which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Education to establish a pilot grant program to develop, implement, and evaluate comprehensive mental health services programs in elementary schools and secondary schools, and for other purposes.</official-title></form><legis-body id="HABA624C735F143B2B0A6211A9A652A6B" style="OLC"><section id="H01D91BA55C774AD38E3856651A14FA1F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Comprehensive Mental Health in Schools Pilot Program Act of 2021</short-title></quote>.</text></section><section id="H4B7693D28C0F48EE9752D0E30A1F997B" section-type="subsequent-section"><enum>2.</enum><header>Mental health pilot grant program</header><subsection id="HA5588671375D440998B5DA1110868163"><enum>(a)</enum><header>Purposes</header><text>The purposes of the program established under this section are to—</text><paragraph id="HF8B4C0E082CD4CC7BB55824DEA87367D"><enum>(1)</enum><text display-inline="yes-display-inline">prioritize, with respect to all elementary school and secondary school students—</text><subparagraph id="HA83FF6E439B642D79C64A0C38EC18D6C"><enum>(A)</enum><text>academic, cognitive, social-emotional, and identity development;</text></subparagraph><subparagraph id="H82792EBE30C8418DBDE7285E8A5C927A"><enum>(B)</enum><text>mental and behavioral health; and</text></subparagraph><subparagraph id="H49A04EB9C3AF4FE2AA29095672EB657D"><enum>(C)</enum><text>physical health;</text></subparagraph></paragraph><paragraph id="H3DE1CDE368F44DF2908836DE60D918D2"><enum>(2)</enum><text display-inline="yes-display-inline">meet the priorities described in paragraph (1) by intervening with equitable multi-tier systems of support;</text></paragraph><paragraph id="H22DD038A527249B382B40520E319EEB1"><enum>(3)</enum><text>support measurable outcomes, which focus on continuous improvement instead of punitive measures;</text></paragraph><paragraph id="H171A1DCE3F6E49C89F8EB79919C81C79"><enum>(4)</enum><text>ensure equitable access to high-quality, safe, and supportive learning environments;</text></paragraph><paragraph id="HB9444DC14553402EB1FE0B9796AE4086"><enum>(5)</enum><text>integrate the teaching of social, emotional, and cognitive learning skills and competencies throughout all aspects of the elementary school and secondary school environments, including through standalone measures;</text></paragraph><paragraph id="H03708A8A11E54814A7A64327CF8EA69E"><enum>(6)</enum><text>use evidence-based instructional materials, practices, programs, and resources to implement the practices described in paragraph (5);</text></paragraph><paragraph id="H49362598C166465681A6516BD14CED40"><enum>(7)</enum><text>build expertise among trusted adults with respect to responding to the mental and behavioral health needs of students in elementary school and secondary school communities, including teachers, administrators, specialized instructional support personnel, paraprofessionals, other staff, parents, and caregivers; and</text></paragraph><paragraph id="HA93E1896E2024614A6C7AB9089F35C6B"><enum>(8)</enum><text>hire a full complement of mental and behavioral health professionals to ensure an appropriate ratio of students to such professionals.</text></paragraph></subsection><subsection id="H0D166043F9A54D47918DD0DDE3C7A3A6"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary shall establish a pilot grant program to award grants, on a competitive basis, to local educational agencies to—</text><paragraph id="HAA9668DB8B194FAD9C3E78F44990015D"><enum>(1)</enum><text display-inline="yes-display-inline">establish, develop, implement, and evaluate a comprehensive, multi-tier system of support with respect to mental and behavioral health services programs in elementary schools and secondary schools served by such local educational agencies; and</text></paragraph><paragraph id="HE219D775CD4048E9B6555B6B4C6474FB"><enum>(2)</enum><text>fully fund comprehensive mental and behavioral health services in such elementary schools and secondary schools.