<official-title display="yes">To amend the Dingell-Johnson Sport Fish Restoration Act with respect to sport fish restoration and recreational boating safety, and for other purposes.</official-title>

<section id="H43218A378F624F989BDEC20D7B1AA5DA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sport Fish Restoration, Recreational Boating Safety, and Wildlife Restoration Act of 2021</short-title></quote>.</text></section> <section id="H9417B489DEA240F8B3A7585FA6A12D87"><enum>2.</enum><header>Division of annual appropriations</header> <subsection id="HBE9045DC68B94D10A2969FCB82E6CEF6"><enum>(a)</enum><header>In general</header><text>Section 4 of the Dingell-Johnson Sport Fish Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/777c">16 U.S.C. 777c</external-xref>) is amended—</text>
<paragraph id="H1A72C72463944B83A9C282BB6CCC1258"><enum>(1)</enum><text>in subsection (a), by striking <quote>2021</quote> and inserting <quote>2025</quote>; </text></paragraph> <paragraph id="HF1E85A3E3A7C4B7BAD607B340D810FAC"><enum>(2)</enum><text>in subsection (b)—</text>
<subparagraph id="H1077C3F93D0247D4B3F77CA7D6C817A9"><enum>(A)</enum><text>in paragraph (1)—</text> <clause id="H888AB791DA294F9A99B3F8AF57916DDE"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>2021</quote> and inserting <quote>2025</quote>; and</text></clause>
<clause id="HF11B63B02E794ECCBD08E94DA318ACD3"><enum>(ii)</enum><text>by amending subparagraph (B) to read as follows—</text> <quoted-block display-inline="no-display-inline" id="H68DEEBF7A460434E9FFE2941FD4D7205" style="OLC"> <subparagraph id="HBE5C2A46E8CB420BA6ABD78E62040105"><enum>(B)</enum><header>Available amounts</header><text display-inline="yes-display-inline">The available amount referred to in subparagraph (A) is—</text>
<clause id="H3411D947C8B7405E9FCA4C338BC6424D"><enum>(i)</enum><text display-inline="yes-display-inline">for fiscal year 2022, $12,786,434, adjusted for inflation as described in clause (ii)(II)(bb); and</text></clause> <clause id="H46F9D8857A764841A556F7204F6A0E3E"><enum>(ii)</enum><text>for fiscal year 2023 and each fiscal year thereafter, the sum of—</text>
<subclause id="H03FF177D58F14278B4113387971F0610"><enum>(I)</enum><text>the available amount for the preceding fiscal year; and</text></subclause> <subclause id="H6B0ACC51CE9F483089698EA8B30230FF"><enum>(II)</enum><text>the amount determined by multiplying—</text>
<item id="H76728A181CA24CEAB49DE9F08841C58D"><enum>(aa)</enum><text>the available amount for the preceding fiscal year; and</text></item> <item id="H67FDD385A3434F828FCA6F5B28FEC83C"><enum>(bb)</enum><text>the change, relative to the preceding fiscal year, in the Consumer Price Index for All Urban Consumers published by the Department of Labor.</text></item></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph id="H022D7EBB1480468D9D74A57F253EC643"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="H79C3E30502D24473ABD896CEC4D66CF2"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>2016 through 2021</quote> and inserting <quote>2022 through 2025</quote>; and</text></clause>
<clause id="H828785472F864453B23247F59801E60C"><enum>(ii)</enum><text>by amending subparagraph (B) to read as follows—</text> <quoted-block display-inline="no-display-inline" id="HECE74DCFE0154C1DA6A6FBADB9CE4459" style="OLC"> <subparagraph id="H7B7BB81AEB2C4099A91E0A4D5262E744"><enum>(B)</enum><header>Available amounts</header><text display-inline="yes-display-inline">The available amount referred to in subparagraph (A) is—</text>
<clause id="H0394CF9CFE424BC18B67780D2D658271"><enum>(i)</enum><text display-inline="yes-display-inline">for fiscal year 2021, $8,988,700; and</text></clause> <clause id="H13F0D63E7FA44C988A1708264CE5284D"><enum>(ii)</enum><text>for fiscal year 2022 and each fiscal year thereafter, the sum of—</text>
<subclause id="HD2796A12E5E04CB08C411B9D52AEAECF"><enum>(I)</enum><text>the available amount for the preceding fiscal year; and</text></subclause> <subclause id="H0AB5F74701D548749E493B134204C1A7"><enum>(II)</enum><text>the amount determined by multiplying—</text>
