which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To incentivize American workers to seek and accept jobs, to aid the economic recovery by converting Federal pandemic emergency unemployment compensation into back to work bonuses, and for other purposes.</official-title></form><legis-body id="HB9B52C3C99694669ADB67B87856B37A4" style="OLC"><section id="HEF2DBF3DD5C44EBA9D3A93CF339C00A1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Back to Work Bonus Act</short-title></quote>.</text></section><section id="H5F7E70CC558F4755983F4176C12542A8"><enum>2.</enum><header>Back to work bonuses</header><subsection id="H766F1A58E7B144E096A680D74544900F"><enum>(a)</enum><header>In general</header><text>Section 2104(b) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9023">15 U.S.C. 9023(b)</external-xref>) is amended—</text><paragraph id="H503ED93BE35745638AE1F9D02D9EA97A"><enum>(1)</enum><text>by redesignating paragraph (4) as paragraph (5); and</text></paragraph><paragraph id="H09242B3F793A41028E862867D35C704F"><enum>(2)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block id="H1BF846A477D14433BA59D15E448D3804" style="OLC"><paragraph id="H457F0803A50848F2BFD10A0B6B563586"><enum>(4)</enum><header>Back-to-work bonuses</header><subparagraph id="HE0A9CBD2F96A42B69965EC6D319A6853"><enum>(A)</enum><header>In general</header><text>Any agreement under this section may also provide that the State agency of the State may make a lump sum payment to each individual who—</text><clause id="H5969AD6391B14D5F978EE6F9F8D3788C"><enum>(i)</enum><text>was eligible for Federal Pandemic Unemployment Compensation under paragraph (1) for—</text><subclause id="H735F6901B99345F2B7B430FA3FDB21DF"><enum>(I)</enum><text>any week beginning after the date of enactment of the <short-title>Back to Work Bonus Act</short-title>; and</text></subclause><subclause id="H2EB13258E5EA43558E3DEE24F9893EBD"><enum>(II)</enum><text>at least 4 weeks immediately preceding the week under clause (I);</text></subclause></clause><clause id="HC620798CB0754414AD94182691712DB6"><enum>(ii)</enum><text>is no longer eligible for Federal Pandemic Unemployment Compensation under paragraph (1) (as determined by the State), as a result of earnings due to commencing employment with an employer by whom the individual has not been employed during the preceding 6 months; and</text></clause><clause id="HDDCF290409D546D8B8103A68A2DE8F82"><enum>(iii)</enum><text>as verified by the individual’s employer pursuant to subparagraph (E)—</text><subclause id="H809FC26A2A604388BDBA3A3AEC9BD8A2"><enum>(I)</enum><text>has been employed by a non-governmental employer throughout the qualifying period; and</text></subclause><subclause id="H586A3AED47E64EFB8E7FD6EF7A8DECFA"><enum>(II)</enum><text>remains employed with an intent to continue such employment.</text></subclause></clause></subparagraph><subparagraph id="HA6DD8BB1632A4C3B87D213DB5E6AB3DB"><enum>(B)</enum><header>Amount</header><text>A payment made to an individual under this paragraph shall be paid in a lump sum $900.</text></subparagraph><subparagraph id="H3ADE61CCEF2542DEB8268B573DB62D5D"><enum>(C)</enum><header>Qualifying period</header><text>For purposes of this paragraph, the term <term>qualifying period</term> means, with respect to an individual, a period—</text><clause id="H4E441B50E0E549C5A5785FC295EF870A"><enum>(i)</enum><text>beginning on the date the individual commenced employment as described in subparagraph (A)(ii); and</text></clause><clause id="H2CFE8C458F1A42E4B82CBA5B1BB3B9C0"><enum>(ii)</enum><text>extending at least 4 consecutive weeks from such date.</text></clause></subparagraph><subparagraph id="H8A7348CA048343B483042EF457EC3384"><enum>(D)</enum><header>Duration</header><text>A lump-sum payment may not be made to any individual under this paragraph with respect to a qualifying period beginning on or after August 14, 2021.</text></subparagraph><subparagraph id="HED48EA1BD49047ED90F1514CCAA367B4"><enum>(E)</enum><header>Employer verification required for lump-sum payment</header><text>Before making a lump-sum payment to an individual pursuant to this paragraph, a State agency shall require verification from the individual’s employer—</text><clause id="HC0D3A0DB22084E64B02CF6CB2651A8DF"><enum>(i)</enum><text>of the individual’s employment status;</text></clause><clause id="H5BE4B5D5FD8E47A49B49351F13A88603"><enum>(ii)</enum><text>of the wages paid to the individual during the applicable qualifying period; and</text></clause><clause id="H0EE8D003C05F45A3AE73CF8A661581D5"><enum>(iii)</enum><text>of the hours worked by the individual during the qualifying period.</text></clause></subparagraph><subparagraph id="H44814BC5B86048B6B094BA06A997F311"><enum>(F)</enum><header>Limitation</header><text>A State may not provide more than 1 lump-sum payment under this paragraph to an individual.