</text></paragraph></subsection><subsection id="H6F29DE239778439B898A264704B051DE"><enum>(c)</enum><header>Consultation and assistance</header><text>In establishing the program under subsection (b), the Secretary shall—</text><paragraph id="H71C141584EEB42378F99435BACA716FB"><enum>(1)</enum><text>consult with nationally-recognized organizations that identify, support, and advocate for evidence-based social-emotional learning policy and practices and multi-tier systems of support within elementary schools and secondary schools;</text></paragraph><paragraph id="HB124AD61E7554256B7666C6CCC124EBD"><enum>(2)</enum><text>consult with nationally recognized organizations—</text><subparagraph id="H54C0CEA409344555AF158A7763018824"><enum>(A)</enum><text>with expertise in child, adolescent, and developmental mental health; and</text></subparagraph><subparagraph id="H4A2A808A72174EB89128F6F51D05BE07"><enum>(B)</enum><text>that identify, support, and advocate for evidence-based prevention of, and intervention for, child trauma; and</text></subparagraph></paragraph><paragraph id="H8D9D325AB5A04D809153A0B5E8724971"><enum>(3)</enum><text>provide technical assistance to grant recipients with respect to implementation and execution of activities under this section.</text></paragraph></subsection><subsection id="HFC67665B2C814147B0EE88EE230D8D9B"><enum>(d)</enum><header>Application</header><paragraph id="HBB4D690D6675429CA33F88EFAE9D8D95"><enum>(1)</enum><header>In general</header><text>To be eligible for a grant under this section, a local educational agency shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including—</text><subparagraph id="H8FE7CE3A275745C79F1F8E41AE319E18"><enum>(A)</enum><text>a needs assessment;</text></subparagraph><subparagraph id="H896DE51EF05949CE94175871F25F84B0"><enum>(B)</enum><text>a plan to—</text><clause id="HD74093168D804FE0AFBCA0E8C51AB176"><enum>(i)</enum><text>during the grant period described in subsection (f), implement the activities described under subsection (h); and</text></clause><clause id="H98CD93506E1345F79077F665E2632050"><enum>(ii)</enum><text>after the conclusion of the grant period described in subsection (f), maintain such activities; and</text></clause></subparagraph><subparagraph id="H1F4DE6F6F07F4D6984FF1497DC48510B"><enum>(C)</enum><text>a cost assessment with respect to implementing the plan described in subparagraph (B).</text></subparagraph></paragraph><paragraph id="HAA4E3CFE17FD466996DA3849AF30175E"><enum>(2)</enum><header>Timing</header><text>A local educational agency may only submit an application during the period—</text><subparagraph id="H9CB0BD5460BF4DB9810AB12B1700A13B"><enum>(A)</enum><text>beginning on the date that the Secretary establishes the program under subsection (b); and</text></subparagraph><subparagraph id="HE222062DFF2042E29CF9EF4AC5681D5C"><enum>(B)</enum><text>ending on the date that is 120 days after the date described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="H2C126F00C74F4872AFD46140741D3300"><enum>(3)</enum><header>Notification period</header><text>The Secretary shall notify each local educational agency that submits an application under this subsection of the decision to award, or not award, a grant to such agency not later than 90 days after the date that is the final day of the period described in paragraph (2)(B).</text></paragraph></subsection><subsection id="H7293E4D8DD2D4981B13275E07B003555"><enum>(e)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall give priority to local educational agencies that—</text><paragraph id="HDBBC0F801F444753B77F6A73191301B4"><enum>(1)</enum><text>serve high-poverty elementary schools and secondary schools; and</text></paragraph><paragraph id="HD6F17664A5984B4AB584DE7FAEE75E8D"><enum>(2)</enum><text>with respect to the services described in paragraphs (3) and (4) of subsection (h)—</text><subparagraph id="H6D9479E71F9F42CAAF25A6FC8F92A679"><enum>(A)</enum><text>provide such services within such elementary schools and secondary schools; or</text></subparagraph><subparagraph id="H768A2CEA180347ED88E972D0AAEA6862" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">provide an assurance, in the application submitted under subsection (d), that such local educational agency will use grant funds awarded under this section to implement such services within such elementary schools and secondary schools.</text></subparagraph></paragraph></subsection><subsection id="H8ABDE0BD7E494330AAFFED2DDB25B274"><enum>(f)</enum><header>Grant period</header><paragraph id="H3F11BF84BD204F5B939D1E08314BB83E"><enum>(1)</enum><header>Duration</header><text>A grant awarded under this section shall be for a period of 4 consecutive academic years.</text></paragraph><paragraph id="HDF16FC4E7FA94ED08CB41325E5C3ACDF"><enum>(2)</enum><header>Beginning of grant period</header><text display-inline="yes-display-inline">The grant period described in paragraph (1) shall begin on the date that is the first day of the first academic year beginning after the Secretary notifies each local educational agency under subsection (d)(3).