R. 366</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210119">January 19, 2021</action-date><action-desc><sponsor name-id="T000460">Mr. Thompson of California</sponsor> (for himself, <cosponsor name-id="M001163">Ms. Matsui</cosponsor>, <cosponsor name-id="S001183">Mr. Schweikert</cosponsor>, <cosponsor name-id="J000292">Mr. Johnson of Ohio</cosponsor>, <cosponsor name-id="C001114">Mr. Curtis</cosponsor>, and <cosponsor name-id="W000800">Mr. Welch</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XI of the Social Security Act to authorize the Secretary of Health and Human Services to waive or modify application of Medicare requirements with respect to telehealth services during any emergency period, and for other purposes.</official-title></form><legis-body id="H918D4C0059A54BFAB36B9ECBE508760A" style="OLC"><section id="H1F34FA3327E1499D8018909FC368EE47" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Access to Post-COVID–19 Telehealth Act of 2021</short-title></quote>.</text></section><section id="H1C7E22A6102D4EF0A6AF36EB6939BE6C"><enum>2.</enum><header>Authorization for the Secretary of Health and Human Services to waive or modify application of Medicare requirements with respect to telehealth services</header><subsection id="HD4D4F6A7FB964CAB916929AD13EC7644"><enum>(a)</enum><header>Secretarial authority to temporarily waive or modify Medicare requirements with respect to telehealth services furnished during any emergency period</header><text display-inline="yes-display-inline">Section 1135 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H7398A5C8EB664040A9B6C387602C38C1" display-inline="no-display-inline"><subsection id="H1768D3D1854D4F0E81DC2E9B3BEAB00C"><enum>(h)</enum><header>Waiver or modification of certain requirements with respect to telehealth services</header><paragraph id="H6CF4B609668F40E1804A629ACBEDAE99"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of this section, during the period described paragraph (2), the Secretary may waive or modify any requirement with respect to a telehealth service payable under section 1834(m)(1) for such period.</text></paragraph><paragraph id="HC4A43DF451CA4F329F812F9B51A23AD2"><enum>(2)</enum><header>Period described</header><text>For purposes of paragraph (1), the period described in this paragraph is the period—</text><subparagraph id="H1E79F58788814FB882CD995F0CFCF479"><enum>(A)</enum><text>beginning on the first day of—</text><clause id="H482A94FBC0394EE4BF1533179E9BE561"><enum>(i)</enum><text display-inline="yes-display-inline">an emergency or disaster declared by the President pursuant to the National Emergencies Act or the Robert T. Stafford Disaster Relief and Emergency Assistance Act; or</text></clause><clause id="HF490CC42CC4D446D9D683BC31D1C3D98"><enum>(ii)</enum><text>a public health emergency declared by the Secretary pursuant to section 319 of the Public Health Service Act; and</text></clause></subparagraph><subparagraph id="HDEA18ED308F6432F951EB8D7B16D0E2D"><enum>(B)</enum><text>ending on the day that is 90 days after the last day of an emergency, disaster, or public health emergency described in subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC8E454D156274B28BBFFFD8F314C422C"><enum>(b)</enum><header>Report</header><paragraph id="H4EF16FC62FA14C79886D1EEF9B028579"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HAA4B91A5CD704571BD30A7FD83D48FD6"><enum>(A)</enum><header>COVID–19 public health emergency</header><text>The term <term>COVID–19 public health emergency</term> means the outbreak and public health response pertaining to Coronavirus Disease 2019 (COVID–19), associated with the emergency declared by the Secretary on January 31, 2020, under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>), and any renewals thereof and any subsequent declarations by the Secretary related to COVID–19.</text></subparagraph><subparagraph id="H16B4CC4B993C4272B0FBF4974E81D1C4"><enum>(B)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></subparagraph></paragraph><paragraph id="HD006DF7603314ED48D5CC654D4BEF6D7"><enum>(2)</enum><header>Data collection and reports on the use of telehealth during the COVID–19 public health emergency</header><subparagraph id="HF13955E769BB4B599F234D6CAD25B53E"><enum>(A)</enum><header>Data collection and analysis</header><clause id="HE3321669B89D4AA8AE4C0550F38B7237"><enum>(i)</enum><header>In general</header><text>Beginning not later than 30 days after the date of enactment of this Act, the Secretary shall collect and analyze qualitative and quantitative data on the impact of telehealth services, virtual check-ins, digital health, and remote patient monitoring technologies on health care delivery permitted by the waiver or modification of certain requirements under titles XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.), and