<section id="HE421DD6B80774E3FB68512FEC22D2887"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text> <paragraph id="H589611CBC5EE4F86A5175B15F85D472A"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>consumer product</quote> has the meaning given such term in section 3(a) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)</external-xref>); and</text></paragraph>
<paragraph id="H3099A1117E22415A90AE7C444DDF9B2E"><enum>(2)</enum><text>the term <quote>Secretary</quote> means the Secretary of Commerce. </text></paragraph></section> <title id="H47528A6BDD4A4ECF966B6822E872335E"><enum>I</enum><header>Artificial Intelligence and Consumer Product Safety</header> <section id="H03BF687DCC164639A99897C7CD7CF445"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>AI for Consumer Product Safety Act</short-title></quote>.</text></section>
<section id="HDCB16677A0BA4CC6B45D9CA275E020BD"><enum>102.</enum><header>Pilot program for use of artificial intelligence by Consumer Product Safety Commission</header>
<subsection id="H56E44782B4754F96BCF4787A20A80DA2"><enum>(a)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, the Consumer Product Safety Commission shall establish a pilot program to explore the use of artificial intelligence by the Commission in support of the consumer product safety mission of the Commission.</text></subsection> <subsection id="H273D54D8952145D3A55EF267960129D2"><enum>(b)</enum><header>Requirements</header><text>In conducting the pilot program established under subsection (a), the Commission shall do the following:</text>
<paragraph id="HEB25B7D8ADBC45ABB6C3895DFDAC90B5"><enum>(1)</enum><text>Use artificial intelligence for at least 1 of the following purposes:</text> <subparagraph id="H179EAA48CA234D0A892C045236A2BA77"><enum>(A)</enum><text>Tracking trends with respect to injuries involving consumer products.</text></subparagraph>
<subparagraph id="H589802C7813C4C0F944CE846DF126D40"><enum>(B)</enum><text>Identifying consumer product hazards.</text></subparagraph> <subparagraph id="H091CC58E6DB242319B319152303B0D0B"><enum>(C)</enum><text>Monitoring the retail marketplace (including internet websites) for the sale of recalled consumer products (including both new and used products).</text></subparagraph>
<subparagraph id="H25C4B152A9304D98A549DD7335F63ED5"><enum>(D)</enum><text>Identifying consumer products required by section 17(a) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2066">15 U.S.C. 2066(a)</external-xref>) to be refused admission into the customs territory of the United States.</text></subparagraph></paragraph> <paragraph id="HD83E783EB488441F87E243458AC66FD2"><enum>(2)</enum><text>Consult with the following:</text>
<subparagraph id="H1A91D04E54E6455D8FE971D23A0CB8EF"><enum>(A)</enum><text>Technologists, data scientists, and experts in artificial intelligence and machine learning.</text></subparagraph> <subparagraph id="H62A4C6471F604044925E47C19B80B059"><enum>(B)</enum><text>Cybersecurity experts.</text></subparagraph>
<subparagraph id="HD8934E81B6EA4084BF67BDC7B18B6AA4"><enum>(C)</enum><text>Members of the retail industry.</text></subparagraph> <subparagraph id="H008E66BD1DD249FB8C1889143A89FC97"><enum>(D)</enum><text>Consumer product manufacturers.</text></subparagraph>
<subparagraph id="HC55055DD8DDC4AD7A7F6851DD598236E"><enum>(E)</enum><text>Consumer product safety organizations.</text></subparagraph> <subparagraph id="HD2D5F885CCB14B19BFD1FE287E3893E8"><enum>(F)</enum><text>Any other person the Commission considers appropriate.</text></subparagraph></paragraph></subsection>
<subsection id="H3E1ECC19E27344B59457DD4341B3E35D"><enum>(c)</enum><header>Report to Congress</header><text>Not later than 180 days after the conclusion of the pilot program established under subsection (a), the Consumer Product Safety Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, and make publicly available on the website of the Commission, a report on the findings and data derived from such program, including whether and the extent to which the use of artificial intelligence improved the ability of the Commission to advance the consumer product safety mission of the Commission.</text></subsection></section></title> <title id="H16D7FB27346147C1BAEA4FF5EB498C15"><enum>II</enum><header>Blockchain Technology Innovation</header> <section id="H2C348373B663463B9410597879822179"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Blockchain Innovation Act</short-title></quote>.</text></section>
<section id="H5CC4EDFC26C348CCAF0D62B4CA29BBA5"><enum>202.</enum><header>Study on blockchain technology and its use in consumer protection</header>
<subsection id="H652E9DBC6F1649E88714AE38D156C0FC"><enum>(a)</enum><header>In general</header>
<paragraph id="H4D54D6490B8C406FBE16CD6166C79B64"><enum>(1)</enum><header>Study required</header><text>Not later than one year after the date of enactment of this Act, the Secretary of Commerce, in consultation with the Federal Trade Commission, and in consultation with the any other appropriate Federal agency the Secretary determines appropriate, shall conduct a study on current and potential use of blockchain technology in commerce and the potential benefits of blockchain technology for limiting fraud and other unfair and deceptive acts and practices.</text></paragraph> <paragraph id="HF69E9429ABF74A0D82FED64A1590FF24"><enum>(2)</enum><header>Requirements for study</header><text>In conducting the study, the Secretary shall examine—</text>