</text></paragraph></subsection><subsection id="HA0ADB92F6F67446FA06C8A7ED7B182B1"><enum>(g)</enum><header>Supplement not supplant</header><text>Grant funds provided under this section shall be used to supplement, not supplant, other Federal, State, or local funds available to carry out the activities described in subsection (h).</text></subsection><subsection id="H45EDB8F6141D4528978E609C6185D320"><enum>(h)</enum><header>Grant uses</header><text display-inline="yes-display-inline">A local educational agency shall use grant funds awarded under this section for the following activities:</text><paragraph id="H00CDB20875E940D9BA2946CA69083D3E"><enum>(1)</enum><text>Evaluating the needs of the elementary schools and secondary schools served by such local educational agency with respect to the activities described in paragraphs (2) through (4). </text></paragraph><paragraph id="H22A8A09BAE6E41679FF0408832BA31E0"><enum>(2)</enum><text>Implementing, in consultation with teachers and school mental and behavioral health professionals, evidence-based universal social-emotional learning programs, approaches, and supports, including by—</text><subparagraph id="H0CA64EC622484DDA8F7E5302B03E2875"><enum>(A)</enum><text display-inline="yes-display-inline">incorporating principles of motivation and engagement and resiliency training into class instruction;</text></subparagraph><subparagraph id="HA32C3D41C48743D8ACD54E1DB59192C7"><enum>(B)</enum><text>promoting connections by establishing regular collaboration and communication between and among students, parents, caregivers, and staff;</text></subparagraph><subparagraph id="H65275534ADB046C7B967B9A6F81D4427"><enum>(C)</enum><text>promoting a safe, equitable, supportive, and healthy school climate that is racially, culturally, developmentally, and linguistically responsive to encourage positive behavior and academic engagement;</text></subparagraph><subparagraph id="H50F476AA121440CB95E3043C32CEF807"><enum>(D)</enum><text display-inline="yes-display-inline">establishing racially, culturally, developmentally, and linguistically appropriate evidence-based trauma-informed and trauma-competent practices to support students and staff;</text></subparagraph><subparagraph id="HC28808825E994470958F59014D9D2853"><enum>(E)</enum><text>establishing evidence-informed psychological supports for students and staff to promote a sense of agency, safety, calmness, self-efficacy, mindfulness, and coping skills; and</text></subparagraph><subparagraph id="HE7EB68BB9CDF4965A0E83D5152F1762C"><enum>(F)</enum><text>adopting positive, non-punitive, restorative policies to address challenging behaviors, discipline, and de-escalation, focused on developing, maintaining, and repairing relationships in place of utilizing retributive and exclusionary practices.</text></subparagraph></paragraph><paragraph id="H11F0DAEC036C4AF3AE48BDDBD328CA79"><enum>(3)</enum><text display-inline="yes-display-inline">Implementing targeted interventions that are equitable for all students and that support emotional management, goal setting, and establishing routines and consistency, including—</text><subparagraph id="H117583D18B6F4F3D9D4018246EC55974"><enum>(A)</enum><text>evidence-based and trauma-informed screening and referral to mental and behavioral health services;</text></subparagraph><subparagraph id="H325078754FAC45DDA12E496EA21CC527"><enum>(B)</enum><text>small groups for support, problem-solving, and strengthening collaborations;</text></subparagraph><subparagraph id="H448B1B698ED449CAA353FF10103D1F15"><enum>(C)</enum><text>peer support groups;</text></subparagraph><subparagraph id="H3AF3F3BBA256401B86470C5E537F013A"><enum>(D)</enum><text>parent and caregiver engagement;</text></subparagraph><subparagraph id="H313BADEB71AE480686CC8C59FAC8F678"><enum>(E)</enum><text>periodic check-in meetings with students during the regular school day;</text></subparagraph><subparagraph id="H9251F30D7BB24A55A5ED59555643DCF6"><enum>(F)</enum><text>by monitoring for evidence of food insecurity, homelessness, neglect, and abuse, including with respect to disadvantaged students; and</text></subparagraph><subparagraph id="HA80CFAF5C90848DA91FBE85EA695DD51"><enum>(G)</enum><text>personalized learning experiences, accommodations, modifications, and technical supports as appropriate for students.