Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Agriculture to establish a food waste research and technical assistance program and grant program, and for other purposes.</official-title></form><legis-body id="HEE91A1E7EFED49C8AFC89D4CCCFE0931" style="OLC"><section id="H73A7D254E44C46EE821132079D280581" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Food Waste Reduction Act</short-title></quote>.</text></section><section id="H189957CD59EF423282F0876B637356A2"><enum>2.</enum><header>Food waste research program</header><subsection id="H6407C702E2924879923D5030B2E9B433"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Food Loss and Waste Reduction Liaison of the Department of Agriculture (in this section referred to as the <quote>Liaison</quote>) shall establish a partnership with 5 regional partner institutions, selected under subsection (c), to carry out a Food Waste Research Program (in this section referred to as the <quote>Program</quote>). </text></subsection><subsection id="H17E940CFA0064EE585D569D9A031E4F1"><enum>(b)</enum><header>Food waste research program requirements</header><paragraph id="HFF1CB8FD39ED43AD953BE386220E9112"><enum>(1)</enum><header>Duties</header><text display-inline="yes-display-inline">In carrying out the Program, the Liaison, in partnership with the 5 regional partner institutions selected under subsection (c), shall—</text><subparagraph id="H07D7EC1155D14A88AB49555865133031"><enum>(A)</enum><text>plan, conduct, and arrange for public research, data, education, and recommendations within the areas of study specified in paragraph (2), as such areas relate to food waste reduction and food recovery issues nationwide, regionally, and locally; </text></subparagraph><subparagraph id="H6DD80468D64B4470894A440B12EAF963"><enum>(B)</enum><text>carry out the activities of the Program within a variety of regions in the United States, which are identified and categorized by the Liaison based on the specific food recovery and food waste reduction issues of such regions;</text></subparagraph><subparagraph id="H7A180A33861B4F74A63BCEBD56FE3E61"><enum>(C)</enum><text>identify areas to increase efficiency in the allocation of resources, coordination, cooperation, and consolidation of efforts as they relate to local, statewide, Tribal, regional, and Federal food recovery and food waste reduction efforts;</text></subparagraph><subparagraph id="H655819E1F8CA4458BE66BED1C3B6B1F8"><enum>(D)</enum><text>create a Program website, as described in paragraph (4), to disseminate information to the public; and</text></subparagraph><subparagraph id="HE5CE0DA324D44758B455CBD020D04E49"><enum>(E)</enum><text>collaborate with other colleges, universities, and nonprofit organizations in the regions selected by the Liaison that have demonstrated capability for research, information dissemination, and professional training in order to develop regional networks that are knowledgeable in food waste reduction issues. </text></subparagraph></paragraph><paragraph id="H28E472A49C844BAF9E48DFBF4C674EB8"><enum>(2)</enum><header>Areas of Study</header><text display-inline="yes-display-inline">In carrying out the duties listed in subsection (a), the Liaison and the regional partner institutions shall consider the following areas of study: </text><subparagraph id="H1E2C4747C1D04DC481FAA5C77A42AC76"><enum>(A)</enum><text>Reducing the volume of surplus food produced.</text></subparagraph><subparagraph id="H018E44368FBE4714B43467F74264FA26"><enum>(B)</enum><text>Feeding individuals in need to utilize excess food, including through the use of donations of surplus food.</text></subparagraph><subparagraph id="H4E1778D24A814C33AF4FD7C334E263BB"><enum>(C)</enum><text display-inline="yes-display-inline">Diverting food unusable for purposes of subparagraph (B) to feed animals.</text></subparagraph><subparagraph id="HCE8C1EFC6EBF40D48B9DF6F403EB6470"><enum>(D)</enum><text>Utilizing food waste to create renewable energy sources. </text></subparagraph><subparagraph id="HAF975913E07C4255A3312F7FEB48EB50"><enum>(E)</enum><text>Composting food waste to create nutrient rich soil.</text></subparagraph><subparagraph id="H6DCC9AE155184CBD9B44BE4CEC76CE7B"><enum>(F)</enum><text>Diminishing the deposits of food waste in landfills and reducing the incineration of food waste.</text></subparagraph></paragraph><paragraph id="H0D2B01F246F64E0AB3AD5EE29806151B" display-inline="no-display-inline"><enum>(3)</enum><header>Use of Funds</header><subparagraph id="H3B17583D43BB43D39F2779981A0ADA45"><enum>(A)</enum><header>In General</header><text display-inline="yes-display-inline">The Liaison may make funds available under this section to improve the facilities of the regional partner institutions to a level that meets the requirements of the role of a regional partner institution.