<official-title display="yes">To provide community-based nonprofit feeding and anti-hunger groups with funding to partner with small and mid-sized restaurants to expand meal access and delivery for low-income and vulnerable populations during, and through 1 year following the end of, a pandemic or public health emergency.</official-title>

<section id="H98014EF8664E492786EBEF225716AA9F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Anti-Hunger Pandemic Recovery Act of 2021</short-title></quote>.</text></section> <section id="H06D69DFBC48643FE9FA4F5F8FD0AF8AA"><enum>2.</enum><header>Definitions</header> <paragraph id="H90583C7595E84BCE930B29580EACEFE6"><enum>(1)</enum><header>Vulnerable population</header><text>The term <term>vulnerable population</term> means any person who is a member of the target population, is a low income individual, or receives a means-tested benefit as defined under this Act.</text></paragraph>
<paragraph id="H412533111A22482A8D40C7B884A2A039"><enum>(2)</enum><header>Grab-and-go meal</header><text>The term <term>grab-and-go meals</term> refers to pre-packaged, ready to eat food that has been prepared and cooked no greater than 8 hours prior to being sealed or enclosed in a container.</text></paragraph> <paragraph id="HFA46BCAC81114DC89943D478955076DA"><enum>(3)</enum><header>Target population</header><text>The term <term>target population</term> includes an individual who (or family that)—</text>
<subparagraph id="HA38F1EEBCD814A018A4333B2DCAB805F"><enum>(A)</enum><text>earns an income below 200 percent of the Federal poverty line;</text></subparagraph> <subparagraph id="H9C70C1AA0D224C69A1218E5247C798D7"><enum>(B)</enum><text>suffers from food insecurity;</text></subparagraph>
<subparagraph id="H789B2B5A03CE45B999EB5F21344287DF"><enum>(C)</enum><text>is homeless;</text></subparagraph> <subparagraph id="H9762D955C4204F84801B10BB14BB111D"><enum>(D)</enum><text>receives (or recently received) assistance under a State program funded under part A of title IV of the Social Security Act (42 U.S.C. et seq.), relating to temporary assistance to needy families; or</text></subparagraph>
<subparagraph id="H9993722412484897ADB257956C64C2EB"><enum>(E)</enum><text>is eligible for benefits under any nutrition assistance or anti-poverty program.</text></subparagraph></paragraph> <paragraph id="H7814AB1FA0C740FDB8C0545C0A9A540B"><enum>(4)</enum><header>Community-based nonprofit feeding and anti-hunger group</header><text>The term <term>community-based nonprofit feeding and anti-hunger group</term> means an anti-hunger organization, food bank, food pantry, soup kitchen, food rescue group, or community food security organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code.</text></paragraph>
<paragraph id="HBB4289767E0643BD9D0A8818B45F8931"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph> <paragraph id="H76A861FBA14742738A71BB8DAC51B1B5"><enum>(6)</enum><header>Low-income individual</header><text>The term <term>low-income individual</term> means, with respect to any calendar year, any individual who lives in a household that has a gross income that does not exceed 300 percent of the poverty line, as defined in section 673(2) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902(2)</external-xref>).</text></paragraph>
<paragraph id="HD27707B0B7264CB4A08A47311C8DB186"><enum>(7)</enum><header>Homeless</header><text>The term <term>homeless</term> has the meaning given such term in subtitle B of title VII of the McKinney-Vento Act and the Housing and Urban Development (HUD) definition in section 103 of subtitle I of the McKinney-Vento Act.</text></paragraph> <paragraph id="H2712889218A94C5D93F0CF31949AE151"><enum>(8)</enum><header>Crisis housing</header><text>The term <term>crisis housing</term> means a supervised publicly or privately operated shelter designated to provide temporary living arrangements (including hotels and motels paid for by Federal, State, or local government programs for low-income individuals or by charitable organizations, congregate shelters, and transitional housing).</text></paragraph>
<paragraph id="H04477CECF942480987D9518EC9323295"><enum>(9)</enum><header>Means-tested benefit</header><text>The term <term>means-tested benefit</term> means a mandatory spending program of the Federal Government for which, as determined by the Secretary, eligibility for the program’s benefits, or the amount of such benefits, is determined on the basis of income or resources of the individual or family seeking the benefit.</text></paragraph> <paragraph id="HF234A94960D04336875CF18C9C214E2D"><enum>(10)</enum><header>Dependent</header><text>The term <term>dependent</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/26/152">section 152</external-xref> of the Internal Revenue Code of 1986, except that the term also includes an individual who is not a citizen or national of the United States if such individual would otherwise be considered a dependent pursuant to such section if such individual were a citizen or national of the United States.</text></paragraph>
<paragraph id="H99805916D0F640B79BA0843FF867395C"><enum>(11)</enum><header>Disaster declaration</header><text>The term <quote>disaster declaration</quote> means—</text> <subparagraph id="H849E8167BEE9420BA6B9CCF3018C96CB"><enum>(A)</enum><text>an emergency involving Federal primary responsibility determined to exist by the President under section 501(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191(b)</external-xref>);</text></subparagraph>
