which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To repeal the mandatory flood insurance coverage requirement for commercial properties located in flood hazard areas, and for other purposes.</official-title></form><legis-body id="H093185444CFE48AA931888F9AED3B986" style="OLC"><section display-inline="no-display-inline" id="HF0EA92CA8806407F86F89911F4D304B6" section-type="section-one"><enum>1.</enum><header>Opt-out of mandatory coverage requirement for commercial properties</header><subsection id="H23009C85DC164FE991F60F3AFE399AC0"><enum>(a)</enum><header>Amendments to Flood Disaster Protection Act of 1973</header><text display-inline="yes-display-inline">The Flood Disaster Protection Act of 1973 is amended—</text><paragraph id="HCC00F91660E64A99BE6A0FE58A511BFB"><enum>(1)</enum><text display-inline="yes-display-inline">in section 3(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/4003">42 U.S.C. 4003(a)</external-xref>)—</text><subparagraph id="H9BA2BF30D9FB4C419FDFADE54D087603"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (10), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HC817CE61C2C44AE6B151964F9CFBC3E4"><enum>(B)</enum><text>in paragraph (11), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H769BFABC162D48C7B4D81052FC8BAE94"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H9EF19A2A3D8E4FCDA378DD76531207DB" style="OLC"><paragraph id="H0CCCCAB69F09475FBE1ADB5C96860646"><enum>(12)</enum><text display-inline="yes-display-inline"><quote>residential improved real estate</quote> means improved real estate that—</text><subparagraph id="HC22AB4CC11B146358F796226BABDB991"><enum>(A)</enum><text>is primarily used for residential purposes, as defined by the Federal entities for lending regulation; and</text></subparagraph><subparagraph id="HE1EA9BD46B3C4BEF8833C7879278A620"><enum>(B)</enum><text display-inline="yes-display-inline">secures financing or financial assistance provided through a federally related single family loan program, as defined by the Federal entities for lending regulation.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HDC114F5654544A6688CD39EAE18C9C75"><enum>(2)</enum><text display-inline="yes-display-inline">in section 102 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a</external-xref>)—</text><subparagraph id="H7073E909B2C645BC95EF970FDB82A709"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><clause id="H0DA8D7F7B50344948250336B56836431"><enum>(i)</enum><text>in paragraph (1)(A)—</text><subclause id="H6B8233B841134455B418D0E67DD8B74F"><enum>(I)</enum><text>by inserting <quote>residential</quote> before <quote>improved real estate</quote>; and</text></subclause><subclause id="H3B30D528F5D24127BC9FB312E839B1F6"><enum>(II)</enum><text display-inline="yes-display-inline">by inserting <quote>residential</quote> before <quote>building or mobile home</quote>;</text></subclause></clause><clause id="HE10980FF962B4620AD985567D35B04B5"><enum>(ii)</enum><text>in paragraph (2)—</text><subclause id="H4CF57C82C5A4400197AEDC625AF6DD07"><enum>(I)</enum><text>by inserting <quote>residential</quote> before <quote>improved real estate</quote>; and</text></subclause><subclause id="HBAE70A0C57BF45588F05F54E96CAF0D1"><enum>(II)</enum><text display-inline="yes-display-inline">by inserting <quote>residential</quote> before <quote>building or mobile home</quote>; and</text></subclause></clause><clause id="H0BB934216DD14458A1D6B02973C6284A"><enum>(iii)</enum><text>in paragraph (3)—</text><subclause id="H3F32112B30C7407F84FE6C6A4BB3222C"><enum>(I)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>residential</quote> before <quote>improved real estate</quote>; and</text></subclause><subclause id="HC1B902DBCAE343DE9178C8C66C4082F4"><enum>(II)</enum><text display-inline="yes-display-inline">in the matter after and below subparagraph (B), by inserting <quote>residential</quote> before <quote>building or mobile home</quote>;</text></subclause></clause></subparagraph><subparagraph id="H469CCC43AE0F40DFA32D81FFB98D648B"><enum>(B)</enum><text>in subsection (c)(3), by striking <quote>, in the case of any residential property, for any structure that is a part of such property</quote> and inserting <quote>for any structure that is part of a residential property</quote>;</text></subparagraph><subparagraph id="H9BDF99FD1D234136810D71D5EBF43AD9"><enum>(C)</enum><text>in subsection (e)—</text><clause id="H70C3E43545EA431EB5A739EAF8F6A51A"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subclause id="HEDEDA5D11DF44F40A04DCB5170DC4C2A"><enum>(I)</enum><text>by inserting <quote>residential</quote> before <quote>improved real estate</quote>; and</text></subclause><subclause id="H7C4123C66DD94905B41ABE7D5630D351"><enum>(II)</enum><text display-inline="yes-display-inline">by inserting <quote>residential</quote> before <quote>building or mobile home</quote> each place such term appears; and</text></subclause></clause><clause id="H73411604F1FB4D3984331872379481E0"><enum>(ii)</enum><text>in paragraph (5)—</text><subclause id="H6B8C9EDEB4694887A29B2FE8728BEE1D"><enum>(I)</enum><text>in subparagraph (A)—</text><item id="H042158A4860B4147990809F5752C2222"><enum>(aa)</enum><text display-inline="yes-display-inline">by inserting <quote>residential</quote> before <quote>improved real estate</quote> each place such term appears; and</text></item><item id="HE044E06046A940A2B00DC4B64FBFE79A"><enum>(bb)</enum><text display-inline="yes-display-inline">by inserting <quote>residential</quote> before <quote>building or mobile home</quote> each place such term appears;</text></item></subclause><subclause id="H4BF33AD9EED44AC6A825DCB931DB26AA"><enum>(II)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>residential</quote> before <quote>building or mobile home</quote> each place such term appears; and</text></subclause><subclause