<subsection id="H67D87829EB4743D0A417DEE00034C3FF"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> <paragraph id="HE674D74DAA9B458899AC3B5D0E790073"><enum>(1)</enum><text>the United States has a unique, legally affirmed government-to-government relationship with Tribal Governments, as set forth in the Constitution of the United States, treaties, statutes, Executive orders, and court decisions;</text></paragraph>
<paragraph id="H7529075333BF48D08B38B4119AB4AFE8"><enum>(2)</enum><text>the United States recognizes the right of Tribal Governments to self-govern and supports Tribal sovereignty and self-determination;</text></paragraph> <paragraph id="H5906EA4976FD4F8885AF1A679175F444"><enum>(3)</enum><text>the United States, through treaties, statutes, and historical relations, has defined a unique trust relationship and responsibility to protect and support Tribal Governments;</text></paragraph>
<paragraph id="H35C5A2E6B4604091893B2C53D4E34F90"><enum>(4)</enum><text>owing to this trust relationship, the United States has a responsibility to consult with Tribal Governments on a government-to-government basis when formulating policies and undertaking activities that may have impacts on Tribal lands and interests;</text></paragraph> <paragraph id="HFD9601A7088142A9B62829B00B8B5593"><enum>(5)</enum><text>procedures for such consultation should be designed and structured to give Tribal Governments the opportunity to provide meaningful, informed input throughout the development and decision-making processes;</text></paragraph>
<paragraph id="H7E02ABADD3D842DB9E1871F5775EAF67"><enum>(6)</enum><text>increasing Federal and Tribal capacities for effective consultation while building institutional knowledge fosters greater efficiency and will benefit future actions;</text></paragraph> <paragraph id="H4C3625454ABE472288B220B8BE594C20"><enum>(7)</enum><text>the consultation process should be formalized according to best practices that are designed and administered by the agency and that fulfill the legal requirements mandated by this Act;</text></paragraph>
<paragraph id="HB58CC2D8A7924F7FAE04C3B8F6A31CB4"><enum>(8)</enum><text>consulting with Tribal Governments during the formulation of long-term management plans reduces the likelihood of project delays and increases the efficiency of project implementations; and</text></paragraph> <paragraph id="HE0875CC2FAD14CE9AA49FEB47E37BB46"><enum>(9)</enum><text>effective consultation demands ongoing, respectful communication between agencies and Tribal Governments.</text></paragraph></subsection>
<subsection id="H0B6671B61E464B76B58CEA5DB7EEBBCF"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text> <paragraph id="H7590356DA20943FA84823804A4685D6D"><enum>(1)</enum><text>to establish and support a process of regular, meaningful consultation and collaboration with Tribal Governments in the initiation of Federal activities and the development of Federal policies and regulations that impact Tribal lands and interests;</text></paragraph>
<paragraph id="H5E4EABD1DB7D4C30A0F5ED64A41659BC"><enum>(2)</enum><text>to strengthen the United States government-to-government relationship with Tribal Governments; and</text></paragraph> <paragraph id="H4FD117F8CAE748F08C04D0F554C2BD84"><enum>(3)</enum><text>to establish minimum standard procedures to ensure the above goals are achieved.</text></paragraph></subsection></section>
<section id="HB75A5E3E811A4B8885C9E17772552292"><enum>4.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="HACCD909AEF354E059300C69DB577759C"><enum>(1)</enum><text>consultation constitutes more than simply notifying an Tribal Government about a planned undertaking;</text></paragraph>
<paragraph id="HE177E9EABE4D47BC8127F8B1538CE6CD"><enum>(2)</enum><text>effective, meaningful consultation requires a two-way exchange of information, a willingness to listen, an attempt to understand and to genuinely consider each other’s opinions, beliefs, and desired outcomes, and a seeking of agreement on how to proceed concerning the issues at hand; and</text></paragraph> <paragraph id="H1AA490AD539C450D9E0D80CA8356533D"><enum>(3)</enum><text>consultation can be considered effective and meaningful when each party demonstrates a genuine commitment to learn, acknowledge, and respect the positions, perspectives, and concerns of the other parties and when Federal agencies accommodate Tribal concerns to the extent feasible and consistent with applicable law.</text></paragraph></section>
<section id="HEF2E9F3B8B79497E84CFFEE35415822B"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act:</text> <paragraph id="HF8DBE118125C4389BF44925149BA4706"><enum>(1)</enum><header>Activity</header><text>The term <term>activity</term> means any plan, project, or program funded in whole or in part under the direct or indirect jurisdiction of a Federal agency, including—</text>
