<section id="H43D8548F941B49D3B8A0DD3BCC88BF4E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Trace Act of 2021</short-title></quote>. </text></section> <section id="H249B84CC03A045D8A8AA873D0FCDC013"><enum>2.</enum><header>Prohibition on obtaining geolocation information</header> <subsection id="HFE7B4957D3614ED98670F8E66F32D804"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, and not later than one year after the date of the enactment of this Act, the head of each Federal agency shall implement a policy prohibiting such agency from obtaining geolocation information of a United States person prior to obtaining a warrant issued using the procedures described in the Federal Rules of Criminal Procedure (or, in the case of a State court, issued using State warrant procedures), issued under section 846 of that title, in accordance with regulations prescribed by the President) by a court of competent jurisdiction.</text></subsection>
<subsection id="H516525D175104A4A96AFF2A041077400"><enum>(b)</enum><header>Limitation on eligibility for funds</header><text display-inline="yes-display-inline">Beginning in the first fiscal year that begins after the date that is one year after the date of enactment of this Act, a State or unit of local government may not receive funds under the Byrne grant program or the COPS grant program for a fiscal year if, on the day before the first day of the fiscal year, the State or unit of local government does not have in effect a policy substantially similar to the policy described in subsection (a).</text></subsection> <subsection id="HF12CD389E2D94CB3A3AAEE137C9542A7" commented="no"><enum>(c)</enum><header>Exception for threat to life</header> <paragraph id="HFF18F6707B474D58BE57BB1A01C0FC1D"><enum>(1)</enum><header>In general</header><text>Subsections (a) and (b) shall not apply with respect to a case if the Attorney General or top justice official of a State determines there is a reasonable belief that such geolocation information could assist in mitigating or eliminating an imminent threat to life or serious bodily harm.</text></paragraph>
<paragraph id="HFACAC24F856B4FE2890D639688920EEF"><enum>(2)</enum><header>Requirement for exception</header><text display-inline="yes-display-inline">If the Attorney General or top justice official of a State makes a determination under paragraph (1), the Attorney General or top justice official of a State shall inform a judge of competent jurisdiction that such a determination has been made as soon as practicable, but not more than seven days after the Attorney General or top justice official of a State makes such determination.</text></paragraph></subsection> <subsection id="HFCB0D54201904DEB999FCB69A2B1C069"><enum>(d)</enum><header>Exception for conducting foreign intelligence surveillance</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, it shall not be unlawful for an officer, employee, or agent of the United States in the normal course of the official duty of the officer, employee, or agent to conduct electronic surveillance, as authorized by the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>).</text></subsection>
<subsection id="HE67FE3B951714DD5B7EA85185B78530F" commented="no"><enum>(e)</enum><header>Applicability</header><text display-inline="yes-display-inline">Subsection (a) shall apply to any request for a warrant after the date of the enactment of this Act. </text></subsection> <subsection id="H502FC1B04205406DBFC13EBDDF3B9737"><enum>(f)</enum><header>GAO Study</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, and annually thereafter, the Comptroller General of the United States shall conduct a study on the compliance of each Federal agency and State and local government with the requirements under subsections (a) and (b). </text></subsection>
<subsection id="HCA45760FC33B4BFA87E89DDF6675DAB7"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HC9C30164431E422D8D315DCB220A75A9"><enum>(1)</enum><header>Byrne grant program</header><text display-inline="yes-display-inline">The term <quote>Byrne grant program</quote> means the grant program authorized under section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref>). </text></paragraph>
<paragraph id="HAE9B72ED857E49F58ACE8A025D2B779E"><enum>(2)</enum><header>COPS grant program</header><text display-inline="yes-display-inline">The term <quote>COPS grant program</quote> means the grant program authorized under section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref>). </text></paragraph> <paragraph id="H628BFE04DC994061AF260046F24DB95D"><enum>(3)</enum><header>Connected device</header><text display-inline="yes-display-inline">The term <quote>connected device</quote> means a device that is capable of connecting to the internet, directly or indirectly, or to another connected device. </text></paragraph>
<paragraph id="HB492A31DC0144E93BA6626117798EFA8" commented="no"><enum>(4)</enum><header>Federal agency</header><text display-inline="yes-display-inline">The term <quote>Federal agency</quote> means each instrumentality of the Federal Government.</text></paragraph> <paragraph id="HE1A1E97F00804E6EB0C431EA7B15704B" commented="no"><enum>(5)</enum><header>Geolocation information</header><text display-inline="yes-display-inline">The term <quote>geolocation information</quote> means the process or technique of identifying the geographical location of a person or connected device by means of digital information processed via the internet or obtaining information from a mobile application, connected device, or other online application to identify or attempt to identify the identity or geographical location of an individual, mobile device, or connected device.</text></paragraph>
<paragraph id="H639737D55B394043936A8489543AD863"><enum>(6)</enum><header>Mobile application</header><text>The term <quote>mobile application</quote> includes—</text> <subparagraph id="H2702410F2F654FC18EE62BA7402D7D1D"><enum>(A)</enum><text display-inline="yes-display-inline">a software program that runs on the operating system of—</text>
<clause id="H787EC1506CA74DE78D72B884DDBCC891"><enum>(i)</enum><text display-inline="yes-display-inline">a cellular telephone;</text></clause> <clause id="HD95EA59E7ECE4FB7B244A49D6B602B3C"><enum>(ii)</enum><text>a tablet computer; or</text></clause>
<clause id="H6CD80C5BC81446DE93C4A9C34EE2C4E3"><enum>(iii)</enum><text>a similar portable computing device that transmits data over a wireless connection; and</text></clause></subparagraph> <subparagraph id="H591B7DBED657419B8CDC551C069EAF11"><enum>(B)</enum><text display-inline="yes-display-inline">a service or application offered via a connected device.</text></subparagraph></paragraph>
<paragraph id="HD60BEF30E7094A0CA6A1124A928C95E2"><enum>(7)</enum><header>Mobile device</header><text display-inline="yes-display-inline">The term <quote>mobile device</quote> means a piece of portable electronic equipment that can connect to the internet, including a smartphone or tablet computer. </text></paragraph> <paragraph id="H6FC3BFC5DA5D45618E5BC82690BEB976"><enum>(8)</enum><header>Online application</header><text>The term <quote>online application</quote> includes—</text>
<subparagraph id="H8C8FF8ACE8604B29A567D786EFD4AE3C"><enum>(A)</enum><text display-inline="yes-display-inline">an internet-connected software program; or</text></subparagraph> <subparagraph id="H886C848878FB441F9BBC1D343B348594"><enum>(B)</enum><text display-inline="yes-display-inline">a service or application located on or utilized by a connected device.</text></subparagraph></paragraph>
<paragraph id="H12E5C7D2521F4A7683709FB12D8B3111"><enum>(9)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any possession of the United States. </text></paragraph> <paragraph id="H8609C01B36264F16BBD938BB263A45CE"><enum>(10)</enum><header>United States person</header><text display-inline="yes-display-inline">The term <quote>United States person</quote> has the meaning given such term in section 101 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801</external-xref>).</text></paragraph></subsection></section>