id="HC117A75AED1A452CBC610CA8699D2193"><enum>(III)</enum><text display-inline="yes-display-inline">in subparagraph (C), by inserting <quote>residential</quote> before <quote>building or mobile home</quote>; and</text></subclause></clause></subparagraph><subparagraph id="H6D43FD4384824978A3411EF08A7EBE6C"><enum>(D)</enum><text>in subsection (h)—</text><clause id="HA01ED683781E432897FCA1607E0387D9"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>residential</quote> before <quote>improved real estate</quote> each place such term appears; and</text></clause><clause id="HCD8864795B4C4AA6BCF5D514B2D6474E"><enum>(ii)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by inserting <quote>residential</quote> before <quote>building or mobile home</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="H2EA0CE02FEE64D0FBCAF43D0EAFC83D9"><enum>(b)</enum><header>Amendments to National Flood Insurance Act of 1968</header><text>The National Flood Insurance Act of 1968 is amended—</text><paragraph id="H59679530E0FE4F2D8C08EC5A0CCAB506"><enum>(1)</enum><text display-inline="yes-display-inline">in section 1364(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/4104a">42 U.S.C. 4104a(a)</external-xref>)—</text><subparagraph id="HF7057AA1DEFB4C088BE6F5B06785FE68"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>residential</quote> before <quote>improved real estate</quote>;</text></subparagraph><subparagraph id="H4ABB8C08F51A4D329DB2A6C550CC507B"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>residential</quote> before <quote>improved real estate</quote>; and</text></subparagraph><subparagraph id="HCD091A6A6DE74302852910458F899AA1"><enum>(C)</enum><text>in paragraph (3)(A), by inserting <quote>residential</quote> before <quote>building</quote>;</text></subparagraph></paragraph><paragraph id="HC00880DBBE5949B7B355E1CAC7551428"><enum>(2)</enum><text>in section 1365 (<external-xref legal-doc="usc" parsable-cite="usc/42/4104b">42 U.S.C. 4104b</external-xref>)—</text><subparagraph id="HB76BC1D5D91F4888962ECD4966AA9043"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><clause id="H699EA089C11D4F3BAC9B31734CA95446"><enum>(i)</enum><text>by inserting <quote>residential</quote> before <quote>improved real estate</quote>; and</text></clause><clause id="HD06A7C627CE14087A1D9476AD845B290"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>residential</quote> before <quote>building</quote>;</text></clause></subparagraph><subparagraph id="HBB937B3F923141CBBA756394BCD986B7"><enum>(B)</enum><text>in subsection (b)(2)—</text><clause id="H204B3F2DD8E94E88A404EBFA0693C612"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>residential</quote> before <quote>building</quote> each place such term appears; and</text></clause><clause id="HC0EEA4E25F834A05B48615659D423000"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>residential</quote> before <quote>improved real estate</quote> each place such term appears;</text></clause></subparagraph><subparagraph id="H5E26652365C34C56A2C20697987E9548"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (d), by inserting <quote>residential</quote> before <quote>improved real estate</quote> each place such term appears; and</text></subparagraph><subparagraph id="H6D3BF9D58AD944F1B1FD3226BFA56E9F"><enum>(D)</enum><text>in subsection (e)—</text><clause id="HAE8BDA1E82894F64BA91160A7C483569"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>residential</quote> before <quote>improved real estate</quote>; and</text></clause><clause id="H394766A402874DC5A254E83C6E52CF53"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>residential</quote> before <quote>building</quote> each place such term appears; and</text></clause></subparagraph></paragraph><paragraph id="H86AC6B6EC7404B3FA125EA08FEF29056"><enum>(3)</enum><text>in section 1370 (<external-xref legal-doc="usc" parsable-cite="usc/42/4121">42 U.S.C. 4121</external-xref>)—</text><subparagraph id="HFFC3320A74014C3997850C7EB1792DCB"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (8), by inserting <quote>residential</quote> before <quote>improved real estate</quote>;</text></subparagraph><subparagraph id="HF9757DC4CCDF4A55B0CEC7A2C928705A"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (14) and (15) as paragraphs (15) and (16), respectively; and</text></subparagraph><subparagraph id="HD90087596AB0413FBEC861C24FCF117C"><enum>(C)</enum><text>by inserting after paragraph (13) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HD1889723ECAE4EE8986266929DB13253" style="OLC"><paragraph id="HFA797530A0014052800CE1452DEAA50E"><enum>(14)</enum><text display-inline="yes-display-inline">the term <term>residential improved real estate</term> means improved real estate that—</text><subparagraph id="H29D42C908AC94AEEBFD2031F2E96C292"><enum>(A)</enum><text>is primarily used for residential purposes, as defined by the Federal entities for lending regulation; and</text></subparagraph><subparagraph id="H701A7BE5028B47E480644D7E4C68D6C8"><enum>(B)</enum><text display-inline="yes-display-inline">secures financing or financial assistance provided through a federally related single family loan program, as defined by the Federal entities for lending regulation;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H82F1FEAFB473407685EEE9014AC2ABCB"><enum>(c)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">This section and the amendments made by this section may not be construed to prohibit the Administrator of the Federal Emergency Management Agency from offering flood insurance coverage under the National Flood Insurance Program for eligible non-residential properties, other residential multifamily properties, or structures financed with commercial loans, or to prohibit the purchase of such coverage for such eligible properties.</text></subsection></section></legis-body></bill>
