which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To expand access to electromagnetic spectrum for the provision of broadband service in rural areas, and for other purposes.</official-title></form><legis-body id="H120F0834BA6E4BC6A82EF4ED341D9A3D" style="OLC"><section id="H297D3C4507904940B8131A523FADE2CF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Opportunities for Broadband in Underserved Settlements and Towns Act</short-title></quote> or the <quote><short-title>ROBUST Act</short-title></quote>.</text></section><section id="H02D949EBC1334FDDA7C62E92C4AB4005"><enum>2.</enum><header>Access to electromagnetic spectrum for provision of broadband service in rural areas</header><subsection id="H71C12194D5624CB7A94994DF27665D52"><enum>(a)</enum><header>Evaluation of spectrum use</header><paragraph id="H776B980EFC7E4904B8EC0B3471C8771F"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Commission shall conduct an evaluation of all covered licenses that are in effect as of the date of the enactment of this Act in order to determine whether spectrum usage rights under such licenses are unutilized or underutilized in rural areas.</text></paragraph><paragraph id="H802C03ABB6D34D648777E70A823CDD2F"><enum>(2)</enum><header>Effect of infrastructure deployment on determination</header><text>In conducting the evaluation under paragraph (1), the Commission may not determine that spectrum usage rights are unutilized or underutilized if—</text><subparagraph id="HD5B234042CD94D97BF176BC092B937C2" commented="no"><enum>(A)</enum><text>in the case of a license that contains terms regarding when the licensee is required to deploy infrastructure or to begin utilizing such spectrum usage rights, the licensee is in compliance with such terms; or</text></subparagraph><subparagraph id="HB6EFC5F32F474B66A69DB5BC196DBCF9"><enum>(B)</enum><text>in the case of a license that does not contain such terms—</text><clause id="HD6E34C39C5C842E4A022CDB8C4CECEF7"><enum>(i)</enum><text>the licensee is, at the time when the Commission conducts the evaluation, in the process of deploying infrastructure to utilize such spectrum usage rights; and</text></clause><clause id="H27CDFE4405194F1A803C59B25D2846BC"><enum>(ii)</enum><text>after the deployment is complete, the spectrum usage rights will not be unutilized or underutilized.</text></clause></subparagraph></paragraph><paragraph id="HA10A95953A7A4F92B03E84CD5B82EC19"><enum>(3)</enum><header>Recommendation to lease unutilized or underutilized spectrum usage rights</header><text display-inline="yes-display-inline">If the Commission determines in the evaluation conducted under paragraph (1) that any spectrum usage rights under a covered license are unutilized or underutilized in a rural area, the Commission shall, not later than 90 days after completing such evaluation, issue a recommendation to the licensee that the licensee lease such unutilized or underutilized spectrum usage rights to other entities for the provision of broadband service in such area, in accordance with subpart X of part 1 of title 47, Code of Federal Regulations (or any successor regulation).</text></paragraph></subsection><subsection id="H4FA037241B5347B1A8F9B87579621AF1"><enum>(b)</enum><header>Sense of Congress on reduction of license sizes</header><text display-inline="yes-display-inline">It is the sense of Congress that, in issuing any covered license (except for a renewal of such a license), the Commission should ensure that the geographic area in which such license permits the use of spectrum is as small as feasible, as determined by the Commission.</text></subsection><subsection id="H7856C99FF1954D52B85EC9CB447A3815"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE8EFF457C31341C3989713ECE3ABFBEE" commented="no"><enum>(1)</enum><header>Broadband service</header><text display-inline="yes-display-inline">The term <quote>broadband service</quote> means broadband internet access service (as defined in section 8.1(b) of title 47, Code of Federal Regulations (or any successor regulation)).</text></paragraph><paragraph id="H46471CBA19D24CF8AEFD8E74A18C9BAC"><enum>(2)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Communications Commission.</text></paragraph><paragraph id="HB810674829BC461187850ECF930D2BB9"><enum>(3)</enum><header>Covered license</header><text>The term <quote>covered license</quote> means a license for the use of electromagnetic spectrum issued by the Commission under the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>)—</text><subparagraph id="HA71B70D6267C49A0B85E367706FA14F4"><enum>(A)</enum><text>under the terms of which a licensee may use such spectrum for the provision of broadband service, regardless of whether such terms expressly refer to the provision of broadband service; and</text></subparagraph><subparagraph id="H4340DE7F2A3743E6B74F9065332FD240"><enum>(B)</enum><text>any part of the geographic scope of which includes a rural area, in whole or in part.</text></subparagraph></paragraph><paragraph id="HBCE29683AEF64AE59165E4D2889EA380"><enum>(4)</enum><header>Rural area</header><text display-inline="yes-display-inline">The term <quote>rural area</quote> means a county with a population density of fewer than 100 individuals per square mile. </text></paragraph></subsection></section><section id="H239C4A014E1C40EA96B42F1FF65DB4A4"><enum>3.</enum><header>Eligibility and performance requirements under the Broadband ReConnect Program</header><text display-inline="no-display-inline">In carrying out the broadband loan and grant pilot program authorized under section 779 of division A of the Consolidated Appropriations Act, 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>; 132 Stat. 399) (commonly known as the <quote>Broadband ReConnect Program</quote>, <quote>ReConnect Program</quote>, or <quote>Rural eConnectivity Pilot Program</quote>), the Secretary of Agriculture shall—</text><paragraph id="H3A2890B2009648FEBFE733129EF38466"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to any award receiving grant assistance under the program, give the highest priority to those projects providing a download speed of at least 25 megabits per second and an upload speed of at least 3 megabits per second;</text></paragraph><paragraph id="HE188AE66629A4DC3AA79A88B13B0BEEB"><enum>(2)</enum><text display-inline="yes-display-inline">have a licensed engineer or otherwise qualified person available to provide guidance to any new applicant for assistance from the program; and</text></paragraph><paragraph id="H3399BF084C2547FD82BA3E8E25928B6B"><enum>(3)</enum><text display-inline="yes-display-inline">use a portion of the amounts made available for the program to cover the costs incurred by applicants for a loan under the program to prepare required preliminary engineering reports.</text></paragraph></section></legis-body></bill>
