which was referred to the <committee-name committee-id="HAP00">Committee on Appropriations</committee-name>, and in addition to the Committees on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, and <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To rescind unused earmarks provided for the Department of Transportation and deposit such funds into the Treasury for purposes of deficit reduction, and for other purposes.</official-title></form><legis-body id="H84957DD043D8412CA444A0F38689ABE7" style="OLC"><section id="H6CC411EBECCA4008A2BB3058DA259C47" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Washington Bureaucrat Accountability Act</short-title></quote>.</text></section><section id="H9DDA52956219461BAB8F54904861759E" section-type="subsequent-section"><enum>2.</enum><header>Unused earmarks</header><subsection id="HA96B663228834453BA617090EBA5D2B0"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="HEF12DC55A7A0468292F223A27351930C"><enum>(1)</enum><text>the term <term>agency</term> has the meaning given the term <term>Executive agency</term> under section 105 of title 5, United States Code;</text></paragraph><paragraph id="HB5A5DABD4C6041B79F16869BB1D34D8D"><enum>(2)</enum><text>the term <term>earmark</term> means—</text><subparagraph id="H48362B37DC6D472DAB9FFED8468D8770"><enum>(A)</enum><text>a congressionally directed spending item, as defined in rule XLIV of the Standing Rules of the Senate; and</text></subparagraph><subparagraph id="H60D441431091485CA6B8D93EC6E71E30"><enum>(B)</enum><text>a congressional earmark, as defined in rule XXI of the Rules of the House of Representatives; and</text></subparagraph></paragraph><paragraph id="H0B124C4ACFC747428EA203D40F52CDA2"><enum>(3)</enum><text>the term <term>unused DOT earmark</term> means an earmark of funds provided for the Department of Transportation as to which any funds remain available for obligation at the end of the 9th fiscal year following the fiscal year during which the earmark was made available.</text></paragraph></subsection><subsection id="HA11FF68F753D45319F9132735E717A92"><enum>(b)</enum><header>Rescission of unused DOT earmarks</header><paragraph id="H8EFF6F61772F4CEC9235F9B8D55F84E1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), effective on October 1 of the 10th fiscal year after funds under an unused DOT earmark are made available, all unobligated amounts made available under the unused DOT earmark are rescinded and deposited into the Treasury for purposes of deficit reduction.</text></paragraph><paragraph id="H8B608AF14029449691C3972692A5F436"><enum>(2)</enum><header>Exception</header><text>The Secretary of Transportation may delay the rescission of amounts made available under an unused DOT earmark for 1 year if the Secretary determines that an additional obligation of the earmark is likely to occur during the 10th fiscal year after funds under the unused DOT earmark are made available.</text></paragraph></subsection><subsection id="H1D92700F46DE4F71B04BF86D3394EE8F"><enum>(c)</enum><header>Agency-Wide identification and report</header><paragraph id="H569E3EAB81AF48069CF726AA5D1C1AB7"><enum>(1)</enum><header>Agency identification</header><text>Each agency shall identify and submit to the Director of the Office of Management and Budget an annual report regarding every project of the agency for which—</text><subparagraph id="HB47980085FDD4CA58C1B1F62D2A6ED17"><enum>(A)</enum><text>amounts are made available under an earmark; and</text></subparagraph><subparagraph id="H515DFA0B7E85418D9E93FC8D5F5EF695"><enum>(B)</enum><text>as of the end of a fiscal year, unobligated balances remain available.</text></subparagraph></paragraph><paragraph id="H90E062E61FD54C16801A7EC65C518E4A"><enum>(2)</enum><header>Annual report</header><text>The Director of the Office of Management and Budget shall submit to Congress and publically post on the website of the Office of Management and Budget an annual report that includes—</text><subparagraph id="HD851E06BD1044AA6AB6E5470C2379FA2"><enum>(A)</enum><text>a listing and accounting for earmarks for which unobligated balances remain available, summarized by agency, which shall include, for each earmark—</text><clause id="H11D30A592A3A4DE490A06635F2A0F127"><enum>(i)</enum><text>the amount of funds made available under the original earmark;</text></clause><clause id="HCB5D2821250F4ACF8E1D14637EC5FEB4"><enum>(ii)</enum><text>the amount of the unobligated balances that remain available;</text></clause><clause id="H67E69301A85D422D88C3BB7003BDB47B"><enum>(iii)</enum><text>the fiscal year through which the funds are made available, if applicable; and</text></clause><clause id="H2089475D482E4A73B3691F826B86F318"><enum>(iv)</enum><text>recommendations and justifications for whether the earmark should be rescinded or retained in the next fiscal year;</text></clause></subparagraph><subparagraph id="H3C204D3032684FA7B29729BCC4A67ACE"><enum>(B)</enum><text>the number of rescissions resulting from this section and the annual savings resulting from this section for the previous fiscal year; and</text></subparagraph><subparagraph id="H1751C8A7C5644FEDB3577EF0BB89D7BF"><enum>(C)</enum><text>a listing and accounting for earmarks provided for the Department of Transportation scheduled to be rescinded under subsection (b) at the end of the fiscal year during which the report is submitted.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
