, prosecutors, traffic safety resource prosecutors, judges, judicial outreach liaisons, and probation officers;</text></subclause>
<subclause id="HE0510F034D1F4DA7A4DF0E7BBD0BFF7D" indent="up1"><enum>(III)</enum><text>training and education of the criminal justice professionals described in subclause (II) to assist those professionals in preventing impaired driving and handling impaired driving cases, including by providing compensation to a law enforcement officer to replace a law enforcement officer who is—</text> <item id="HBDF24CBE17A94B7FA0EE457786619D97"><enum>(aa)</enum><text>receiving such drug recognition expert training; or</text></item>
<item id="H9AA7F78E32684493994F96F00C6BDC9F"><enum>(bb)</enum><text>participating as an instructor in such drug recognition expert training; and</text></item></subclause> <subclause id="HB04C2A086B97448DA9F5EE5EAA33F836" indent="up1"><enum>(IV)</enum><text>establishing driving while intoxicated courts;</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause>
<clause id="H098052AAF5B84CDFBA841702F77C6CDF"><enum>(ii)</enum><text>by striking clauses (v) and (vi) and inserting the following:</text> <quoted-block id="HC5A997230F234ECC9BFC9833868F5CA5" style="OLC"> <clause id="H9B0546249CD449E78C0F1E9BF0FF5A91"><enum>(v)</enum><text>improving—</text>
<subclause id="H94B0EC6A3FD94CF18AC0D60AD7A156EE"><enum>(I)</enum><text>blood alcohol concentration screening and testing;</text></subclause> <subclause id="H212CCA374EA94C3CB32BA2FF32920DC2"><enum>(II)</enum><text>the detection of potentially impairing drugs, including through the use of oral fluid as a specimen; and</text></subclause>
<subclause id="H7453D153F66D43A89C8F76486592BDC4"><enum>(III)</enum><text>reporting relating to the testing and detection described in subclauses (I) and (II);</text></subclause></clause> <clause id="H90C4D9B0C8A541168D4936D895291D73"><enum>(vi)</enum> <subclause commented="no" display-inline="yes-display-inline" id="H22E60C5AEB264F2295C4BE00C4BBA22C"><enum>(I)</enum><text>paid and earned media in support of high-visibility enforcement efforts;</text></subclause>
<subclause id="HA8178D1197C84520903BB96CF1245989" indent="up1"><enum>(II)</enum><text>conducting initial and continuing—</text> <item id="H6EFE30E34F6C47BAB2F6033C56807C55"><enum>(aa)</enum><text>standardized field sobriety training, advanced roadside impaired driving enforcement training, and drug recognition expert training for law enforcement; and</text></item>
<item id="H04BA7F93E1A2446B88EF2ACC7CFE2A1E"><enum>(bb)</enum><text>law enforcement phlebotomy training; and</text></item></subclause> <subclause id="H5E4B5AAA026841B28DFB7230BDE32C7C" indent="up1"><enum>(III)</enum><text>to purchase equipment to carry out impaired driving enforcement activities authorized by this subsection;</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause>
<clause id="H9C2F42CC1815475DBA8ACF288BEBE2BE"><enum>(iii)</enum><text>in clause (ix), by striking <quote>and</quote> at the end;</text></clause> <clause id="HE93460E19A6942B7A44CCB4515ACDEE5"><enum>(iv)</enum><text>in clause (x), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause>
<clause id="H97C1764B6F9D4387ACE24FAE22E83BD9"><enum>(v)</enum><text>by adding at the end the following:</text> <quoted-block id="H3A4F9A26151C456A8B7451475E69B4BC" style="OLC"> <clause id="H85E27DC2CA9E494B99617043DAF642A4"><enum>(xi)</enum><text>testing and implementing programs and purchasing technologies to better identify, monitor, or treat impaired drivers, including—</text>
<subclause id="H4021340CAF5B4D29A2FAF9C0DF6617DD"><enum>(I)</enum><text>oral fluid screening technologies;</text></subclause> <subclause id="H5D23800B866C4A0AA450A67A2AF21427"><enum>(II)</enum><text>electronic warrant programs;</text></subclause>
<subclause id="H80D680C9DC9747108FA00D5896E70853"><enum>(III)</enum><text>equipment to increase the scope, quantity, quality, and timeliness of forensic toxicology chemical testing;</text></subclause> <subclause id="HC0A8876DC27B4C3B9038FC0CEDD3A919"><enum>(IV)</enum><text>case management software to support the management of impaired driving offenders; and</text></subclause>
<subclause id="HD39BB6940E9649EF93B866B99F882CB6"><enum>(V)</enum><text>technology to monitor impaired driving offenders.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="HCF029D041829446FA4E7FB491AA49B7E"><enum>(B)</enum><text>in subparagraph (C)—</text>
<clause id="H1FF635D26D384D4AAFEC9738D4BD624B"><enum>(i)</enum><text>in the second sentence, by striking <quote>Medium-range</quote> and inserting the following:</text> <quoted-block id="HA8155708D08D44418098AEE8C175F3D3" style="OLC"> <clause id="HC3FF8C2375A44E769135CF6FB0BC19D5"><enum>(ii)</enum><header>Medium-range and high-range states</header><text>Subject to clause (iii), medium-range</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause>
