which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish an initiative for national testing, contact tracing, and pandemic response, and for other purposes.</official-title></form><legis-body id="H8732FBD0BBEF4F6DBC10401D1A60133B" style="OLC"><section id="H1DD6B0D658B04203834A0AC5AC1CC088" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Jobs to Fight COVID–19 Act of 2021</short-title></quote>.</text></section><section id="HB3D94773B22147FEBDC79F1198EF7886"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Except as otherwise explicitly provided, in this Act:</text><paragraph id="HA567052E56734B4CB33D18EED4DBBCBB"><enum>(1)</enum><header>COVID–<enum-in-header>19</enum-in-header></header><text>The term <term>COVID–19</term> means the novel coronavirus disease of 2019 (COVID–19).</text></paragraph><paragraph id="H8D5D01EA69C34B1EB463BAC5FA66F75C"><enum>(2)</enum><header>Health professional shortage area</header><text>The term <term>health professional shortage area</term> has the meaning given the term in section 332(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254e">42 U.S.C. 254e(a)</external-xref>).</text></paragraph><paragraph id="HEAB7BB8148B14474AFBF420CC28A5F7E"><enum>(3)</enum><header>Medically underserved populations</header><text>The term <term>medically underserved population</term> has the meaning given the term in section 330(b)(3) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b(b)(3)</external-xref>). </text></paragraph><paragraph id="H1A8CD30108654E688E285E0CA3D513B4"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph><paragraph id="HEB329BBB4A3C41ED860501F6D14902ED"><enum>(5)</enum><header>State</header><text>The term <term>State</term> refers to each of the 50 States and the District of Columbia.</text></paragraph><paragraph id="H5DF47119E63A46A8B3E02BD34FAE553A"><enum>(6)</enum><header>Territory</header><text>The term <term>territory</term> means the Commonwealth of Puerto Rico, American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, and the United States Virgin Islands.</text></paragraph><paragraph id="H27CA092B65FD4EC99075B4E0C08EB122"><enum>(7)</enum><header>Tribal</header><text display-inline="yes-display-inline">The term <term>Tribal</term>, with respect to a health department, includes—</text><subparagraph id="H0B39E504D8404559801CBC64650F6869"><enum>(A)</enum><text>Indian Tribes that—</text><clause id="HF6A0459C3C474739BD39BEA129BA550F"><enum>(i)</enum><text>are operating one or more health facilities pursuant to an agreement under the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301</external-xref> et seq.); or</text></clause><clause id="H4E8E849598854111AE613E2E9D21D6BA"><enum>(ii)</enum><text>receive services from a facility operated by the Indian Health Services; and </text></clause></subparagraph><subparagraph id="H903D073440AC49F6AE4B084C8B08E646" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>Tribal organizations and Native Hawaiian organizations, as such terms are defined in section 166 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3221">29 U.S.C. 3221</external-xref>), and urban Indian organizations. </text></subparagraph></paragraph></section><section id="HFB6EA52BB609449DB2BA46A118CC45DC"><enum>3.</enum><header>Grants to support pandemic public works</header><subsection id="H30ADBFBDF4874D42AF2E8A02C117F67E"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H8957101DFF284F478F65FE2144787A9B"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided in this section or section 2, the terms in this section have the meanings given the terms in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>). </text></paragraph><paragraph id="H93B06C8277F44F6B9818F44B73AE7ABA"><enum>(2)</enum><header>Apprenticeship; apprenticeship program</header><text display-inline="yes-display-inline">The term <term>apprenticeship</term> or <term>apprenticeship program</term> means an apprenticeship program registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>) (50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50</external-xref> et seq.), including any requirement, standard, or rule promulgated under such Act, as such requirement, standard, or rule was in effect on December 30, 2019.</text></paragraph><paragraph id="HF6B71EA2765E476088B4A239C68CE3C9"><enum>(3)</enum><header>Contact tracing and pandemic response positions</header><text>The term <term>contact tracing and pandemic response positions</term> means employment related to—</text><subparagraph id="HFC31ABCD7C144363A3A4D9D61420E745"><enum>(A)</enum><text>contact tracing, surveillance, containment, and mitigation activities needed to implement the national system under section 6; </text></subparagraph><subparagraph id="H1EAD30819A6B414B930E7CC79D9AE838"><enum>(B)</enum><text>other activities necessary for pandemic response, including cleaning and mitigation activities; and</text></subparagraph><subparagraph id="H8E85B6496469493B826C53FB332678DA"><enum>(C)</enum><text>activities necessary to respond to the economic impacts of COVID–19.</text></subparagraph></paragraph><paragraph id="HFAAF303DD5914151BC3BFAEAF33EF6EC"><enum>(4)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H946F6B04DA204FB59267DEE950BE412B"><enum>(A)</enum><text>a State or territory; </text></subparagraph><subparagraph id="H65A582BB28444529B4F7FEF48A460EAA"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H0C7ABD0DB39F4EDE9269C82608DDB6CC"><enum>(i)</enum><text>an Indian Tribe, Tribal organization, Alaska Native entity, or Native Hawaiian organization <italic></italic>as such terms are defined in section 166 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3221">29 U.S.C. 3221</external-xref>); or</text></clause><clause id="H8F3B5F4978884EF0816B843CB524AD81" indent="up1"><enum>(ii)</enum><text>an Indian-controlled organization serving Indians as defined in such section 166; or</text></clause></subparagraph><subparagraph id="H6AD9F17CD7AA4EE099C6350BD30D7A0E"><enum>(C)</enum><text>a unit of local government, if an entity described in subparagraph (A) has not applied with respect to the area over which the unit has jurisdiction by the deadline required under subsection (b)(2)(B).</text></subparagraph></paragraph><paragraph id="H27AA0A92CAE74F5D89DF27C6F82FA4A6" commented="no"><enum>(5)</enum><header>Eligible individual</header><text>The term <term>eligible individual</term> means an individual seeking or securing employment in a contact tracing or pandemic response position and who is served by an eligible entity or community-based organization receiving funding under this section.