which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HHA00">House Administration</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require face masks in Federal facilities to prevent the transmission of SARS–CoV–2, and for other purposes.</official-title></form><legis-body id="H4613A53899C141619B569EE915B83232" style="OLC"><section id="HAA5983685E3A4DD7BAB4C7DA3C0EBD4F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wear Your Mask Act</short-title></quote>.</text></section><section id="H6B1ADC76D7A2439AAC46F35F68DB36E1"><enum>2.</enum><header>Masks required in Federal facilities</header><subsection id="H1CF624C5791B48E8A5CE32F091BEAC88"><enum>(a)</enum><header>Masks required</header><text display-inline="yes-display-inline">Each Federal agency shall take action to ensure that an individual is required to wear a face mask if such individual is—</text><paragraph id="HCA8E495BDF8746AC8605F54224155E07"><enum>(1)</enum><text>inside a Federal facility under the jurisdiction of such agency; and</text></paragraph><paragraph id="H5B6067A373244604815A34C546376E02"><enum>(2)</enum><text>within 6 feet of another individual.</text></paragraph></subsection><subsection id="H71C8CF14FDFD444DBFA7BF9D066CE0BF"><enum>(b)</enum><header>Enforcement</header><text>A Federal agency may remove or deny service to an individual who fails to wear a mask in accordance with subsection (a).</text></subsection><subsection id="H73D0D820CA534EBD86339F5CFF36F75B"><enum>(c)</enum><header>Provision of masks</header><text display-inline="yes-display-inline">Each Federal agency shall make face masks available at each entrance to a Federal facility at which such agency maintains a presence.</text></subsection><subsection id="H83080E2804324434BBA3D0BD2D9D8CFD"><enum>(d)</enum><header>Funding</header><text display-inline="yes-display-inline">A Federal agency shall use funds otherwise appropriated to such agency to carry out this section.</text></subsection><subsection id="H7AA61CF6E57448988E51D64142EAE559"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the following definitions apply:</text><paragraph id="HBFAD4F8586B145809F6F9DDC9ED4D576"><enum>(1)</enum><header>Capitol Buildings</header><text display-inline="yes-display-inline">The term <term>Capitol Buildings</term> has the meaning given such term in section 5101 of title 40, United States Code.</text></paragraph><paragraph id="H4F7BA1F963ED4C2BBC707ED5E0EC1C0E" display-inline="no-display-inline"><enum>(2)</enum><header>Face mask</header><text>The term <term>face mask</term> means a mask covering both the nose and mouth that reasonably can be expected to minimize the transmission of SARS–CoV–2.</text></paragraph><paragraph id="H0D6AEC112BC24CF19BA80E2AC7BBFDC1"><enum>(3)</enum><header>Federal agency</header><text display-inline="yes-display-inline">The term <term>Federal agency</term> has the meaning given such term in section 102 of title 40, United States Code, except that with respect to Capitol Buildings, the Office of the Architect of the Capitol shall be treated as the relevant Federal agency.</text></paragraph><paragraph id="HFAA29FD1226B4EC2B8B10835DD127A86"><enum>(4)</enum><header>Federal facility</header><text>The term <term>Federal facility</term> means—</text><subparagraph id="H1F4479D4318A4719A0BCF7ABB06F45B5"><enum>(A)</enum><text>a building or any part thereof owned or leased by the Federal Government for use by a Federal agency; and</text></subparagraph><subparagraph id="HAD846572C7E9421E84C859FEB5ED18D2"><enum>(B)</enum><text>the Capitol Buildings or any part thereof.</text></subparagraph></paragraph></subsection><subsection id="HE20ABB17CF5F4F9B8618F24424F54323"><enum>(f)</enum><header>Termination</header><text display-inline="yes-display-inline">The requirements of this section shall cease to have effect on the date on which the Director of the National Institute of Allergy and Infectious Diseases determines, and publishes in the Federal Register a notification of such determination, that the requirement to wear a mask is no longer necessary to prevent transmission of SARS–CoV–2.</text></subsection></section></legis-body></bill>