</text></subparagraph></paragraph><paragraph id="HEAF46774E1874328AB422233914FA821"><enum>(4)</enum><text>Implementing intensive supports, including—</text><subparagraph id="HAC2DA633ACA740AEA6E71BD35BD5ABEC"><enum>(A)</enum><text>individualized intervention and support from school-based professionals;</text></subparagraph><subparagraph id="H70ACCFE554A24668AEE7861FD293C00D"><enum>(B)</enum><text>by hiring such school-based professionals; and</text></subparagraph><subparagraph id="HDA2FBF9C14E64846BD278A731C97B3B4"><enum>(C)</enum><text>ongoing evidence-based and trauma-informed progress monitoring of students and intervention based on such monitoring.</text></subparagraph></paragraph><paragraph id="H5ACCBE2FA1CA452DA43F539CC9306277"><enum>(5)</enum><text>Providing professional development for teachers and other school staff with respect to—</text><subparagraph id="HD39B8C3E287B4BC786D49667153D2B16"><enum>(A)</enum><text display-inline="yes-display-inline">developing a healthy learning climate, including through positive classroom management, enhancing empathy and respect, and promoting a sense of belonging for students;</text></subparagraph><subparagraph id="H7F257CD9932349BE8F7A0C81F866CFA0"><enum>(B)</enum><text display-inline="yes-display-inline">integrating social and emotional learning, motivation and engagement, and resiliency training into classroom instruction and practices;</text></subparagraph><subparagraph id="H37BA28FAD3464511962E28933B61C0D9"><enum>(C)</enum><text display-inline="yes-display-inline">the impact of adverse childhood experiences and traumatic experiences on the health and development of students;</text></subparagraph><subparagraph id="HBA5FBE8878894D13BC1F308D754944D7"><enum>(D)</enum><text display-inline="yes-display-inline">evidence-based and trauma-informed approaches to teaching and managing student behavior;</text></subparagraph><subparagraph id="H0C63189A3DB34A27AA5CAF89A2C6B154"><enum>(E)</enum><text display-inline="yes-display-inline">racially, culturally, developmentally, and linguistically appropriate techniques for providing more agency to students;</text></subparagraph><subparagraph id="H55585EBFCE5C4441A964CA5A0FFDE4F2"><enum>(F)</enum><text display-inline="yes-display-inline">implicit bias and restorative justice practices; and</text></subparagraph><subparagraph id="H59EE5F55CE7443A9B21A378B1299214D"><enum>(G)</enum><text display-inline="yes-display-inline">racially, culturally, developmentally, and linguistically responsive teaching.</text></subparagraph></paragraph></subsection><subsection id="HA03C8A67145B4B7CA585443AF0E3161E"><enum>(i)</enum><header>Evaluation</header><paragraph id="HC27E27C4AD354C8F84E72456BF4C561C"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text><subparagraph id="HF5D7C30562884A1EB080545E661316B9"><enum>(A)</enum><text>not later than 1 year before the last day of the grant period described in subsection (f), enter into a contract with a nationally-recognized educational evaluation institution or organization; and</text></subparagraph><subparagraph id="H787E093A3DC44C04ADD48621ABB2746F"><enum>(B)</enum><text>not later than 1 year after the conclusion of the grant period described in subsection (f), coordinate with such institution or organization to provide an evaluation of the pilot grant program, including—</text><clause id="HB5702C8AF2FD43E2BF431D14FAC7EC93"><enum>(i)</enum><text>a determination with respect to the sufficient ratio of school-based professionals to students;</text></clause><clause id="H29F7E1A158064B4984A2BAB5F40FD588"><enum>(ii)</enum><text display-inline="yes-display-inline">information with respect to the practices used by local educational agencies to improve the mental and behavioral well-being of students;</text></clause><clause id="HC86A4ABF68CD44978BC6ADDD4CB129D2"><enum>(iii)</enum><text display-inline="yes-display-inline">information with respect to increased competencies among teachers and other school staff on social and emotional learning and trauma-informed practices;</text></clause><clause id="H166020CB38054420B1061C9635AF1854"><enum>(iv)</enum><text display-inline="yes-display-inline">data on the mental and behavioral health outcomes of students, in the aggregate and disaggregated by—</text><subclause id="H63557068685E4D34ADAD87EF339F2FDC"><enum>(I)</enum><text>race and ethnicity;</text></subclause><subclause id="H4EAF4BB086E0429E9A39E763C4862425"><enum>(II)</enum><text>gender;</text></subclause><subclause id="H38DF7DFC83FD43A8AC20BAA345C8C5F9"><enum>(III)</enum><text>sexual orientation;</text></subclause><subclause id="HA12E9659A07D4F80AA8FD535324BE9A8"><enum>(IV)</enum><text>status as an English learner; and</text></subclause><subclause id="H16EF868C2CEE4BCEB22C03E9F4494260"><enum>(V)</enum><text>status as a student with a disability; and</text></subclause></clause><clause id="H5A394DA72062476E93272C165A4CE7FA"><enum>(v)</enum><text>a recommendation as to whether such program should be continued or expanded.