</text></paragraph><paragraph commented="no" id="H3232783FA0754AD3846E10797F73D749"><enum>(6)</enum><header>Unit of local government</header><text>The term <term>unit of local government</term> means any city, county, township, town, borough, parish, village, or other general purpose political subdivision of a State.</text></paragraph></subsection><subsection id="HA4A36726B4EB4D2A8E5074EFA7150104"><enum>(b)</enum><header>Grants</header><paragraph id="HDCF40311D02E4D139D3ECD2A2413BE3A"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations under subsection (l), the Secretary shall award a grant to each eligible entity that submits a complete application under subsection (c), to enable the eligible entity to—</text><subparagraph id="H23AA9374153F43E2926866239976E849"><enum>(A)</enum><text> as applicable, support the recruitment, placement, and training of, and provide employment to, eligible individuals seeking employment in contact tracing and pandemic response positions; and</text></subparagraph><subparagraph id="H0B0D50D542DE4DD2B32B85A771154973"><enum>(B)</enum><text display-inline="yes-display-inline">assist with the employment transition to new employment or education and training of individuals employed under this section in preparation for and upon termination of such employment.</text></subparagraph></paragraph><paragraph id="HFFC9644F691A48E0884C037552760E0B"><enum>(2)</enum><header>Timeline</header><subparagraph id="HF84460F5EC3D41F298653855635CE691"><enum>(A)</enum><header>Deadline for Secretary application requirements</header><text>The Secretary shall issue application requirements under subsection (c) not later than 10 days after the date of enactment of this Act.</text></subparagraph><subparagraph id="H8B21A778F89E4488AF3B7CEFC565C041"><enum>(B)</enum><header>State and Tribal applications</header><text>The deadline for applications from eligible entities described in subparagraph (A) or (B) of subsection (a)(4) shall be the date that is 30 days after the date the Secretary issues application requirements under subparagraph (A).</text></subparagraph><subparagraph id="H8F830A2E28FA4DB1A6329BDC99D67532"><enum>(C)</enum><header>Applications for local governments serving as eligible entities</header><text>The deadline for applications for grants from eligible entities described in subsection (a)(4)(C) shall be the date that is 10 days after the date that applications are due under subparagraph (B). </text></subparagraph><subparagraph id="H31FC2BFA4AEC4753867CA18619932C30"><enum>(D)</enum><header>Grant awards</header><text>The Secretary shall award a grant to an eligible entity under paragraph (1) not later than 15 days after the date on which applications are due under subparagraph (C). </text></subparagraph></paragraph></subsection><subsection id="H80DA65D18545469DB642E7B8A19916FC"><enum>(c)</enum><header>Grant application</header><text>An eligible entity applying for a grant under this section shall submit an application to the Secretary, at such time and in such form and manner as the Secretary may reasonably require, which shall include a description of—</text><paragraph id="H1816A569635B411192AD90CC089964BD"><enum>(1)</enum><text>how the eligible entity will, as applicable, support the recruitment, placement, and training of, and provide employment to, of eligible individuals seeking employment in contact tracing and pandemic response positions;</text></paragraph><paragraph id="HB7BA9281EDC5408CAE0C91B4A8B2FEF9"><enum>(2)</enum><text>how the activities described in paragraph (1) will support State efforts to address the demand for contact tracing and pandemic response positions with respect to—</text><subparagraph id="H55779B0F39554F429E373070EF39CDC3" commented="no"><enum>(A)</enum><text>the State plans referred to in the heading <quote>Public Health and Social Services Emergency Fund</quote> in title I of division B of the Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>); and</text></subparagraph><subparagraph id="H761938254C524226A6EF6FD8623D99A8"><enum>(B)</enum><text>the number of eligible individuals that the State plans to recruit, train, and employ under the plans described in subparagraph (A);</text></subparagraph></paragraph><paragraph id="H83EA4F390E0B4D9E9E7574C9CF788984"><enum>(3)</enum><text display-inline="yes-display-inline">the specific strategies for recruiting, placement, and employment of eligible individuals from or residing within the communities in which they will work, including—</text><subparagraph id="H009CED9A44AE433D9A35E2F5534FF9AC"><enum>(A)</enum><text display-inline="yes-display-inline">plans for the recruitment of eligible individuals to serve in contact tracing or pandemic response positions, including dislocated workers, individuals with barriers to employment, veterans, new entrants in the workforce, self-employed individuals who are unemployed as a result of COVID–19, or underemployed or furloughed workers, who are from or reside in or near the locality in which they will serve, and who, to the extent practicable—</text><clause id="H540AB8A4F8E04282901A06D6349037DD"><enum>(i)</enum><text>have experience or a background in industry sectors and occupations such as public health, social services, customer service, case management, or occupations that require related qualifications, skills, or competencies, such as strong interpersonal and communication skills, needed for contact tracing or pandemic response positions; or</text></clause><clause id="HBEE7D6D611A34EDA96821276C8779B8C"><enum>(ii)</enum><text>seek to transition to public health and public health related occupations upon the conclusion of employment in contact tracing or pandemic response positions; and</text></clause></subparagraph><subparagraph id="H0DFA04F46817406A8EB441E35BA1D1D6"><enum>(B)</enum><text>how such strategies will take into account the diversity of such community, including racial, ethnic, socioeconomic, linguistic, or geographic diversity;</text></subparagraph></paragraph><paragraph id="H0AB1705B3CBF4191A77A56E6E3F453D0"><enum>(4)</enum><text>the amount, timing, and mechanisms for distribution of funds provided to local units of government or through subgrants as described in subsection (d)(2)(A) or (e);</text></paragraph><paragraph id="H547FB779836546219E2EA185A8283DEE"><enum>(5)</enum><text display-inline="yes-display-inline">for eligible entities described in subparagraph (A) or (B) of subsection (a)(4), a description of how the eligible entity will ensure the equitable distribution of funds with respect to—</text><subparagraph id="H078CD00612494DD4B0CF269DF7D8C05A"><enum>(A)</enum><text>geography (such as urban and rural distribution);</text></subparagraph><subparagraph