<section id="H3C249BA9B6AF4121B307761D1BF3E7D4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Permanency for Audio-Only Telehealth Act</short-title></quote>.</text></section> <section id="H44893B332BB14ADD8DC3A05FEADB7DDA"><enum>2.</enum><header>Expanding accessibility to certain telehealth services under the Medicare program</header> <subsection id="H011FEEFDA6BF4E7A8D8A358062AAE174"><enum>(a)</enum><header>Use of audio-Only telecommunications systems for certain services</header><text display-inline="yes-display-inline">Section 1834(m)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="HF5EF5D9A1BAD47C58650F02B9B487384"><enum>(G)</enum><header>Telecommunications system</header>
<clause id="HD020BAEF5717457FA7EEFE67FD124AEB"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>telecommunications system</quote> includes, in the case of a qualified provider (as defined in clause (ii)) furnishing a specified telehealth service (as defined in such clause) to an individual, a communications system consisting only of audio capabilities, but only if such individual elects to use such system in lieu of a communications system providing both audio and visual capabilities.</text></clause> <clause id="H1320A3C4F9444BAA997CFAD8C3380593"><enum>(ii)</enum><header>Definitions</header><text>For purposes of clause (i):</text>
<subclause id="H9EDEC5CDEA4C4C2CB07EC066D2CC4125"><enum>(I)</enum><header>Qualified provider</header><text>The term <quote>qualified provider</quote> means, with respect to a telehealth service furnished to an individual, a physician or practitioner who—</text> <item id="HEDBB1F23764840B78C12D6D83ADDD8E5"><enum>(aa)</enum><text display-inline="yes-display-inline">furnished to such individual an item or service (other than such telehealth service) in-person, or through a communications system consisting of both audio and visual capabilities, during the 3-year period ending on the date such telehealth service was furnished; or</text></item>
<item id="HB097CD12D540487F862FD1CB7D78545C"><enum>(bb)</enum><text>is in the same practice (as determined by tax identification number) of a physician or practitioner described in item (aa).</text></item></subclause> <subclause id="H50433F3C929D4E218632B142A9970074"><enum>(II)</enum><header>Specified telehealth service</header><text>The term <quote>specified telehealth service</quote> means a telehealth service consisting of—</text>
<item id="H73497BBB812A49EAA8388819E8E08FD3"><enum>(aa)</enum><text>evaluation and management services;</text></item> <item id="H10F8226514E14D05B41B003044BDF483"><enum>(bb)</enum><text>mental and behavioral health services;</text></item>
<item id="H44A8651D025341A9828C82B6C46AC789"><enum>(cc)</enum><text>substance use disorder services; or</text></item> <item id="H5C239544D75A40AFB02CFA9C57E88554"><enum>(dd)</enum><text>any other service specified by the Secretary.</text></item><continuation-text continuation-text-level="subclause">Such term does not include communication of lab results from a physician or practitioner to an individual via a telecommunications system unless such communication involves a diagnosis of such individual based on such results or the prescription, or modification of a prescription, of a drug based on such results.</continuation-text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H1ADA0E12BF894CE79D4E47B1DC3CCD48"><enum>(b)</enum><header>Nonapplication of originating site requirements with respect to telehealth services under Medicare program</header><text>Section 1834(m)(4)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)</external-xref>) is amended—</text> <paragraph id="HECC69DE285D741A8AF32B1D68010203C"><enum>(1)</enum><text>in clause (i), by inserting before <quote>paragraphs (5), (6), and (7)</quote> the following: <quote>clause (iii) and</quote>; and</text></paragraph>
<paragraph id="H1E404AF23EE74D4F80FF1EE0FFFA894B"><enum>(2)</enum><text>by adding at the end the following new clause:</text> <quoted-block style="OLC" id="H704C36DB195B491FA1D832D06AC0AE1A" display-inline="no-display-inline"> <clause id="H4F6505C065CC49DA8821294599EA5C2C"><enum>(iii)</enum><header>Nonapplication of originating site requirements</header><text display-inline="yes-display-inline">Beginning on the first day of the emergency period described in section 1135(g)(1)(B), the term <term>originating site</term> means any site at which the eligible telehealth individual is located at the time the service is furnished via a telecommunications system.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H98258D3415344D428BE42AEF920056D6"><enum>(c)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to telehealth services furnished after the last day of the emergency period described in section 1135(g)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>). </text></subsection></section> </legis-body> </bill>