any regulations thereunder, pursuant to section 1135 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5</external-xref>) during the COVID–19 public health emergency, which may include the collection of data regarding—</text><subclause id="H140CB75729A94B8B8DCFFBE7EFD7485E"><enum>(I)</enum><text>health care utilization rates across the Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.) for individuals confirmed or suspected to have COVID–19 and individuals seeking care unrelated to COVID–19, including—</text><item id="H4AC2CC01BCCB40D096CF9DFC86363F4E"><enum>(aa)</enum><text>patient access to telehealth services in medically underserved communities; or</text></item><item id="HE16BB998AA894AC08035322B990BDBBC"><enum>(bb)</enum><text display-inline="yes-display-inline">individuals receiving telehealth services through federally qualified health centers (as defined in section 1861(aa)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)(4)</external-xref>) or rural health clinics (as defined in section 1861(aa)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)(2)</external-xref>)) serving as originating sites or distant sites, and any challenges for providers furnishing telehealth services in these communities;</text></item></subclause><subclause id="HE1C2B3453C2141E2B6268E4BE46E70D0"><enum>(II)</enum><text>health care quality for individuals confirmed or suspected to have COVID–19 and individuals seeking care unrelated to COVID–19 as measured by—</text><item id="HAF261D74F91F482C822F41109ED41949"><enum>(aa)</enum><text display-inline="yes-display-inline">quality of care metrics, such as hospital readmission rates, missed appointment rates, or wellness visits, and</text></item><item id="H0B0BF7E8641242C1A89A1E1D1B989CC8"><enum>(bb)</enum><text>engagement metrics, such as voluntary patient satisfaction surveys and voluntary provider satisfaction surveys;</text></item></subclause><subclause id="H926154FEFE6D4706A8EA1DC7A022CED7"><enum>(III)</enum><text>audio-only telehealth utilization rates when other video-based telehealth was not an option or any other telehealth services that were not provided in real-time (including text-messaging or through online chat platforms), the types of visits, and the types of providers treating individuals;</text></subclause><subclause id="HF2CD642DB9B34A99B72B55DC8E43C013"><enum>(IV)</enum><text>telehealth utilization rates used to treat individuals across State lines;</text></subclause><subclause id="HDAFD49EF7E3F438691A185ED5C095A25"><enum>(V)</enum><text display-inline="yes-display-inline">the health outcomes of any individual who utilizes telehealth services to treat an underlying health condition such as diabetes, end-stage renal disease, chronic lung disease, obstructive pulmonary disease, coronary artery disease, or cirrhosis and the types of technology utilized to receive care, including text-messaging, online chat platforms, audio-only, or video conferencing;</text></subclause><subclause id="H3A8740CAD1B244C8BDC4D8015776778E"><enum>(VI)</enum><text display-inline="yes-display-inline">the health outcomes of any individual who utilizes mental health care and substance use disorder treatment services, and the types of technology utilized to receive care, including text-messaging, online chat platforms, audio-only, or video conferencing; </text></subclause><subclause id="HF96BA6DCF6C14D6BB0AAEE3426077546"><enum>(VII)</enum><text display-inline="yes-display-inline">the impact of State and Federal privacy and security protections on the delivery of care and patient safety, including the security of the various technologies utilized to deliver or receive telehealth care;</text></subclause><subclause id="HBC468538183A4330B0A648C30C476DF3"><enum>(VIII)</enum><text>how telehealth access differs by race, ethnicity, or income levels;</text></subclause><subclause id="H83100764EFC34847BA4091D49BC285DF"><enum>(IX)</enum><text display-inline="yes-display-inline">the types of technologies utilized to deliver or receive telehealth care, including Zoom, Skype, FaceTime, text messaging, online chat platforms, or other technologies, as observed by the Secretary, and utilization rates, disaggregated by type of technology (as applicable);</text></subclause><subclause id="HD49ECBCB71564FDBAE6DBB1D776DCFE2"><enum>(X)</enum><text display-inline="yes-display-inline">the investments necessary for providers to develop a platform to effectively provide telehealth services to their patients, including the costs of the necessary technology and the costs of training staff; and</text></subclause><subclause id="H8B86E581E2BD4A249B86741C45B057B3"><enum>(XI)</enum><text>any additional information determined appropriate by the Secretary.