<section id="H0FDC27259E8F47B08543678F1294F71C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Greenhouse gas Reduction and Environmental Enhancement through New Ferries Act</short-title></quote> or the <quote><short-title>GREEN Ferries Act</short-title></quote>. </text></section> <section id="H3E862D3830F04825A729122B5AEFA45F" section-type="subsequent-section"><enum>2.</enum><header>Passenger ferry grants</header> <subsection id="H81F9D73ECF0E4BBCBDDEFE728325B0F9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5307(h) of title 49, United States Code, is amended by adding at the end the following paragraph:</text>

<paragraph id="HDC64CD731F9C44C5BAA1560D6501890D"><enum>(4)</enum><header>Zero-emission or reduced-emission grants</header>
<subparagraph id="HE7B05AA4A4C04BF3A70069D528E9445B"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text> <clause id="H0E1DB54BF8BE4297AE08DD6CAA253A2A"><enum>(i)</enum><header>Eligible project</header><text>The term <term>eligible project</term> means a project or program of projects in an area eligible for a grant under subsection (a) for—</text>
<subclause id="HB2C3D127240148E9926342D5EF448CA1"><enum>(I)</enum><text display-inline="yes-display-inline">acquiring zero- or reduced-emission passenger ferries;</text></subclause> <subclause id="H1BA5CD5AED1C4B5295DEB2B10615E0DB"><enum>(II)</enum><text display-inline="yes-display-inline">leasing zero- or reduced-emission passenger ferries;</text></subclause>
<subclause id="H87D9588E7744410DB9A693BBDDD0B36D"><enum>(III)</enum><text display-inline="yes-display-inline">constructing new vessels, facilities, and related equipment for zero- or reduced-emission passenger ferries;</text></subclause> <subclause id="HA437DADB71D345029B6E75FB29BD238D"><enum>(IV)</enum><text display-inline="yes-display-inline">leasing facilities and related equipment for zero- or reduced-emission passenger ferries;</text></subclause>
<subclause id="H4E802ED27A3A44A2A6F98B30F46FAE76"><enum>(V)</enum><text display-inline="yes-display-inline">constructing new public transportation facilities to accommodate zero- or reduced-emission passenger ferries;</text></subclause> <subclause id="H2689519C596C47F088A3327967FA1FEF"><enum>(VI)</enum><text display-inline="yes-display-inline">constructing shoreside ferry charging or fueling infrastructure for zero- or reduced-emission passenger ferries; or</text></subclause>
<subclause id="HA1F810AF7A864480ABD22CF72A19CAEC"><enum>(VII)</enum><text display-inline="yes-display-inline">rehabilitating or improving existing public transportation facilities to accommodate zero- or reduced-emission passenger ferries. </text></subclause></clause> <clause id="HD775E11380F449BE9E331DC3E63A4D6C"><enum>(ii)</enum><header>Zero- or reduced-emission passenger ferry</header> <subclause id="H572BC2163CBA4600BE140E23402F8A2B"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>zero- or reduced-emission passenger ferry</quote> means a passenger ferry used to provide public transportation that reduces operational lifecycle emissions by at least 75 percent through the use of eligible technologies and fuels, that may include utilizing onboard energy storage systems or alternative fuels, hybrid-electric or 100 percent electric propulsion, related shoreside charging or fueling infrastructure, and other technologies deployed under normal operation.</text></subclause></clause>
<clause id="H021896CFAF8D434B86D1D38FB1A37E97"><enum>(iii)</enum><header>Recipient</header><text>The term <term>recipient</term> means a designated recipient, a local government authority, or a State that receives a grant under subsection (a).</text></clause></subparagraph> <subparagraph id="H1AC2ABFDB7DA48A9903EC6E0C0A0CAC8"><enum>(B)</enum><header>General authority</header><text>The Secretary may make grants to recipients to finance eligible projects under this paragraph.</text></subparagraph>
<subparagraph id="H8B3ABAB6B82B4E22A7FA79EE21A51312"><enum>(C)</enum><header>Grant requirements</header><text display-inline="yes-display-inline">A grant under this paragraph shall be subject to the same terms and conditions as a grant under subsection (a).</text></subparagraph> <subparagraph id="HA22ACDA144774097BB2B31A59C491A69"><enum>(D)</enum><header>Competitive process</header><text display-inline="yes-display-inline">The Secretary shall solicit grant applications and make grants for eligible projects under this paragraph on a competitive basis.</text></subparagraph>
<subparagraph id="H480F6E29A65F4DB18698718FA54D9E54"><enum>(E)</enum><header>Government Share of Costs</header>
<clause id="H0859A91935CF47BCAA6BA8FE478F29C2"><enum>(i)</enum><header>In general</header><text>The Federal share of the cost of an eligible project carried out under this paragraph shall not exceed 80 percent.</text></clause> <clause id="H762FFF9BE0614B39AA687ED77F21F83E"><enum>(ii)</enum><header>Non-Federal share</header><text>The non-Federal share of the cost of an eligible project carried out under this subsection may be derived from in-kind contributions.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H1FFF4A730F6943E48FBAF5EC7A312F12"><enum>(b)</enum><header>Set aside</header><text>Section 5336(h)(1) of title 49, United States Code, is amended to read as follows: </text> <quoted-block style="USC" id="H0CD67EAEC616494D883CB801002B41FD" display-inline="no-display-inline"> <paragraph id="HD40D1EA79EDF448F8CA0D24BE55910E7"><enum>(1)</enum><text display-inline="yes-display-inline">to carry out section 5307(h)—</text>
<subparagraph id="HD1DC14711AE24DB186A3190C70D20762"><enum>(A)</enum><text display-inline="yes-display-inline">$60,906,000 shall be set aside in fiscal year 2022, of which, not less than $20,000,000 shall be used to make grants under section 5307(h)(4);</text></subparagraph> <subparagraph id="H0CFB3777D99642EA9FFE8CA97187DE3F"><enum>(B)</enum><text display-inline="yes-display-inline">$61,856,134 shall be set aside in fiscal year 2023, of which, not less than $20,000,000 shall be used to make grants under section 5307(h)(4);</text></subparagraph>
<subparagraph id="H1242A796CA2B4C7F9C230153E6D5B8B5"><enum>(C)</enum><text display-inline="yes-display-inline">$62,845,832 shall be set aside in fiscal year 2024, of which, not less than $20,000,000 shall be used to make grants under section 5307(h)(4); and</text></subparagraph> <subparagraph id="H32096408D42249049562D99DB10447E6"><enum>(D)</enum><text display-inline="yes-display-inline">$63,832,511 shall be set aside in fiscal year 2025, of which, not less than $20,000,000 shall be used to make grants under section 5307(h)(4);</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