<item id="H09534C422034418A9619A88BB22AE505"><enum>(aa)</enum><text>the available amount for the preceding fiscal year; and</text></item> <item id="H2D5621256C314C11BAE111B026D492E7"><enum>(bb)</enum><text>the change, relative to the preceding fiscal year, in the Consumer Price Index for All Urban Consumers published by the Department of Labor.</text></item></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph>
<paragraph id="HF51034423D0C49208D050B2475343C78"><enum>(3)</enum><text>in subsection (e)(2), by striking <quote>$900,000</quote> and inserting <quote>$1,300,000</quote>.</text></paragraph></subsection> <subsection id="H558846A6A15F40109D72354947A23C31"><enum>(b)</enum><header>Administration</header><text>Section 9(a) of the Dingell-Johnson Sport Fish Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/777h">16 U.S.C. 777h(a)</external-xref>) is amended—</text>
<paragraph id="H9A0CA544D97A484E9045104E94689DCD"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="HAF7E06D4D53F4BDF92DD0C936A37EAFD"><enum>(A)</enum><text>by striking <quote>on a full-time basis</quote>; and</text></subparagraph>
<subparagraph id="HAFB3EA8D364C48B7AFC13DCE2DC30B93"><enum>(B)</enum><text>by inserting <quote>for work hours the employee spends directly administering this Act, as such hours are certified by the supervisor of the employee</quote> after <quote>administer this Act</quote>; </text></subparagraph></paragraph> <paragraph id="H94690A26B0574CBDB82CFB0EE4FBEEB0"><enum>(2)</enum><text>by striking paragraph (2) and redesignating paragraphs (3) through (12) as paragraphs (2) through (11), respectively;</text></paragraph>
<paragraph id="H32C3D5F9C44544C29957C6FE83D3DA41"><enum>(3)</enum><text>by striking <quote>paragraphs (1) and (2)</quote> and inserting <quote>paragraph (1)</quote> each place it appears;</text></paragraph> <paragraph id="HE0CB5470FBBD4E87A765BBAAA932F6A9"><enum>(4)</enum><text>in paragraph (7), as so redesignated, by striking <quote>full-time</quote>; </text></paragraph>
<paragraph id="HCBEF1A83CAAA44EC87F31F41A58A474C"><enum>(5)</enum><text>in paragraph (8)(A), as so redesignated, by striking <quote>on a full-time basis</quote>;</text></paragraph> <paragraph id="HD7B8B449101C496ABF68ABD5550358FF"><enum>(6)</enum><text>in paragraph (9), as so redesignated, by striking <quote>on a full-time basis</quote>; and</text></paragraph>
<paragraph id="H0145DD0BDF264D32B15BB86FD042382C"><enum>(7)</enum><text>in paragraph (10), as so redesignated—</text> <subparagraph id="HBA02CBE81E4849A6BCCF4D539E8DA7F2"><enum>(A)</enum><text>by inserting <quote>or a part-time basis</quote> after <quote>on a full-time basis</quote>; and</text></subparagraph>
<subparagraph id="HC70E0A3862804EFAAC21657F426EEF4E"><enum>(B)</enum><text>by inserting <quote>provided that the percentage of relocation expenses paid with funds under this chapter do not exceed the percentage of work hours the employee spends administering this Act</quote> after <quote>at which the relocation expenses are incurred</quote>. </text></subparagraph></paragraph></subsection> <subsection commented="no" id="H483B757BA2D4409E8872ED8D1AD4A501"><enum>(c)</enum><header>Other activities</header><text>Section 14(e) of the Dingell-Johnson Sport Fish Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/777m">16 U.S.C. 777m(e)</external-xref>) is amended by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H3C6EE3FD1BBB40A99DB8F4E0ED6BB9FB" style="OLC">
<paragraph commented="no" id="HE27EC0636F8846EC8DD02481A126BBC7"><enum>(3)</enum><text display-inline="yes-display-inline">A portion, as determined by the Sport Fishing and Boating Partnership Council, of funds disbursed for the purposes described in paragraph (2) but remaining unobligated prior to fiscal year 2020 shall be used to study—</text> <subparagraph id="H3BA6974365F740069C6C955876394528"><enum>(A)</enum><text>the impact of derelict recreational vessels on recreational boating safety and recreational fishing; and</text></subparagraph>
