<section id="H10A0E7C4D90543FE805C9EADC747071A" section-type="section-one"><enum>1.</enum><header>Short title; Findings</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Total Recall Act</short-title></quote>.</text></section> <section id="HAA36618AAE02457386595B284DECFEF2"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
<paragraph id="H9D121363F1144EB1B544156731DCED03"><enum>(1)</enum><text>the safety of the consumers in the United States relies on the effectiveness of a company’s outreach;</text></paragraph> <paragraph id="HAC4B409EDF78418089CACCB00E1D211A"><enum>(2)</enum><text>there are at least 400 products recalled each year by the Consumer Product Safety Commission; and</text></paragraph>
<paragraph id="H456DB376BA244F50996D750CE0209EF5"><enum>(3)</enum><text>according to the Commission, the average response rate of consumers for most product recalls is between 4 and 18 percent.</text></paragraph></section> <section id="H76B92A8DACB94E58BC2D36BBAE00E0B1"><enum>3.</enum><header>Increased notification about recalls by companies participating in recalls</header> <subsection id="H2CBC716740B74C07874645CDBD6470A0"><enum>(a)</enum><header>Mandating public notice and including importers</header><text display-inline="yes-display-inline">Section 15 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2064">15 U.S.C. 2064</external-xref>)—</text>
<paragraph id="H90D64FA17207470E9E45346114F15FDB"><enum>(1)</enum><text>in subsection (c)(1), by striking <quote>the Commission may order</quote> and inserting <quote>the Commission shall order</quote>; and</text></paragraph> <paragraph id="H2F96DD6E57AC42038810322FFBCC1214"><enum>(2)</enum><text>in subsection (d)(1), by striking <quote>any distributor or retailer of the product</quote> and inserting <quote>any importer distributor, or retailer of the product to cease distribution of the product or</quote></text></paragraph></subsection>
<subsection id="H5F92E54F732B40A4926502DFA8F0F1DE"><enum>(b)</enum><header>Notification requirements</header>
<paragraph id="H55995AC7D9A64D8F845E00EB12ABA108"><enum>(1)</enum><header>Requirements</header><text>Section 15(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2064">15 U.S.C. 2064(d)</external-xref>) is further amended—</text> <subparagraph id="H226EF2C2EC284049BB00652FCBA82927"><enum>(A)</enum><text>by redesignating paragraph (3) as paragraph (4);</text></subparagraph>
<subparagraph id="H5ED05BFFD1164CF2B0DA449680C510B7"><enum>(B)</enum><text>by inserting after paragraph (2) the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H2C6E407CDE84489EAA157D6C4DA2F3DE" style="traditional"> <paragraph id="H022404643A4B46C3B16FFA03725F3953" indent="up1"><enum>(3)</enum><text>The Commission may not approve an action plan submitted pursuant to paragraph (2) unless such action plan provides that the person submitting the action plan has performed or will perform the following:</text>
<subparagraph id="HAF3C5451D72040B889A63B036535A7EF"><enum>(A)</enum><text>Not later than the expiration of the 365-day period starting on the date the Commission approves the action plan, spending on advertising the recall of the product subject to the order, using methods including those determined by the Commission for conducting recalls, an amount equal to the greater of—</text> <clause id="H9532A6FBFAF841B98DC7BA0F7593A8B6"><enum>(i)</enum> <subclause commented="no" display-inline="yes-display-inline" id="HF44A52F6ED1841F795F2AD0635B0254D"><enum>(I)</enum><text display-inline="yes-display-inline">at least 25 percent of the dollar amount spent by such person in the 12-month period during which such person spent the greatest amount on traditional marketing (not including marketing through the internet) of the product; plus</text></subclause>
<subclause id="HE532A415965E47EE8F01FEC14B586392" indent="up1"><enum>(II)</enum><text>at least the total dollar amount spent by such person marketing the product through the internet; or</text></subclause></clause> <clause id="HFE37E9BF2793423494B4EDE546B85316"><enum>(ii)</enum><text>if the product was part of a subscription service, at least 5 percent of the dollar amount spent by such person marketing the subscription service under which the product was sold.</text></clause></subparagraph>
<subparagraph id="H692999D06C3A4A67A379035ECD9EE1C9"><enum>(B)</enum><text>Submitting to the Commission such evidence the Commission determines adequate to show that such person has complied with the requirements in subparagraph (A).</text></subparagraph> <subparagraph id="H9C55EBDBAD22494F8AC82DF57E15113D"><enum>(C)</enum><text>Posting in a clear and conspicuous manner the notice described in subsection (c)(1)(D) on any internet website maintained by such person until the participation rate in the recall that is the subject of the notice is at least 95 percent.</text></subparagraph>