<subparagraph id="H0099DFA2CFB74954B5526F69728336B5"><enum>(A)</enum><text>trends in the commercial use of and investment in blockchain technology;</text></subparagraph> <subparagraph id="HD602DC807B1C47AFBD672504FC97C107"><enum>(B)</enum><text>best practices in facilitating public-private partnerships in blockchain technology;</text></subparagraph>
<subparagraph id="H0664C07539C74703859EDD2198E97CA2"><enum>(C)</enum><text display-inline="yes-display-inline">potential benefits and risks of blockchain technology for consumer protection; </text></subparagraph> <subparagraph id="H386CED5AB1A54B95AD5B53B1D951DDEA"><enum>(D)</enum><text>how blockchain technology can be used by industry and consumers to reduce fraud and increase the security of commercial transactions; </text></subparagraph>
<subparagraph id="H827711148AD9426999B3BD3B502C173C"><enum>(E)</enum><text>areas in Federal regulation of blockchain technology that greater clarity would encourage domestic innovation; and</text></subparagraph> <subparagraph id="H7730121CA5FF41258730BEA9552968D2"><enum>(F)</enum><text display-inline="yes-display-inline">any other relevant observations or recommendations related to blockchain technology and consumer protection.</text></subparagraph></paragraph>
<paragraph id="HC20CA5211F3941DC8C195530FC1E68A0"><enum>(3)</enum><header>Public comment</header><text>In producing the study required in subsection (a)(2), the Secretary shall provide opportunity for public comment and advice relevant to the production of the study.</text></paragraph></subsection> <subsection id="HDFC66723A3204583BDB2E92F5FAF0FC8"><enum>(b)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 6 months after the completion of the study required pursuant to subsection (a), the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, and make publicly available on the website of the Department of Commerce, a report that contains the results of the study conducted under subsection (a).</text></subsection></section></title>
<title id="H916A7A51E7F3418A8183E9BEB486D50B"><enum>III</enum><header>Digital Token Taxonomy</header>
<section id="H64DC9023A97B4089A3ED3CE6671E4A37"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Digital Taxonomy Act</short-title></quote>. </text></section> <section id="HF9A1D9A733B0405F9CFACA9BE315AAD4" commented="no"><enum>302.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
<paragraph id="H96835745665D4C0784850446790421B0" commented="no"><enum>(1)</enum><text>it is important that the United States remains a leader in innovation;</text></paragraph> <paragraph id="H95092BCBD72E4A30903C20C00D4F0C80" commented="no"><enum>(2)</enum><text>digital tokens and blockchain technology are driving innovation and providing consumers with increased choice and convenience;</text></paragraph>
<paragraph id="HE97564E922EA41EBB4F0CD00D4FB614C" commented="no"><enum>(3)</enum><text>the use of digital tokens and blockchain technology is likely to increase in the future;</text></paragraph> <paragraph id="HB5634CB278B4446C8B41E48FB2AFAF02" commented="no"><enum>(4)</enum><text>the Federal Trade Commission is responsible for protecting consumers from unfair or deceptive acts or practices, including relating to digital tokens; </text></paragraph>
<paragraph id="H826AE9027F844D9184E4776651092132" commented="no"><enum>(5)</enum><text>the Commission has previously taken action against unscrupulous companies and individuals that committed unfair or deceptive acts or practices involving digital tokens; and</text></paragraph> <paragraph id="HB412527AAE6640B4878037C52E099FA0" commented="no"><enum>(6)</enum><text>to bolster the Commission’s ability to enforce against unfair or deceptive acts or practices involving digital tokens, the Commission should ensure staff have appropriate training and resources to identify and pursue such cases.</text></paragraph></section>
<section id="H47D7C665DFDF42EC83E2E07C5FD323C3"><enum>303.</enum><header>Reports on unfair or deceptive acts or practices in transactions relating to digital tokens</header><text display-inline="no-display-inline">Not later than one year after the date of enactment of this Act and each year thereafter until fiscal year 2024, the Federal Trade Commission shall transmit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, and make publicly available on its website, a report of—</text> <paragraph id="H9350452C651E483480EC64495067CF3D"><enum>(1)</enum><text>any actions taken by the Commission relating to unfair or deceptive acts or practices in transactions relating to digital tokens;</text></paragraph>
<paragraph id="H2BDF4ABFCDEC47CC80098658513A0FA4"><enum>(2)</enum><text>the Commission’s other efforts to prevent unfair or deceptive acts or practices relating to digital tokens; and</text></paragraph> <paragraph id="H677E6168E1184F7285299308D06A07AD"><enum>(3)</enum><text>any recommendations by the Commission for legislation that would improve the ability of the Commission and other relevant Federal agencies—</text>
<subparagraph id="H3333D9F30F344503A90A7D9285D75606"><enum>(A)</enum><text>to further protect consumers from unfair or deceptive acts or practices in the digital token marketplace; and</text></subparagraph> <subparagraph id="HFF373FBC17964FD7B4D9EBCB68A2E077"><enum>(B)</enum><text>to promote competition and promote innovation in the global digital token sector.</text></subparagraph></paragraph></section></title>
