<official-title display="yes">To establish a Freight Rail Innovation Institute to carry out a research and development program to develop new technologies for freight rail locomotives.</official-title>

<section id="H45BC926C515F41BF89260B10B5C09B58" section-type="section-one"><enum>1.</enum><header>Freight Rail Innovation Institute</header> 
<subsection id="H61D8AD1F9F6E41BFAD556F5424DEC919"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/229">Chapter 229</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="H02B587BF2BBB4F84A583C5047BC323F8"> <section id="H1637BD1868FC46638CB0FC56ACE38D49"><enum>22909.</enum><header>Freight Rail Innovation Institute</header> <subsection id="HB0480172F66548D89C78A2A9AD5FD769"><enum>(a)</enum><header>Establishment</header><text>Not later than 6 months after the date of the enactment of this section, the Secretary of Transportation, in coordination with the Secretary of Energy, representatives of the National Laboratories, the National Institute of Standards and Technology, and the National Science Foundation, and in partnership with an eligible institution of higher education and a freight rail locomotive manufacturer, shall establish a Freight Rail Innovation Institute (referred to in this section as the <quote>Institute</quote>) to carry out a research and development program—</text> 
<paragraph id="HB3AA9996A3C641B48E583516126E7C24"><enum>(1)</enum><text>to develop—</text> <subparagraph id="HDF0BD637CAF54C6A83293F5C31E64480"><enum>(A)</enum><text>technologies necessary for the design, development, manufacturing, and operation of zero-emission battery and hydrogen-powered freight locomotives; and</text></subparagraph> 
<subparagraph id="H00810ED5B7A7469D90082C5064F9034D"><enum>(B)</enum><text>technologies that enhance freight rail safety, efficiency and utilization; and</text></subparagraph></paragraph> <paragraph id="HE114FA18245F484F9EE6208C57F4522D"><enum>(2)</enum><text>to accelerate the deployment of—</text> 
<subparagraph id="H3D95F05D085D45E18A7062E25C88AF1E"><enum>(A)</enum><text>zero-emission locomotives, including passenger locomotives;</text></subparagraph> <subparagraph id="H078CC507D0B043C1946D1EC260ECEC4C"><enum>(B)</enum><text>supporting supply chains;</text></subparagraph> 
<subparagraph id="H4E6BC8551EB24EAEA2FDADC5075472D8"><enum>(C)</enum><text>advanced freight and logistics systems; and </text></subparagraph> <subparagraph id="H2FB4561C1765486D82A1ED099B541DED"><enum>(D)</enum><text>related workforce development and education innovations.</text></subparagraph></paragraph></subsection> 
<subsection id="H965503AC1F99432A970F35291784536E"><enum>(b)</enum><header>Activities</header><text>The Institute shall—</text> <paragraph id="H977DD1636A9F47618A0C24D14DDC70D9"><enum>(1)</enum><text>research, develop, and deploy zero-emission battery- and hydrogen-powered freight locomotives and locomotive technologies;</text></paragraph> 
<paragraph id="H8BE88D2E658845A9AA5ADBFEE1CF0F61"><enum>(2)</enum><text>develop and operate testing programs and demonstration facilities;</text></paragraph> <paragraph id="H6B2873E4D04C43108370FB30EF535F7B"><enum>(3)</enum><text>develop advanced technologies that advance freight rail safety, efficiency, logistics, and utilization;</text></paragraph> 
<paragraph id="HEE0351C1BA5E410EB1431C5C1492BD5A"><enum>(4)</enum><text>develop and deploy an operating prototype hydrogen-powered locomotive;</text></paragraph> <paragraph id="HB62D3017567849E8B870DD7E1430F519"><enum>(5)</enum><text>deploy a revenue service testing and demonstration program to accelerate commercial adoption of battery electric locomotives;</text></paragraph> 
<paragraph id="H597E83986F9E46DE9ABAF98231BC3ED0"><enum>(6)</enum><text>develop specific technologies and innovations to support the manufacturing and deployment of zero-emission locomotives for passenger rail; </text></paragraph> <paragraph id="H6F7C2FC43333473C9AD07422FA1C9328"><enum>(7)</enum><text>pay wages to all laborers and mechanics employed by the Institute at rates that are not less than those prevailing for the same type of work for similar projects in the immediate locality, consistent with the wage requirement set forth in section 113(a) of title 23, United States Code; </text></paragraph> 
