which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Transportation to establish a grant program to educate the public on the dangers of drug-impaired driving, and for other purposes.</official-title></form><legis-body id="H7876EC5689CD4F5CBDC81D1A91DE8D73" style="OLC"><section id="H2C7D89DCB33F4DFCA14FD3049FAEEC0E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drug-Impaired Driving Education Act of 2021</short-title></quote>.</text></section><section id="H38BBEE9046E94C3BB05B19388364DC04"><enum>2.</enum><header>Drug-impaired driving education grant program</header><subsection id="HA76194F506014B7F83209D75BECC9003"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall establish a program to provide grants on a competitive basis to States to educate the public on the dangers of drug-impaired driving.</text></subsection><subsection id="H2C31D23A7EDA456EB65F6787EA889D1D"><enum>(b)</enum><header>Application for grant</header><text display-inline="yes-display-inline">To be eligible for a grant provided under this Act, a State shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary may require.</text></subsection><subsection id="HC947A5F7AE8F4A778F058C73ED7ABD99"><enum>(c)</enum><header>Use of grant through covered entity</header><text display-inline="yes-display-inline">A State that receives a grant under the program established under subsection (a) may use such grant to provide funds to a covered entity that will educate the public on the dangers of drug-impaired driving.</text></subsection><subsection id="HA5CEB56BF88B453188DFB8CB446B1CF1" commented="no"><enum>(d)</enum><header>Best available evidence</header><text display-inline="yes-display-inline">A State that receives a grant provided under this Act, or an entity using funds provided by a State that received such grant, to educate the public on the dangers of drug-impaired driving shall—</text><paragraph id="H735AA30656A04B72A7E1DF7ED1E9F1B7" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">use evidence and strategies recommended by the Congressional Research Service publication titled “Marijuana Use and Highway Safety”, published in May, 2019; </text></paragraph><paragraph id="H26D0BE68211646EB95DED19110861383" commented="no"><enum>(2)</enum><text>use evidence and strategies recommended by the National Highway Traffic Safety Administration publication titled <quote>Countermeasures That Work: A Highway Safety Countermeasure Guide For State Highway Safety Offices, Ninth Edition, 2017</quote>, published in April, 2018; or</text></paragraph><paragraph id="H539E78FA15E043ED94EA69DDFA1BDE1A" commented="no"><enum>(3)</enum><text>use other evidence-based, peer-reviewed strategies as determined by the Secretary.</text></paragraph></subsection><subsection id="H449A2127FBA341C18C47124383E87A9D"><enum>(e)</enum><header>Evaluation</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which a State receives a grant under the program established under subsection (a), the State shall submit to the Secretary an evaluation of the progress made toward reducing drug-impaired driving within the State.</text></subsection><subsection id="H00C1C56C3E534F748CECF588F3985729" commented="no"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this Act $10,000,000 for each of the first 2 fiscal years beginning after the date of enactment of this Act.</text></subsection><subsection id="H5ACD6726A2A04215B482FDCF84FEE0E8"><enum>(g)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="H6308EA96000740BFBC53069EBED9CEE0"><enum>(1)</enum><header>Covered entity</header><text>The term <term>covered entity</term> includes the following:</text><subparagraph id="H12368915B180427BB80BD36AD76D9366"><enum>(A)</enum><text display-inline="yes-display-inline">A State government agency.</text></subparagraph><subparagraph id="H046CA9E7F306424586CFEF7EA6961CB2"><enum>(B)</enum><text display-inline="yes-display-inline">A local government agency or political subdivision of a State.</text></subparagraph><subparagraph id="HA45410E44DDA4697AFAF8D3CDDDBEC75"><enum>(C)</enum><text>An Indian Tribal Government.</text></subparagraph><subparagraph id="H7D6B152880054DF092B0D0F7A99B054C"><enum>(D)</enum><text>A nonprofit organization.</text></subparagraph><subparagraph id="HE744DFD6A2AA4DBFBFC8FFE63A811718" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">A State or local prosecution office.</text></subparagraph><subparagraph id="H28A72B22B3EA4307B6C38D0D9454E637" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">A State or local law enforcement agency.</text></subparagraph></paragraph><paragraph id="HB7C98A88F7244841AA7CB0161A932186" commented="no"><enum>(2)</enum><header>Drug-impaired driving</header><text display-inline="yes-display-inline">The term <term>drug-impaired driving</term> means driving under the influence of marijuana, opioids, cocaine, amphetamines, fentanyl, or phencyclidine.</text></paragraph><paragraph id="H4AD5DEB6284B4614B73EB03B2F9B729D"><enum>(3)</enum><header>Marijuana</header><text display-inline="yes-display-inline">The term <term>marijuana</term> has the meaning given such term in section 4008 of the FAST Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>).</text></paragraph><paragraph id="H4855BDBDDFC04DEB95681172CDE1FA54" commented="no"><enum>(4)</enum><header>Nonprofit organization</header><text display-inline="yes-display-inline">The term <term>nonprofit organization</term> means an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/501">26 U.S.C. 501(c)(3)</external-xref>) and is exempt from taxation under section 501(a) of such Code.</text></paragraph><paragraph id="H3B52B1C10BC6498FBA24D56C6F8D4382"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph id="H3515DF46273245AABEA58B9B6EA908E6" commented="no"><enum>(6)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means a State of the United States, the District of Columbia, each territory of the United States, and each federally recognized Indian Tribe.</text></paragraph></subsection></section></legis-body></bill>