<subparagraph id="H950C0DBA5C5E4A099B90827DC0AB9294"><enum>(A)</enum><text>those carried out by or on behalf of an agency;</text></subparagraph> <subparagraph id="HAA163DC4D8D64A5D936D63025AF8A192"><enum>(B)</enum><text>those carried out with Federal financial assistance;</text></subparagraph>
<subparagraph id="H292CE3E3A668473492A0B5B8EC422468"><enum>(C)</enum><text>those requiring a Federal permit, license, or approval; and</text></subparagraph> <subparagraph id="H063129ADD4FE4CECAFEDDAD1D75A952B"><enum>(D)</enum><text>those subject to state or local regulation administered pursuant to a delegation or approval by a Federal agency.</text></subparagraph></paragraph>
<paragraph id="H53F05F52B4814B57B86333326434E464"><enum>(2)</enum><header>Agency</header><text>The term <term>agency</term> means any authority of the United States that is an agency under section 551 of title 5, United States Code.</text></paragraph> <paragraph id="H357929591B2E4E4D96A22930A1C54E63"><enum>(3)</enum><header>Lead agency</header><text>The term <term>lead agency</term> means a designated agency that will fulfill the collective consultation responsibilities under this Act if more than one agency is involved in an activity or regulatory action. Any agency that does not designate a lead agency shall remain individually responsible for the consultation responsibilities of that agency under this Act.</text></paragraph>
<paragraph id="HEF143E65B6394BC0B403D9B3FBF2A796"><enum>(4)</enum><header>Memorandum of agreement</header><text>The term <term>memorandum of agreement</term> means a document that records the terms and conditions agreed upon by an agency, or lead agency, and a Tribal Government or designated Tribal Leader Task Force through the consultation process regarding an activity or regulatory action.</text></paragraph> <paragraph id="H2DC5C70FB41E442B8EAD01FBFA97D92B"><enum>(5)</enum><header>New discovery</header><text>The term <term>new discovery</term> means any unexpected development that occurs during the course of an activity, such as the discovery of a new archeological site, unanticipated impacts on organisms or ecosystems, or the realization of unintended consequences that may have impacts on Tribal lands and interests.</text></paragraph>
<paragraph id="HD05BD6E5B762467694D5E91AC6558C26"><enum>(6)</enum><header>Regulatory action</header><text>The term <term>regulatory action</term> means any regulation, policy, guidance, or grant funding formula change that is proposed by an agency.</text></paragraph> <paragraph id="HF325DE8183CE4AF083FA985768A79693"><enum>(7)</enum><header>Sacred site</header><text>The term <term>sacred site</term> means any geophysical or geographical area or feature that is identified by a Tribal Government—</text>
<subparagraph id="H4B270CEAB8AA4A758FE6E747F1619DBA"><enum>(A)</enum><text>as sacred by virtue of its established religious significance to, or ceremonial use by, a Tribal religion; or</text></subparagraph> <subparagraph id="HCD7A7B36BB294189A8855BDA749ED8F5"><enum>(B)</enum><text>to be of established cultural significance.</text></subparagraph></paragraph>
<paragraph id="H613811AB6E7946F2B694A418598BFFE9"><enum>(8)</enum><header>Standard method of communication</header><text>The term <term>standard method of communication</term> means the mode of communication that the agency uses in the typical course of communicating with persons outside the Federal Government.</text></paragraph> <paragraph id="HE84DF4315AAA4B2BA7671CC0D020303D"><enum>(9)</enum><header>Standard process</header><text>The term <term>standard process</term> means a process for Federal agency and Tribal Government interactions agreed to by both parties through consultation and certified in a memorandum of agreement that applies to certain specified activities or regulatory actions, or to limited categories of activities or regulatory actions.</text></paragraph>
<paragraph id="H1D32490C12E346BD8F7FB11B1F7DC114"><enum>(10)</enum><header>Tribal Government</header><text>The term <term>Tribal Government</term> means the governing body of any Indian or Alaska Native Tribe, band, nation, pueblo, village, community, component band or component reservation, individually identified (including parenthetically) in the list published most recently as of the date of enactment of this Act pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph> <paragraph id="H26D7604FB58E47F6B9FE1CE5BFF48805"><enum>(11)</enum><header>Tribal impact</header><text>The term <term>Tribal impact</term> means any Federal action that may have an impact on one or more Tribal Governments on matters, including—</text>
<subparagraph id="H111B84FB05104B108C7D53900D70550A"><enum>(A)</enum><text>Tribal cultural practices, lands, resources, or access to traditional areas of cultural or religious importance;</text></subparagraph> <subparagraph id="H6ADD09FA020B43FD9A531B9CA71C2B91"><enum>(B)</enum><text>Tribal treaty-protected rights;</text></subparagraph>