id="H499B8450DB5B4EEEB2042EB62A141A7D" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">medically underserved populations;</text></subparagraph><subparagraph id="H357D7619A657476E9C91B6A2EBB63F60" commented="no"><enum>(C)</enum><text>health professional shortage areas; and</text></subparagraph><subparagraph id="HF5A078BAA199462AA6A4486E2CE20359"><enum>(D)</enum><text>the racial and ethnic diversity of the area;</text></subparagraph></paragraph><paragraph id="H58D4310C8F504F5FAB081D8683AA1D90"><enum>(6)</enum><text>for eligible entities described in subsection (a)(4)(C), a description of how a grant to such eligible entity would serve the equitable distribution of funds as described in paragraph (5); and</text></paragraph><paragraph id="HAA0111785ABD4707B105D9D4E6EB6F9D"><enum>(7)</enum><text>how the eligible entity will collaborate with State boards and local boards, the unemployment compensation system of the State, and the employment service offices (providing services under the Wagner-Peyser Act (<external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50</external-xref> et seq.)) of the State regarding the State reemployment services and eligibility assessment activities and the activities provided under this section. </text></paragraph></subsection><subsection id="HEE7450FF7C3147F89471FF3042A17E20"><enum>(d)</enum><header>Grant distribution</header><paragraph id="H00F729E5713B40568083E34908B18DEA" commented="no"><enum>(1)</enum><header>Federal distribution</header><subparagraph id="H1096ED6E84554EE9A6F63A1C42B1E831" commented="no"><enum>(A)</enum><header>Use of funds</header><text>The Secretary shall use the funds appropriated to carry out this section as follows:</text><clause id="HE9725846DD0448BD83CB67F2A5CD6F91" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">Subject to clause (ii), the Secretary shall distribute funds among eligible entities that submit a complete application under subsection (c) in accordance with a formula to be established by the Secretary that—</text><subclause commented="no" id="HE66579CA10824971B1C8B55B25372793"><enum>(I)</enum><text display-inline="yes-display-inline">provides a minimum level of funding to each eligible entity that submits a complete application; and </text></subclause><subclause commented="no" id="H6C79F7437B1D44C69CCAFBDF03F3D5E1"><enum>(II)</enum><text display-inline="yes-display-inline">allocates additional funding as follows:</text><item id="H96E50C7AF19C4F8C936043E110743CBB" commented="no"><enum>(aa)</enum><text display-inline="yes-display-inline">The formula shall give first priority based on the number and proportion of contact tracing or pandemic response positions for which the eligible entity plans to recruit, place, train, and employ individuals as a part of the State strategy described in subsection (c)(2)(A).</text></item><item id="H5668B9E2E81E4204AD97503CBB61E95B" commented="no"><enum>(bb)</enum><text>The formula shall give second highest priority to applications that will serve States, territories, Indian Tribes, or Native Hawaiian populations that have the highest unemployment rates, as determined based on the most recent data available.</text></item><item id="H3CB3C51AFD384ACC966058B59216A478"><enum>(cc)</enum><text>The formula shall give third highest priority to applicants proposing to serve populations in one or more geographic regions with a high burden of COVID–19 based on data provided by the Centers for Disease Control and Prevention, or other sources as determined by the Secretary.</text></item><item id="H133ACB0E9A794EB0B05FC4890D7D6AD6"><enum>(dd)</enum><text display-inline="yes-display-inline">The formula shall give fourth highest priority to applicants preparing for, or currently working to mitigate, a COVID–19 surge in a geographic region that does not yet have a high number of reported cases of COVID–19 based on data provided by the Centers for Disease Control and Prevention, or other sources as determined by the Secretary.</text></item><item id="HB4DBD23062B745B8B5B027FBDE08B37C" commented="no" display-inline="no-display-inline"><enum>(ee)</enum><text>The formula shall give fifth highest priority to applicants proposing to serve high numbers of low-income and uninsured populations, including medically underserved populations, health professional shortage areas, racial and ethnic minorities, or geographically diverse areas, as determined by the Secretary.</text></item></subclause></clause><clause id="H5ECC571521574D06AFA2A7A99FB2C786" commented="no"><enum>(ii)</enum><text>Not more than 2 percent of the funding for administration of the grants and for providing technical assistance to recipients of funds under this section.</text></clause></subparagraph><subparagraph id="H660CACEC487B45DB8CAA7D1EE7BC4E27" commented="no"><enum>(B)</enum><header>Equitable distribution</header><text display-inline="yes-display-inline">If the geographic region served by one or more eligible entities overlaps, the Secretary shall distribute funds among such entities in such a manner that ensures equitable distribution with respect to the factors under subsection (c)(5). </text></subparagraph></paragraph><paragraph id="H174C69428B774767932DCC412373D017"><enum>(2)</enum><header>Eligible entity use of funds</header><text>An eligible entity described in subsection (a)(4)(A)—</text><subparagraph id="H78BB32CAB40F473EB5EF0D600DAE7B9E"><enum>(A)</enum><text display-inline="yes-display-inline">shall, not later than 30 days after the date on which the entity receives grant funds under this section, use not less than 40 percent of grant funds to award subgrants to units of local government for the purpose of carrying out activities described in subsection (f);</text></subparagraph><subparagraph id="HD485E3DCB40C429E8A21F67DA1A1362C"><enum>(B)</enum><text display-inline="yes-display-inline">may use not more than 5 percent of such funds to make subgrants to community-based organizations in the service area to conduct outreach, to potential eligible individuals, as described in subsection (e);</text></subparagraph><subparagraph id="HBAF64B5775A74FD0BFC34C42A592DAD2"><enum>(C)</enum><text display-inline="yes-display-inline">in providing subgrants to units of local government under subparagraph (A) and awarding subgrants under subsection (e), shall ensure the equitable distribution with respect to the factors described in subsection (c)(5); and</text></subparagraph><subparagraph id="H89EBC07B21BD48A285EA8EED378AD63A"><enum>(D)</enum><text display-inline="yes-display-inline">may use not more than 10 percent of the funds awarded under this section for the administrative costs of carrying out the grant and for providing technical assistance to local units of government and community-based organizations. </text></subparagraph></paragraph></subsection><subsection id="HAC21B8C1A1A54320B25599FD82EED997"><enum>(e)</enum><header>Outreach and education subgrant authorization and application process</header><paragraph id="H4CCFB9AB9AC148F9BA9DD0F11D5C0064"><enum>(1)</enum><header>In general</header><text>An eligible entity receiving a grant under this section may use a portion of such funds to award a subgrant to one or more community-based organizations for the purposes of partnering with an eligible entity to conduct outreach and education activities to inform potentially eligible individuals about employment opportunities in contact tracing or pandemic response positions.