<subparagraph id="HE3E282AB18454E38979A007C440C1DCE"><enum>(B)</enum><text>a national emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>);</text></subparagraph> <subparagraph id="HC1DCA87225EB43A29BA824163DF22EF3"><enum>(C)</enum><text>an emergency declared by a Federal official with respect to coronavirus (as defined in section 506 of the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/123">Public Law 116–123</external-xref>));</text></subparagraph>
<subparagraph id="HBAB02276C98045F487936CA28FAB46B1"><enum>(D)</enum><text>a public health emergency declared by the Secretary of Health and Human Services pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247">42 U.S.C. 247(d)</external-xref>) with respect to COVID–19 or any other coronavirus with pandemic potential; or</text></subparagraph> <subparagraph id="H29E0C3FBF9254FBE8345DF9FC4CF9232"><enum>(E)</enum><text>the instance a Governor requests a major disaster declaration under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>).</text></subparagraph></paragraph>
<paragraph id="H0A5663C818194B2F941FEB3B1020BB8B"><enum>(12)</enum><header>Temporary community need</header><text>The term <term>temporary community need</term> means prepared meals during the time period under which a disaster declaration is provided. Such community need shall terminate 3 years after the termination of such declaration.</text></paragraph> <paragraph id="HBDE2D7DCCE7E4FC9BE17541975C9C79B"><enum>(13)</enum><header>Pandemic</header><text>The term <term>pandemic</term> means a communicable disease for which the Federal Government has issued a travel alert or travel warning.</text></paragraph></section>
<section id="HD3CD54036A4A4FF487243D5A9D46C0EF"><enum>3.</enum><header>Anti-hunger pandemic recovery fund</header>
<subsection id="H6BB23C6C09F54CB0881DC9C39E5E6902"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant to address temporary community needs under this section, a community-based nonprofit feeding and anti-hunger group shall submit to the Secretary an application that contains a description of how the applicant proposes to use the grant funds to implement the components of the temporary grant program listed in subsection (b). The application shall be submitted in such form, at such time, and containing such other information as the Secretary may require.</text></subsection> <subsection id="HA4340441999A4D27843DE7ABB3703EE7"><enum>(b)</enum><header>Anti-Hunger pandemic recovery grant program components</header><text display-inline="yes-display-inline">An application for a grant under this section shall contain an assurance that the applicant will expand the capacity of community-based nonprofit feeding and anti-hunger groups and schools to meet the needs of children, families, and vulnerable populations in a pandemic by—</text>
<paragraph id="HAA82CBF3C4E34C8ABAB46B3661645BBA"><enum>(1)</enum><text>contracting with small and mid-sized business restaurants or small and mid-sized food contractors that are small business concerns as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>) for—</text> <subparagraph id="H711B06E072A24B5E9351BF2FB4464EB0"><enum>(A)</enum><text>preparing, cooking, and storing grab-and-go meals;</text></subparagraph>
<subparagraph id="HEB308517027542F7AF8FE1B13576D424"><enum>(B)</enum><text display-inline="yes-display-inline"> serving meals to vulnerable populations or make them available for pick up, or distributed in high poverty areas designated by State and local agencies;</text></subparagraph> <subparagraph id="HF3F2E406AEFA4167AC6ACF0BD3B20D2C"><enum>(C)</enum><text> bolstering food security for children, dependents, families, and the elderly in rural and hard to reach communities;</text></subparagraph>
<subparagraph id="H6EF6F3142D1440BAA4826D2A4FAA9E3F"><enum>(D)</enum><text>bolstering food security for dependents, target populations, and families in crisis housing; and</text></subparagraph> <subparagraph id="HD1DD1A83C34A4530BF4D2363A64EE179"><enum>(E)</enum><text>improving the nutrition of vulnerable populations.</text></subparagraph></paragraph></subsection>
<subsection id="H9307224498344BD4AA461DF209B2A5D5"><enum>(c)</enum><header>Criteria</header><text>In evaluating an application of a community-based nonprofit feeding and anti-hunger group to receive a grant, the Secretary shall consider criteria as the Secretary determines appropriate.</text></subsection> <subsection id="H322B438C6BF849E28B7F361C3E83255A"><enum>(d)</enum><header>Grant administration</header> <paragraph id="HC94BA97076A847CBB3BC6F939813FD11"><enum>(1)</enum><header>Amount</header><text>A grant awarded under this section may not exceed $500,000.</text></paragraph>
<paragraph id="H4E88B13C75E0445984B8B393E28E86F9"><enum>(2)</enum><header>Renewals</header>
<subparagraph id="HD8BD6EDBD5AC420BB30762C148CBB142"><enum>(A)</enum><header>In general</header><text>The Secretary may renew a grant awarded under this section with respect to an eligible entity if the entity—</text> <clause id="HF7F830DF32B54F3EA70DA3A0828E5E28"><enum>(i)</enum><text>submits to the Secretary an application for renewal at such time, in such manner, and containing such information as the Secretary may require; and</text></clause>
