which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the American Rescue Plan Act of 2021 to require increased oversight with respect to restaurant revitalization grants, and for other purposes.</official-title></form><legis-body id="HC3951329D8694CFBAB6DAAEEB7C19D80" style="OLC"><section id="H68B6FC7ED7E94855A2F05EAA63E3F833" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restaurant Recovery Fairness Act of 2021</short-title></quote>. </text></section><section id="HFD4FDD07681A43F8A8C9C6516BB1A229"><enum>2.</enum><header>Support for restaurants</header><text display-inline="no-display-inline">Section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>) is amended—</text><paragraph id="H5BD05E6F4D1C4DCD8A950AF127258245"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(2), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H06851D4A062F4D5AA73046E20C36E0FF" display-inline="no-display-inline"><subparagraph id="HC0061D522C354E86AE645791C6898094"><enum>(C)</enum><header>Prevention of waste, fraud, and abuse</header><text display-inline="yes-display-inline">The Administrator shall impose requirements on applicants for the purpose of reducing waste, fraud, and abuse.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HA01D796BB3FD4D7898715E763A64123B"><enum>(2)</enum><text>by adding at the end the following new subsections:</text><quoted-block style="OLC" id="H966799FE241740018E4ED49EE99A28C0" display-inline="no-display-inline"><subsection id="H3C800195D05C4E91ADAB4F1B6973A68C"><enum>(d)</enum><header>Oversight and audit plan</header><paragraph id="H3529689928E0499DB8E7EC8049558DCF"><enum>(1)</enum><header>In general</header><text>Not later than 45 days after the date of enactment of this subsection, the Administrator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives an oversight and audit plan that details the policies and procedures of the Administrator for conducting oversight and an appropriate level of audits with respect to grants made under this section, which shall include the metrics used to determine which grants to audit.</text></paragraph><paragraph id="H5EDB28A2A2D24AB484519C3B5BE4E869"><enum>(2)</enum><header>Reports</header><text>Not later than 60 days after the date of enactment of this subsection, and each month thereafter until the date that is 1 year after the date on which all amounts appropriated under subsection (b)(2) have been expended, the Administrator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report on the oversight and audit activities carried out by the Administrator with respect to grants made under this section, which shall include for the period covered by the report—</text><subparagraph id="HD29A150E3DEF47D78F85049FA4814CAA"><enum>(A)</enum><text>the number of grants approved and disbursed;</text></subparagraph><subparagraph id="H86B3C74B6BA249C6AE1F329DC46F6DE4"><enum>(B)</enum><text>the amount of grant funds received by each recipient;</text></subparagraph><subparagraph id="HA0A0501D9B004C75A6B121B387E947D3"><enum>(C)</enum><text>the number of active investigations and audits of grants being conducted;</text></subparagraph><subparagraph id="HA35C4ABFEA4645FCA8DA7BDCFC6CE6D7"><enum>(D)</enum><text>the number of completed investigations and audits of grants, including a description of any findings of fraud or other material noncompliance; and</text></subparagraph><subparagraph id="H230288B8E4F140199B076B7D8AA77C68"><enum>(E)</enum><text>any substantial changes made to the oversight and audit plan submitted under paragraph (1).</text></subparagraph></paragraph><paragraph id="HE618ED9504B440B38636F1E691EC94DB"><enum>(3)</enum><header>Identifiable or proprietary information</header><text>The Administrator shall ensure that each report submitted pursuant to paragraph (2) is free from any identifiable or proprietary information of a grant recipient.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
