<section id="H3BCDE82F5CCE4C14890C31DBFEA1CCA5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Affordable Housing Near Transit Act</short-title></quote>.</text></section> <section id="HBAEE867E0B604367A6544C515CB43472" section-type="subsequent-section"><enum>2.</enum><header>Property disposition for affordable housing</header><text display-inline="no-display-inline">Section 5334(h)(1) of title 49, United States Code, is amended to read as follows:</text>
<quoted-block id="H41D62B150DF9464FA1AC1330A6C1DD3C" style="USC">
<paragraph id="HED79FAD806D14925854F45902750747F"><enum>(1)</enum><header>In general</header><text>If a recipient of assistance under this chapter decides an asset acquired under this chapter at least in part with that assistance is no longer needed for the purpose for which such asset was acquired, the Secretary may authorize the recipient to transfer such asset to—</text> <subparagraph id="HBF70AD02EE184C5E8E7A471965002197"><enum>(A)</enum><text>a local governmental authority to be used for a public purpose with no further obligation to the Government if the Secretary decides—</text>
<clause id="H8AE4248FD4D24449A80989E3F6F8A237"><enum>(i)</enum><text>the asset will remain in public use for at least 5 years after the date the asset is transferred;</text></clause> <clause id="HD0BFE85D2B454FFBB270308AC6C41253"><enum>(ii)</enum><text>there is no purpose eligible for assistance under this chapter for which the asset should be used;</text></clause>
<clause id="HD7E3B5D3F8144EE68DDA445E917FD436"><enum>(iii)</enum><text>the overall benefit of allowing the transfer is greater than the interest of the Government in liquidation and return of the financial interest of the Government in the asset, after considering fair market value and other factors; and</text></clause> <clause id="H2B4425F02B8740A69AC0B54F5D1C35F4"><enum>(iv)</enum><text>through an appropriate screening or survey process, that there is no interest in acquiring the asset for Government use if the asset is a facility or land; or</text></clause></subparagraph>
<subparagraph id="H57119DD89E2B4486A66826CB3C5B4BDF"><enum>(B)</enum><text>a local governmental authority, nonprofit organization, or other third-party entity to be used for the purpose of transit-oriented development with no further obligation to the Government if the Secretary decides—</text> <clause id="H51185E78125941059D12BD54D07352F1"><enum>(i)</enum><text>the asset is a necessary component of a proposed transit-oriented development project;</text></clause>
<clause id="H01A806E5ADE049BC80C08D2FE4FDFB8F"><enum>(ii)</enum><text>the transit-oriented development project will increase transit ridership;</text></clause> <clause id="HDBB864AB13D54D71AA04AA7D0450D5E1"><enum>(iii)</enum><text>at least 40 percent of the housing units offered in the transit-oriented development, including housing units owned by nongovernmental entities, are legally binding affordability restricted to tenants with incomes at or below 60 percent of the area median income and owners with incomes at or below 60 percent the area median income, which shall include at least 20 percent of such housing units offered restricted to tenants with incomes at or below 30 percent of the area median income and owners with incomes at or below 30 percent the area median income; </text></clause>
<clause id="H58056EB34585446292C6C470203A3816"><enum>(iv)</enum><text>the asset will remain in use as described in this section for at least 30 years after the date the asset is transferred; and</text></clause> <clause id="H250CEF0951434362A675DC0020FB9B98"><enum>(v)</enum><text>with respect to a transfer to a third-party entity—</text>
<subclause id="HEC9104A7062342DA8A8E44F99D88B5C9"><enum>(I)</enum><text>a local government authority or nonprofit organization is unable to receive the property;</text></subclause> <subclause id="HEF57BDD6FA014383A3B9DFD384F8DA9E"><enum>(II)</enum><text>the overall benefit of allowing the transfer is greater than the interest of the Government in liquidation and return of the financial interest of the Government in the asset, after considering fair market value and other factors; and</text></subclause>
<subclause id="HE3632DFE6519430C82760091BCE2C552"><enum>(III)</enum><text>the third party has demonstrated a satisfactory history of construction or operating an affordable housing development.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body> </bill>