<subparagraph id="HE42C498CF2204D16BBB4ADAF539175B6"><enum>(B)</enum><text>identify options and methods for recycling for recreational vessels.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="HC32B248473D8447FBC807D178D80738A"><enum>3.</enum><header>Recreational boating access</header> <subsection id="H5793A45472A245649919C5E37D914D21"><enum>(a)</enum><header>In general</header><text>The Comptroller General of the United States shall conduct a study on recreational boating access. In carrying out such study, the Comptroller General shall consult with the Sport Fishing and Boating Partnership Council and the National Boating Safety Advisory Council on the design, scope, and priorities of such study.</text></subsection>
<subsection id="H29986B09C918448B9294612E958A8CAE"><enum>(b)</enum><header>Contents</header><text>To the extent practicable, the study required under subsection (a) shall contain a description of—</text> <paragraph id="H248A6A6A50F84985B33FD9C06E844E51"><enum>(1)</enum><text>the use of nonmotorized vessels in each State and how the increased use of nonmotorized vessels is impacting motorized and nonmotorized vessel access to waterway entry points;</text></paragraph>
<paragraph id="H1A98AE5607C5478A841C094E2BB62EF1"><enum>(2)</enum><text>recreational fishing and boating user conflicts concerning motorized and nonmotorized vessels at waterway access points; and</text></paragraph> <paragraph id="H48395B31125F4DE8B8F403AC2969657C"><enum>(3)</enum><text display-inline="yes-display-inline">the use of funds provided under the Dingell-Johnson Sport Fish Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/777">16 U.S.C. 777 et seq.</external-xref>) for—</text>
<subparagraph id="H6BA3666AA06D48C38FEADA2CD847E0AA"><enum>(A)</enum><text>the sport fish restoration program to improve nonmotorized vessel access at waterway entry points and the reasons for providing such access; and</text></subparagraph> <subparagraph id="HD00E567231D740BD800F38E42FB4CE23"><enum>(B)</enum><text>the Recreational Boating Safety Program funds for nonmotorized boating safety programs.</text></subparagraph></paragraph></subsection>
<subsection id="H5AC1D6A14EE945349763917535839373"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General shall submit to the Sport Fishing and Boating Partnership Council, the Committees on Natural Resources and Transportation and Infrastructure of the House of Representatives, and the Committees on Commerce, Science, and Transportation and Environment and Public Works of the Senate a report containing the study required under this section.</text></subsection> <subsection id="HCF91F52CE3A24E23B7FA4EE0ED7ED81A"><enum>(d)</enum><header>State defined</header><text display-inline="yes-display-inline">In this section, the term <quote>State</quote> means any State, the District of Columbia, the Commonwealths of Puerto Rico and the Northern Mariana Islands, and the territories of Guam, the U.S. Virgin Islands, and American Samoa.</text></subsection></section>
<section id="H8995E67193714ABDBEBEF40861C5D64A"><enum>4.</enum><header>Wildlife Restoration Fund administration</header>
<subsection id="H585770759E944FA880B9578AE0652DAC"><enum>(a)</enum><header>Allocation and apportionment of available amounts</header><text display-inline="yes-display-inline">Section 4 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669c">16 U.S.C. 669c</external-xref>), is amended—</text> <paragraph id="H2B0CF4F0CBD443FA81F1FD2C25743AA5"><enum>(1)</enum><text>in subsection (a)(1)(B)—</text>
<subparagraph id="HBB1CD51942294A508BA3DC332D0C47E6"><enum>(A)</enum><text>in clause (i) by striking <quote>for each of fiscal years 2001 and 2002, $9,000,000;</quote> and inserting the following:</text> <quoted-block style="USC" id="HA47977A36476400EAF58EA15107E930D" display-inline="yes-display-inline"><text>for fiscal year 2022, $12,786,434, adjusted for inflation as described in clause (ii)(II)(bb); </text><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph>
<subparagraph id="HF41B431F4A14449CB1733EAA3F87A98B"><enum>(B)</enum><text>by striking clauses (ii) and (iii) and inserting the following: </text> <quoted-block style="OLC" id="H49712C39BAA24EEEA2703E8B5B309CBF" display-inline="no-display-inline"> <clause id="HD6AB8E27B5484A21A485461BC027F4BC"><enum>(ii)</enum><text display-inline="yes-display-inline">for fiscal year 2023, and each fiscal year thereafter, the sum of—</text>