<subparagraph id="H3FB58E4EDFDE42E2BCCD152A5960E884"><enum>(C)</enum><text>the ability of a Tribal Government to govern or provide services to its members;</text></subparagraph> <subparagraph id="HB9A56221179E40189543DA8108666B87"><enum>(D)</enum><text>a Tribal Government’s formal relationship with the Federal Government; or</text></subparagraph>
<subparagraph id="H4AF28E472C2540EFA28D69E42F38E5C6"><enum>(E)</enum><text>the consideration of the Federal Government’s trust responsibility to Tribal Governments.</text></subparagraph></paragraph> <paragraph id="H18BC76DD7B9F42588578388952BC428E"><enum>(12)</enum><header>Tribal leader task force</header><text>The term <term>Tribal Leader Task Force</term> means a task force that is collaboratively determined by affected Tribal Governments.</text></paragraph></section>
<title id="HBFC470BCE0794F16B14C7F31D8B86EFF"><enum>I</enum><header>Standards for Consultation</header>
<section id="H1BBC4F2554B244CF8312405A2B8AC45C"><enum>101.</enum><header>Standards for consultation</header>
<subsection id="H6A608B0B67824464B718B5F7373904DF"><enum>(a)</enum><header>Scope</header><text>Consultation with Tribal Governments shall occur before undertaking any proposed Federal activity or finalizing any Federal regulatory action that may have Tribal impacts. Additionally, consultation with Tribal Governments shall occur for all activities that would affect any part of any Federal land that shares a border with Indian Country, as defined in section 1151 of title 18, United States Code, but is not limited to activities on such lands.</text></subsection> <subsection id="H4731E58E51FF4896946A181FBF82EC14"><enum>(b)</enum><header>Limitation</header><text>Nothing in this Act shall—</text>
<paragraph id="H3AF88555F56942269E35106029FC3209"><enum>(1)</enum><text>exempt an agency from additional consultation required under any other law or from taking any other consultative actions as required by any other law or agency prerogative in addition to those required by this Act; or</text></paragraph> <paragraph id="H805D52CC71CB4B61AC559DE431647631"><enum>(2)</enum><text>preclude an agency from additional consultation that complies with agency regulations for consultation, advances agency consultation practices, or supports agency efforts to build or strengthen government-to-government relationships with Tribal Governments.</text></paragraph></subsection></section></title>
<title id="H7D48A4F656664FD5B248E3A900ED41FF"><enum>II</enum><header>Consultation Procedures</header>
<section id="H0A7AB8B43771424B8F2685DF7299E46C"><enum>201.</enum><header>Assessing Tribal impacts</header><text display-inline="no-display-inline">As early as possible in the planning stage of an activity or a regulatory action, the agency, or lead agency, shall—</text> <paragraph id="HA384D1D5C1074824AFADFA72F6981D79"><enum>(1)</enum><text>prepare a Tribal Impact Statement that identifies any potential Tribal impacts of the proposed activity or regulatory action. At a minimum, the Tribal Impact Statement shall include the scope of the activity or regulatory action being considered, including any geographic areas important to Tribal Governments that might be affected, as well as a list of all affected Tribal Governments;</text></paragraph>
<paragraph id="HEFE7300E924B4337B036D8C8720DF884"><enum>(2)</enum><text>make a good faith effort to identify areas that contain sacred sites important to Tribal Governments, whether such sacred sites are explicitly known to an agency or not; and</text></paragraph> <paragraph id="HA89A2EA644DB42DBB940C10B741D2E1A"><enum>(3)</enum><text display-inline="yes-display-inline">publish the completed Tribal Impact Statement in the Federal Register, excluding all information designated as sensitive by a Tribal Government pursuant to section 502, before any further action on the proposed activity or regulatory action.</text></paragraph></section>
<section id="HEB00F464B8CD4363B30C5282141129BD"><enum>202.</enum><header>Consultation stage</header>
<subsection id="HF2B29A4DB9F84FC9A539959DC178CADB"><enum>(a)</enum><header>Initial consultation outreach</header><text>The agency, or lead agency, shall—</text> <paragraph id="HDEFA242BF6BA4FD8B9E019B1FB809E79"><enum>(1)</enum><text>transmit, via the agency’s standard method of communication, a formal request for a consultation meeting, along with along with a copy of the proposed activity or regulatory action as well as copy of the Tribal Impact Statement as prepared according to section 201, to each affected Tribal Government identified in the Tribal Impact Statement. In the case of a proposed activity, the documents shall also be transmitted to relevant Tribal governmental agencies (including the Tribal Historic Preservation Officer or cultural resource manager), and relevant non-Tribal stakeholders (including the State Historic Preservation Officer and local governments that have jurisdiction on any affected land via agreement with the agency);</text></paragraph>