</text></subclause></clause><clause id="H8BC31613FC0242A8B591C9D5A9237CF3"><enum>(ii)</enum><header>Broadband availability data</header><text display-inline="yes-display-inline">Upon request by the Secretary, the Assistant Secretary of Commerce for Communications and Information and the Federal Communications Commission shall provide the Secretary any relevant data regarding the availability of broadband internet access service (as defined in section 801 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/641">47 U.S.C. 641</external-xref>)) for the purposes of completing the report under clause (i).</text></clause></subparagraph><subparagraph id="H0C6369B223EB447D9FA08514CD356F1F"><enum>(B)</enum><header>Interim report to congress</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall submit to the Committees on Finance and Health, Education, Labor, and Pensions of the Senate and the Committees on Ways and Means and Energy and Commerce of the House of Representatives an interim report on the impact of telehealth based on the data collected and analyzed under subparagraph (A). For the purposes of the interim report, the Secretary may determine which data collected and analyzed under subparagraph (A) is most appropriate to complete such report.</text></subparagraph><subparagraph id="H7886B3DEA6994B73915A1FF7379896C0"><enum>(C)</enum><header>Final report to congress</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall submit to the Committees on Finance and Health, Education, Labor, and Pensions of the Senate and the Committees on Ways and Means and Energy and Commerce of the House of Representatives a final report on the impact of telehealth based on the data collected and analyzed under subparagraph (A) that includes—</text><clause id="H93F74BF86D7C409A87FBE4EAB345AA04"><enum>(i)</enum><text>conclusions regarding the impact of telehealth services on health care delivery during the COVID–19 public health emergency; and</text></clause><clause id="HF4C19B7D36F145ECA8F2E3BA2AF53C84"><enum>(ii)</enum><text display-inline="yes-display-inline">an estimation for total Medicare spending on telehealth services, including total spending for each specific type of service for which Medicare reimbursed. </text></clause></subparagraph><subparagraph id="HADE7BACA5D23498293D83FFA6444E23B"><enum>(D)</enum><header>Stakeholder input</header><clause id="H7DD1254B63414A8DB56F62837218F5C5"><enum>(i)</enum><header>In general</header><text>For purposes of subparagraph (A), (B), and (C), the Secretary shall seek input from the Medicare Payment Advisory Commission, the Medicaid and CHIP Payment and Access Commission and nongovernmental stakeholders, including patient organizations, providers, and experts in telehealth.</text></clause><clause id="HCB4E191FE3DC446B94F5E827469DC0E9"><enum>(ii)</enum><header>Comment period</header><text>For the purposes of this subsection, the Secretary shall establish a comment period not later than 14 days after the date of enactment of this Act.</text></clause></subparagraph></paragraph></subsection></section><section id="H64C063F492554DA49B5AB426C9DD9DE5" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Rural health clinics and federally qualified health centers</header><subsection id="HB00840179DE543BD952F9EB31CA6D2D0"><enum>(a)</enum><header>Expansion of distant sites</header><text>Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text><paragraph id="H2666D1C2D31C493E83F13F15BE17D913"><enum>(1)</enum><text>in the first sentence of paragraph (1)—</text><subparagraph id="H6F254FA511094FC38583863BB6500E48"><enum>(A)</enum><text>by striking <quote>or a practitioner (described in section 1842(b)(18)(C))</quote> and inserting <quote>, a practitioner (described in section 1842(b)(18)(C)), a federally qualified health center, or a rural health clinic</quote>; and</text></subparagraph><subparagraph id="HD5EB27F594BB42CAA4419B3CA67BC674"><enum>(B)</enum><text>by striking <quote>or practitioner</quote> and inserting <quote>, practitioner, federally qualified health center, or rural health clinic</quote>;</text></subparagraph></paragraph><paragraph id="H9DE9B4EEBC934778B62D32E89F94F291"><enum>(2)</enum><text>in paragraph (2)(A)—</text><subparagraph id="H7CF597D9C4664B939EAC3DCD1EEAC690"><enum>(A)</enum><text>by inserting <quote>or to a federally qualified health center or rural health clinic that serves as a distant site</quote> after <quote>a distant site</quote>; and</text></subparagraph><subparagraph id="H411AF04DB3F14BE4BDD6750B01B58128"><enum>(B)</enum><text>by striking <quote>such physician or practitioner</quote> and inserting <quote>such physician, practitioner, federally qualified health center, or rural health clinic</quote>; and</text></subparagraph></paragraph><paragraph id="HCEF539D2F6824EC89599A7BB6391186D"><enum>(3)</enum><text>in paragraph (4)—</text><subparagraph