R. 3444</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210520">May 20, 2021</action-date><action-desc><sponsor name-id="S001189">Mr. Austin Scott of Georgia</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title II of the Social Security Act to disregard certain contributions to ABLE accounts when determining an individual’s ability to engage in substantial gainful activity, and for other purposes.</official-title></form><legis-body id="HC3FCF87F0E704594ABE9812ABBAEC840" style="OLC"><section id="H88C93B5EA6A34701B125F3FBBBA9B349" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>ABLE Accounts for Veterans Act of 2021</short-title></quote>.</text></section><section id="HD7CDE8BA04BB4481B4FDF864EE1D7156"><enum>2.</enum><header>Certain contributions to ABLE accounts disregarded in determination of substantial gainful activity</header><subsection id="HE5FF937B17A64741891802734E14290D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 223(d)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/423">42 U.S.C. 423(d)(4)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HCDA7AB148EFB4DF8937A4A0D411A4B0E" style="OLC"><subparagraph id="H8AE9A71CDC8146CDBF59FE4547788E42" indent="up2"><enum>(D)</enum><text display-inline="yes-display-inline">In determining when earnings derived from services demonstrate an individual’s ability to engage in substantial gainful activity, in the case of earnings earned in a month by an individual who receives compensation for a service-connected disability for such month under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States Code, the Commissioner of Social Security shall disregard an amount of such earnings equal to the amount of any contribution made by the individual in such month to a qualified ABLE program (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/529A">section 529A</external-xref> of the Internal Revenue Code of 1986) established for the benefit of such individual.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6B3C02FA679A4092AE18F35E8135B776"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to earnings earned for months beginning after the date that is 6 months after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