</text></paragraph><paragraph id="H9CCE0018493D4FA19B08CDFA53E58167"><enum>(2)</enum><header>Application</header><text>A community-based organization desiring a subgrant under this subsection shall submit an application at such time and in such manner as the eligible entity may reasonably require, including—</text><subparagraph id="HA8D59653C0CF487F8590957F684128FD"><enum>(A)</enum><text>a demonstration of the community-based organization’s established expertise and effectiveness in community outreach in the locality that such organization plans to serve;</text></subparagraph><subparagraph id="H5399801CA37849789BD791766AC608EF"><enum>(B)</enum><text>a demonstration of the community-based organization’s expertise in providing employment or information to the locality in which such organization plans to serve; and</text></subparagraph><subparagraph id="HF5D13D09FD44414784D8CFC4CC2AEDFD" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>a description of the expertise of the community-based organization in utilizing culturally competent and multilingual strategies in the provision of services. </text></subparagraph></paragraph></subsection><subsection id="HEE33E300401E463BB7C49D1226DFA51D" commented="no"><enum>(f)</enum><header>Eligible activities</header><text>An eligible entity receiving a grant, or a unit of local government receiving a subgrant from an eligible entity, under this section shall use such grant or subgrant funds— </text><paragraph id="H9398503A99FE4BC6B74B49A24617685B"><enum>(1)</enum><text>to support the recruitment and placement of eligible individuals;</text></paragraph><paragraph id="HFC7ED39338DD4D96A04C1A6F4ED03787"><enum>(2)</enum><text>to employ eligible individuals in contact training or pandemic response positions;</text></paragraph><paragraph id="H4754060C561B4CDF9ED88B17E2E0CDDB"><enum>(3)</enum><text>to support the training and employment transition as related to contact tracing or pandemic response positions;</text></paragraph><paragraph id="HAADDB992267D479F81C60ADD072C00D2"><enum>(4)</enum><text>for the following activities:</text><subparagraph id="H793A3FAD95AD4461B4429B1EF04C92A5"><enum>(A)</enum><text>Establishing or expanding training partnerships with—</text><clause id="H6207DC11644D4AAAA21CCD5A9544A712"><enum>(i)</enum><text>community-based health providers, including community health centers and rural health clinics;</text></clause><clause id="H0E1E8AA604554BB1BDAD85ED6E952D95"><enum>(ii)</enum><text>labor organizations or joint labor management organizations;</text></clause><clause id="H717F583EC98E4641A101DE16512A5A85"><enum>(iii)</enum><text>2-year and 4-year institutions of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)), including institutions eligible to receive funds under section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>); and</text></clause><clause id="H05E723F725A34F25BD15C385C6778002"><enum>(iv)</enum><text>community action agencies or other community-based organizations serving localities in which there is a demand for contact tracing or pandemic response positions. </text></clause></subparagraph><subparagraph id="H2508384FB4684FF6ACBB09E78A343002"><enum>(B)</enum><text>Providing training for contact tracing or pandemic response positions in coordination with State, local, Tribal, or territorial health departments that is consistent with the State or territorial testing and contact tracing strategy and ensuring that eligible individuals receive compensation while participating in such training. </text></subparagraph><subparagraph id="HF6DCD660BB814AB9B287AE89A023A9C4"><enum>(C)</enum><text>Providing eligible individuals with—</text><clause id="H7B812982201D40C5B0C98F7E920E28AA"><enum>(i)</enum><text>adequate and safe equipment, environments, and facilities for training and supervision, as applicable;</text></clause><clause id="H52393F6B016043B6A7EEE9A089E7E473"><enum>(ii)</enum><text>supplies and equipment needed by the program participants to support placement of an individual in contact tracing or pandemic response positions, as applicable; and</text></clause><clause id="H839DBF1062C74996BA029FCEA9F86EA3"><enum>(iii)</enum><text>services for the period during which the individual is employed in a contact tracing or pandemic response position to ensure job retention, which may include—</text><subclause id="H6A9D655A72C44F59899E355DA2039D44"><enum>(I)</enum><text>supportive services throughout the term of employment; or</text></subclause><subclause id="H1F880FD5B2F947F0BC226EA112057451"><enum>(II)</enum><text>a continuation of skills training as related to employment in a contact tracing or pandemic response position, that is conducted in collaboration with the employers of such participants; and</text></subclause></clause></subparagraph></paragraph><paragraph id="HFC0A467560A347CBB141EE37B604B0A5"><enum>(5)</enum><text>supporting the transition and placement in unsubsidized employment for eligible individuals serving in the contact tracing or pandemic response positions after such positions are no longer necessary in the State or locality, which may include—</text><subparagraph id="H4B7AE1ED9A684A60B918909D1B70CA80"><enum>(A)</enum><text>providing additional disaster relief employment and employment and training activities described in subparagraphs (A) and (C) of section 170(d)(1) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3225">29 U.S.C. 3225(d)(1)</external-xref>) and services described in section 7(a)(1) of the Wagner-Peyser Act (<external-xref legal-doc="usc" parsable-cite="usc/29/49f">29 U.S.C. 49f(a)(1)</external-xref>); </text></subparagraph><subparagraph id="H02AB3141AFEC44E9B9CF0975CF73BDDE"><enum>(B)</enum><text>providing services to assist eligible individuals in maintaining employment for not less than 12 months after the completion