<clause id="H528531589E644CB396F2E014DA90006A"><enum>(ii)</enum><text>demonstrates in such application that—</text> <subclause id="H17C16DFCE3EE4F3E8C7EC34378C461AC"><enum>(I)</enum><text>grant, contract, or cooperative agreement funds made available to the entity were used in a manner required under the most recently approved application of the entity under this section; and</text></subclause>
<subclause id="HFA80DCFFA7E04BF69F4A9D6661EC4AC8"><enum>(II)</enum><text>the entity has made progress in achieving the objectives of the initial application approved for the entity under this section.</text></subclause></clause></subparagraph> <subparagraph id="HC57BA1A7D2EF4BA9929DB3BACF4A1F79"><enum>(B)</enum><header>Duration</header><text>A grant shall be eligible for renewal so long as a disaster declaration is active on the date of the renewal application.</text></subparagraph></paragraph></subsection>
<subsection id="HE7CD87FED6D04F48927E396F034F53AD" display-inline="no-display-inline"><enum>(e)</enum><header>Supplement, not supplant, requirement</header><text>A grant, contract, or cooperative agreement made under this Act shall be expended to supplement, and not supplant, the expenditures of the eligible entity involved and the value of in-kind contributions.</text></subsection> <subsection id="HB5D0C5398C0D4268928DB534849789FB"><enum>(f)</enum><header>Administration of grants</header><text display-inline="yes-display-inline">Grants made under this section shall be administered through the National Institute of Food and Agriculture.</text></subsection></section>
<section id="HAB1FC9E8B7E741CE8A77109ED91F6673"><enum>4.</enum><header>Authorization of appropriations</header>
<subsection id="H813D51D8B6354E219CD9048A437A7BFF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section “$2,000,000,000 for fiscal year 2022.</text></subsection> <subsection id="H5928424B0B0C44E8B9BFCB0940CAC82F"><enum>(b)</enum><header>Availability</header><text>Funds appropriated under subsection (a) shall remain available until expended.</text></subsection></section>
<section id="HC175752564AF4897B2B6172ACDA3834C"><enum>5.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to limit a community-based nonprofit feeding and anti-hunger group from receiving a grant under this Act for any vulnerable population otherwise served by such group with other Federal funds.</text></section> <section id="H156C6A5407E64C349F7BFC505F8A877A"><enum>6.</enum><header>Reporting requirements</header> <subsection id="HECF83A456AD24ACE97238A0ACA368C86"><enum>(a)</enum><header>Best practices</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall develop and publish a report on the best practices for community-based nonprofit feeding and anti-hunger groups to do business with the Department of Agriculture, including how to register with the Federal system of award management (SAM), how to obtain and validate a Federal Data Universal Number System (DUNS), and how to apply for a grant under section 3. Such report shall be available for public review and inspection on the public websites of the Department of Agriculture.</text></subsection>
<subsection id="H080BC6FE3D984318B0C34C3A62E6D2A1"><enum>(b)</enum><header>Grantees</header><text>Not later than 3 years after the date of the enactment of this Act, an eligible entity that receives a grant under this Act shall submit to the Secretary a report that contains an evaluation of the results of the activities, including financial expenditures, made during such fiscal year to carry out the program for which such grant is received and any other data the Secretary determines to be necessary for an evaluation of the benefits of the grants awarded under this Act.</text></subsection> <subsection id="H5D34249EA356479E991029FB0B60217F"><enum>(c)</enum><header>Annual reports to congress</header><text>Not later than 4 years after the date of the enactment of this Act, the Secretary shall submit to the Committee on Agriculture of the House of Representatives a report describing—</text>
<paragraph id="HC4CF4BB10A8E42C89D407678EDAFDC90"><enum>(1)</enum><text>each grant application received under this Act;</text></paragraph> <paragraph id="H61521A4E15CE4685891AE888BA2FE622"><enum>(2)</enum><text>any grants awarded under this Act, including—</text>
<subparagraph id="HAA09622EF2B547A6AB07AACBA9A58E16"><enum>(A)</enum><text>the name and location of the eligible entity; </text></subparagraph> <subparagraph id="H0747003E06354782B2742C9AD440EB9E"><enum>(B)</enum><text>the total amount of the grant; </text></subparagraph>
<subparagraph id="HD9A2B2AAB03D4882971B1139739A3752"><enum>(C)</enum><text>the date on which the grant was awarded; and</text></subparagraph> <subparagraph id="HB86BF369B6264881B83A1E6F1FC3B68F"><enum>(D)</enum><text>information from reports received under subsection (b); and</text></subparagraph></paragraph>
<paragraph id="H0AD7F927DADE48849DDA19862A4D82D7"><enum>(3)</enum><text>any other data the Secretary determines to be necessary for an evaluation of benefits of the grants awarded under this Act.</text></paragraph></subsection></section> </legis-body> </bill>