<paragraph id="H61A9C95477E243B28AB076DA513DACAB"><enum>(2)</enum><text>at the request of an affected Tribal Government, transmit, via the agency’s standard method of communication, a copy of the Tribal Impact Statement and the letter requesting a consultation meeting to non-governmental Tribal stakeholders;</text></paragraph> <paragraph id="H322111F1138145BA85BD92C4ECB4E1B8"><enum>(3)</enum><text>not request consultation with non-governmental Tribal stakeholders without the written consent of the affected Tribal Government;</text></paragraph>
<paragraph id="HAD778182BC704072ACC882464F5A479A"><enum>(4)</enum><text>follow up within 5 business days to ensure receipt of the documents by all intended recipients; and</text></paragraph> <paragraph id="HD0CC449AD9AB4956A86D945DE16F4149"><enum>(5)</enum><text>if the documents were not received by any of the intended recipients, retransmit all materials via a form of communication that is suitable to the recipient.</text></paragraph></subsection>
<subsection id="H7993EC13F8964CEE8F8EBA120CA3B7B9"><enum>(b)</enum><header>Non-Response to consultation outreach</header><text>If, after a good faith effort, the agency, or lead agency, fails to engage an affected Tribal Government in the consultation process, the agency, or lead agency, may conclude its consultation efforts by providing the Tribal Government with a written notification and explanation for its decision, signed by the head of the agency, or lead agency, which shall be made part of the official consultation record as described in section 301(a).</text></subsection> <subsection id="H79BF0996DAC54A799CA3D95EDD67241A"><enum>(c)</enum><header>Meeting arrangements</header> <paragraph id="H4AA975037D2442A483D2FD2284B40BE5"><enum>(1)</enum><text>The agency, or lead agency, shall negotiate with each affected Tribal Government to determine the format, agenda, and goals of a consultation meeting, and shall keep thorough documentation of all steps taken to engage the affected Tribal Government in consultation meetings.</text></paragraph>
<paragraph id="H7D08BF8974F34F6DA26B4656012F8A23"><enum>(2)</enum><text display-inline="yes-display-inline">In appropriate circumstances, affected Tribal Governments may elect to form a Tribal Leader Task Force, to aid in consultation on activities that are regional in scope or that affect multiple Tribal Governments. To the maximum extent possible, the Tribal Leader Task Force shall represent a cross-section of Tribal interests with respect to the proposed activity or regulatory action. Affected Tribal Governments that do not elect to join a Tribal Leader Task Force shall be consulted separately.</text></paragraph></subsection> <subsection id="HC6CFBF1A8E994052AF8FD4435842C548"><enum>(d)</enum><header>Consultation meeting requirements</header><text>A consultation meeting shall—</text>
<paragraph id="H70180E6F0D6F47BA9347D0585DEE7D11"><enum>(1)</enum><text>begin with confirmation of the format, agenda, and goals of the meeting, with adequate time scheduled for introductions and any ceremonial proceedings;</text></paragraph> <paragraph id="HAD2472298FD04B8788B74ECFF8CD4234"><enum>(2)</enum><text>be structured to allow for meaningful and respectful interaction throughout the meeting among all meeting participants; and</text></paragraph>
<paragraph id="H53BB77BD3C194DFBAF38EA26C1C7E1F4"><enum>(3)</enum><text>conclude with planning for the next meeting, if necessary, as well as confirmation of the method of any potential interim communications between all parties participating in the consultation.</text></paragraph></subsection> <subsection id="H4B58D04606334449917C22551C576CDF"><enum>(e)</enum><header>Conclusion of consultation with a memorandum of agreement</header> <paragraph id="H22D3959811F048CD9F05193C31079D66"><enum>(1)</enum><text>Except as provided by subsection (b), subsection (f), and subsection (g), consultation shall conclude only upon the execution of a memorandum of agreement signed by the head of the agency, or lead agency, and the head of the affected Tribal Government or the members of the designated Tribal Leader Task Force.</text></paragraph>
<paragraph id="H21D5330403C94BA4B9C09DD856125F66"><enum>(2)</enum><text>The memorandum of agreement—</text> <subparagraph id="H82B6FA574BD645919BAC4A7005592F76"><enum>(A)</enum><text>may address multiple activities or regulatory actions if the activities or regulatory actions are similar and repetitive in nature, or are multistate or regional in scope, or where routine management activities are undertaken at Federal installations, facilities, or other land management units;</text></subparagraph>
<subparagraph id="H78B6A53534CD4419BFFBD26149E6F73C"><enum>(B)</enum><text>may establish standard processes for certain categories of activities and regulatory actions determined through consultation and defined in the memorandum of agreement;</text></subparagraph> <subparagraph id="H0A5251CF137A453EA628339CB8651A97"><enum>(C)</enum><text>shall, in the case of a proposed activity—</text>