of employment in contact tracing or pandemic response positions, as appropriate; and</text></subparagraph><subparagraph id="HBE632DFFD5064F769FFDAB01183CCB24" commented="no"><enum>(C)</enum><text>assisting eligible individuals in obtaining other employment directly with the eligible entity, or with a unit of local government, after serving in a contact tracing or pandemic response position supported under this section, by paying for the costs of not more than 10 percent of the total compensation provided by the eligible entity or unit of local government to such eligible individual for a period of not more than the first year in which the individual is so employed, if such employment is not otherwise subsidized under this or any other Act. </text></subparagraph></paragraph></subsection><subsection id="H9CBC324C4F1F469CAEA1BD4BAC480BDE"><enum>(g)</enum><header>Requirements for transition back to unemployment compensation</header><text>As a condition of an eligible entity that is a State receiving a grant under this section, the State law (as defined in section 205 of the Federal-State Extended Unemployment Compensation Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C. 3304</external-xref> note)) of the State shall, in the case of an individual who is receiving unemployment compensation under at the time the individual enrolls in a program funded under the grant, provide for the following:</text><paragraph id="H8B87950E7EF74F8887DB7816771CDB7F"><enum>(1)</enum><text>Such individual shall be eligible to resume receiving unemployment compensation after leaving such program if the individual is unemployed.</text></paragraph><paragraph id="H03AB272051054838886A775E9B253DEE"><enum>(2)</enum><text>The amount of the weekly benefit amount for such individual shall be the greater of—</text><subparagraph id="H108B26B8BF324338BD29FBC0BDE39F5A"><enum>(A)</enum><text>the weekly benefit amount such individual was receiving when such individual entered the program; or</text></subparagraph><subparagraph id="HCD1CC71698274C58969F85DC2D5DFC1E"><enum>(B)</enum><text>a weekly benefit amount that is determined based on such individual's earnings from employment under the program.</text></subparagraph></paragraph></subsection><subsection id="H0E8D5D29386945B181B5383279F5443D"><enum>(h)</enum><header>Limitations</header><paragraph id="H1E6608BEF15B48CBA2F23B27F78C98A6" commented="no"><enum>(1)</enum><header>Extension of period for contact tracing or pandemic response positions</header><text display-inline="yes-display-inline">A person may be employed in a contact tracing or pandemic response position using funds under this section for a period not greater than 2 years.</text></paragraph><paragraph id="H18C8567B15FA40888904412DA604A106"><enum>(2)</enum><header>Prohibition of displacement</header><text>An individual placed in a contact tracing or pandemic response position under this section shall not displace (including a partial displacement, such as a reduction in the hours of nonovertime work, wages, or employment benefits)—</text><subparagraph id="HF7B12A96525F46D9B940B5761DD4D137"><enum>(A)</enum><text>any employee of the eligible entity; or </text></subparagraph><subparagraph id="H0DA8D2BB435A4A599277725F11558F67"><enum>(B)</enum><text>any contractor, or employee of any contractor, of the eligible entity. </text></subparagraph></paragraph></subsection><subsection id="HFDF7A709F96B456DB213AF16A4E013D9"><enum>(i)</enum><header>Reporting by the Department of Labor</header><paragraph id="H013577A7287A431DA819AC7DEF6A70A3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days of the enactment of this Act, and once grant funds have been expended under this section, the Secretary shall report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Labor of the House of Representatives, and make publicly available, a report containing a description of—</text><subparagraph id="H1E6813D8EAC0415FA5E710F0C40498FC"><enum>(A)</enum><text>the number of eligible individuals recruited, hired, and trained for contact tracing or pandemic response positions under this section;</text></subparagraph><subparagraph id="H8B7630AFF265467B8A7977701C9205EB"><enum>(B)</enum><text>the number of individuals successfully transitioned to unsubsidized employment or training at the completion of employment in contact tracing or pandemic response positions using funds under this Act;</text></subparagraph><subparagraph id="H36659538D0B54D9CBB491ED8060AFF9D" commented="no"><enum>(C)</enum><text>the number of such individuals who were unemployed prior to being hired or trained as described in subparagraph (A);</text></subparagraph><subparagraph id="H7A851EF8A03B42419E8D0ECE78D94AA9"><enum>(D)</enum><text>the performance of each program supported by funds under this Act with respect to the indicators of performance under section 116 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141</external-xref>), as applicable;</text></subparagraph><subparagraph id="HF4FCD269E12F4793A84AACD742F3E8C1"><enum>(E)</enum><text>the number of individuals in unsubsidized employment within 6 months and 1 year, respectively, of the conclusion of employment in contact tracing or pandemic response positions, the quarterly wages, and number of hours worked per week, of such individuals, and, of those individuals, the number of individuals within a State, territorial, or local public health department in an occupation related to public health; and </text></subparagraph><subparagraph id="H47677DAD6C004BD1A550949BFCE09377"><enum>(F)</enum><text display-inline="yes-display-inline">any information on how eligible entities, units of local government, or community-based organizations that received funding under this section were able to support the goals of the national system for COVID–19 testing, contact tracing, surveillance, containment, and mitigation established under section 6.</text></subparagraph></paragraph><paragraph id="H5CC06A95B95C4347A84A232005615B10"><enum>(2)</enum><header>Disaggregation</header><text display-inline="yes-display-inline">All data reported under paragraph (1) shall be disaggregated by race, ethnicity, sex, age, and, with respect to individuals with barriers to employment, subpopulation of such individuals, except for when the number of participants in a category is insufficient to yield statistically reliable information or when the results would reveal personally identifiable information about an individual participant.