which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Transportation to promulgate standards and regulations requiring all new commercial motor vehicles to be equipped with technology to limit maximum operating speed, to require existing speed-limiting technologies already installed in commercial motor vehicles manufactured after 1992 to be used while in operation, and to require that the maximum safe operating speed of commercial motor vehicles shall not exceed 65 miles per hour, or 70 miles per hour with certain safety technologies.</official-title></form><legis-body id="HF3E1B23952AA4DFC8A1018C81CAFDD0F" style="OLC"><section id="H3E5FBC66E1BA4DADB35C5D4C03145135" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cullum Owings Large Truck Safe Operating Speed Act of 2021</short-title></quote>.</text></section><section id="HF7DAB8E3428746FCAE65402D04E90B10"><enum>2.</enum><header>Federal motor vehicle safety standard and Federal motor carrier safety regulation for speed-limiting technologies</header><subsection id="H89BE806382F14E54B63CF6B65B76F2BE"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text><paragraph id="H906807E65C2347B8871F0D3E7B1988E3"><enum>(1)</enum><text>according to the Federal Motor Carrier Safety Administration, during the period beginning on January 1, 2004, and ending on December 31, 2013, 10,440 people were killed in motor vehicle crashes in which the speed of a commercial motor vehicle likely contributed to severity;</text></paragraph><paragraph id="H9F7186EFE8CB4D249F27FBD3F19303C3"><enum>(2)</enum><text>a 2007 survey of truck drivers by the Insurance Institute for Highway Safety determined that 64 percent of the drivers were in favor of a speed-limiting requirement;</text></paragraph><paragraph id="H86187FD551354790A062D14E9B209AB9"><enum>(3)</enum><text>according to a 2012 study commissioned by the Federal Motor Carrier Safety Administration, trucks not using a speed-limiting technology had a speed limit-relevant crash rate almost 2 times higher than the rate of trucks using a speed-limiting technology;</text></paragraph><paragraph id="H0A00A706FB304E208B7790014EB8C787"><enum>(4)</enum><text>speed-limiting devices have been required to be installed and used on commercial motor vehicles throughout the world, including in—</text><subparagraph id="H2032C93DC33241F7B7913E8060F472BD"><enum>(A)</enum><text>Australia, which has required the use of those devices since 1990;</text></subparagraph><subparagraph id="HBB25CE4D78B042DBB62741808770E32C"><enum>(B)</enum><text>the United Kingdom, which has required the use of those devices since 1992; and</text></subparagraph><subparagraph id="H7BAF6A830D8F4F0D998AD655C68C764E"><enum>(C)</enum><text>the European Union, which has required the use of those devices since 1994; and</text></subparagraph></paragraph><paragraph id="H3EF0F8C6311D435E96D424B34CBAA37D"><enum>(5)</enum><text>the Department of Transportation has been examining the issues involving speed-limiting technologies since at least 2006.</text></paragraph></subsection><subsection id="HBD08E0B9CB1044D6B2E55A1ECC7B69EF"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H13A1B4F73AA546D89150E4ECC23060C3"><enum>(1)</enum><header>Adaptive cruise control system</header><text>The term <term>adaptive cruise control system</term> means a system on a commercial motor vehicle that is designed—</text><subparagraph id="H3D03184F014D432C95A1C11801D5B6B4"><enum>(A)</enum><text>to maintain a set speed; and</text></subparagraph><subparagraph id="H5E410F8FD4DA40868B2AE89C2AD7EF23"><enum>(B)</enum><text>when applicable, to adjust the set speed to maintain a specified distance from a lead vehicle.