introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit Federal funding of National Public Radio and the use of Federal funds to acquire radio content.</official-title></form><legis-body id="H42C2F1BD52194F59931B8324A96BE8AB" style="OLC"><section id="HA520405CAB0B4AFF9ECCEE17ED054D0D" section-type="section-one"><enum>1.</enum><header>Prohibition on Federal funding of National Public Radio and radio content acquisition</header><subsection id="H72680A0132DF498C93FBCF8F5DDB5840"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No Federal funds may be made available—</text><paragraph id="H68C3DE69AE3D40208BC402620B01EDA6"><enum>(1)</enum><text display-inline="yes-display-inline">to an organization that is incorporated as of the date of the enactment of this Act for each of the purposes described in subsection (c), or to any successor organization;</text></paragraph><paragraph id="HA4C03C236B844AFC8B55B5BE1AFEA304"><enum>(2)</enum><text display-inline="yes-display-inline">for payment of dues to an organization described in paragraph (1); or</text></paragraph><paragraph id="H1A7F63F216C642558F0537B21AFB707E"><enum>(3)</enum><text display-inline="yes-display-inline">for the acquisition of radio programs (including programs to be distributed or disseminated over the internet) by or for the use of a radio broadcast station that is a public broadcast station (as defined in section 397(6) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/397">47 U.S.C. 397(6)</external-xref>)).</text></paragraph></subsection><subsection id="H08FBC0E9594E4E9DAEB8C056501AA9D3"><enum>(b)</enum><header>Rules of construction</header><paragraph id="HE07D4FE81C0B4FCA8BC22BAEEFDF97F2"><enum>(1)</enum><header>Other purposes</header><text display-inline="yes-display-inline">Paragraphs (2) and (3) of subsection (a) shall not be construed to prohibit the making available of Federal funds to any entity, including an entity that engages in the payment described in such paragraph (2) or the acquisition described in such paragraph (3), for purposes other than such payment or acquisition.</text></paragraph><paragraph commented="no" id="H8711648DE2964751A8F8F8F6B5FEEE67"><enum>(2)</enum><header>Radio content acquisition by United States Agency for Global Media or Defense Media Activity</header><text display-inline="yes-display-inline">Subsection (a)(3) shall not be construed to apply to the acquisition of radio programs by the United States Agency for Global Media or the Defense Media Activity.</text></paragraph></subsection><subsection id="HC4C6379833E047A081AADE63D6820824"><enum>(c)</enum><header>Purposes described</header><text>The purposes described in this subsection are the following:</text><paragraph id="HA6856FE3A71C4E53BB58E9BC97CB9415"><enum>(1)</enum><text display-inline="yes-display-inline">To propose, plan and develop, to acquire, purchase and lease, to prepare, produce and record, and to distribute, license and otherwise make available radio programs to be broadcast over noncommercial educational radio broadcast stations, networks and systems.</text></paragraph><paragraph id="H7E3CBF7B2F4648B88A7EAB729DB1B0A2"><enum>(2)</enum><text display-inline="yes-display-inline">To engage in research study activities with respect to noncommercial educational radio programming and broadcasting.</text></paragraph><paragraph id="H1329E45B1F2F4B458120DEB336136463"><enum>(3)</enum><text display-inline="yes-display-inline">To lease, purchase, acquire and own, to order, have, use and contract for, and to otherwise obtain, arrange for and provide technical equipment and facilities for the production, recording and distribution of radio programs for broadcast over noncommercial educational radio stations, networks and systems.</text></paragraph><paragraph id="H8D5E6ADCDE8A46F092DD6170A8F1267C"><enum>(4)</enum><text display-inline="yes-display-inline">To establish and maintain one or more service or services for the production, duplication, promotion and circulation of radio programs on tape, cassettes, records or any other means or mechanism suitable for noncommercial educational transmission and broadcast thereof.</text></paragraph><paragraph id="HADE4F8C328374127A7B4399F5A502624"><enum>(5)</enum><text display-inline="yes-display-inline">To cooperate and participate with foreign broadcasting systems and networks in all aspects of international radio programming and broadcasting.</text></paragraph><paragraph id="H81C69396AE3E4A4D8BD716BD2DEC87E7"><enum>(6)</enum><text display-inline="yes-display-inline">To develop, prepare and publish information, data, reports and other materials in support of or relating to noncommercial educational radio programming and broadcasting.</text></paragraph><paragraph id="H1CD74BC6DC2B4DF8BC724F09572680E9"><enum>(7)</enum><text display-inline="yes-display-inline">To otherwise forward and advance the development, production, distribution and use of noncommercial educational radio programs, materials and services, and to assist and support noncommercial educational radio broadcasting pursuant to the Public Broadcasting Act of 1967, as it may from time to time be amended.