<subparagraph id="HD93BA8EBE19140B28E7B1B000F6ED539" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">Posting to each social media platform maintained by such person the notice subsection (c)(1)(D), or a description of such notice and a link to such notice, at least 5 times each calendar month for the 12 months after the Commission has approved the action plan.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HCB253593B4F9458897C4B628CAADD86C"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="HEE696B3E49B042499F4397264931EA47" indent="up1" commented="no"><enum>(5)</enum><text>In this subsection—</text> <subparagraph id="H48A63074E0EC4634A54C75FBC8FF4659" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>social media platform</term> means a website or internet medium that—</text>
<clause id="HFA53ABDE164B432897CB55408AE8CF76" commented="no"><enum>(i)</enum><text>permits a person to become a registered user, establish an account, or create a profile for the purpose of allowing users to create, share, and view user-generated content through such an account or profile; </text></clause> <clause id="H56DD801DF03D4FF6A886B0532B6FD307" commented="no"><enum>(ii)</enum><text>enables one or more users to generate content that can be viewed by other users of the medium; and </text></clause>
<clause id="HAC14E8D580C846DEBB59403E0882F7C6" commented="no"><enum>(iii)</enum><text>primarily serves as a medium for users to interact with content generated by other users of the medium; and</text></clause></subparagraph> <subparagraph id="HB1A0CECBF74C402ABCBA123F5E996AE3"><enum>(B)</enum><text>the term <term>subscription service</term> means a service under which two or more consumer products are sold to consumers that does not permit the consumer to select each product comprising an individual package.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H6350D43CC6284B0688D848D11EB37A6E"><enum>(2)</enum><header>Tolling of expenditures</header><text display-inline="yes-display-inline">Paragraph (4) of section 15(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2064">15 U.S.C. 2064(d)</external-xref>) (as redesignated by section 3(b)(1)(A) of this Act) is amended by adding at the end the following new subparagraph:</text> <quoted-block display-inline="no-display-inline" id="H901879A189664C3996FF1333C9BFAC60" style="OLC"> <subparagraph id="H0FA958BBA14C4215A5BECCDE1896B38B" indent="up2"><enum>(D)</enum><text display-inline="yes-display-inline">If the Commission revokes its approval of the action plan, the running of the 365-day period in paragraph (3)(A) shall be tolled. If the Commission approves an alternative action plan to the action plan for which approval was revoked, the time period for completing the expenditures as required by paragraph (3)(A) for such alternative action plan shall not exceed the number of days that did not elapse under such 365-day period.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HEF0A68C047F343B082B427DA6842BD3D"><enum>(c)</enum><header>Notification requirements apply to settlement offers</header><text>Section 15(f) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2064">15 U.S.C. 2064(f)</external-xref>) is amended—</text> <paragraph id="H2AE33330FD90458CA372123EFD398E9C"><enum>(1)</enum><text>in paragraph (1)—</text>
<subparagraph id="HC4776C809FC645EE9AB832E18155FBC1"><enum>(A)</enum><text>by striking <quote>Any settlement</quote> and inserting <quote>Subject to paragraph (2), any settlement</quote>; and</text></subparagraph> <subparagraph id="H0AD8E9D5649A49E8B872CEB5DD420881"><enum>(B)</enum><text>by striking <quote>unless the settlement offer is clearly frivolous or duplicative of offers previously made</quote>;</text></subparagraph></paragraph>
<paragraph display-inline="no-display-inline" id="H7B9EBD0E2E3E4235A9722460B331C5A9"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (4); and</text></paragraph> <paragraph id="H3FA6E1FB9F6A4FE1BA5F85B48EDA5420"><enum>(3)</enum><text>by inserting after paragraph (1) the following new paragraphs:</text>
<quoted-block display-inline="no-display-inline" id="H55332C620DD446C3809D2B891ABD309B" style="traditional">
<paragraph display-inline="no-display-inline" id="H990E01D8CB0F4F20B9B7B2F5D3707129" indent="up1"><enum>(2)</enum><text>A settlement offer described in paragraph (1) may not be transmitted if such offer—</text> <subparagraph id="H3BE050ABC5B641E08110585F29E3E38C"><enum>(A)</enum><text>is clearly frivolous;</text></subparagraph>
<subparagraph id="HD1A6614106BE47A2AFDB2F7D3FB4AAEC"><enum>(B)</enum><text>is duplicative of offers previously made; or</text></subparagraph> <subparagraph id="H2B173AF8F0F444D1BE9F61C09AB01A71"><enum>(C)</enum><text>does not obligate the manufacturer, distributor, importer, or retailer that is a party to such offer to perform the actions in subparagraphs (A) and (B) of subsection (k)(1).</text></subparagraph></paragraph>
<paragraph id="H21FAEB91F8C84135985F56535B23AF42" indent="up1" commented="no"><enum>(3)</enum><text>At the outset of a hearing under this subsection, the Commission shall recommend that a manufacturer, distributor, importer, or retailer that is or becomes a party to a settlement offer perform the actions described in subsection (d)(3).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H8911AF0C3F64480796BDD90F8E718325"><enum>(d)</enum><header>Voluntary corrective action notification</header><text>Section 15 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2064">15 U.S.C. 2064</external-xref>) is further amended by adding at the end the following new subsection:</text>