<paragraph id="H56CB8220120E451F887CB6047AC8B00C"><enum>(8)</enum><text display-inline="yes-display-inline">ensure that the freight rail locomotive manufacturer that is associated with the Institute fully complies with the Buy America requirement set forth in section 22905(a) with respect to manufacturing and production associated with the Institute and as a result of new technologies, innovations, and methods developed at least in part by the Institute; and</text></paragraph> <paragraph id="H74153EA9640E4311A981EF32C489D9A2"><enum>(9)</enum><text>carry out other activities that the Secretary of Transportation considers necessary.</text></paragraph></subsection> 
<subsection id="HAEA0C029EC6B4728B16C6653E4592DCE"><enum>(c)</enum><header>Applicant requirements</header><text>Applicants seeking to establish the Institute under this section shall—</text> <paragraph id="H6C206869CFBB45028E6CF2A608352906"><enum>(1)</enum><text>be a partnership consisting of at least 1 institution of higher education and at least 1 freight rail locomotive manufacturer, which shall enter into a cost-sharing agreement for purposes of the Institute; and</text></paragraph> 
<paragraph id="H403DBA543BB844F3BC0890EDB5A5C440"><enum>(2)</enum><text>submit a comprehensive proposal to the Secretary of Transportation that—</text> <subparagraph id="H7F5BDCCB8AC846B0B40BC1C8F109A5B5"><enum>(A)</enum><text>identifies how activities described in subsection (b) will be carried out by the Institute; and</text></subparagraph> 
<subparagraph id="H3C5D65A8DC2646E6B09608C7B88D0EC6"><enum>(B)</enum><text>includes a Memorandum of Understanding, signed by all partners, that comprehensively addresses all aspects of the Institute’s work, including how intellectual property and revenue sharing from resulting technological developments will be handled;</text></subparagraph> <subparagraph id="H0F1ED22A3329494EA5B19A378E970695"><enum>(C)</enum><text>includes such other information as the Secretary may require. </text></subparagraph></paragraph></subsection> 
<subsection id="HD7B3A5A149A441AEBC6E4027522C2349"><enum>(d)</enum><header>Considerations</header><text>In selecting the applicant that will receive funding to establish the Institute, the Secretary of Transportation shall consider—</text> <paragraph id="H9330F35674624CEEB2C339BDD40A8A32"><enum>(1)</enum><text>the extent to which the applicant’s proposal maximizes greenhouse gas reductions and other environmental benefits;</text></paragraph> 
<paragraph id="H6531DCE13A9C482D9254CA9001442486"><enum>(2)</enum><text>the ability of the applicant’s proposal to increase the use of low- and zero-emission freight rail technologies among the United States freight and passenger rail industry;</text></paragraph> <paragraph id="H20DC41CE91EF4323B70745A953D0D92C"><enum>(3)</enum><text>the anticipated public benefits of the applicant’s proposal, including the creation of construction, manufacturing, and services jobs that pay prevailing wages;</text></paragraph> 
<paragraph id="HF6F1569BBA5847E0B8CE3D8997493127"><enum>(4)</enum><text>proposed plans to train workers from the area surrounding the Institute to develop competitive advanced manufacturing, battery or hydrogen power, and advanced freight utilization, network safety and logistics technology skills;</text></paragraph> <paragraph id="H72FED75151D2457ABF5AB2DC8992E207"><enum>(5)</enum><text>the degree to which the applicant, including its freight rail locomotive manufacturer, has experience—</text> 
<subparagraph id="HBA1DF884EE4F4A6CAEF995ED4665F505"><enum>(A)</enum><text>carrying out battery and hydrogen research on freight locomotives that reduce greenhouse gas emissions; and</text></subparagraph> <subparagraph id="H3F3F1F7AB6D7408C9EF7CB667641F0B1"><enum>(B)</enum><text>developing freight rail advanced signaling, network safety, and logistics technologies;</text></subparagraph></paragraph> 
<paragraph id="H61E60DB8CBF5435AB1A88DCAEE08613D"><enum>(6)</enum><text>the extent to which the applicant’s proposal increases the proportional amount of goods moved by freight rail in the United States;</text></paragraph> <paragraph id="HEED5920999214869AED900146D001731"><enum>(7)</enum><text>the extent to which such proposal—</text> 
