R. 360</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210119">January 19, 2021</action-date><action-desc><sponsor name-id="S001214">Mr. Steube</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Veterans Affairs to automate third-party health insurance billings and collections of the Department of Veterans Affairs.</official-title></form><legis-body id="H10E274AB27804CE9BE9F1F4B76EED433" style="OLC"><section id="HDF04AD2001184615BDA68E72CF5A5F4A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA Fiscal Responsibility Act</short-title></quote>. </text></section><section id="H89495CD6420C46BF98A08A030BB1CE7E"><enum>2.</enum><header>Third-party billings and collections procedures of Department of Veterans Affairs</header><subsection id="HEF7FC25661BB4EBFAA93F26BB61CD4DF"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text><paragraph id="H5204D5E3D4C7474AA7CF7155C0D07C98"><enum>(1)</enum><text display-inline="yes-display-inline">A large number of third-party health billings by the Department of Veterans Affairs go uncollected each year.</text></paragraph><paragraph id="HD87E163C52D14B0598381DBD5BB8C5EE"><enum>(2)</enum><text>Procedures to provide for correct billing and prompt collection must improve at the Department.</text></paragraph><paragraph id="HDB9AD33C21824DE68D19EC617D65742B"><enum>(3)</enum><text>Congress has urged the Department to improve its systems for the collection of third-party payments that are owed to the Department for non-service-connected care for veterans.</text></paragraph><paragraph id="H6FFDE0FD0AF94DBEB1B4EC034157C41C"><enum>(4)</enum><text>It is important for the Department to increase collections of payments that are rightfully owed to the United States.</text></paragraph><paragraph id="HC04ED60A9AB14A869CA16168F31FE9EA"><enum>(5)</enum><text>A comprehensive solution to the fee care issue is necessary to realize full collection potential.</text></paragraph></subsection><subsection id="H068049AFF40E42B3BE38D4C63B15834D"><enum>(b)</enum><header>Use of automated technology</header><paragraph id="HF7C23DBF7E30430B84C834C9C86FD033"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall automate the collection of outstanding, overdue, and not fully paid third-party health insurance claims, regardless of the amount owed under any single claim.</text></paragraph><paragraph id="HE58A5EA823D04B9EB2B9B59F2B42902B"><enum>(2)</enum><header>Contract authority</header><text display-inline="yes-display-inline">The Secretary shall seek to enter into a contract using competitive procedures to provide the capability described in paragraph (1). The Secretary shall award such a contract from among contractors that the Secretary determines have proven expertise and documented success in the private sector through the use of automated small-balance recovery and appeal processes.</text></paragraph><paragraph id="HB48B77A76FB74162A527B96D221A4FA7"><enum>(3)</enum><header>Third-party health insurance claims</header><text display-inline="yes-display-inline">In this section, the term <term>third-party health insurance claims</term> means claims made by the Secretary of Veterans Affairs to recover amounts from third parties pursuant to sections 1725 and 1729 of title 38, United States Code, and other similar provisions of law.</text></paragraph></subsection></section></legis-body></bill>
