R. 356</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210119">January 19, 2021</action-date><action-desc><sponsor name-id="S001214">Mr. Steube</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide greater flexibility to agencies to make appointments to positions for which there is a severe shortage of candidates, and for other purposes.</official-title></form><legis-body id="HB76B5A5ACBCF4492B7693173498CD916" style="OLC"><section id="HD0AD13EBB48B4F729C1E0DB6AA2A2CB4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Hiring Improvement Reform and Enforcement Act</short-title></quote> or the <quote><short-title>Federal HIRE Act</short-title></quote>. </text></section><section id="H9D74A5A45831471FA454B124987E8483"><enum>2.</enum><header>Federal agency appointment flexibility</header><subsection id="HEBC75751D19847049DBED58F48EC399D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">Chapter 31</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/3116">section 3116</external-xref> the following new section:</text><quoted-block style="USC" id="H24E3742A2C4841F783F0B59DA79F6584" display-inline="no-display-inline"><section id="H5D6B3830160F41C099964A3CBFAFD5D5"><enum>3117.</enum><header>Agency appointment flexibility</header><subsection id="HB510A514064441C4AB8FEE089B846931"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The head of an agency may, without regard to the provisions of section 3304 and sections 3309 through 3318, appoint a qualified individual to a position within the agency that is in the competitive service and for which the head of the agency determines that there is a severe shortage of candidates. </text></subsection><subsection id="H6288291B8CAA4F9A970F149FC23336B5"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">This provision shall not be construed as superseding or otherwise affecting any authority granted to the head of any agency under any other provision of law to make appointments without regard to a provision of chapter 33.</text></subsection><subsection id="HB8EA362AC7B6413CB318906A417FDCB7"><enum>(c)</enum><header>Agency defined</header><text>The term <term>agency</term> has the meaning given such term under section 551.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB1B84A82A42649F3AD66D1FD35CD29F8"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">chapter 31</external-xref> of title 5, United States Code, is amended by inserting after the item related to section 3116 the following item:</text><quoted-block style="USC" id="HF79B2E01BC7E4E8DAA62288D2FBF68FF" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">3117.
