R. 3638</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210528">May 28, 2021</action-date><action-desc><sponsor name-id="S001200">Mr. Soto</sponsor> (for himself and <cosponsor name-id="D000626">Mr. Davidson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Federal Trade Commission to transmit to Congress a report on the Commission’s actions related to digital tokens.</official-title></form><legis-body id="HBA52B5ADC13847C6AF898A6838DE2FED" style="OLC"><section id="H42B8C2E6B628478986A4A062A75A5F7F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Digital Taxonomy Act</short-title></quote>.</text></section><section id="H585011F06AFE4D8EB950791A080FF8EA"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="H98E83E5B38D84EBEBD08FCE9BF7F24EC"><enum>(1)</enum><text>it is important that the United States remains a leader in innovation;</text></paragraph><paragraph id="HFE1CE3421FE54712BB14199B3D91F22D"><enum>(2)</enum><text>digital tokens and blockchain technology are driving innovation and providing consumers with increased choice and convenience;</text></paragraph><paragraph id="HD93F92064EB24F45BC1CFC9F74A17E4E"><enum>(3)</enum><text>the use of digital tokens and blockchain technology is likely to increase in the future;</text></paragraph><paragraph id="H8F3FF5D931904E9699136068B236A4E0"><enum>(4)</enum><text>the Federal Trade Commission is responsible for protecting consumers from unfair or deceptive acts or practices, including relating to digital tokens;</text></paragraph><paragraph id="HCF9FD0D930E1407D99C9A44B5733ED1D"><enum>(5)</enum><text>the Commission has previously taken action against unscrupulous companies and individuals that committed unfair or deceptive acts or practices involving digital tokens; and</text></paragraph><paragraph id="H9FEBE9693BED47958717D8345AD2F77B"><enum>(6)</enum><text>to bolster the Commission’s ability to enforce against unfair or deceptive acts or practices involving digital tokens, the Commission should ensure staff have appropriate training and resources to identify and pursue such cases.</text></paragraph></section><section id="H9DA4AC5C03C44FD3992E3282051CDE05"><enum>3.</enum><header>Reports on unfair or deceptive acts or practices in transactions relating to digital tokens</header><text display-inline="no-display-inline">Not later than one year after the date of enactment of this Act and each year thereafter through fiscal year 2024, the Federal Trade Commission shall transmit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, and make publicly available on its website, a report on—</text><paragraph id="H098C1AA3E0524275AEC8AD626A2C6846"><enum>(1)</enum><text>any actions taken by the Commission relating to unfair or deceptive acts or practices in transactions relating to digital tokens;</text></paragraph><paragraph id="H2CA79C2E8C9A4C00B472DCA33E808C8C"><enum>(2)</enum><text>the Commission’s other efforts to prevent unfair or deceptive acts or practices relating to digital tokens; and</text></paragraph><paragraph id="H32B39EA4B46C423B8A811F5F009740A0"><enum>(3)</enum><text>any recommendations by the Commission for legislation that would improve the ability of the Commission and other relevant Federal agencies—</text><subparagraph id="H221916E8DFE14B4D81A881194219D7C9"><enum>(A)</enum><text>to further protect consumers from unfair or deceptive acts or practices in the digital token marketplace; and</text></subparagraph><subparagraph id="H9BD2E587642E4E2DB1FCC351F5FE56E7"><enum>(B)</enum><text>to promote competition and promote innovation in the global digital token sector.</text></subparagraph></paragraph></section></legis-body></bill>