</text></subparagraph><subparagraph id="H525C627CF4C741049DA98AC8C6E11CD0"><enum>(B)</enum><header>Plan</header><text display-inline="yes-display-inline">A regional partner institution may not receive any funding for any facility upgrade under subparagraph (A), unless—</text><clause id="HA0299C992C814A1EA21FA4080A5F3953"><enum>(i)</enum><text display-inline="yes-display-inline">the regional partner institution submits to the Liaison a plan detailing the type of facility construction or improvements to take place (including any land acquisition, engineering, design, and staffing and equipment needs, in addition to other information as required by the Liaison); and</text></clause><clause id="H1029F56268F8493ABFCA27B58CDBE926"><enum>(ii)</enum><text>the Liaison approves such plan. </text></clause></subparagraph><subparagraph id="H3AC3CD752AF941A88B0812D445167C41"><enum>(C)</enum><header>Non-Federal Cost Share for Facility Improvement</header><text display-inline="yes-display-inline">A regional partner institutions shall be required to provide at least a 20 percent non-Federal cost share for facility improvement or construction projects pursued by a regional partner institution under subparagraph (A).</text></subparagraph><subparagraph id="HD5779E6496CB412688BECB2B5DD1E23E"><enum>(D)</enum><header>Matching Funds for Operating Expenses</header><text display-inline="yes-display-inline">A regional partner institution shall be required to provide at least a 30 percent non-Federal cost share for all Program operating expenses related to such regional partner institution.</text></subparagraph><subparagraph id="H22A382038B52400B9B1236F983193BF8"><enum>(E)</enum><header>Wage Rate Requirements</header><text>A construction activity carried out pursuant to this section shall meet Federal prevailing wage requirements as determined by the Secretary of Labor in accordance with subchapter IV of chapter 31 of part A of subtitle II of title 40, United States Code, (commonly referred to as the <quote>Davis-Bacon Act</quote>).</text></subparagraph></paragraph><paragraph id="H5654DD85F8E844CF8839411EF4C4D780"><enum>(4)</enum><header>Food waste research program website</header><text>The Liaison shall establish a website that shall contain at least the following information:</text><subparagraph id="H2426F99E2794455498A590B3E7A4B45E"><enum>(A)</enum><text>Key findings and best practices.</text></subparagraph><subparagraph id="HC27AFBA145A34A3FB886BB8B7FF88630"><enum>(B)</enum><text>A list of collaborations and partnerships carried out pursuant to this section.</text></subparagraph><subparagraph id="H719DD5320CF24ED392230CFB42226E69"><enum>(C)</enum><text>Annual reports and other pertinent information on the duties of the Program.</text></subparagraph><subparagraph id="H3EDC7F29F10A4BEBA9FC1C117AFD86CF"><enum>(D)</enum><text>The location and contact information for regional partner institutions.</text></subparagraph><subparagraph id="H3C17000771AE4F9C8576F8E9D63F77E0"><enum>(E)</enum><text>Federal, State, local, and regionally specific public research, data, education, and policy recommendations that shall be updated in a timely manner with new information.</text></subparagraph><subparagraph id="H68C35DA342934695A4109A83ABA0EC04"><enum>(F)</enum><text>Tools for tracking reduction efforts and measuring food waste production.</text></subparagraph></paragraph></subsection><subsection id="H25288062F4A14D68B174E435DC97DA64"><enum>(c)</enum><header>Selection of regional partner institutions</header><paragraph id="H07EBCCFCD98E4FC8BD3DF394936B17C2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, the Liaison shall select 5 regional partner institutions to partner with to carry out the requirements of the Program.</text></paragraph><paragraph id="H3AE1B2D2A6F541E8B2560D8CAB8584BE"><enum>(2)</enum><header>Criteria for Regional Partner Institutions</header><text>In making a selection under paragraph (1), the Liaison shall select an institution of higher education that—</text><subparagraph id="HB28D98BD04424DE0BE726BD33B6B44D3"><enum>(A)</enum><text>has a focus or expertise in at least one of the areas of study described in subsection (b)(2); </text></subparagraph><subparagraph id="HE2F7363F7946474B8F5FFEB04C272C68"><enum>(B)</enum><text>has the ability to plan, conduct, and arrange for public research, data, education, and recommendations related to food waste reduction and the areas of study described in subsection (b)(2);</text></subparagraph><subparagraph id="H0C77276F00814FDC84DB562EBEBC6C56"><enum>(C)</enum><text>can assist the Liaison in fulfilling the duties listed in subsection (b)(1);</text></subparagraph><subparagraph id="HCA27D26A3BE945EAB094286A3E865B2B"><enum>(D)</enum><text>can contribute the required non-Federal funding to maintain a regional partner institution center; and</text></subparagraph><subparagraph id="HB9CEC91FA41C4D759A44FC0E01CCFB85"><enum>(E)</enum><text display-inline="yes-display-inline">satisfies any other criteria determined by the Liaison.