which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Safe Drinking Water Act to provide for drinking water fountain replacement in public playgrounds, parks, and libraries, and for other purposes.</official-title></form><legis-body id="H4ADACBB5154C4B85A508A36DD7A919B0" style="OLC"><section id="H2A553E92C3AA4F0189A069C92F559279" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Drinking Water in Public Playgrounds, Parks, and Libraries Act</short-title></quote>.</text></section><section id="H3AB562CCEA0C43068DC5ECB6CA813BA3"><enum>2.</enum><header>Public playgrounds, parks, and libraries</header><subsection id="HE766E2ED107143E8A12671249FE128A6"><enum>(a)</enum><header>Grant program</header><text display-inline="yes-display-inline">Part F of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-21">42 U.S.C. 300j–21 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H46F6932B17AB40A586413149A756B756" style="OLC"><section id="HDAB2A4315E16495D84C91FB292A3A2F8"><enum>1466.</enum><header>Drinking water fountain replacement in public playgrounds, parks, and libraries</header><subsection id="HA926B7F8F9E14063A0D86169F93229E3"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Administrator shall establish a grant program to provide assistance to States and municipalities for the replacement, in playgrounds, parks, or libraries owned by (or libraries located in) States or municipalities, of drinking water fountains, including any lead service line that supplies the fountains, manufactured prior to 2014.</text></subsection><subsection id="H00A585694FB9471189C242BD229A1CE9"><enum>(b)</enum><header>Use of Funds</header><text>Funds awarded under the grant program—</text><paragraph id="H8C59A48E3DBD4FCDBEA7D08715D2D559"><enum>(1)</enum><text display-inline="yes-display-inline">shall be used to pay the costs of replacing drinking water fountains, in playgrounds, parks, or libraries owned by (or libraries located in) a State or municipality receiving such funds, with plumbing endpoint devices certified by a third party certification body accredited by the ANSI National Accreditation Board as meeting the NSF/ANSI/CAN 61: Q≤1 standard, and, for endpoint devices connected to premises plumbing, with filters installed at the point where water is dispensed from the device and is certified as compliant with NSF International/American National Standards Institute (ANSI) Standard 53-2017, Drinking Water Treatment Units - Health Effects published by NSF International, and incorporates an integral performance indication device as specified in section 6.1 of NSF/ANSI standard 53-2017, or any more stringent requirements adopted thereafter;</text></paragraph><paragraph id="HD15ABCF1BEDD49EB86F7FC0484E05F93"><enum>(2)</enum><text>may be used to pay the costs of monitoring and reporting of lead levels in the drinking water of playgrounds, parks, and libraries owned by (or libraries located in) a State or municipality receiving such funds, as determined appropriate by the Administrator; and</text></paragraph><paragraph id="H468C54EEF82F414C98BEE9A51A80D2E7" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">shall be used to pay the cost of replacing lead service lines servicing the water fountains.</text></paragraph></subsection><subsection id="HAF184A1E5BE04DB8A36E165E190C0654"><enum>(c)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding funds under the grant program, the Administrator shall give priority to—</text><paragraph id="HB3F1BB54308A4EC6AFF52ACEF4F84180"><enum>(1)</enum><text>projects and activities that benefit an underserved community or a disadvantaged community; and</text></paragraph><paragraph id="HA7621DA1DE354F7EB4186CEA2200BCAA"><enum>(2)</enum><text>applications for projects that replace pre-1988 water fountains.</text></paragraph></subsection><subsection id="HE37781CB9DC3460D9215072EAE7F4E5C" commented="no"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section—</text><paragraph id="H78D22040260A4D2CBB704BFFE2C5D2DD"><enum>(1)</enum><text>$200,000,000 for fiscal year 2022;</text></paragraph><paragraph id="H38E69CF9C28A4D9B9ED89098596728E9"><enum>(2)</enum><text>$100,000,000 for fiscal year 2023;</text></paragraph><paragraph id="HB4B948E2C7CD43EBA1261D7A2E0044AD"><enum>(3)</enum><text>$100,000,000 for fiscal year 2024;</text></paragraph><paragraph id="H5F24800CC22B41749CEC75DEC3C49DD5"><enum>(4)</enum><text>$50,000,000 for fiscal year 2025; and</text></paragraph><paragraph id="H99D78B4C9DF940739EEE44A824EBED67"><enum>(5)</enum><text>$50,000,000 for fiscal year 2026.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB8FDFAD39A96464D9034F847A5A9E004" commented="no"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 1461 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-21">42 U.S.C. 300j–21</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5735AFE8D23244338BD21EDEF8EB6126" style="OLC"><paragraph commented="no" id="HBC0A6BE11288461DA96890E619C9F730"><enum>(8)</enum><header>Disadvantaged community</header><text display-inline="yes-display-inline">The term <term>disadvantaged community</term> has the meaning given such term in section 1452(d)(3).</text></paragraph><paragraph id="HCD5A78015E2D4265BB7CD45A9EEE4167"><enum>(9)</enum><header>Playground or park</header><text display-inline="yes-display-inline">The term <term>playground or park</term> means an indoor or outdoor park, building, site, or other facility, including any parking lot appurtenant thereto, that is intended for recreation purposes.</text></paragraph><paragraph id="HC096A0C661F048A19C6FB7D4368CABC6"><enum>(10)</enum><header>Underserved community</header><text display-inline="yes-display-inline">The term <term>underserved community</term> has the meaning given such term in section 1459A.</text></paragraph><paragraph id="H45138432BF1D4F6098C87F261C3446AF"><enum>(11)</enum><header>Library</header><text>The term <quote>library</quote> includes—</text><subparagraph id="HFE64B95CCA004BD8B5F24BF6DE770272"><enum>(A)</enum><text display-inline="yes-display-inline">a public library;</text></subparagraph><subparagraph id="H7EDD32157AFD4AFF92D12DC131E34BE8"><enum>(B)</enum><text>a public elementary school or secondary school library;</text></subparagraph><subparagraph id="HF7E251897DD943A1803B4B5E9DF654D7"><enum>(C)</enum><text>a tribal library;</text></subparagraph><subparagraph id="H70C41C85817B410092821C50D244F416"><enum>(D)</enum><text>an academic library;</text></subparagraph><subparagraph id="HAE42F19E45B843509AAFD50EAA1CC492"><enum>(E)</enum><text>a research library, which, for purposes of this subchapter means a library that—</text><clause id="HAB977BB81610463D832C8FB911B65600"><enum>(i)</enum><text>makes publicly available library services and materials suitable for scholarly research that are not otherwise available to the public; and</text></clause><clause id="H0C7428049FD0454E81D74970974FACDE"><enum>(ii)</enum><text>is not an integral part of an institution of higher education; and</text></clause></subparagraph><subparagraph id="H54BF53BE65B0433CA840BD767F34554A"><enum>(F)</enum><text>a private library or other special library, but only if the State in which the private or special library is located determines that the library should be considered a library for purposes of this part.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
