R. 3502</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210525">May 25, 2021</action-date><action-desc><sponsor name-id="H001082">Mr. Hern</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title IV of the Social Security Act to prevent the child care cliff and increase parental choice for low-income families, and for other purposes.</official-title></form><legis-body id="H5F733C36712B4C68AD42D23479A3E223" style="OLC"><section id="HF3EBB8C6B8314C08B3372540E40F8F09" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Increasing Parent Choice and Preventing the Child Care Cliff Act of 2021</short-title></quote>.</text></section><section id="H58367303F50840958B7EFF08E925BE87"><enum>2.</enum><header>Preventing the child care cliff</header><text display-inline="no-display-inline">Section 418 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/618">42 U.S.C. 618</external-xref>) is amended by redesignating subsection (d) as subsection (e) and inserting after subsection (c) the following:</text><quoted-block style="OLC" id="HED0329FE9D7541DE84CBC0D025666992" display-inline="no-display-inline"><subsection id="HACED0F61775F4170BA3FFFE820FEEE25"><enum>(d)</enum><header>Grant condition</header><text display-inline="yes-display-inline">As a condition of receiving a grant under this subsection, a State shall have policies and procedures in place to provide a graduated phase-out of child care assistance for parents—</text><paragraph id="H2901EDDAB6B7455F8256E85C0C2DA99E"><enum>(1)</enum><text>who are working or attending a job training or educational program; and</text></paragraph><paragraph id="H8548135E43814AE594856A89F1CC8ACF"><enum>(2)</enum><text>whose family income exceeds the income limit established by the State for initial qualification for child care assistance and does not exceed 85 percent of the State median income for a family of the same size.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HA01D284CF94E4A4B8A5ADCC1F641D8E8"><enum>3.</enum><header>Increasing parent choice for low-income families</header><text display-inline="no-display-inline">With respect to each of fiscal years 2022 and 2023, the percentage set forth in section 418(b)(2) of the Social Security Act is deemed to be 100 percent.</text></section></legis-body></bill>