<clause id="H8BFD8B3DC550489893E5494728A822F5"><enum>(i)</enum><text>include a provision for monitoring and reporting on the implementation of the activity;</text></clause> <clause id="H35C4CECCC4034524929420AE779BC48F"><enum>(ii)</enum><text>include provisions for reconsideration if the activity has not been completed within a specified time; and</text></clause>
<clause id="H7FBD810EF4904533A6F22C7F413D9F75"><enum>(iii)</enum><text>include provisions to address new discoveries, which may include halting the activity and returning to the consultation stage.</text></clause></subparagraph></paragraph> <paragraph id="H2BDF7D1C942442ADA3398C0196B5DE52"><enum>(3)</enum><text>The signed memorandum of agreement may be amended at any time by the joint approval of all signatories.</text></paragraph></subsection>
<subsection id="HEC80BF258CEE4323ADCB730C1E4B7DC0"><enum>(f)</enum><header>Conclusion of consultation without a memorandum of agreement</header>
<paragraph id="H0F9718F0BC754B7F9B903A775AFFB160"><enum>(1)</enum><text>The agency, or lead agency, shall make a good faith effort through sustained interaction and collaboration to reach a consensus resulting in a memorandum of agreement.</text></paragraph> <paragraph id="HD7BBAAAF84B64260ABC71EEED5C9142F"><enum>(2)</enum><text>If, after a good faith effort, the agency, or lead agency, determines that further consultation will not be productive, it may conclude consultation by providing the Tribal Government with a written notification and explanation for its decision, including identification of any legal, policy, or factual barriers that prevented the agency from reaching agreement with the affected Tribal Government, signed by the head of the agency, or lead agency, which shall be made part of the official consultation record as described in section 301(a).</text></paragraph></subsection>
<subsection id="H23683C7EC1DB400C9F672CBC823A8363"><enum>(g)</enum><header>Tribal withdrawal from consultation</header><text>An affected Tribal Government may at any point decide to withdraw from the consultation process. In such case, the agency, or lead agency, shall provide the affected Tribal Government with the opportunity to submit a written statement, explanation, or comment on the consultation proceedings that will become part of the official consultation record as described in section 301(a).</text></subsection></section> <section id="H920E4DCCA4B74EA4908ABFA4D3AA4352"><enum>203.</enum><header>Decision stage for proposed activity</header> <subsection id="HD85EC6C2A7744E35B84E12D309F758E8"><enum>(a)</enum><header>Proposal document</header><text>Upon completion of the consultation stage pursuant to section 202, the agency, or lead agency, shall—</text>
<paragraph id="HD03B6C639C674A11976A239754DFBC99"><enum>(1)</enum><text>compile a proposal document consisting of the plan for the proposed activity, its anticipated Tribal impacts, and any signed memorandum of agreement;</text></paragraph> <paragraph id="H63BCFF0D7F694ECC926E298F39845B75"><enum>(2)</enum><text>include sufficient supporting documentation to the extent permitted by law to enable any reviewing parties to understand its basis;</text></paragraph>
<paragraph id="H10BE74BEC9F640A39D29AB7C21CC32F4"><enum>(3)</enum><text>transmit, via the agency’s standard method of communication, a copy of the proposal document to the affected Tribal Governments, including those that withdrew from the process;</text></paragraph> <paragraph id="H00B7651DAAB145ED80D9510D1A2B9333"><enum>(4)</enum><text>follow up within 5 business days to ensure receipt of the proposal document by all intended recipients;</text></paragraph>
<paragraph id="HEEECDC2EDE6040328105980FA6C97C34"><enum>(5)</enum><text>if the proposal document was not received by an intended recipient, retransmit all material via a form of communication that is suitable to the recipient; and</text></paragraph> <paragraph id="HBB163D1E77154CC4BEC90C9039E57C44"><enum>(6)</enum><text display-inline="yes-display-inline">after the verified receipt of the proposal document by all intended recipients, the proposal document shall be published in the Federal Register, excluding all information designated as sensitive by a Tribal Government pursuant to section 502.</text></paragraph></subsection>
<subsection id="H2B2570A0DA5C4010AC320AD03E01C875"><enum>(b)</enum><header>Public comment period</header><text>The agency, or lead agency, shall provide a period of not less than 90 days after publication of the proposal document in the Federal Register for public comment. A 30-day extension of the 90-day period shall be automatically granted upon request by an affected Tribal Government.</text></subsection> <subsection id="HBA335312FEC74D93BB6D9616B7D647C3"><enum>(c)</enum><header>Preliminary decision document</header><text>After expiration of the public comment period pursuant to subsection (b), the agency, or lead agency, shall prepare a preliminary decision letter, signed by the head of the agency, or lead agency, that shall—</text>