</text></subparagraph></paragraph><paragraph id="HCF80B7815E3A4AC3AF2E38D3D1A949CB"><enum>(3)</enum><header>Eligible sub-awardees</header><text display-inline="yes-display-inline">A State, Tribal, or local government, local educational agency, agricultural or commodity organization, farmer, or other organization focused on food waste prevention may serve as an eligible sub-awardee of a regional partner institution if the entity meets the requirements of subparagraphs (A) through (C) of paragraph (2).</text></paragraph><paragraph id="H486F45A1C3204B05B12DDE01262E314C"><enum>(4)</enum><header>Employment status</header><text>Members of regional partner institutions shall not be considered Federal employees for any purpose. </text></paragraph></subsection><subsection id="HBB9F6DD216774EFEADBDCB3065317F70"><enum>(d)</enum><header>Collaboration with Federal, regional, State, Tribal, and local governments and organizations</header><text>The Liaison, in conjunction with the 5 regional partner institutions selected under subsection (c) shall collaborate and share best practices on regional, State, Tribal, and locally specific food waste and food waste reduction issues with—</text><paragraph id="H513BECC223994D6CB9DE8355D0E2C715" display-inline="no-display-inline"><enum>(1)</enum><text>State and county governments;</text></paragraph><paragraph id="H86027CBE58AF48E4B469BB48106FC66E"><enum>(2)</enum><text>Tribal governments; </text></paragraph><paragraph id="H03934F8CD7E946C490DDE1186EA810A8"><enum>(3)</enum><text>units of local government;</text></paragraph><paragraph id="HC6AFC3BDF47C4A22AC284BA66BFBA314"><enum>(4)</enum><text>local educational entities;</text></paragraph><paragraph id="H6571BC0E51064B3FB9556F86D6F64B75"><enum>(5)</enum><text>colleges and universities;</text></paragraph><paragraph id="H71561D2D4C0A4E23899F2155E88DEC7F"><enum>(6)</enum><text>agricultural and commodity organizations;</text></paragraph><paragraph id="H04207F6401E14F1FBC655C397C5BC4F5"><enum>(7)</enum><text>farmers; and</text></paragraph><paragraph id="H47068E9862A94F6B8C9ECCB5FF666669"><enum>(8)</enum><text>organizations focused on food waste prevention. </text></paragraph></subsection><subsection id="H6BE613F92FE34E6097A3331717F0C9BF"><enum>(e)</enum><header>Information collection and dissemination</header><paragraph id="H836981C4CEED46F288402E7A890DFD41"><enum>(1)</enum><header>Report of regional partner institutions</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, and annually thereafter, the regional partnership institutions shall submit to the Liaison a report containing the activities, partnerships, collaborations, Federal policy recommendations, previous and continuing budgets, findings, and any other applicable information carried out under the Program.</text></paragraph><paragraph id="H05947C49B4324ECC8F565954BFA98C45"><enum>(2)</enum><header>Liaison report</header><text display-inline="yes-display-inline">Not later than 15 months after the date of the enactment of this section, and annually thereafter, the Liaison shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate and publish on the Program website an annual report containing a compilation of the activities, partnerships, collaborations, Federal policy recommendations, previous and continuing budgets, findings, and any other applicable information relating to the Program.</text></paragraph><paragraph id="HFC923D1581F147EFA7B5CC5C75FD5387"><enum>(3)</enum><header>Review of report</header><text>The Liaison shall review the annual report from the regional partner institutions to ensure that funds are being used efficiently according to the duties of the Program and that the Program is producing utilizable public research, data, education, and recommendations related to food waste and food waste reduction issues.</text></paragraph></subsection><subsection id="H790E3DE761A442B28F84C50C05841165"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $10,000,000 for fiscal year 2022. </text></subsection></section><section id="H726257259E7748DEB3B04419E34898F1" section-type="subsequent-section"><enum>3.