</text></subparagraph></paragraph><paragraph id="H96445076B44845D29692CF18675F6A08"><enum>(2)</enum><header>Automatic emergency braking system</header><text>The term <term>automatic emergency braking system</term> means a system on a commercial motor vehicle that—</text><subparagraph id="HC85ED9E6796A46A4A06ED5C9E8A21F1B"><enum>(A)</enum><text>detects potential collisions;</text></subparagraph><subparagraph id="HBD02CB8B001347C0A3AE403030CC66A4"><enum>(B)</enum><text>provides to the driver a warning of each detected potential collision; and</text></subparagraph><subparagraph id="H0F6C2F666E624FC8971AB15C7ACE0581"><enum>(C)</enum><text>applies brakes automatically when a forward collision is imminent.</text></subparagraph></paragraph><paragraph id="H52A8B7767D704922B177A82DB0C5EE3E"><enum>(3)</enum><header>Commercial motor vehicle</header><text>The term <term>commercial motor vehicle</term> means a motor vehicle that—</text><subparagraph id="H2F7C3BE12C53448191F314D1CD092392"><enum>(A)</enum><text>is used in interstate commerce; and</text></subparagraph><subparagraph id="HA1FB2B9432F44E54B130E64CF6320A09"><enum>(B)</enum><text>has a gross vehicle weight rating or a gross vehicle weight of not less than 26,001 pounds.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2919D0F62E514320B71137809375CC0D"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAA50852C0B454BA593E0CE046671F870"><enum>(5)</enum><header>Speed-limiting technology</header><text>The term <term>speed-limiting technology</term> means a technology that prevents a commercial motor vehicle from exceeding a preprogrammed maximum speed.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC14FFCB3D6C24292A20E2DA1D7DC9FAF"><enum>(c)</enum><header>Federal motor vehicle safety standard and motor carrier safety regulation</header><paragraph commented="no" display-inline="no-display-inline" id="H10E918B94B8C4763A08201A29BEBFEA2"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall—</text><subparagraph id="HE2C2B3511FAA483FB7E5C588F0E25C49"><enum>(A)</enum><text>acting through the Administrator of the National Highway Traffic Safety Administration, issue a final rule that—</text><clause id="H4CE0EEB65B9345DE8C45615FB35ACD85"><enum>(i)</enum><text>establishes a Federal motor vehicle safety standard that requires that all commercial motor vehicles manufactured after the effective date of the standard shall be equipped with a speed-limiting technology; and</text></clause><clause id="H89FEA8B7E9CC47439939E545EB5E28A1"><enum>(ii)</enum><text>prescribes performance standards for speed-limiting technologies, automatic emergency braking systems, and adaptive cruise control systems that reduce or mitigate collisions at speeds of not faster than 70 miles per hour; and</text></clause></subparagraph><subparagraph id="H255C8841A2D5468EA15709B7E883A97F"><enum>(B)</enum><text>acting through the Administrator of the Federal Motor Carrier Safety Administration, issue a final rule that establishes a Federal motor carrier safety regulation that requires that any existing speed-limiting technology already installed in a commercial motor vehicle manufactured after December 31, 1992, shall be used at any time during which the commercial motor vehicle is in operation, in accordance with paragraph (2).</text></subparagraph></paragraph><paragraph id="HA81560C96228494393BDE1D7537F0570"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">In issuing a final rule pursuant to paragraph (1), the Secretary shall—</text><subparagraph id="H3004E8B0236A44B1AF3A248DB88ECE62"><enum>(A)</enum><text>include requirements to ensure that each speed-limiting technology—</text><clause id="HF6CEFE779E544986B9E3B6C144B5F346"><enum>(i)</enum><text>accurately measures the speed of the applicable commercial motor vehicle; and</text></clause><clause id="H7A0C40A6D6C14E269C10642996E44B56"><enum>(ii)</enum><text>maintains a maximum speed of not faster than 65 miles per hour, or not faster than 70 miles per hour with the use of an adaptive cruise control system and an automatic emergency braking system, to ensure the safety of commercial motor vehicle drivers and the public, regardless of whether the speed-limiting technology was installed in the commercial motor vehicle—</text><subclause