<paragraph id="HA1C409ADD2224991BFD9F7DF8D6EBC0B"><enum>(1)</enum><text>state the decision to proceed or not proceed with the activity;</text></paragraph> <paragraph id="H1449ED9624A14152B52EAA87C1257FFA"><enum>(2)</enum><text>state the rationale for the decision;</text></paragraph>
<paragraph id="H0DFE54E2DA4B47F6B35CE9C8B774C2F4"><enum>(3)</enum><text>list any changes to the proposed activity made in response to the comments filed pursuant to subsection (b);</text></paragraph> <paragraph id="H3C31A3B8BA274670A68EA2252DBE0953"><enum>(4)</enum><text>specifically address any points where the decision conflicts with the request of an affected Tribal Government, including a detailed explanation of why the request was disregarded;</text></paragraph>
<paragraph id="HDFD1AD881D4B461B88709BDC76B1D2BD"><enum>(5)</enum><text>transmit, via the agency’s standard method of communication, a copy of the preliminary decision letter to the affected Tribal Governments, including those that withdrew from the process;</text></paragraph> <paragraph id="H003F844780ED4CDF95566E2AC7E3650B"><enum>(6)</enum><text>follow up within 5 business days to ensure receipt of the preliminary decision letter by all intended recipients; and</text></paragraph>
<paragraph id="HF4CC69324B614328B7E090A46A3049A3"><enum>(7)</enum><text>if the preliminary decision letter was not received by an intended recipient, retransmit the material via a form of communication that is suitable to the recipient.</text></paragraph></subsection> <subsection id="H0A3E0C66DCE54075AF9E426C527DABC4"><enum>(d)</enum><header>Tribal response period</header><text>The agency, or lead agency, shall provide a period of no less than 45 days after issuance of the preliminary decision letter for a response by an affected Tribal Government.</text></subsection>
<subsection id="HCA436ACD14994C419D8671633B3D1009"><enum>(e)</enum><header>Final decision document</header><text>After expiration of the Tribal Response Period pursuant to subsection (d), the agency, or lead agency, shall prepare a letter stating the final decision of the agency, signed by the head of the agency, or lead agency, that shall—</text> <paragraph id="HBC02271AB52D436BAF56AB80B05FFE07"><enum>(1)</enum><text>state the decision to proceed or not proceed with the activity;</text></paragraph>
<paragraph id="H95E084E40CE649BBAB3F6E1CE57633FD"><enum>(2)</enum><text>state the rationale for the decision;</text></paragraph> <paragraph id="H348E9F90952546ACA3C01CA79B033327"><enum>(3)</enum><text>list any changes to the preliminary decision in response to comments received from an affected Tribal Government pursuant to subsection (d);</text></paragraph>
<paragraph id="H24B89D2D4F094567AB493204AEEA0B7C"><enum>(4)</enum><text>specifically address any points where the final decision conflicts with the request of an affected Tribal Government, including a detailed explanation of why the request was disregarded;</text></paragraph> <paragraph id="H5C4176F413134ABDBD8CAE627AA3C090"><enum>(5)</enum><text>transmit, via the agency’s standard method of communication, a copy of the final decision letter to the affected Tribal Governments, including those that withdrew from the process;</text></paragraph>
<paragraph id="H7CDC10938C2D45469A0F11A3656B6650"><enum>(6)</enum><text>follow up after 5 business days to ensure receipt of the final decision letter by all intended recipients; and</text></paragraph> <paragraph id="HD1E9BBB5E0644D389FF4F8657E1BD849"><enum>(7)</enum><text>if the final decision letter was not received by an intended recipient, retransmit the material via a form of communication that is suitable to the recipient.</text></paragraph></subsection>
<subsection id="HDBF4F615A57D45A689A4C92CE409E0AC"><enum>(f)</enum><header>Publication of letter</header><text display-inline="yes-display-inline">The agency shall make public the final decision letter, excluding all information designated as sensitive by a Tribal Government pursuant to section 502.</text></subsection></section> <section id="H52116EDF09BD44AB8650823C9E4709E2"><enum>204.</enum><header>Decision stage for proposed regulatory action</header> <subsection id="H06D44A98B46C4C8EBBA144130734AEA1"><enum>(a)</enum><header>Decision document</header><text>Upon completion of the consultation stage pursuant to section 202, the agency, or lead agency, shall prepare a decision letter, signed by the head of the agency, or lead agency, that shall—</text>
<paragraph id="H7D2E6ED369A1414098D9C3F261183405"><enum>(1)</enum><text>state the decision to proceed or not proceed with the proposed regulatory action;</text></paragraph> <paragraph id="HFE0582AA69D048B698825C498C11C330"><enum>(2)</enum><text>state the rationale for the decision;</text></paragraph>
