R. 3590</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210528">May 28, 2021</action-date><action-desc><sponsor name-id="J000020">Mr. Jacobs of New York</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to require facilities generating electricity from wind or solar power to obtain local government approval as a condition of eligibility for certain tax credits.</official-title></form><legis-body id="H38DEC34070084FABAF39A6A2398AAE94" style="OLC"><section id="HB118E4537ECB4035BE45E09E441B6801" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Local Control and Community Preservation Act</short-title></quote>. </text></section><section id="H9ED5BDBF5F8F46F1A2C352A727AB61D1"><enum>2.</enum><header>Local government approval of facilities generating electricity from wind or solar power required for certain tax credits</header><subsection id="HD1340D10DF0E47AFB9087AE880B91061"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/45">Section 45(d)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H307CFAC7A0F34F89A99A5170F2B9A4AC" display-inline="no-display-inline"><paragraph id="HA0CD3398FCAE47A8A126175475CF8D2E"><enum>(12)</enum><header>Approval of local government required for wind and solar facilities</header><text display-inline="yes-display-inline">In the case of any facility which uses wind or solar energy to produce electricity and the construction of which begins after the date of the enactment of this paragraph, such facility shall not be treated as a qualified facility unless the construction of such facility is approved (at such time and in such manner as the Secretary may provide) by the local government within the jurisdiction of which such facility is located. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB2C8A8B053474026A026C7CD780F5799"><enum>(b)</enum><header>Application to certain energy property</header><text>Section 48(a) of such Code is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H9A104BFE43574FA5BF493DEEC81CF413" display-inline="no-display-inline"><paragraph id="H0AE16F739097479C93E9222C6C3BBA24"><enum>(8)</enum><header>Approval of local government required for certain solar facilities</header><subparagraph id="H05C91D45B6774389AFF706A52CE76909"><enum>(A)</enum><header>In general</header><text>In the case of any property which is part of a specified solar facility, such property shall not be treated as energy property unless the construction of such facility is approved (at such time and in such manner as the Secretary may provide) by the local government within the jurisdiction of which such facility is located.</text></subparagraph><subparagraph id="H368BEC39901E4B98A3E408F16C496349"><enum>(B)</enum><header>Specified solar facility</header><text>For purposes of this paragraph, the term <term>specified solar facility</term> many any facility—</text><clause id="H567874CC536A41988D933D408274873C"><enum>(i)</enum><text>which uses solar energy to generate electricity,</text></clause><clause id="H8FDEC881689D4112AA54ABAE3039B60D"><enum>(ii)</enum><text>which has a nameplate capacity rating of at least 20,000 megawatts, and</text></clause><clause id="H4361C28478504947A94F912F0BD4748A"><enum>(iii)</enum><text>construction of which begins after the date of the enactment of this paragraph.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H16A78C0CEA824D059413D28A2D8950BB"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to facilities the construction of which begins after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
