which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Transportation to prescribe a motor vehicle safety standard that requires new commercial motor vehicles to be equipped with an automatic emergency braking system, to require automatic emergency braking installed in commercial motor vehicles to be used while in operation, and for other purposes.</official-title></form><legis-body id="H250704038E6841D8B9D6D8ACD72D6A2C" style="OLC"><section id="H52FCA9902DFA4CFE972CF15E6CE19F76" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Roads Act of 2021</short-title></quote>.</text></section><section id="HB4BF1B749368465B9567A2FB1A7910E1"><enum>2.</enum><header>Motor vehicle safety standard</header><subsection id="H7CB2EDD353F54D379D7334654FC121FD"><enum>(a)</enum><header>Motor vehicle safety standard for truck tractors with electronic stability control</header><text>Not later than 1 year after the date of enactment of this section, the Secretary of Transportation shall—</text><paragraph id="H21EC2A35F6A64D11B8E702EA3E5AC650"><enum>(1)</enum><text display-inline="yes-display-inline">prescribe a motor vehicle safety standard under section 30111 of title 49, United States Code, that requires any truck-tractor subject to Federal motor vehicle safety standard 136 (49 C.F.R. 571.136; relating to electronic stability control systems for heavy vehicles) that is manufactured after the effective date of the standard to be equipped with an automatic emergency braking system; and</text></paragraph><paragraph id="HB54677B130B24751AC3B75A1E4EAD098"><enum>(2)</enum><text>include standards that establish the performance requirements for automatic emergency braking systems.</text></paragraph></subsection><subsection id="H42F5EB9946F84EBF84621300CE281F21"><enum>(b)</enum><header>Federal motor carrier safety regulation for truck tractors with electronic stability control</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Secretary shall prescribe a regulation under section 31136 of title 49, United States Code, that requires an automatic emergency braking system installed in any truck-tractor subject to Federal motor vehicle safety standard 136 (49 C.F.R. 571.136; relating to electronic stability control systems for heavy vehicles) in operation on or after the effective date to be used at any time during which the truck-tractor is in operation.</text></subsection><subsection id="H630D05C1121E4F5485830CC8A95865B2"><enum>(c)</enum><header>Report on automatic emergency braking in medium commercial motor vehicles</header><text>Not later than 2 years after the date of enactment of this section, the Secretary shall—</text><paragraph id="H34844E2A22E84A5E9D96BCEEDAA40443"><enum>(1)</enum><text>complete a study on equipping commercial motor vehicles with automatic emergency braking to avoid or mitigate a collision with an obstacle in the path of the vehicle; </text></paragraph><paragraph id="H9F93FAB23D2649B9A8B58308914ADA29"><enum>(2)</enum><text>submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committees on Transportation and Infrastructure and Energy and Commerce of the House of Representatives a report on the study described in paragraph (1); and</text></paragraph><paragraph id="H47B1D7CE2F274875A5B4EE22011DE07D"><enum>(3)</enum><text display-inline="yes-display-inline">if the Secretary determines it to be necessary, initiate a Federal Motor Vehicle Safety Standard for automatic emergency braking for all commercial motor vehicles, if appropriate.</text></paragraph></subsection><subsection id="HFA206FB2B30B4430BE8E4F0829548123"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H51F94EBB8400413EA823B3EA9641E556"><enum>(1)</enum><header>Automatic emergency braking system</header><text>The term <term>automatic emergency braking system</term> means a system on a commercial motor vehicle that, based on a predefined distance and closing rate with respect to an obstacle in the path of the vehicle—</text><subparagraph id="HC77A5A28E413401FB04F9E227F680DDB"><enum>(A)</enum><text>alerts the driver of the obstacle; and</text></subparagraph><subparagraph id="HDAC3EE0FDB9D45AEBC014299F2BE6D53"><enum>(B)</enum><text>if necessary, to avoid or mitigate a collision with the obstacle, automatically applies the brakes of the vehicle.</text></subparagraph></paragraph><paragraph id="HA424BA4A696047BF97A619B03A962C3D"><enum>(2)</enum><header>Commercial motor vehicle</header><text>The term <term>commercial motor vehicle</term> means a motor vehicle or truck-tractor used in commerce to transport property that has a gross vehicle weight rating or a gross vehicle weight of not less than 10,001 pounds.</text></paragraph><paragraph id="H4FB803308CC54AF98A821E9554C9671C"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation. </text></paragraph></subsection></section></legis-body></bill>