<paragraph id="H580DA5F080D64DA397A26929120E0601"><enum>(3)</enum><text>list any changes to the proposed regulatory action made at the request of an affected Tribal Government during the consultation process as outlined in section 202;</text></paragraph> <paragraph id="HA6ABB4357E28469FB4E85CFC0745114F"><enum>(4)</enum><text>specifically address any points where the decision conflicts with the request of an affected Tribal Government, along with a detailed explanation of why the request was disregarded;</text></paragraph>
<paragraph id="HA63A2C0C77E34A3B9F4A8A2DDA6F0F92"><enum>(5)</enum><text>transmit, via the agency’s standard method of communication, a copy of the decision letter to the affected Tribal Governments, including those that withdrew from the process;</text></paragraph> <paragraph id="H395C3165235D40138C026A8C883D22AF"><enum>(6)</enum><text>follow up within 5 business days to ensure receipt of the decision letter by all intended recipients; and</text></paragraph>
<paragraph id="HDDFD5E1C7B374C759BAFF72DBAA1539E"><enum>(7)</enum><text>if the decision letter was not received by an intended recipient, retransmit the material via a form of communication that is suitable to the recipient.</text></paragraph></subsection> <subsection id="H11EC560858E5433686014A6B7215B524"><enum>(b)</enum><header>Publication in Federal Register</header><text display-inline="yes-display-inline">The decision letter shall be published in the Federal Register alongside the final decision on the regulatory action, excluding all information designated as sensitive by a Tribal Government pursuant to section 502.</text></subsection></section></title>
<title id="H9503E513315E4C31A77EDA71CC9652EB"><enum>III</enum><header>Documentation and Reporting</header>
<section id="H70E334AF92B14378BA0C69B801216DB5"><enum>301.</enum><header>Documentation and reporting</header>
<subsection id="H26527960E309493A813BFA1AEF5246A8"><enum>(a)</enum><header>Official consultation record</header><text>The agency, or lead agency, shall—</text> <paragraph id="HEF021C1371B24005B1629E4CD8F8ED41"><enum>(1)</enum><text>keep an official consultation record that allows accurate tracking of the process so that the agency and all consulting parties can correct any errors or omissions, and provides an official record of the process that can be referred to in any litigation that may arise;</text></paragraph>
<paragraph id="H9FCE559B8EB7411D9B5E5173A2912293"><enum>(2)</enum><text>document all efforts to initiate consultation as well as documenting the process once it has begun, such as correspondence, telephone logs, and emails;</text></paragraph> <paragraph id="H703F8E48DC4D456BB6F6A7F5AED586A8"><enum>(3)</enum><text>keep notes so that the consultation record documents the content of consultation meetings, site visits, and phone calls in addition to information about dates and who participated; </text></paragraph>
<paragraph id="HB2D14F1E0B5F447C870BCC98892EAEB6"><enum>(4)</enum><text>include all documentation in the official consultation record; and</text></paragraph> <paragraph id="H6DB576F294D34C16839597BB4976D0D8"><enum>(5)</enum><text display-inline="yes-display-inline">ensure that all information designated as sensitive by a Tribal Government pursuant to section 502 is kept confidential.</text></paragraph></subsection>
<subsection id="H235B2AB090D34C3DADBD157E925A90F3"><enum>(b)</enum><header>Payment for Tribal documentation work</header><text>If the agency, or lead agency, asks a Tribal Government for specific information or documentation that in any way fulfills the duties of the agency in a role similar to that of a consultant or contractor, then the agency, or lead agency, must pay for such services, if so requested by the Tribal Government, as it would for any private consultant or contractor.</text></subsection> <subsection id="H82A30580D4EE4E76956AC0347B28C8EA"><enum>(c)</enum><header>Report to congress</header><text>Each agency shall submit a biennial report on its consultation activities to Congress, including outcomes.</text></subsection></section></title>
<title id="H151C8E74520F4DB087F42BE909673C57"><enum>IV</enum><header>Implementation and Training</header>
<section id="HBC650F93C5534D839AE6B156CC3D0D22"><enum>401.</enum><header>Designated agency official</header><text display-inline="no-display-inline">No later than 90 days after the date of the enactment of this Act—</text> <paragraph id="HF7CC7CD639C8422E96634C8F7D462D72"><enum>(1)</enum><text>the head of each agency shall designate an official with principal responsibility for the agency’s implementation of this Act; and</text></paragraph>
