<official-title display="yes">To direct the Secretary of Commerce to establish within the Bureau of Economic Analysis of the Department of Commerce a China Economic Data Coordination Center.</official-title>

<section id="H98B41206DBD64878BC249BA54A91B7F7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Documenting Adversarial Trade Aggression Act</short-title></quote> or <quote><short-title>DATA Act</short-title></quote>.</text></section> <section id="H803D3B0E95E1419A942E147767289EAC"><enum>2.</enum><header>China Economic Data Coordination Center</header> <subsection id="H56E15F5FDA56452CA065B40C489308D7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Commerce, in coordination with the Secretary of the Treasury, shall establish within the Bureau of Economic Analysis of the Department of Commerce a China Economic Data Coordination Center (in this section referred to as the <quote>Center</quote>). </text></subsection>
<subsection id="HE0D4448D2B804EBDA630E2CECEB8BEF2"><enum>(b)</enum><header>Duties</header><text>The Center, in coordination with the heads of other relevant Federal agencies and the private sector, shall collect and synthesize official and unofficial Chinese economic data on developments in China’s financial markets and United States exposure to risks and vulnerabilities in China’s financial system, including—</text> <paragraph id="H2286704C281A4C0680CDF9F97DE12197"><enum>(1)</enum><text>data on baseline economic statistics such as gross domestic product (GDP) and other indicators of economic health;</text></paragraph>
<paragraph id="HCE248C9E13574D03B93C1BF98EAB4706"><enum>(2)</enum><text>data on national and local government debt;</text></paragraph> <paragraph id="H3AB8C9B258CB4B86822977DD55096C84"><enum>(3)</enum><text>data on nonperforming loan amounts;</text></paragraph>
<paragraph id="H135913AFAC4C4CF0AEEFF3BAF4ACFD06"><enum>(4)</enum><text>data on the composition of shadow banking assets;</text></paragraph> <paragraph id="HB5E7553AE2F54451A6626E2C13EF7B2F"><enum>(5)</enum><text>data on the composition of China’s foreign exchange reserves;</text></paragraph>
<paragraph id="HA37FD6F8A00D473F859D59E116FC54A6"><enum>(6)</enum><text>data on bank loan interest rates;</text></paragraph> <paragraph id="HC1C7D22EF4DA4055804780CBCBB74E24"><enum>(7)</enum><text>data on United States retirement accounts tied to Chinese investments;</text></paragraph>
<paragraph id="H2C475EA8E52D4230A8BDE988D2426527"><enum>(8)</enum><text display-inline="yes-display-inline">data on China’s exposure to foreign borrowers and flows of official financing for China’s Belt and Road Initiative and other trade-related initiatives, including data from the Export-Import Bank of China, the China Export and Credit Insurance Corporation (Sinosure), and the China Development Bank;</text></paragraph> <paragraph id="H6820B0D49C5E4DE296588C1279F02A4F"><enum>(9)</enum><text>data on sovereign or near-sovereign loans made by China to other countries or guaranteed by sovereign entities; and</text></paragraph>
<paragraph id="H0EC26A0D8CBE46A289C705EE66E0D849"><enum>(10)</enum><text>data on Chinese domestic retirement accounts and investments.</text></paragraph></subsection> <subsection id="HB3D9A5C4F00F45E092D0A70C576328C1"><enum>(c)</enum><header>Briefings</header><text display-inline="yes-display-inline">The Center shall provide to the appropriate congressional committees and the private sector on a biannual basis briefings on implementation of the duties of the Center.</text></subsection>
<subsection id="H2CDDFD2C27CC40E9B68B677D06BFFC8F"><enum>(d)</enum><header>Reports and public updates</header>
<paragraph id="H7424D80FE9804088BDEF24AD4C5E7D7D"><enum>(1)</enum><header>Reports</header>
<subparagraph id="H784810649C844FB09F31D77E31926721"><enum>(A)</enum><header>In general</header><text>The Center shall submit to the appropriate congressional committees on a quarterly basis a report in writing on implementation of the duties of the Center.</text></subparagraph> <subparagraph id="H8534CC56AF4541ACB9B6607E967F1B4C"><enum>(B)</enum><header>Matters to be included</header><text display-inline="yes-display-inline">The report required by this subsection shall include—</text>
<clause id="H8C569A2FFE184D84898A618E4EB48E1A"><enum>(i)</enum><text>key findings, data, the research and development activities of the affiliates of United States multinational enterprises operating in China, and a description of the implications of such activities for United States production, employment, and the economy; and</text></clause> <clause id="HC4AA0433ACE74652AEC5A2B66F3B6C41"><enum>(ii)</enum><text display-inline="yes-display-inline">a description of United States industry interactions with Chinese state-owned enterprises and other state-affiliated entities and inbound Chinese investments.</text></clause></subparagraph></paragraph>
<paragraph id="HDDABB509C9B345A0BB4251C3ABF74BEF"><enum>(2)</enum><header>Public updates</header><text display-inline="yes-display-inline">The Center shall provide to the public on a monthly basis updates on implementation of the duties of the Center.</text></paragraph></subsection> <subsection id="HBF695043EA444696B7CDC0770DCC0CCF"><enum>(e)</enum><header>Recommendations and strategies</header><text display-inline="yes-display-inline">The Secretary of the Treasury, using data collected and synthesized by the Center under subsection (b) and in consultation with the Center, shall—</text>
<paragraph id="H730976451196457D9D8905CBABDC5F51"><enum>(1)</enum><text>develop recommendations and strategies for ways in which the United States can respond to potential risks and exposures within China’s financial system; and</text></paragraph> <paragraph id="HB8D9B8780DE440F3B7B7A77CF1F17F46"><enum>(2)</enum><text>submit to the appropriate congressional committees a report that contains such recommendations and strategies.</text></paragraph></subsection>
<subsection id="H2DF76CFF35D84210AE9F6614AD17EBFC"><enum>(f)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text> <paragraph id="H521468943A26453788F2DAEB3FAAFEB8"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs, the Committee on Financial Services, and the Committee on Energy and Commerce of the House of Representatives; and</text></paragraph>
<paragraph id="H13E783A03B404812A95822B29DF440AD"><enum>(2)</enum><text>Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, and the Committee on Commerce, Science, and Transportation of the Senate.</text></paragraph></subsection></section> </legis-body> </bill>