<clause id="H1BCF3DEAB1E54CEFA649D5726E3C9591"><enum>(ii)</enum><text>in the first sentence, by striking <quote>Low-range</quote> and inserting the following:</text> <quoted-block id="H7759B0D7B2A24BC589D903A16DD14F19" style="OLC"> <clause id="HB6ADB2390704479F88D936BF3CD137F2"><enum>(i)</enum><header>Low-range states</header><text>Subject to clause (iii), low-range</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause id="HC75238546036410980E8EEBDBF2189CE"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block id="H80DF00639AD8460DB0C51FA2BBAABC26" style="OLC"> <clause id="HCAAB3306A65C47FDA1043E011AD0C419"><enum>(iii)</enum><header>All states</header> <subclause id="HA70B58E273CC4DFD94B1F21BE7933BFB"><enum>(I)</enum><header>Reporting of impaired driving criminal justice information</header><text>A State may use grant funds for any expenditure designed to increase the timely and accurate reporting of crash information and impaired driving criminal justice information to Federal, State, and local databases.</text></subclause>
<subclause id="HCE11C6CB33C84CF2BDD0FB03B8CFDF32"><enum>(II)</enum><header>Impaired driving countermeasures</header><text>A State may use grant funds for any expenditure to research or evaluate impaired driving countermeasures.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph> <paragraph id="HB54B79337AB84DCEA91474E92141D797"><enum>(2)</enum><text>in paragraph (7)(A), in the matter preceding clause (i), by inserting <quote>or local</quote> after <quote>authorizes a State</quote>.</text></paragraph></subsection>
<subsection id="HCFCE49E2A9054B7BB47667D54BD5B0C2"><enum>(c)</enum><header>GAO study on national DUI reporting</header>
<paragraph id="HA495290F1ACF4C8DAA7534D05C29B36B"><enum>(1)</enum><header>In general</header><text>The Comptroller General of the United States shall conduct a study on the reporting of impaired driving arrest and citation data to Federal databases and the interstate sharing of information about convictions and license suspensions relating to impaired driving to facilitate the widespread identification of repeat impaired driving offenders.</text></paragraph> <paragraph id="H26AA362CA4F34C62812CC7F65C5890BF"><enum>(2)</enum><header>Inclusions</header><text>The study conducted under paragraph (1) shall include a detailed assessment of—</text>
<subparagraph id="H4EFD6F1603E14140996C994946DCCE24"><enum>(A)</enum><text>the extent to which State and local criminal justice agencies are reporting impaired driving arrest and citation data to Federal databases;</text></subparagraph> <subparagraph id="HBEC12554BB9A415988EB87BC2783E243"><enum>(B)</enum><text>any barriers—</text>
<clause id="HA548936E2EE249D188655C93133DFA5A"><enum>(i)</enum><text>at the Federal, State, or local level to the reporting of impaired driving arrest and citation data to Federal databases; and</text></clause> <clause id="H52AF4208BFA545B6B4A8962980EDF489"><enum>(ii)</enum><text>to the use by State and local criminal justice agencies of—</text>
<subclause id="H6B37593C385244FBB5C358A2C3BAC338"><enum>(I)</enum><text>those databases; and</text></subclause> <subclause id="H1793B9A40BBD4B9AAC04CB4E08531A8D"><enum>(II)</enum><text>any systems for the reporting of that data;</text></subclause></clause></subparagraph>
<subparagraph id="HE19DAAD0E3AF4D8D9C43CB24BA2E3E1B"><enum>(C)</enum><text>the extent to which States are sharing impaired driving conviction and license-suspension data;</text></subparagraph> <subparagraph id="H989DAB2DBE554543B50324C425566314"><enum>(D)</enum><text>any barriers at the Federal, State, or local level to the sharing of impaired driving conviction and license-suspension data;</text></subparagraph>
<subparagraph id="HF28921EB78C84EDD8B430773958D7C04"><enum>(E)</enum><text>any Federal, State, and local resources available to improve the reporting and sharing of impaired driving data;</text></subparagraph> <subparagraph id="HE26095D0F09243B692D46EBE5BF2E2C3"><enum>(F)</enum><text>any recommendations for policies and programs to be carried out by the National Highway Traffic Safety Administration to improve—</text>
<clause id="HE483C0AED1484AA18ABEF888BA997EA0"><enum>(i)</enum><text>the reporting of impaired driving arrest and citation data to Federal databases; or</text></clause> <clause id="H95292E22A5284BA7BFEAA6FEBF13212A"><enum>(ii)</enum><text>the interstate sharing of impaired driving conviction and license-suspension data; and</text></clause></subparagraph>
<subparagraph id="H7B491E8AA57647D2AF146F94F5DB4204"><enum>(G)</enum><text>any recommendations for programs or grant funding to be authorized by Congress to improve—</text> <clause id="HA18842ADC93E456AB7BECC5011FBD9A0"><enum>(i)</enum><text>the reporting of impaired driving arrest and citation data to Federal databases; or</text></clause>
<clause id="H306AB4E9CF1D4FDC87FD579F93460FCF"><enum>(ii)</enum><text>the interstate sharing of impaired driving conviction and license-suspension data.</text></clause></subparagraph></paragraph> <paragraph id="HC6F6B130005B4E6AA1181A16EF903283"><enum>(3)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to the appropriate committees of Congress a report on the results of the study conducted under paragraph (1).</text></paragraph></subsection></section>