</enum><header>Grants to research centers or non-profit organizations</header><subsection id="H47E7D476CE4A43DBA06D4E7BDCA68FF9"><enum>(a)</enum><header>Grant authority</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, the Food Loss and Waste Reduction Liaison of the Department of Agriculture (in this section referred to as the <quote>Liaison</quote>) shall establish a grant program under which the Liaison shall make grants to eligible entities, on a competitive basis, to establish contracts or cooperative agreements described in subsection (c) of section 224 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6924">7 U.S.C. 6924(c)</external-xref>) with such eligible entities to carry out the duties described in subsection (b) of such section.</text></subsection><subsection id="H5904E00DBF884B7ABAEC011A9C9ABB51"><enum>(b)</enum><header>Application</header><text>To be eligible to receive a grant under this section, an eligible entity shall submit to the Liaison an application at such time and in such manner as the Liaison may require.</text></subsection><subsection id="HED83C80F365D41D6B724218B2816DC7F"><enum>(c)</enum><header>Criteria</header><text display-inline="yes-display-inline">In making grants under this section, the Liaison shall consider, with respect to each applicant, the following:</text><paragraph id="HF9B6654C27DE4867B7D08D14DC0B2976"><enum>(1)</enum><text display-inline="yes-display-inline">The alignment of food loss and recovery programs and resources developed by such applicant with the Environmental Protection Agency Food Recovery Hierarchy.</text></paragraph><paragraph id="HBEF152274F45406785311F3E0A09191D"><enum>(2)</enum><text display-inline="yes-display-inline">The ability of the facilities and resources of such applicant to develop and deliver food loss reduction and recovery programs.</text></paragraph><paragraph id="H5935C63B6AE840D6AFF13516F7AB23A7"><enum>(3)</enum><text display-inline="yes-display-inline">The experience of such applicant in developing high-impact food loss reduction and recovery programs and resources at the State, Tribal, regional, or national scale.</text></paragraph><paragraph id="H9F7442DBE79445D0A7D6DD6787A70380"><enum>(4)</enum><text>Previous collaboration of such applicant with other food loss reduction and recovery focused organizations in the private, nonprofit, and government sectors.</text></paragraph><paragraph id="H0F5D8639556C40E4B431BAB0FC806B91"><enum>(5)</enum><text>Any other information that the Liaison shall require. </text></paragraph></subsection><subsection id="H1C06E5A9ADAD4ADFBDB1DCCBE4EEF4C6"><enum>(d)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section shall use such grant to carry out the activities described in subsection (c) of section 224 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6924">7 U.S.C. 6924(c)</external-xref>) to accomplish the duties described in subsection (b) of such section.</text></subsection><subsection id="HFF80251D47114494956B69AA9C518F0D"><enum>(e)</enum><header>Duration</header><text display-inline="yes-display-inline">Each grant under this section shall be for a period of 3 years.</text></subsection><subsection id="H91A417768AEF4BA7BED5EFD50B6FF907"><enum>(f)</enum><header>Grant Renewal</header><text>The Liaison may renew a grant under this section for an additional period of 3 years.</text></subsection><subsection id="H96402EDC7B3B43F6A7BD596414F3F2A9"><enum>(g)</enum><header>Federal share</header><text>The Federal share of a grant under this section shall not exceed 70 percent of the costs of the activities carried out under this section. </text></subsection><subsection id="H01E0BDE06A784DDEB36BB1BCE7A189FB"><enum>(h)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Liaison shall submit to Congress a report describing the activities conducted under this section and the effects of such activities on food loss and waste reduction nationally.</text></subsection><subsection id="HE3CB4C29C4F54EC49E75FA4DB4EBBD0A"><enum>(i)</enum><header>Eligible entity defined</header><text display-inline="yes-display-inline">The term <quote>eligible entity</quote> means a research center or nonprofit organization described in section 224(c) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6924">7 U.S.C. 6924(c)</external-xref>).</text></subsection><subsection id="HA82F9E4AC5E646C9B9FF6C64DD6BCA21"><enum>(j)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $10,000,000 for fiscal year 2022. </text></subsection></section></legis-body></bill>