<subclause id="H95EB8728D9B54D58B52EF7050F63FD45"><enum>(I)</enum><text>the available amount for the preceding fiscal year; and</text></subclause> <subclause id="H5D77709FA385452AB63085402F2E556D"><enum>(II)</enum><text>the amount determined by multiplying—</text>
<item id="H0C1429FA80F94C2899287D1DDFB2735C"><enum>(aa)</enum><text>the available amount for the preceding fiscal year; and </text></item> <item id="H92DB802C56BD47E3B6FBD413197A4A02"><enum>(bb)</enum><text>the change, relative to the preceding fiscal year, in the Consumer Price Index for All Urban Consumers published by the Department of Labor.</text></item></subclause></clause><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H73476787C912496F8ABC77ED613C0F56"><enum>(2)</enum><text>in subsection (a)(2)(A) by striking <quote>the end of the fiscal year</quote> and inserting <quote>the end of the subsequent fiscal year</quote>.</text></paragraph></subsection> <subsection id="HF48B5F3CFD9449259874ED216D0C5AD3"><enum>(b)</enum><header>Authorized Expenses for Administration</header><text>Section 9(a) of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669h">16 U.S.C. 669h(a)</external-xref>) is amended—</text>
<paragraph id="H701660CA295248B69F44DCFBA7182743"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="HFFDC4B4094A542E89A6C17E2EE5373D1"><enum>(A)</enum><text>by striking <quote>on a full-time basis</quote>; and</text></subparagraph>
<subparagraph id="HDD29F4E8DCD14DCAA247BB93982E3BBD"><enum>(B)</enum><text>by inserting <quote>for the work hours the employee spends directly administering this Act, as such hours are certified by the supervisor of the employee</quote> after <quote>administer this Act</quote>;</text></subparagraph></paragraph> <paragraph id="HE920180F97104E81A627F8B3AF1E145E"><enum>(2)</enum><text>by striking <quote>paragraphs (1) and (2)</quote> and inserting <quote>paragraph (1)</quote> each place it appears; </text></paragraph>
<paragraph id="HB6AC37743DC74F11B2E719B85B5FC153"><enum>(3)</enum><text>by striking paragraph (2) and redesignating paragraphs (3) through (12) as paragraphs (2) through (11), respectively;</text></paragraph> <paragraph id="H3F052B5B37EB47CB8C65083A5D5C9268"><enum>(4)</enum><text>in paragraph (7), as so redesignated, by striking <quote>full-time</quote>;</text></paragraph>
<paragraph id="H81EE1F723AFD481AA19E396DE150B4CB"><enum>(5)</enum><text>in paragraph (8)(A), as so redesignated, by striking <quote>on a full-time basis</quote>;</text></paragraph> <paragraph id="H7FF94CB6A71947DC8CD31F4114DB4E3C"><enum>(6)</enum><text>in paragraph (9), as so redesignated, by striking <quote>on a full-time basis</quote>; and </text></paragraph>

<subparagraph id="H574CF6325467490FAB9A3558D13897D0"><enum>(B)</enum><text>by inserting <quote>, provided that the percentage of relocation expenses paid with funds under this chapter do not exceed the percentage of work hours the employee spends administering this Act</quote> after <quote>at which the relocation expenses are incurred</quote>.</text></subparagraph></paragraph></subsection></section> <section id="H25F3B1EFCE1F4C7D82F572B7484ECBB4"><enum>5.</enum><header>Sport fish restoration and boating trust fund</header><text display-inline="no-display-inline">Section 13107(c)(2) of title 46, United States Code, is amended by striking <quote>No funds available</quote> and inserting <quote>On or after October 1, 2023 no funds available,</quote>.</text></section>
<section id="H20B9ECAD79134A7BBD298536A9BC4C35"><enum>6.</enum><header>Sport fishing and boating partnership council</header><text display-inline="no-display-inline">The Sport Fishing and Boating Partnership Council established by the Secretary of the Interior shall be a Federal advisory committee of both the Department of the Interior and the Department of Commerce, and the secretaries of Interior and Commerce shall jointly carry out the requirements of the Federal Advisory Committee Act with respect to the Sport Fishing and Boating Partnership Council. </text></section> </legis-body> </bill>