id="H6BD7E01E76C34F519B99048EA6E12F69"><enum>(I)</enum><text>prior to the effective date of the standard or regulation; or</text></subclause><subclause id="H93B42B81606B41A1A8347AE1075ADE69"><enum>(II)</enum><text>for purposes of achieving compliance with the standard under paragraph (1)(A); and</text></subclause></clause></subparagraph><subparagraph id="H01B8F370EA7844CE8A2585423D7CB5BF"><enum>(B)</enum><text>as necessary, amend any Federal motor vehicle safety standards or Federal motor carrier safety regulations to require that all commercial motor vehicles shall travel at a speed of not faster than—</text><clause id="H15A8E04B5E8C4C1192D636460103F65A"><enum>(i)</enum><text>65 miles per hour; or</text></clause><clause id="H02053519F000425E9D93E808ADF9ADEB"><enum>(ii)</enum><text>70 miles per hour with the use of adaptive cruise control systems and automatic emergency braking systems.</text></clause></subparagraph></paragraph><paragraph id="H7FC2D1317067412EA672B55E05E8F66E"><enum>(3)</enum><header>Secretarial review</header><subparagraph id="HB8561700355C43FAA3AECE6E1C6FE2E3"><enum>(A)</enum><header>In general</header><text>Not less frequently than once every 5 years, the Secretary shall conduct a review of all applicable Federal speed-governing regulations, taking into consideration—</text><clause id="HDF6EFAA61CA941F4B877A741D90BE521"><enum>(i)</enum><text>deployed safety technologies available in commercial motor vehicles;</text></clause><clause id="H00DAFAB1519F42D78244595235A5E8B5"><enum>(ii)</enum><text>the overall impact of the safety technologies described in clause (i) on highway safety; and</text></clause><clause id="H6575C2390A584E6B9FE2C17BEC22D5A8"><enum>(iii)</enum><text>available data relating to the use of speed-limiting technologies by commercial motor vehicles.</text></clause></subparagraph><subparagraph id="H5B0FEEC3454B42DFAD9C61BD07A0081A"><enum>(B)</enum><header>Purpose</header><text>The purpose of each review under this paragraph shall be to ensure that proven technologies and data are considered in the context of speed-governing regulations to enhance road safety.</text></subparagraph><subparagraph id="H6D87C02CE386499FB692C9678CACDEF7"><enum>(C)</enum><header>Recommendations; publication</header><text>On conclusion of each review under this paragraph, the Secretary shall—</text><clause id="HD382EA1D73964DF2BBD77F1230EBFE81"><enum>(i)</enum><text>submit to Congress recommendations for improvement of Federal speed-governing regulations, if any; and</text></clause><clause id="HDD32BD2F472A4046816AFC5DE945AD69"><enum>(ii)</enum><text>publish and provide an opportunity for public comment regarding the findings of the review and recommendations, if any.</text></clause></subparagraph></paragraph></subsection><subsection id="H0DE5A518D21E41F68E70CFD28F873632"><enum>(d)</enum><header>Implementation</header><paragraph id="H6EBBCF2C46394DE1B5BAD935150C7F4A"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, each commercial motor vehicle that is subject to the standard established under subsection (c)(1)(A) shall ensure that a speed-limiting technology establishes and maintains for the commercial motor vehicle a maximum safe speed of not faster than—</text><subparagraph id="H86331740DC0949D580A9CE25F7D75C1F"><enum>(A)</enum><text>65 miles per hour; or</text></subparagraph><subparagraph id="H67CD976D531F4C95A4A73C6A7E5B5E79"><enum>(B)</enum><text>70 miles per hour with the use of an adaptive cruise control system and an automatic emergency braking system.</text></subparagraph></paragraph><paragraph id="H83D2442AD5DE4ED59D102442DD2FAA81"><enum>(2)</enum><header>Verification of compliance with requirements</header><text>The owner of each commercial motor vehicle subject to a requirement under this section shall verify, and submit to the Secretary a certification of, compliance with the requirement at such time and in such manner as the Secretary may establish, by regulation.</text></paragraph></subsection></section></legis-body></bill>
