R. 3656</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210601">June 1, 2021</action-date><action-desc><sponsor name-id="D000399">Mr. Doggett</sponsor> (for himself and <cosponsor name-id="K000376">Mr. Kelly of Pennsylvania</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to provide authority to add additional vaccines to the list of taxable vaccines.</official-title></form><legis-body id="H7AC55BFD0D004DDCB092740297EE4F3A" style="OLC"><section id="H3D38EB0B1AA34071BA8536C1717A46A7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vaccine Access Improvement Act of 2021</short-title></quote>.</text></section><section id="H7F8FFCEB3CD340CCBA6579A187632EA3" section-type="subsequent-section"><enum>2.</enum><header>Addition of new vaccines to list of taxable vaccines</header><subsection id="H80989DB8F9E945EA9BF7AD3FFB6890CE"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/4132">Section 4132(a)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H17B4EF47DFE041B08F0C283C72CDC592" style="OLC"><subparagraph id="H1BFCE46D227348E584293A8B68212149"><enum>(Q)</enum><text>Any vaccine which is not described in any other subparagraph of this paragraph and which is included on the Vaccine Injury Table under section 2114 of the Public Health Service Act.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H98637D30128241D6B7D0CB2830D5DE97"><enum>(b)</enum><header>Notification</header><text>Not later than 30 days after the Secretary of Health and Human Services adds a vaccine to the Vaccine Injury Table pursuant of section 2114 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-14">42 U.S.C. 300aa–14</external-xref>), the Secretary shall notify the Secretary of the Treasury, the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions of the Senate</committee-name>, the <committee-name committee-id="SSFI00">Committee on Finance of the Senate</committee-name>, the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Ways and Means of the House of Representatives</committee-name> of such designation.</text></subsection><subsection id="H61B1BAC72C504370915448D592388F89"><enum>(c)</enum><header>Effective date</header><paragraph id="H9EF8820959EA41C5AAD4F6EFF37128AA"><enum>(1)</enum><header>Sales, etc</header><text>The amendment made by subsection (a) shall apply to sales and uses on or after the date on which the Secretary of Health and Human Services lists any new vaccine pursuant to section 2114 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-14">42 U.S.C. 300aa–14</external-xref>) for purposes of compensation for any vaccine-related injury or death through the Vaccine Injury Compensation Trust Fund.</text></paragraph><paragraph id="H01A5CAA800E542C3B4275B061506F413"><enum>(2)</enum><header>Deliveries</header><text>For purposes of paragraph (1) and <external-xref legal-doc="usc" parsable-cite="usc/26/4131">section 4131</external-xref> of the Internal Revenue Code of 1986, in the case of sales on or before the effective date described in such paragraph for which delivery is made after such date, the delivery date shall be considered the sale date.</text></paragraph></subsection></section></legis-body></bill>
