R. 3612</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210528">May 28, 2021</action-date><action-desc><sponsor name-id="M001163">Ms. Matsui</sponsor> (for herself and <cosponsor name-id="G000558">Mr. Guthrie</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Commerce to establish a working group to recommend to Congress a definition of blockchain technology, and for other purposes.</official-title></form><legis-body id="H982E1FEEDFEA43FDBA783C93DD1A11EA" style="OLC"><section id="H7C3C785AAB14429E8F9D4C17AF3A1055" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Blockchain Promotion Act of 2021</short-title></quote>.</text></section><section id="H4435FC647B0446409E5C866E85931789"><enum>2.</enum><header>Working group to recommend definition of blockchain technology</header><subsection id="H070A3250A1584AF9A8FC35BFF4EAB437"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Commerce shall establish within the Department of Commerce a working group to be known as the <quote>Blockchain Working Group</quote>.</text></subsection><subsection id="H81733F5B0FE344E790C2C2BF32CE267A"><enum>(b)</enum><header>Membership</header><paragraph id="HFD43698CD2A743DA882F7C3CCB04FECD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Blockchain Working Group shall be composed of a number of members to be determined by the Secretary, to be appointed in accordance with paragraph (2).</text></paragraph><paragraph id="H9528301808324574851F9279F9E0AB4F"><enum>(2)</enum><header>Appointment</header><subparagraph id="H68ECC8FBA8594919B64F2B04F5992E79"><enum>(A)</enum><header>Representatives of Federal agencies</header><text display-inline="yes-display-inline">The Secretary shall designate Federal agencies to be represented on the Blockchain Working Group, as the Secretary considers appropriate to ensure representation of a cross-section of Federal agencies that could use or benefit from blockchain technology. The head of each agency so designated shall appoint an officer or employee of such agency to serve as a member of the Blockchain Working Group.</text></subparagraph><subparagraph id="HC8CD66FA9B3F4ABD94BC4E14010182F5"><enum>(B)</enum><header>Representatives of nongovernmental stakeholders</header><clause id="H0F023CE0C0D44BF8BEAF71FDF8B840F0"><enum>(i)</enum><header>In general</header><text>The Secretary shall appoint representatives of nongovernmental stakeholders with respect to blockchain technology to serve as members of the Blockchain Working Group.</text></clause><clause id="H24C9FDD29BC34A0CA6E250E853FA2307"><enum>(ii)</enum><header>Representation of certain stakeholders required</header><text>The members of the Blockchain Working Group appointed under clause (i) shall include representatives of the following:</text><subclause id="HA0F7BA67977B4800BCC13EB54935D776"><enum>(I)</enum><text>Information and communications technology manufacturers, suppliers, software providers, service providers, and vendors.</text></subclause><subclause id="HDC1C2F1B542749808F315B8D54D65476"><enum>(II)</enum><text>Subject matter experts representing industrial sectors other than the technology sector that the Secretary determines can benefit from blockchain technology.</text></subclause><subclause id="H2E190E0EEAA148709A7F0DA91017DE0A"><enum>(III)</enum><text>Small, medium, and large businesses.</text></subclause><subclause commented="no" id="HBB825FE123FE48169930A0680C1C0ACA"><enum>(IV)</enum><text>Individuals and institutions engaged in academic research relating to blockchain technology.</text></subclause><subclause commented="no" id="H8CB3AFAC9D6642908675745B06EFEEFE"><enum>(V)</enum><text>Nonprofit organizations and consumer advocacy groups engaged in activities relating to blockchain technology.</text></subclause><subclause id="HEF67C776DE544B14BAFB517060D8D936"><enum>(VI)</enum><text>Rural and urban stakeholders.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="HEB7CAA890889431182FB6856E2BE5BBE"><enum>(c)</enum><header>Report to Congress</header><paragraph id="HBF1B6AF092724E699C00C0714E837EF4"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Blockchain Working Group shall submit to Congress a report that contains—</text><subparagraph id="H74B21C2731064A54865C8D82519B7002"><enum>(A)</enum><text>a recommended definition of the distributed ledger technology commonly referred to as <quote>blockchain technology</quote>; and</text></subparagraph><subparagraph id="H65A7E013D3E1488CB659F1DF12A6298E"><enum>(B)</enum><text>recommendations for—</text><clause id="HC8ABE46F592848E4B35483344ADF41ED"><enum>(i)</enum><text>a study to be conducted by the Assistant Secretary of Commerce for Communications and Information, in coordination with the Federal Communications Commission, on the impact of blockchain technology on electromagnetic spectrum policy;</text></clause><clause id="HDC9FCF0EFC6D435A8DBB5F593B989320"><enum>(ii)</enum><text display-inline="yes-display-inline">a study that examines a range of potential applications, including non-financial applications, for blockchain technology; and</text></clause><clause commented="no" id="H8A50933744454938AE62EEAFFE053DF6"><enum>(iii)</enum><text display-inline="yes-display-inline">opportunities within Federal agencies to use blockchain technology.</text></clause></subparagraph></paragraph><paragraph id="H4B2D8F3566AB4C4590833478EDB52B86"><enum>(2)</enum><header>Consideration of recommendations in draft NIST report</header><text display-inline="yes-display-inline">In making recommendations under paragraph (1), the Blockchain Working Group may consider any recommendations contained in the draft of National Institute of Standards and Technology Internal Report 8202, entitled <quote>Blockchain Technology Overview</quote>, that was released in January 2018.</text></paragraph></subsection><subsection id="HF1B334AA45A4430695F1CFE15FF02D30"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HA921C06962A6472F9CDFB3E3AE289972"><enum>(1)</enum><header>Federal agency</header><text display-inline="yes-display-inline">The term <quote>Federal agency</quote> means an agency, as defined in section 551 of title 5, United States Code.</text></paragraph><paragraph id="HEB1F8E035ACE463595F6063F4F886AC6"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the Secretary of Commerce.</text></paragraph></subsection></section></legis-body></bill>