id="H44CB3CD27AF940B5A4E9A1EA43A98B9F"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>and includes a federally qualified health center or rural health clinic that furnishes a telehealth service to an eligible individual</quote> before the period at the end; and</text></subparagraph><subparagraph id="H523E1D068A7B47F2AC1230AB05565DF5"><enum>(B)</enum><text>in subparagraph (F), by adding at the end the following new clause:</text><quoted-block id="HB7FCBC577D8E4EA4BB0A681580832275" style="OLC"><clause id="HBFF1441E331145E8BF0A9DC9F6458044"><enum>(iii)</enum><header>Inclusion of rural health clinic services and federally qualified health center services furnished using telehealth</header><text>For purposes of this subparagraph, the term <term>telehealth services</term> includes a rural health clinic service or Federally qualified health center service that is furnished using telehealth to the extent that payment codes corresponding to services identified by the Secretary under clause (i) or (ii) are listed on the corresponding claim for such rural health clinic service or Federally qualified health center service.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HCDD88DE1B5664B679504023D9896DB6F"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to services furnished on or after January 1, 2022.</text></subsection></section><section id="HAAEB8D1A80CA4ADC91C5EE0023C092FC"><enum>4.</enum><header>Elimination of restrictions relating to telehealth services</header><subsection id="H4E6AF5C8074546BD9B22DD7C353E0785" commented="no"><enum>(a)</enum><header>Elimination of geographic restrictions of originating sites</header><text display-inline="yes-display-inline">Section 1834(m)(4)(C)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)(i)</external-xref>) is amended—</text><paragraph id="HC339EC43F90D4EB88092AC82E0494896" commented="no"><enum>(1)</enum><text>by striking <quote>the service is furnished via a telecommunications system and only if such site is located—</quote> and inserting <quote>the service—</quote>;</text></paragraph><paragraph id="H5667E5F19A8844C884D22495B4B70C3E" commented="no"><enum>(2)</enum><text>by redesignating subclauses (I) through (III) as items (aa) through (cc), respectively, and moving the margins two ems to the right; and</text></paragraph><paragraph id="H15D984CA89694CC88E6E8CD6051BAC9F" commented="no"><enum>(3)</enum><text>by inserting before item (aa), as redesignated by paragraph (2), the following new subclauses:</text><quoted-block style="OLC" id="H808F38DB22C94E4FBC36F945B8968EF1" display-inline="no-display-inline"><subclause id="H8078EABD29EF49B08781A99F1F827B4D" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">is furnished via a telecommunications system; and</text></subclause><subclause id="H1355A2283E1547ED87E92D1FBE8E864F" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">for the period beginning on the date of the enactment of this subclause and ending on December 31, 2021, only if such site is located—</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H263FE80648C14CB0861DE050CAA00A22"><enum>(b)</enum><header>Elimination of restrictions in which telehealth services may be furnished in the home</header><text display-inline="yes-display-inline">Section 1834(m)(4)(C)(ii)(X)) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)(ii)(X)</external-xref> is amended to read as follows:</text><quoted-block style="OLC" id="HC63926D750A24882B188CF47DD1DE0D0" display-inline="no-display-inline"><subclause id="H595FE995E9474D83AC6AA5E560359FEB"><enum>(X)</enum><item commented="no" display-inline="yes-display-inline" id="H8B47B09C6828477EBAF1E5782F3C87C6"><enum>(aa)</enum><text>For the period beginning on the date of the enactment of this subclause and ending on December 31, 2021, the home of an individual but only for purposes of section 1881(b)(3)(B) or telehealth services described in paragraph (7).</text></item><item id="HF29B2EC898954FF8A4A5FDBA574F07CD" indent="up1"><enum>(bb)</enum><text>For the period beginning on or after January 1, 2022, the home of an individual.</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H48CC51113A564275AE283807C987F6D8"><enum>(c)</enum><header>Inclusion of additional originating sites as determined by the Secretary</header><text display-inline="yes-display-inline">Section 1834(m)(4)(C)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)(ii)</external-xref>) is amended by adding at the end the following new subclause:</text><quoted-block style="OLC" id="H85834C006D3748C8ACC8A1C0C5E61E4E" display-inline="no-display-inline"><subclause id="H58FF6A4283864F5396B9DC49D7A4038D"><enum>(XI)</enum><text display-inline="yes-display-inline">Any other location determined by the Secretary.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