</text></paragraph></subsection><subsection id="HA8429FF30D3942339380A56B22E68070"><enum>(j)</enum><header>Special rule</header><text display-inline="yes-display-inline">Any funds used for programs under this section that are used to fund an apprenticeship or apprenticeship program shall only be used for, or provided to, an apprenticeship or apprenticeship program that meets the definition of such term in subsection (a), including any funds awarded for the purposes of grants, contracts, or cooperative agreements, or the development, implementation, or administration, of an apprenticeship or an apprenticeship program.</text></subsection><subsection id="H6AC8D2E5FE1E46349A3ECE5CA6C05E64" display-inline="no-display-inline"><enum>(k)</enum><header>Information sharing requirement for HHS</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention, shall provide the Secretary of Labor, acting through the Assistant Secretary of the Employment and Training Administration, with information on grants under section 7, including—</text><paragraph id="H5C6D24FA26B14925BB05C159C76ADB96"><enum>(1)</enum><text> the formula used to award such grants to State, local, Tribal, and territorial health departments;</text></paragraph><paragraph id="HA5F4B51BE36E460B99D4929C349A8EC0"><enum>(2)</enum><text>the dollar amounts of and scope of the work funded under such grants;</text></paragraph><paragraph id="HDE4024EE35E34A868B1F58F413A7D9C7"><enum>(3)</enum><text display-inline="yes-display-inline">the geographic areas served by eligible entities that receive such grants; and</text></paragraph><paragraph id="H1B5DDF9857EE4E6CB0AEE550CE3C0281"><enum>(4)</enum><text>the number of individual to be hired in contact tracing or pandemic response positions using such grants.</text></paragraph></subsection><subsection id="HC2AB03213720420796AB2836225DD2AD" commented="no" display-inline="no-display-inline"><enum>(l)</enum><header>Authorization of appropriations</header><text>Of the amounts appropriated to carry out this Act under section 9, $100,000,000,000 shall be used by the Secretary to carry out subsections (a) through (h).</text></subsection></section><section id="H21BEF93F75324FB88E6C01416A57739C"><enum>4.</enum><header>Service Contract Act application</header><text display-inline="no-display-inline">Contracts and grants that include contact tracing or other pandemic response activities as part of the scope of work and that are awarded under this Act shall require that individuals in contact tracing and pandemic response positions are paid not less than the prevailing wage and fringe rates required under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/67">chapter 67</external-xref> of title 41, United States Code (commonly known as the <quote>Service Contract Act</quote>) for the area in which the work is performed. To the extent that a nonstandard wage determination is required to establish a prevailing wage for contact tracing or pandemic response positions for purposes of this Act, the Secretary of Labor shall issue such determination not later than 14 days after the date of enactment of this Act, based on a job description used by the Centers for Disease Control and Prevention and contractors or grantees performing contact tracing or pandemic response activities for State public health agencies. </text></section><section id="HCA04FDD0B5854267BC32258E688A7E06"><enum>5.</enum><header>Awareness campaigns</header><subsection id="HBC5122908BEA4828A5E99EE31808D96F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention and in coordination with other offices and agencies, as appropriate, shall award competitive grants or contracts to one or more public entities to carry out multilingual and culturally appropriate awareness campaigns. Such campaigns shall—</text><paragraph id="H7962E587250641D785F8AA75FC7CD9C8"><enum>(1)</enum><text>be based on available scientific evidence;</text></paragraph><paragraph id="H4AE7B36236064662A2C0E30D5F051341"><enum>(2)</enum><text>increase awareness and knowledge of COVID–19, including countering stigma associated with COVID–19;</text></paragraph><paragraph id="H929D660FA3764886B559325A6CFBFD04"><enum>(3)</enum><text>improve information on the availability of COVID–19 diagnostic testing; </text></paragraph><paragraph id="H7279CDA2B2E341CD9FC43609E770D2C7" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>promote cooperation with contact tracing efforts; and</text></paragraph><paragraph id="H96AAF647ED1B4C3EB605EA2ED7FE3C94"><enum>(5)</enum><text>promote employment opportunities performing contact tracing and other pandemic response activities. </text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="HE1A71936CDB647748FF3400128032042"><enum>(b)</enum><header>Authorization of appropriations</header><text>Of the amounts appropriated to carry out this Act under section 9, $5,000,000,000 shall be used by the Secretary to carry out this section.</text></subsection></section><section id="H490157D5554E411495CD9C0D9B0EEC3A"><enum>6.</enum><header>National system for COVID–19 testing, contact tracing, surveillance, containment, and mitigation</header><subsection id="H1661B29E9D774702ABF32AB596412D51"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention, and in coordination with the applicable offices of the Department of Health and Human Services and State, local, Tribal, and territorial health departments, shall establish and implement a nationwide evidence-based system for— </text><paragraph id="H15D3F96FFCF441B3B6D9E7119AE30F7A"><enum>(1)</enum><text>testing, contact tracing, surveillance, containment, and mitigation with respect to COVID–19; </text></paragraph><paragraph id="H4E347A9B00524A96BCA30A0DDA57D97C"><enum>(2)</enum><text>offering guidance on voluntary isolation and quarantine of individuals infected with, or exposed to individuals infected with, the virus that causes COVID–19; and</text></paragraph><paragraph id="HA45CDEE6BC984F1F855906E95DF61A8E"><enum>(3)</enum><text display-inline="yes-display-inline">public reporting on testing, contact tracing, surveillance, and voluntary isolation and quarantine activities with respect to COVID–19.</text></paragraph></subsection><subsection id="H75CB0C8F2F604843B85C16FEBF366D82"><enum>(b)</enum><header>Coordination; technical assistance</header><text display-inline="yes-display-inline">In carrying out the national system under this section, the Secretary of Health and Human Services shall—</text><paragraph id="HD479D2771CE54570B9F11155A5B965FF"><enum>(1)</enum><text display-inline="yes-display-inline">coordinate State, local, Tribal, and territorial activities related to testing, contact tracing, surveillance, containment, and mitigation with respect to COVID–19, as appropriate; and</text></paragraph><paragraph id="H0D0AF6BFD4C44EADBB674E32C10594F3"><enum>(2)</enum><text>provide technical assistance for such activities, as appropriate.