R. 359</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210119">January 19, 2021</action-date><action-desc><sponsor name-id="S001214">Mr. Steube</sponsor> (for himself, <cosponsor name-id="M001159">Mrs. Rodgers of Washington</cosponsor>, and <cosponsor name-id="H001091">Mrs. Hinson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to allow individuals who are entitled to Post-9/11 educational assistance to use such assistance to repay Federal student loans.</official-title></form><legis-body id="HB9FA24F3B61E4DE89A61AE88C47D6447" style="OLC"><section id="H213348217E604A48833D44A23D00D04B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modern GI Bill Act</short-title></quote>.</text></section><section id="H28303D0A9DB8401B8BB246C2EF7F2B60" section-type="subsequent-section"><enum>2.</enum><header>Use of Post-9/11 educational assistance to repay Federal student loans</header><subsection id="HD842475E53B24D8491D93B71DFACA2DF"><enum>(a)</enum><header>Authority</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/33">chapter 33</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/3320">section 3320</external-xref> the following new section:</text><quoted-block display-inline="no-display-inline" id="HDD4C7B50C54441A9B7BB42B0AFFEF86F" style="USC"><section id="H6B4D39194FCF47418CD454F5BCFF8235"><enum>3320A.</enum><header>Use of educational assistance benefits for the repayment of Federal student loans</header><subsection id="H733AE52526544196855AA8E4435609AA"><enum>(a)</enum><header>Use of benefits</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this chapter, an individual who is entitled to educational assistance for tuition or fees under this subchapter may apply amounts of such educational assistance to repay some or all of the outstanding balance of principal and interest due on a Federal student loan to the individual.</text></subsection><subsection id="H5DCD903CC10844B29485D1731F8B24CF"><enum>(b)</enum><header>Maximum annual amount; annual adjustment</header><paragraph commented="no" display-inline="yes-display-inline" id="HD3C27AD5818D4003B7BA19525FE95D37"><enum>(1)</enum><text display-inline="yes-display-inline">Payment of educational assistance under this section to an individual during fiscal year 2020 may not exceed $15,900.</text></paragraph><paragraph id="HA70E8FDB040A494882860D8DA766444C" indent="up1"><enum>(2)</enum><text>In each fiscal year after fiscal year 2020, the dollar amount in paragraph (1) shall be increased by the same percentage as the percentage by which benefit amounts payable under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401</external-xref> et seq.) are increased effective December 1 of that year as a result of a determination under section 215(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(i)</external-xref>).</text></paragraph></subsection><subsection id="H5F517AD938DC483D99F83F8B31967102"><enum>(c)</enum><header>Monthly payments: maximum amount; maximum number</header><paragraph commented="no" display-inline="yes-display-inline" id="HE270B1245190449C89475762B070230E"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall make monthly payments under this section in such amounts as an individual who is entitled to educational assistance for tuition or fees under this subchapter may elect for the repayment of a Federal student loan to that individual. No such amount may exceed one-twelfth of the maximum annual amount calculated under subsection (b)(1).</text></paragraph><paragraph id="HEB01340C74F048A49A439BE0F38690DA" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The total number of months of payments for the repayment of a Federal student loan to an individual under this section may not exceed 36 months.</text></paragraph></subsection><subsection id="H5C3F9EF5115C4C4DA95AE2C0277511A2"><enum>(d)</enum><header>Benefit non-Transferable</header><text display-inline="yes-display-inline">Notwithstanding section 3319 of this title, an individual who is entitled to educational assistance under this section may not transfer such assistance to another individual.</text></subsection><subsection id="HA9549ADE809848CC9314EF782C05CFD9"><enum>(e)</enum><header>Eligible payees</header><text display-inline="yes-display-inline">The Secretary shall make payments of educational assistance under this section directly to the lender of the Federal student loan of the individual who is entitled to educational assistance under this section.</text></subsection><subsection id="H8DAF6557A225483FB6B3E658ADF779CF"><enum>(f)</enum><header>Arrangements To make payments; regulations</header><text>The Secretary shall enter into such arrangements, and shall prescribe such regulations, that the Secretary determines necessary to carry out this section.</text></subsection><subsection id="HA34B6BCAB0C741DC9D21773F03E0BE47"><enum>(g)</enum><header>Federal student loan defined</header><text>In this section, the term <term>Federal student loan</term> means any loan made, insured, or guaranteed under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070</external-xref> et seq.).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H47F9C0729FB4486ABDD0D484039BD2E7"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 3320 the following new item:</text><quoted-block display-inline="no-display-inline" id="H0A0A710D36274B609D3FFAE4445E1A84" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">3320A. Use of educational assistance benefits for the repayment of Federal student loans.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6B6FE81428F84A818A0E4BF801382412"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to educational assistance paid for months beginning on or after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