</text></paragraph></subsection><subsection id="HA9EB097F224F40759A0BEECC5BD0CEFE"><enum>(d)</enum><header>Federal funds defined</header><paragraph id="H7852A785991246F58B6AE65C50F9E891"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>Federal funds</term> means, with respect to receipt by a non-Federal entity from the Federal Government, the following:</text><subparagraph id="HF5046DCAC1C54F59B2099E7037D935A4"><enum>(A)</enum><text>Grants.</text></subparagraph><subparagraph id="H7E12F5AF11984B2D8BE8998429783B3A"><enum>(B)</enum><text>Loans.</text></subparagraph><subparagraph id="H5CE22DE8638645EC9A86EF766CDABD83"><enum>(C)</enum><text>Property.</text></subparagraph><subparagraph id="H3668981D36404DF5896FD0D9BFA72F9A"><enum>(D)</enum><text>Cooperative agreements.</text></subparagraph><subparagraph id="H14116CE8579D41D6822B53ED0DEF28D9"><enum>(E)</enum><text>Direct appropriations.</text></subparagraph></paragraph><paragraph id="HE24A195B116C4716A27557126E254023"><enum>(2)</enum><header>Grants or subgrants from non-Federal entity</header><text>Such term also includes grants or subgrants from Federal funds made available to a non-Federal entity.</text></paragraph></subsection><subsection id="HF5755E4EC9B2453C8833DF107584F4EB"><enum>(e)</enum><header>Changes to funding formula</header><text display-inline="yes-display-inline">Section 396(k)(3)(A) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/396">47 U.S.C. 396(k)(3)(A)</external-xref>) is amended—</text><paragraph id="H7C20747B7A8144EEA1552BD6159A3C3D"><enum>(1)</enum><text>in clause (iii), by striking <quote>fiscal year</quote> and all that follows and inserting <quote>fiscal year, such amounts shall be available for distribution among the licensees and permittees of public radio stations pursuant to paragraph (6)(B).</quote>; and</text></paragraph><paragraph commented="no" id="H6EF820A6F633455C9F5B38A69EDA1434"><enum>(2)</enum><text>in clause (v)(II), by striking <quote>clause (iii)(II) and (III)</quote> and inserting <quote>clause (iii)</quote>.</text></paragraph></subsection><subsection id="HE92A0D05C6E845BAAE4D8F155DC92935"><enum>(f)</enum><header>Conforming amendments</header><text>Section 396 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/396">47 U.S.C. 396</external-xref>) is amended—</text><paragraph id="H4A1A32576A7F480FBFEED23CC547AD18"><enum>(1)</enum><text>in subsection (g)(2)—</text><subparagraph id="HF0990F8616044AEDA09ED012D56ECFCE"><enum>(A)</enum><text>in the matter before clause (i) of subparagraph (B), by inserting <quote>(except for the acquisition of radio programs)</quote> after <quote>public telecommunications services</quote>; and</text></subparagraph><subparagraph id="H7D7F88EB14B64575B05230D1E5570FB2"><enum>(B)</enum><text>in subparagraph (C), by inserting <quote>(except for the acquisition of radio programs)</quote> after <quote>public telecommunications services</quote>;</text></subparagraph></paragraph><paragraph id="H1E37CE103BB64A639E14CF8D55F215B1"><enum>(2)</enum><text>in subsection (k)—</text><subparagraph id="H6D744D7B8BB6478C821C1C9425037C0E"><enum>(A)</enum><text>in the 1st sentence of paragraph (3)(B)(i)—</text><clause id="H08DD48416BB54BB28149F54418352068"><enum>(i)</enum><text>by striking <quote>and subparagraph (A)(iii)(II)</quote>; and</text></clause><clause id="H2DA5188EACDE4E4895F3DA2F73194450"><enum>(ii)</enum><text>by striking <quote>or radio</quote>;</text></clause></subparagraph><subparagraph id="H84CB4EEE34A74B7C86DE29F587B5164C"><enum>(B)</enum><text>in the 3rd sentence of paragraph (6)(B), by striking <quote>paragraph (3)(A)(iii)(I)</quote> and inserting <quote>paragraph (3)(A)(iii)</quote>; and</text></subparagraph><subparagraph id="H8D459348C8ED4CB0A7B82869C9580E5E"><enum>(C)</enum><text>in paragraph (7)—</text><clause id="HD000F675B7E74BBEBBB7CFCF891AFD3A"><enum>(i)</enum><text>by striking <quote>(iii)(I)</quote> and inserting <quote>(iii)</quote>; and</text></clause><clause id="H280DB1982D3B48FA8B5898FA7ADDA323"><enum>(ii)</enum><text>by inserting <quote>(except for the acquisition of radio programming)</quote> before the period at the end; and</text></clause></subparagraph></paragraph><paragraph id="H0838899DF63045BD94763A8112C36A83"><enum>(3)</enum><text>in subsection (l)(4)—</text><subparagraph id="H58D1D309307B45DC853735084AC5CD5F"><enum>(A)</enum><text>in the matter before clause (i) of subparagraph (B), by striking <quote>(iii)(II)</quote> and inserting <quote>(iii)</quote>;</text></subparagraph><subparagraph id="H08975037B38B47C9A23C9C9B2BC42D58"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>subsection (k)(3)(A)(iii)(III)</quote> and inserting <quote>subsection (k)(3)(A)(iii)</quote>; and</text></subparagraph><subparagraph id="H97887B8807F74F4DB84E3D7B4AA85C7D"><enum>(C)</enum><text>in subparagraph (D), by striking <quote>subsection (k)(3)(A) (ii)(III) or (iii)(II)</quote> and inserting <quote>subsection (k)(3)(A)(ii)(II) or subsection (k)(3)(A)(iii)</quote>.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