</text></paragraph></subsection><subsection id="H8B7F69AFEC9C4BAFAFBEFB2265B968E2" commented="no"><enum>(c)</enum><header>Consideration</header><text>In establishing and implementing the national system under this section, the Secretary of Health and Human Services shall take into consideration the State and Tribal plans referred to in the heading <quote>Public Health and Social Services Emergency Fund</quote> in title I of division B of the Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>).</text></subsection><subsection id="H383B377ABD7A44E5BDF426452E8A2EDA" commented="no"><enum>(d)</enum><header>Reporting</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall—</text><paragraph id="HDC1C0F8BA4B6448AA9DF5552E298EB7B"><enum>(1)</enum><text display-inline="yes-display-inline">not later than December 31, 2021, submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a preliminary report on the effectiveness of the activities carried out pursuant to this Act; and</text></paragraph><paragraph id="H519EFE7689944CC7898470405F6AD880"><enum>(2)</enum><text>not later than December 21, 2022, submit to such committees a final report on such effectiveness.</text></paragraph></subsection></section><section id="H5ACE9F850F6941EA9A80014792365724" commented="no"><enum>7.</enum><header>Health department grants</header><subsection id="H3BECE255AE664AE18868F53AD5AC0478" commented="no"><enum>(a)</enum><header>Definition of Secretary</header><text>In this section, the term <quote>Secretary</quote> means the Secretary of Health and Human Services.</text></subsection><subsection commented="no" id="HA98754C527B644528C45894C2FA37E20"><enum>(b)</enum><header>Grants authorized</header><text>To implement the national system under section 6, the Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall, subject to the availability of appropriations, award grants to State, local, Tribal, and territorial health departments that seek grants under this section to carry out coordinated testing, contact tracing, surveillance, containment, and mitigation with respect to COVID–19, including—</text><paragraph id="H453FA591362E4F9F821627E1BAD19586" commented="no"><enum>(1)</enum><text>diagnostic and surveillance testing and reporting;</text></paragraph><paragraph id="H868BBD5AB7CB4EDA927F072B73BF6048" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">community-based contact tracing efforts; and</text></paragraph><paragraph id="H6D9C06CFC11A4A6B8764735BCFC3CBD1" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">policies related to voluntary isolation and quarantine of individuals infected with, or exposed to individuals infected with, the virus that causes COVID–19.</text></paragraph></subsection><subsection id="H50EDA3CB2A2B4115ACB061A558BD71EE" commented="no"><enum>(c)</enum><header>Flexibility</header><text display-inline="yes-display-inline">The Secretary shall ensure that—</text><paragraph id="H4303671F78BC44BA9634E821AAAE24D8"><enum>(1)</enum><text>the grants under subsection (b) provide flexibility for State, local, Tribal, and territorial health departments to modify, establish, or maintain evidence-based systems; and </text></paragraph><paragraph id="H2FFBFFC09A874B63BDD53ECF97F63E27"><enum>(2)</enum><text display-inline="yes-display-inline">local health departments receive funding from State health departments or directly from the Centers for Disease Control and Prevention to contribute to such systems, as appropriate.</text></paragraph></subsection><subsection id="H245ED61AB4FF4CF5AF12FD284E7EE006"><enum>(d)</enum><header>Allocations</header><paragraph id="HE4FBF9C8468144418A9A24EE1FFA783E"><enum>(1)</enum><header>Formula</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall allocate amounts made available pursuant to subsection (b) in accordance with a formula, to be established by the Secretary, that—</text><subparagraph id="HECB25B3D341B4DE3822363ED68300219"><enum>(A)</enum><text display-inline="yes-display-inline">provides a minimum level of funding to each State, local, Tribal, and territorial health department that seeks a grant under this section; and </text></subparagraph><subparagraph id="HFE84CA900CE742CCA9DBE0BA1DC6C840"><enum>(B)</enum><text display-inline="yes-display-inline">allocates additional funding based on the following prioritization:</text><clause id="H14215D188C9745DDB19BAD4B69949954"><enum>(i)</enum><text>The Secretary shall give highest priority to applicants proposing to serve populations in one or more geographic regions with a high burden of COVID–19 based on data provided by the Centers for Disease Control and Prevention, or other sources as determined by the Secretary.</text></clause><clause id="H51311C6C9B3F420F90367DA091B22561"><enum>(ii)</enum><text display-inline="yes-display-inline">The Secretary shall give second highest priority to applicants preparing for, or currently working to mitigate, a COVID–19 surge in a geographic region that does not yet have a high number of reported cases of COVID–19 based on data provided by the Centers for Disease Control and Prevention, or other sources as determined by the Secretary.</text></clause><clause id="HFC94CBD8FD214644B3BB174DE980F95C"><enum>(iii)</enum><text>The Secretary shall give third highest priority to applicants proposing to serve high numbers of low-income and uninsured populations, including medically underserved populations, health professional shortage areas, racial and ethnic minorities, or geographically diverse areas, as determined by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="H5336D8261B7341FE81F620FE4417152E"><enum>(2)</enum><header>Notification</header><text display-inline="yes-display-inline">Not later than the date that is 7 days before first awarding grants under this section, the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a notification detailing the formula established under paragraph (1) for allocating amounts made available pursuant to subsection (b).