R. 3746</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210608">June 8, 2021</action-date><action-desc><sponsor name-id="A000375">Mr. Arrington</sponsor> (for himself, <cosponsor name-id="S001185">Ms. Sewell</cosponsor>, <cosponsor name-id="D000628">Mr. Dunn</cosponsor>, <cosponsor name-id="O000171">Mr. O'Halleran</cosponsor>, <cosponsor name-id="G000589">Mr. Gooden of Texas</cosponsor>, <cosponsor name-id="D000617">Ms. DelBene</cosponsor>, <cosponsor name-id="B001287">Mr. Bera</cosponsor>, and <cosponsor name-id="K000376">Mr. Kelly of Pennsylvania</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to improve the benchmarking process for the Medicare Shared Savings Program.</official-title></form><legis-body id="H1649F3A5803346489E92202792E17F36" style="OLC"><section id="HD333015DEF854A2481A7BFE37301E9B9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accountable Care in Rural America Act</short-title></quote>.</text></section><section id="H8A3FFDF9868F47FF984A756BFB8CA85E" section-type="subsequent-section"><enum>2.</enum><header>Exclusion of Medicare fee-for-service beneficiaries assigned to an ACO from aspects of other payment models in certain circumstances including determination of regional adjustments</header><text display-inline="no-display-inline">Section 1899(i)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395jjj">42 U.S.C. 1395jjj(i)(3)</external-xref>) is amended—</text><paragraph id="HB419763CE9DE42C1AB8AEA25E5ED2DB3"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>subparagraph (B)</quote> and inserting <quote>subparagraphs (B) and (C)</quote>; and</text></paragraph><paragraph id="H921A43F1357B4309B8455B4BCE507A30"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H8BD3B456062E46369E8E001D44E3912F" style="OLC"><subparagraph id="H19D2B36F25194CDD95B78AC9C5C2EE6E"><enum>(C)</enum><header>Exclusion of assigned beneficiaries in certain circumstances including determination of regional adjustments</header><text>For performance periods beginning on or after the date of the enactment of this subparagraph, in determining any shared savings for any ACO under a model described in this paragraph, the Secretary shall—</text><clause id="H3290B6152B7D41039AF3AADC82BCED62"><enum>(i)</enum><text>remove Medicare fee-for-service beneficiaries who are assigned to that ACO from the methodology for calculating regional expenditures used to establish, update, and adjust the benchmark expenditures; and</text></clause><clause id="H110EDDBE24CF4D2CB1E41E21E1537C18"><enum>(ii)</enum><text>otherwise ensure that no such ACO is in a less favorable financial position due to differences between the share of Medicare fee-for-service beneficiaries assigned to the ACO of all such beneficiaries in the counties an ACO operates in compared to the share of such beneficiaries assigned to other ACOs.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