</text></subparagraph><subparagraph id="H646DBA54624E4114A3E46B8104B882B9"><enum>(G)</enum><header>Special rule</header><text>A payment made pursuant to an agreement under this paragraph shall not be considered to violate the withdrawal requirements of section 303(a)(5) or <external-xref legal-doc="usc" parsable-cite="usc/26/3304">section 3304(a)(4)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB30CAE0AE25D4D5285451DD98AC80F6A"><enum>(b)</enum><header>Conforming amendments</header><text>Section 2104 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9023">15 U.S.C. 9023</external-xref>) is amended—</text><paragraph id="H057270BB6F484C2AA0CDCF3DE4150030"><enum>(1)</enum><text>in subsections (d) and (f), by inserting <quote>, payments under subsection (b)(4)</quote> after <quote>Federal Pandemic Unemployment Compensation</quote> each place it appears; and</text></paragraph><paragraph id="HF032FAFB49334EFAAC84A9F831A3E31B"><enum>(2)</enum><text>in subsection (g)—</text><subparagraph id="H4F1410CE5187410391F078248D0742C8"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HC5CB3820527743068B6FFC75CBCA6C3B"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HF37ABFC5E12B45CBAA5A1B53B72930EE"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="H9B2B7D7865CF4690A4686933DDF369E9" style="OLC"><paragraph id="H2D93F628ACDF43639FBAF64AA47F8B62"><enum>(3)</enum><text>the purposes of the preceding provisions of this section, as such provisions apply with respect to payments under subsection (b)(4), shall be applied with respect to unemployment benefits described in subsection (i)(2) to the same extent and in the same manner as if those benefits were regular compensation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="H335476AD38C541F09717E8291F59D864"><enum>3.</enum><header>Sunsetting Federal pandemic unemployment compensation</header><text display-inline="no-display-inline">Section 2104(b)(3)(A)(ii) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9023">15 U.S.C. 9023(b)(3)(A)(ii)</external-xref>) is amended by striking <quote>September 6, 2021</quote> and inserting <quote>the date of enactment of the <short-title>Back to Work Bonus Act</short-title></quote>.</text></section><section id="H0098AD3B66104939BFE9447018BC6D52"><enum>4.</enum><header>Strengthening work search requirements</header><subsection id="HD8185A4E97CD498492AFC22428C77135"><enum>(a)</enum><header>Modifying pandemic unemployment assistance</header><text display-inline="yes-display-inline">Section 2102(a)(3)(A)(ii)(I) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9021">15 U.S.C. 9021(a)(3)(A)(ii)(I)</external-xref>) is amended by striking items (aa) through (kk) and inserting the following:</text><quoted-block style="OLC" id="H49DBD759977D4AEABADAFE4821CAB165" display-inline="no-display-inline"><item id="H87389E3008A24109902BDEBE800CB421"><enum>(aa)</enum><text display-inline="yes-display-inline">the individual has an active infection with COVID–19;</text></item><item id="HC658F105C17440B7820268AE4490D598"><enum>(bb)</enum><text>the individual received an order from a physician to quarantine due to exposure to COVID–19; or</text></item><item id="H9B37E86462D248FFA1FC71B89A59CB7C"><enum>(cc)</enum><text>the individual is caring for a family member or a member of the individual’s household described in items (aa) or (bb); or</text></item><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3EE00E02BF8048E6A0F2EAEB7C16F684"><enum>(b)</enum><header>Conforming amendments</header><text>Section 2102(c) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9021">15 U.S.C. 9021(c)</external-xref>) is amended by—</text><paragraph id="H4E8FAE47195F4AC3A2780E49BCC929E2"><enum>(1)</enum><text>inserting at the end of paragraph (6) the following: <quote>A State shall require proof of active infection or quarantine order required by subsection (a)(3)(A)(ii)(I).</quote>; and</text></paragraph><paragraph id="H0EA15353434647A9B8A3EA0E17121182"><enum>(2)</enum><text>by redesignating paragraphs (5) and (6) as paragraphs (4) and (5), respectively.</text></paragraph></subsection><subsection id="H5CE4AD986EBA4E499F7158E208E40FCD"><enum>(c)</enum><header>Modifying Pandemic Emergency Unemployment Compensation</header><text>Section 2107(a)(7) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9025">15 U.S.C. 9025(a)(7)</external-xref>) is amended by striking subparagraph (B) and inserting the following:</text><quoted-block id="H139CD1B7701A418A82E20B99D21A424B" style="OLC"><subparagraph id="HB6B2E6AA641444DC9C04337E236F2CE9"><enum>(B)</enum><header>Flexibility</header><clause id="H762ECC840B3E4A8CBDEF0D7E0B1765E8"><enum>(i)</enum><text>Notwithstanding the requirements under subparagraph (A) and paragraph (2)(D), a State may provide flexibility in meeting such requirements in case of individuals unable to search for work because—</text><subclause id="H09C7CF4A911A40EF862391F1B71B359E"><enum>(I)</enum><text>the individual has an active infection with COVID–19;</text></subclause><subclause id="H49BA392CCC70483581680CC2F2029D31"><enum>(II)</enum><text>the individual received an order from a physician to quarantine due to exposure to COVID–19; or</text></subclause><subclause id="HFF44289AE7F34030B7F0F7219DA4D508"><enum>(III)</enum><text>the individual is caring for a family member or a member of the individual’s household described in subclause (I) or (II).</text></subclause></clause><clause id="H769F709CEFC549F4A1BFFE3CF126A9C3"><enum>(ii)</enum><text>Prior to providing flexibility under this subparagraph, a State shall require proof of active infection or quarantine order required by subclause (I) or (II).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