<paragraph id="H84615E95A30D490AB748535DB553A306"><enum>(2)</enum><text>each bureau or office within the agency shall designate one or more officials with the responsibility to work with the principal agency official on implementation of this Act.</text></paragraph></section> <section id="H917BF85C84494F74BB7A94DB46E7F342"><enum>402.</enum><header>Consultation policy</header><text display-inline="no-display-inline">No later than 180 days after enactment of this Act, the designated agency official shall submit to the Office of Management and Budget a description of the agency’s consultation policy, including all designated agency officials, in conformity with this Act.</text></section>
<section id="H454D094641004B28AA2D3B5129F4FBAF"><enum>403.</enum><header>Training</header><text display-inline="no-display-inline">Each agency shall design training for staff aimed at improving the agency’s capacity for interacting with Tribal Governments and executing the consultation process. The training shall—</text> <paragraph id="HEB4FE11BE9ED4B9BBA4A7DE903D07101"><enum>(1)</enum><text>promote consultation, communication, collaboration, and other interactions with Tribal Governments;</text></paragraph>
<paragraph id="HC9CB8084A8E84292B6CADC8BF8060E94"><enum>(2)</enum><text>outline and reinforce the agency duties concerning Tribal interests; and</text></paragraph> <paragraph id="H71B310804C1149F8B3E2810DDB867826"><enum>(3)</enum><text>strengthen the understanding of the United States government-to-government relationship with Tribal Governments.</text></paragraph></section></title>
<title id="H0120053765AB4D99BC70CA25123D92F5"><enum>V</enum><header>Tribal Sovereignty</header>
<section id="HF88C1826C150472F9D735C96013EC88F"><enum>501.</enum><header>Tribal sovereignty</header>
<subsection id="HC17351BED74E430DBC6214B63E686C00"><enum>(a)</enum><header>In general</header><text>Agencies shall recognize and respect Tribal self-government and sovereignty, honor Tribal treaty and other rights, and strive to meet the responsibilities that arise from the unique legal relationship between the Federal Government and Tribal Governments.</text></subsection> <subsection id="H3F470A816E0F4685B5E429AA72AA5F9D"><enum>(b)</enum><header>Maximum Tribal administrative discretion</header><text>With respect to Federal statutes and regulations administered by Tribal Governments, the Federal Government shall grant Tribal Governments the maximum administrative discretion possible.</text></subsection>
<subsection id="HC2E06E86BBA548118D329CA200CDB92F"><enum>(c)</enum><header>Alternatives to Federal regulation</header><text>With respect to the formulation and implementation of policies that have an impact on Tribal matters, agencies shall—</text> <paragraph id="H9763939FACDF415DB4388B0A88A47DB4"><enum>(1)</enum><text>encourage Tribal Governments to develop their own policies to achieve program objectives;</text></paragraph>
<paragraph id="H3DA2F0C2E44846B48245DD12090C6E2F"><enum>(2)</enum><text>when possible, defer to Tribal Governments to establish standards; and</text></paragraph> <paragraph id="HE36339751CA647B798671A73273DA355"><enum>(3)</enum><text>in determining whether to establish Federal standards, consult with Tribal Governments as to the need for Federal standards and any alternatives that would limit the scope of Federal standards or otherwise preserve the prerogatives and authority of Tribal Governments.</text></paragraph></subsection></section>
<section id="HAB39BEFCCEF848AC839008D2F709281A"><enum>502.</enum><header>Sensitive Tribal information</header><text display-inline="no-display-inline">Notwithstanding <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code (commonly known as the Administrative Procedure Act), consultation meetings shall be closed to the public at the request of the Tribal Government. Notwithstanding section 552 of title 5, United States Code (commonly known as the Freedom of Information Act), all information designated by the Tribal Government as sensitive, such as the location of sacred sites or other details of cultural or religious practices, shall be deleted from any public publication made as part of the consultation process or in the process of carrying out the activity. Once information has been designated as sensitive, the agency will determine in consultation with the Tribal Government who may have access to the information for the purposes of carrying out the activity.</text></section></title> <title id="HA4DED362FFAC4A80944CA0B6652AC0B6"><enum>VI</enum><header>Judicial Review</header> <section id="H7381275E26E3435FA981B65BF0E0ED93"><enum>601.</enum><header>Judicial review</header><text display-inline="no-display-inline">A Tribal Government may seek judicial review of a determination of an agency under this Act in accordance with subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code (commonly known as the Administrative Procedure Act), if the Tribal Government has exhausted all other administrative remedies available to the Tribal Government.</text></section></title>