<quoted-block display-inline="no-display-inline" id="HB01E4B25A2844089B165F1CAAC90F2EE" style="OLC">
<subsection id="H219C89A9418F4520864EA701FEE6A3E9"><enum>(k)</enum><header>Voluntary Corrective Action</header>
<paragraph id="HCFBD1FB618304243A549720A7503C48E"><enum>(1)</enum><header>Requirements</header><text>Any voluntary corrective action taken by a manufacturer, distributor, importer, or retailer in consultation with the Commission relating to a product described in subsection (b) may be determined by the Commission as a sufficient remedial measure only if, as part of such voluntary corrective action—</text> <subparagraph id="H7E9CA665C9124FA2A56357B76088A1C2"><enum>(A)</enum><text>such manufacturer, distributor, importer, or retailer provides the notice required by subsection (c); and</text></subparagraph>
<subparagraph id="H5D5239B2F2284705BEB0D1706942C619"><enum>(B)</enum><text>such notice is posted in the manner required by subparagraphs (C) and (D) of subsection (d)(3).</text></subparagraph></paragraph> <paragraph id="H0C0776EDAA044B73AAFF3D3C1B5FA7F1"><enum>(2)</enum><header>Recommendations</header><text>When a manufacturer, distributor, importer, or retailer informs the Commission that it will take voluntary corrective action in consultation with the Commission, the Commission shall recommend that such manufacturer, distributor, importer, or retailer perform the actions described in subsection (d) as part of the voluntary corrective action.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="HF79530BE153643FF91B830403B1EE513"><enum>4.</enum><header>Applicability</header>
<subsection id="H1185F1784FBA40629860B9C98A1547A0"><enum>(a)</enum><header>Action plans and settlement offers</header><text display-inline="yes-display-inline">The amendments made by subsections (a) through (c) of section 3 shall only apply to action plans initiated under section 15(d) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2064">15 U.S.C. 2064(d)</external-xref>) and settlement offers submitted under section 15(f) of such Act, (<external-xref legal-doc="usc" parsable-cite="usc/15/2064">15 U.S.C. 2064(f)</external-xref>) on or after the date of enactment of this Act.</text></subsection> <subsection id="HC16F8527A50D4F82864C726B218C64D0"><enum>(b)</enum><header>Voluntary Corrective Action</header><text display-inline="yes-display-inline">The amendments made by subsection (d) of section 3 shall only apply to voluntary corrective actions about which the Consumer Product Safety Commission is initially informed on or after the date of enactment of this Act.</text></subsection></section>
<section id="H2CA58A2A03424B60BB8793883C0A0292"><enum>5.</enum><header>Recall participation rates reported to Congress</header>
<subsection id="H1829FCB1C39C4553A5A87274425A65C0"><enum>(a)</enum><header>Report to congress</header><text display-inline="yes-display-inline">Section 27(j) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2076">15 U.S.C. 2076(j)</external-xref>) is amended—</text> <paragraph id="HE55B805D0E874BF69A406458B4072A1A"><enum>(1)</enum><text>in the matter preceding paragraph (1), by inserting after <quote>and the Congress</quote> the following: <quote>, and shall make publicly available on its website,</quote>;</text></paragraph>
<paragraph id="HD46D910963874A128BABA23E7CBD140A"><enum>(2)</enum><text>in paragraph (12)(F), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="HAF2F047BED6C48EF9B242AB3ECF9F05A"><enum>(3)</enum><text>by redesignating paragraph (13) as paragraph (14); and</text></paragraph>
<paragraph id="HB6B47FE020BF40C89DA4B2DF96630E91"><enum>(4)</enum><text>by inserting after paragraph (12) the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H51274E454D9A415DB3E70C0562FACC63" style="traditional"> <paragraph id="H3CDC48D8EC05424480CE9EF85376C074"><enum>(13)</enum><text display-inline="yes-display-inline">for each recall initiated or ongoing during the reporting period that is pursuant to an order under section 15(d), a settlement agreement, or a voluntary corrective action taken in consultation with the Commission—</text>
<subparagraph id="HD3FDEF08834748B2B3494AA6CF6B88C5"><enum>(A)</enum><text>the number of products subject to the recall sold;</text></subparagraph> <subparagraph id="HBA82F4A3D4784DE6887D0A74E1872669"><enum>(B)</enum><text>the number of such products for which a consumer has been remedied;</text></subparagraph>
<subparagraph id="HC60216A2EB364851983CC9BB6F7A7BEE"><enum>(C)</enum><text>the number of consumers to whom a notification has been made directly; and</text></subparagraph> <subparagraph id="H99A7A87D68244DB38CB7FF3B57012F74"><enum>(D)</enum><text>the number of incidences of injuries resulting from a product subject to the recall occurring after the initiation of the recall that are reported to the Commission; and</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection display-inline="no-display-inline" id="HCAACB291C44C4C0094EFAB4C3675D91D"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply on the first day of the first fiscal year which begins after the date of the enactment of this Act.</text></subsection></section> </legis-body> </bill>