</text></clause></subparagraph></paragraph><paragraph id="H8B74F99C27944276B0ED4C6D29C93F75"><enum>(2)</enum><header>Publication</header><text>The Secretary shall make the evaluation required under paragraph (1) publicly available on the website of the Department.</text></paragraph><paragraph id="H2FC97BA904E9467AAD5AD64A9328B156"><enum>(3)</enum><header>Report</header><text>Not later than 60 days after the completion of the evaluation required under paragraph (1), the Secretary shall submit to Congress a report on the outcome of the pilot grant program, including a recommendation with respect to continuing or expanding the program.</text></paragraph></subsection><subsection id="H664BABC4C8F14A5D954C4EBC730627A9"><enum>(j)</enum><header>Continuation of program</header><paragraph id="H6D959A5A68654E209733D7AB0D008577"><enum>(1)</enum><header>Applications</header><text>If the evaluation required under subsection (i)(1) contains a recommendation that the pilot grant program should be continued or expanded, the Secretary—</text><subparagraph id="HAEBD1E55D62C4E0CA34D5BDC4C74B699"><enum>(A)</enum><text>may continue or expand such program; and</text></subparagraph><subparagraph id="H27552EFD1D5A44EE9241D3376FFF243A"><enum>(B)</enum><text>if such program is expanded or continued—</text><clause id="H3846AC2DE96F4B5B96FB433ACF7BD099"><enum>(i)</enum><text display-inline="yes-display-inline">shall allow a local educational agency that did not receive a grant under the pilot program established under this section to apply for a grant in accordance with subsection (d)(1); and</text></clause><clause id="H71DAE9BC092B498D9B914EE45D2FD4B5"><enum>(ii)</enum><text display-inline="yes-display-inline">shall allow a local educational agency that received a grant under the pilot program established under this section to apply for a renewal of such grant for an additional period of 4 consecutive academic years.</text></clause></subparagraph></paragraph><paragraph id="HE28E390609FA43EA83BEA5BFC21815FC"><enum>(2)</enum><header>Evaluation</header><text>Not later than 1 year after the first grant is awarded or renewed after the continuation or expansion of the program, the Secretary shall coordinate with the institution or organization described in subsection (i)(1)(A) to provide an evaluation of the renewal of the pilot grant program.</text></paragraph><paragraph id="H2045DB8B0A1A4CE8B952139CAD266660"><enum>(3)</enum><header>Publication</header><text display-inline="yes-display-inline">The Secretary shall make the evaluation required under paragraph (2) publicly available on the website of the Department.</text></paragraph><paragraph id="HFC108DE12E6A4A429D34898045D80AE2"><enum>(4)</enum><header>Report</header><text>Not later than 60 days after the completion of the evaluation required under paragraph (2), the Secretary shall submit to Congress a report on the progress of the renewal or expansion of the program.</text></paragraph></subsection><subsection id="H3FD0D6ABC5D04F90A86586517D516E8B"><enum>(k)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $20,000,000, for fiscal year 2022, to be available until expended.</text></subsection><subsection id="HECCC62BE120C4BC5B42149DEF49E9470"><enum>(l)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H544C54406CA440B9A01837CE1C7EC7EF"><enum>(1)</enum><header>ESEA terms</header><text display-inline="yes-display-inline">The terms <quote>Department</quote>, <quote>elementary school</quote>, <quote>multi-tier system of supports</quote>, and <quote>Secretary</quote> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="HBD8EC24FC9DF4108A8AB234B5979E47D"><enum>(2)</enum><header>School-based professional</header><text>The term <quote>school-based professional</quote> means a behavioral specialist or mental health specialist. </text></paragraph></subsection></section></legis-body></bill>
