R. 3507</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210525">May 25, 2021</action-date><action-desc><sponsor name-id="J000304">Mr. Jackson</sponsor> (for himself, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, <cosponsor name-id="F000246">Mr. Fallon</cosponsor>, <cosponsor name-id="N000190">Mr. Norman</cosponsor>, <cosponsor name-id="H001084">Ms. Herrell</cosponsor>, <cosponsor name-id="D000616">Mr. DesJarlais</cosponsor>, <cosponsor name-id="M001212">Mr. Moore of Alabama</cosponsor>, <cosponsor name-id="M001199">Mr. Mast</cosponsor>, <cosponsor name-id="G000552">Mr. Gohmert</cosponsor>, <cosponsor name-id="R000103">Mr. Rosendale</cosponsor>, <cosponsor name-id="R000614">Mr. Roy</cosponsor>, and <cosponsor name-id="G000578">Mr. Gaetz</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 10, United States Code, to prohibit the rescission of a military decoration except under certain circumstances.</official-title></form><legis-body id="H2957FF3594CF4F529ACA17E816F6812F" style="OLC"><section id="HE9D37666339145CEA91E7CEF1C5BDCE0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Cancel Culture from Degrading Honor Act</short-title></quote>.</text></section><section id="H7781120E3C2445D99CED241BB40F00C0" section-type="subsequent-section"><enum>2.</enum><header>Prohibition of rescission of a military decoration except under certain circumstances</header><text display-inline="no-display-inline">Section 1136 of title 10, United States Code, is amended—</text><paragraph id="H5B31B5EF10C048938DC9F633854B941C"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote><header-in-text level="subsection" style="USC"><enum-in-header>(a) </enum-in-header></header-in-text><header-in-text level="subsection" style="USC">In general.—</header-in-text></quote> before <quote>No</quote>; and</text></paragraph><paragraph id="H17E2540BFD0949198DEC676F80C0473D"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="USC" id="HABB2E662717C43B3AE5A17309EC20517" display-inline="no-display-inline"><subsection id="H24D8DDA735A648A0A80ECE601D84546A"><enum>(b)</enum><header>Rescission of military decoration: prohibition; exceptions</header><text display-inline="yes-display-inline">The Secretary concerned may not rescind the award of a military decoration described in subsection (a) after the day that is 10 years after the date of such award except in the following circumstances:</text><paragraph id="H388CABFF621045459CBE7D78311FE7C0"><enum>(1)</enum><text>Such award was based on fraud or other misinformation.</text></paragraph><paragraph id="HC9328E1B41A0415F8DEF18CAD69DF87E"><enum>(2)</enum><text display-inline="yes-display-inline">The individual awarded such decoration is prohibited from interment or memorialization in the National Cemetery Administration or Arlington National Cemetery under section 2411 of title 38.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
