R. 3618</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210528">May 28, 2021</action-date><action-desc><sponsor name-id="N000179">Mrs. Napolitano</sponsor> (for herself, <cosponsor name-id="S001157">Mr. David Scott of Georgia</cosponsor>, <cosponsor name-id="G000559">Mr. Garamendi</cosponsor>, <cosponsor name-id="H001068">Mr. Huffman</cosponsor>, <cosponsor name-id="L000579">Mr. Lowenthal</cosponsor>, and <cosponsor name-id="S001150">Mr. Schiff</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to clarify the use of certain taxes and revenues.</official-title></form><legis-body id="H24A6CBDD7B794ED09C36AA9C9F0AE498" style="OLC"><section id="HD58F57501BB947918CBD052B615B8F31" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State and Local General Sales Tax Protection Act</short-title></quote>.</text></section><section id="H0C374BA349A94F1CA258CC8AED621FEA" section-type="subsequent-section"><enum>2.</enum><header>Use of revenues</header><subsection id="HBB65AD0370CE4EA89B25E312A6DFD532"><enum>(a)</enum><header>Written assurances on use of revenue</header><text display-inline="yes-display-inline">Section 47107(b) of title 49, United States Code, is amended—</text><paragraph id="H3B848A5639B447C3870800AD384290F7"><enum>(1)</enum><text>in each of paragraphs (1) and (2) by striking <quote>local taxes</quote> and inserting <quote>local excise taxes</quote>;</text></paragraph><paragraph id="HA62F173C874743F186B84BB3664E3DBA"><enum>(2)</enum><text>in paragraph (3) by striking <quote>State tax</quote> and inserting <quote>State excise tax</quote>; and</text></paragraph><paragraph id="H230B4F32497B43068580C17B1503BBC0"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HDCAE951ECFCE4903885E3884BEE51E63" style="OLC"><paragraph id="H342331B748804E43A6912259C5DB15FD" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">This subsection does not apply to State or local general sales taxes nor to State or local generally applicable sales taxes.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8CCEC42525EF41C08BBEB40AAB34287F"><enum>(b)</enum><header>Restriction on use of revenues</header><text>Section 47133 of title 49, United States Code, is amended—</text><paragraph id="H12752B670AF84B978E0AFED37D637F63"><enum>(1)</enum><text>in subsection (a) in the matter preceding paragraph (1) by striking <quote>Local taxes</quote> and inserting <quote>Local excise taxes</quote>;</text></paragraph><paragraph id="HD0890C584078484798EABDC591E740AB"><enum>(2)</enum><text>in subsection (b)(1) by striking <quote>local taxes</quote> and inserting <quote>local excise taxes</quote>;</text></paragraph><paragraph id="H00A27BD6847C47EC9D50E556C563BF05"><enum>(3)</enum><text>in subsection (c) by striking <quote>State tax</quote> and inserting <quote>State excise tax</quote>; and</text></paragraph><paragraph id="HC51AC00E861D463A9C97014CC448110F"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HD76DCEDB64614957ADEA83609D373B64" style="OLC"><subsection id="H6B596FFEE0994CCEA3CE9BEC23AC864C"><enum>(d)</enum><header>Limitation on applicability</header><text display-inline="yes-display-inline">This subsection does not apply to—</text><paragraph id="HB6E8C12DD09C487F951F6BC1F3C45F05"><enum>(1)</enum><text>State or local general sales taxes; or</text></paragraph><paragraph id="HA4FF7B14D2DE4D5C98CD9D343F9CAA4B"><enum>(2)</enum><text>State or local generally applicable sales taxes.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
