which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to ensure that veterans may attend pre-apprenticeship programs using certain educational assistance provided by the Secretary of Veterans Affairs, and for other purposes.</official-title></form><legis-body id="HFF10EDFED3FB47369736310ACD438546" style="OLC"><section id="HAF2A2854652D446BB005387A711D0C6A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans’ Entry to Apprenticeship Act</short-title></quote>.</text></section><section id="HF2EA8AFFFE28460B9F36F0F5574D18BF" section-type="subsequent-section"><enum>2.</enum><header>Programs of pre-apprenticeship</header><subsection id="HE8867E325EEE40B685C9A4AD78EC4831"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/36">Chapter 36</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/3687">section 3687</external-xref> the following new section:</text><quoted-block display-inline="no-display-inline" id="H2F7BACAF5DFC40CFA140FCCE9479764A" style="USC"><section id="H46D8AE6E331646CDBD65158327B343D7"><enum>3687A.</enum><header>Programs of pre-apprenticeship</header><subsection commented="no" id="HA166AA5B742A440C827E20DA4FAD8DB9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subsection (b), and except as provided by subsection (c), the Secretary shall treat a pre-apprenticeship program as a program of apprenticeship for purposes of providing educational assistance.</text></subsection><subsection id="H2CD3856878CB4F36931A0A4B89C9C4D7"><enum>(b)</enum><header>Approval of pre-Apprenticeship program</header><text display-inline="yes-display-inline">A pre-apprenticeship program may be covered under subsection (a)—</text><paragraph commented="no" id="HD90A60A88B3E404E99391F280BE9F846"><enum>(1)</enum><text display-inline="yes-display-inline">if the program is recognized under or compliant with any standards for a postsecondary pre-apprenticeship program required by the State in which the program is located; or</text></paragraph><paragraph id="H901B0EF72156444C9396E34B48ACEDF0"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a program for which a State does not require any such standards, if—</text><subparagraph id="H381472C3D118405789E9426636930179"><enum>(A)</enum><text>the curriculum of the program is approved by a sponsor and the sponsor certifies to the Secretary that the program will prepare an individual with skills and competencies needed to enroll in a registered apprenticeship program; and</text></subparagraph><subparagraph id="H68245EA358A048ECA8CD5A2EE47D5EF3"><enum>(B)</enum><text display-inline="yes-display-inline">the program maintains conduct and attendance policies in accordance with a sponsor.</text></subparagraph></paragraph></subsection><subsection id="HB65AB19B6B3A44ADA59BC271458F24F5"><enum>(c)</enum><header>Benefits</header><text display-inline="yes-display-inline">The educational assistance received by a covered individual enrolled in a pre-apprenticeship program under subsection (a) shall be equal to the amount and kind of such assistance received by the individual if the individual were enrolled in a program of apprenticeship, except that if the individual is not paid as part of such program, each monthly allowance for housing payable to the individual under such assistance shall be an amount equal to the monthly amount of the basic allowance for housing payable under section 403 of title 37 for a member with dependents in pay grade E–5 residing in the military housing area that encompasses all or the majority portion of the ZIP code area in which is located the pre-apprenticeship program.</text></subsection><subsection id="H9B60FCFB2ADB4097B30ED6AE7C6B090B"><enum>(d)</enum><header>Charge to entitlement</header><text display-inline="yes-display-inline">The entitlement of a covered individual pursuing a pre-apprenticeship program under subsection (a) shall be charged at a rate equal to the rate charged if the program were a program of apprenticeship.</text></subsection><subsection id="H2CC42DB5D6624D10B5867D62869C4861"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HB0481FB8A18D4E98A923BAC6AD7C1824"><enum>(1)</enum><text>The term <term>covered individual</term> means an individual who is—</text><subparagraph id="H91AC2782D1B2485C85C2B3660883491F"><enum>(A)</enum><text>entitled to educational assistance; and</text></subparagraph><subparagraph id="HA0B5BD7AD61444278797583F9D27EF32"><enum>(B)</enum><text>seeking to use such assistance for a program of apprenticeship.</text></subparagraph></paragraph><paragraph id="H5ECB74CF32CC4C1A80D864E664D992A9"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>educational assistance</term> means educational assistance provided under chapter 30, 32, 33, 34, or 35 of this title or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/1606">chapter 1606</external-xref> of title 10.</text></paragraph><paragraph commented="no" id="H252449CF71C94CA78D4C05AE5879B50A"><enum>(3)</enum><text>The term <term>pre-apprenticeship program</term> means a program or set of objectives—</text><subparagraph id="HB847B3422D2546D799A3D799FD913FB7"><enum>(A)</enum><text>designed to prepare individuals to enter and succeed in a registered apprenticeship program; and</text></subparagraph><subparagraph id="H9478999568A84D24BF0D3F5755E6F335"><enum>(B)</enum><text>that has a documented partnership with at least one sponsor.</text></subparagraph></paragraph><paragraph id="H44196891B63B4759A296534EDE834ED4"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>registered apprenticeship program</term> means an apprenticeship program registered with the Office of Apprenticeship of the Employment Training Administration of the Department of Labor or a State apprenticeship agency recognized by the Office of Apprenticeship pursuant to the Act of August 16, 1937 (popularly known as the <quote><short-title>National Apprenticeship Act</short-title></quote>; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>).</text></paragraph><paragraph id="H6EE8DF79267140188B570248D9FF05E6"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>sponsor</term>, with respect to a pre-apprenticeship program, means an entity that formally supports the pre-apprenticeship program, including—</text><subparagraph id="H9FED087B19D14D5E9FD194089F93C2CE"><enum>(A)</enum><text display-inline="yes-display-inline">a registered apprenticeship program;</text></subparagraph><subparagraph id="H2212AC1F4ECC49F983051058A70E5DCB"><enum>(B)</enum><text>a department or agency of a State or local government;</text></subparagraph><subparagraph id="HA324F8755728426395244F87F711868B"><enum>(C)</enum><text>an institution of higher learning; or</text></subparagraph><subparagraph id="H60008DF6F12C4FC8AC68E5BAE93D80D4"><enum>(D)</enum><text>any other public, private, or nonprofit entity that the Secretary determines to be a sponsor for purposes of this section.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H557BA1FEFF7740D7B3CA44A12440AACB"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 3687 the following new item:</text><quoted-block display-inline="no-display-inline" id="H30CC988D848F4E6B9B3D12DD24E79095" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">3687A. Programs of pre-apprenticeship.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCA11753037294F938496A6F59EED5F55"><enum>(c)</enum><header>Effective date</header><text>Section 3687A of title 38, United States Code, as added by subsection (a), shall apply with respect to an individual who enrolls in a program of pre-apprenticeship described in such section beginning on or after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