<subparagraph id="H2C6E407DEA8A4B9CBCFC5D97075F7317"><enum>(A)</enum><text>maximizes the private share of the total cost of the institute beyond the minimum level required under subsection (d); and </text></subparagraph> <subparagraph id="HA2D1D4748CDE42298C753D2A4231C79E"><enum>(B)</enum><text>sustains the private investment up to and beyond 2026; and</text></subparagraph></paragraph> 
<paragraph id="H4B8A674A238F4A9DB6D751D391F9F838"><enum>(8)</enum><text>whether the proposed Institute is located at a site that—</text> <subparagraph id="H6BF06367DA944EC7B7A07E51AF9C2B8E"><enum>(A)</enum><text>has legacy rail infrastructure;</text></subparagraph> 
<subparagraph id="H4F90A82F0EE84E6A8B848407CB51C901"><enum>(B)</enum><text>has access to freight rail tracks and rail connections; and</text></subparagraph> <subparagraph id="HA6A5440BE847498490240C60766D7D78"><enum>(C)</enum><text>is located on a redeveloped brownfield site in close proximity to a freight rail locomotive manufacturer, an institution of higher education, and a short line or regional railroad.</text></subparagraph></paragraph></subsection> 
<subsection id="HD6B630DE94C84BC7BC75FC72ABB429EA"><enum>(e)</enum><header>Funding requirement</header><text>The non-Federal share of the costs of the Institute’s research and development program shall be not less than 50 percent.</text></subsection> <subsection id="HCEC860F6A7CC4DD38321FC807CC05A6E"><enum>(f)</enum><header>Notification</header> <paragraph id="HFDFC66988ECE4812A08A76B495B79FD7"><enum>(1)</enum><header>Notice</header><text>Not later than 3 days after Congress appropriates funds for the Institute for any fiscal year, the Secretary of Transportation shall submit to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name>—</text> 
<subparagraph id="H05C09361613F4903AC7F4981D89B8D43"><enum>(A)</enum><text>the institution of higher education and freight rail locomotive manufacturer that have been selected to receive such funding to operate the Institute; and</text></subparagraph> <subparagraph id="HC1F63484318C4A1BA8429DD989B8DC63"><enum>(B)</enum><text>a summary of activities to be carried out by the Institute.</text></subparagraph></paragraph> 
<paragraph id="HEB9ED3DE5B2C4EC6B49B14D1F17A7B1B"><enum>(2)</enum><header>Annual report</header><text>Not later than 1 year after Congress appropriates funds for the Institute for any fiscal year, the Secretary shall submit a report to the committees listed under paragraph (1) that summarizes the work of the Institute on—</text> <subparagraph id="H0BDD100D39C34A448352276A4B880EEC"><enum>(A)</enum><text>low- and zero-emission rail technologies;</text></subparagraph> 
<subparagraph id="HFDCFA664D6F440C28F7814D8161E1F81"><enum>(B)</enum><text>increased freight rail utilization; and</text></subparagraph> <subparagraph id="H7B71F4EFEFDC42669BA72F0D707837AF"><enum>(C)</enum><text>training a workforce in advanced manufacturing, battery or hydrogen power, advanced freight utilization, network safety, logistics technology skills, and advanced rail safety and logistics technologies.</text></subparagraph></paragraph></subsection> 
<subsection id="H47FE5288ABF84194ADF062E237BA35D9"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $120,000,000 for each of the fiscal years 2022 through 2026, to carry out the activities of the Institute described in subsection (b). Such sums shall remain available until expended.</text></subsection> <subsection id="HC7E18FBDDFA946428C28E03A962C0485"><enum>(h)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H9B356DDAC53949A2B36EEC97E2A90D56"><enum>(1)</enum><header>Freight rail locomotive manufacturer</header><text>The term <term>freight rail locomotive manufacturer</term> means a company—</text> <subparagraph id="H9F26B70CBD104145B5574210D2BE3E88"><enum>(A)</enum><text>headquartered in the United States; and </text></subparagraph> 
<subparagraph id="HE9B13375B4B64166A86BBB02C434AB44"><enum>(B)</enum><text>that is engaged in the design, manufacture, and sale of freight rail locomotives, train network systems, engines, parts, logistics, rail safety and braking systems, and other freight rail and locomotive products.</text></subparagraph></paragraph> <paragraph id="H93BF9DCFF82643B9BDE94669F0751834"><enum>(2)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