</text></paragraph></subsection><subsection id="H4BE81B5684F7452F8BABEB93BF81E722" commented="no"><enum>(e)</enum><header>Use of funds</header><text>A State, local, Tribal, or territorial health department receiving a grant under this section shall, to the extent possible, use the grant funds for activities determined appropriate by the Director of the Centers for Disease Control and Prevention (in coordination with Tribal health organizations) to implement the national system under section 6. </text></subsection><subsection id="H8EEC169BF713473E9A91F30CF8539096" commented="no"><enum>(f)</enum><header>Reporting</header><paragraph commented="no" id="HDDBE4DB35E3D45428BCE306B085FEFF3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall facilitate mechanisms for timely, standardized reporting by grantees under this section regarding implementation of the systems established under this section and coordinated processes with the reporting as required under the heading <quote>Public Health and Social Service Emergency Fund</quote> in title I of division B of the Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>, 134 Stat. 620), including—</text><subparagraph id="H36AD5B1C47524509B036F2FEAEC135C3" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a summary of county or local health department level information from the entities receiving funding under this section about the activities that will be undertaken using funding awarded under this section, including subgrants; and</text></subparagraph><subparagraph id="H5A809C8DB92F46718EB5820EACE607F5" commented="no"><enum>(B)</enum><text>any barriers in the prevention, testing, mitigation, or treatment of COVID–19 under this section.</text></subparagraph></paragraph><paragraph id="H02FF4E74D52E4CE6BDFC42B5310A1F42"><enum>(2)</enum><header>Tribal data sovereignty</header><text>The Secretary shall consult with Indian Tribes and Tribal organizations and coordinate with Tribal health organizations to ensure that any reporting process under this section honors and preserves the data sovereignty of individuals who are members of Indian Tribes or Tribal organizations (as such terms are defined in section 166 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3221">29 U.S.C. 3221</external-xref>)), including individuals who are members of Native Hawaiian organizations (as defined in such section 166), and urban Indian organizations. </text></paragraph></subsection><subsection id="H32B1920B2A1241CDA73F1140CFB13802"><enum>(g)</enum><header>Public listing of awards</header><text display-inline="yes-display-inline">The Secretary shall—</text><paragraph id="H6F0A7B60FBD4423DACD86F2EA8F879F5"><enum>(1)</enum><text>not later than 7 days after first awarding grants under this section, post in a searchable, electronic format a list of all awards made by the Secretary under this section, including the recipients and amounts of such awards; and</text></paragraph><paragraph id="HCBEA0DA695D94A81A742EDEECFEC6465"><enum>(2)</enum><text>update such list not less than once every 7 days until all funds made available to carry out this section are expended.</text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="HA5D2A123F2F54D0A810AAE3B32E01114"><enum>(h)</enum><header>Authorization of appropriations</header><text>Of the amounts appropriated to carry out this Act under section 9, $15,000,000,000 shall be used by the Secretary to carry out this section.</text></subsection></section><section id="H74D02A329B07469D8FADE08187D86326" commented="no"><enum>8.</enum><header>Guidance and technical assistance</header><subsection id="H6DF6DD7C73F745CBB7801FE1D74296D0" commented="no"><enum>(a)</enum><header>Department of Health and Human Services guidelines</header><paragraph commented="no" id="HC3AE430FB72442F4A37F0DCB64C6FE9B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 14 days after the date of the enactment of this Act, the Secretary of Health and Human Services, in coordination with the heads of other Federal agencies as appropriate, shall issue guidance, provide technical assistance, and provide information to States, units of local government, Tribes, and territories, with respect to the following: </text><subparagraph id="HECCDB0218C3C43B2B823679144C58794" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Best practices regarding contact tracing, including the collection of data with respect to such contact tracing and requirements related to the standardization of demographic and syndromic information collected as part of contact tracing efforts. </text></subparagraph><subparagraph id="H4C757E4DF036402B9AA4C9AD9DEB38CE" commented="no"><enum>(B)</enum><text>Best practices regarding COVID–19 disease surveillance, including best practices to reduce duplication in surveillance activities, identifying gaps in surveillance and surveillance systems, and ways in which the Secretary of Health and Human Services plans to effectively support State, local, Tribal, and territorial health departments in addressing such gaps.</text></subparagraph><subparagraph id="HF16DA5CEC6EE497F91A1582266BA8D6E" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">Information on ways for State, local, Tribal, and territorial health departments to establish and maintain the contact tracing and surveillance activities described in subparagraphs (A) and (B). </text></subparagraph><subparagraph id="HB585A838AE724420BD03166CCBC9573F"><enum>(D)</enum><text display-inline="yes-display-inline">Best practices regarding privacy and cybersecurity protection related to contact tracing, containment, and mitigation efforts. </text></subparagraph></paragraph><paragraph id="H7EC86D1C618242AE9EB4B02C92D9CE0B" commented="no"><enum>(2)</enum><header>Communication</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall identify and publicly announce the form and manner for communication with State, local, Tribal, and territorial health departments for purposes of carrying out the activities addressed by guidance issued under paragraph (1).</text></paragraph></subsection><subsection commented="no" id="HD324F855138A4F218A049371F98C923F"><enum>(b)</enum><header>Labor and workplace related guidance</header><text display-inline="yes-display-inline">Not later than 14 days after the date of enactment of this Act, the Secretary of Labor, acting through the Assistant Secretary of Labor for Occupational Safety and Health, shall provide guidance and technical assistance regarding how to provide individuals in contact tracing and pandemic response positions with healthy and safe working conditions.</text></subsection><subsection id="H7DCF6EDF20D743CD88ACD51158B23023" commented="no"><enum>(c)</enum><header>Ongoing provision of guidance and technical assistance</header><text>Notwithstanding whether funds are available specifically to carry out this Act<italic></italic>, guidance and technical assistance shall continue to be provided under this section.</text></subsection></section><section id="H7E93DAE20F974FD59CFDF016CAB62CD8" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>9.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this Act, $125,000,000,000 to remain available until expended. </text></section></legis-body></bill>
