which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To abolish the Agency for Toxic Substances and Disease Registry, and for other purposes.</official-title></form><legis-body id="H95EBE3E583564C97B3AA7AB31B216CCC" style="OLC"><section id="HF51A889BF25247568B37266D5885B14F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Freedom for Farmers Act of 2021</short-title></quote>.</text></section><section id="H841726357D7841E3A04662CFE9A737FA"><enum>2.</enum><header>Abolishment of Agency for Toxic Substances and Disease Registry</header><subsection id="H731A15FA7133404B92EB1C7B3CDDC24C"><enum>(a)</enum><header>Abolishment of Agency</header><text display-inline="yes-display-inline">The Agency for Toxic Substances and Disease Registry (in this section referred to as the <quote>Agency</quote>) is abolished effective on the date that is 1 year after the date of enactment of this Act.</text></subsection><subsection id="HDD84DF4C8D20498F9C8928530160894D"><enum>(b)</enum><header>Termination of functions</header><text display-inline="yes-display-inline">Except as provided in subsection (c)(1), all functions of the Agency shall terminate on the date specified in subsection (a).</text></subsection><subsection id="HDFEBF94C21C9459FAF3A87B356352FCA"><enum>(c)</enum><header>Transferred authority</header><paragraph id="H541C08F371754AFEA062FC9DEA2E9633"><enum>(1)</enum><header>In general</header><text>Prior to the date specified in subsection (a), the Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall transfer the authority vested in the Agency by section 104(i)(1)(A) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(i)(1)(A)</external-xref>) as in effect on the day before the date of enactment of this Act (relating to a national registry of serious diseases and illnesses and a national registry of persons exposed to toxic substances) to an appropriate agency within the Department of Health and Human Services.</text></paragraph><paragraph id="HBA52C912845F432EA7262D69CEEF960C"><enum>(2)</enum><header>Corresponding transfer of assets and personnel</header><text>In connection with the transfer of authority under paragraph (1), the Secretary may transfer within the Department of Health and Human Services such assets, funds, personnel, records, and other property relating to the transferred authority as the Secretary determines to be appropriate.</text></paragraph></subsection><subsection id="H48CAEEB0F095406F8A8B6D9B03B1EEC5"><enum>(d)</enum><header>Wind-Up period</header><paragraph id="HCA6B33B8F8EA41D58AEBC970A65D1314"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>wind-up period</term> means the period beginning on the date of the enactment of this Act and ending on the date specified in subsection (a).</text></paragraph><paragraph id="H494A688D68CB426681F71127F4E0C24B"><enum>(2)</enum><header>Responsibilities</header><text>The Secretary shall be responsible for—</text><subparagraph id="H0856932A9BF34505A2933D63BC8376EC"><enum>(A)</enum><text>the administration and wind-up, during the wind-up period, of all functions of the Agency that are terminated by this section;</text></subparagraph><subparagraph id="H7DD1075D502F4F85975D73DF74EAA3F2"><enum>(B)</enum><text>the administration and wind-up, during the wind-up period, of any outstanding obligations of the Federal Government under any programs of the Agency that are terminated by this section; and</text></subparagraph><subparagraph id="H22D5E766096B41DBA6ECBF64DC3BE3A8"><enum>(C)</enum><text>taking such other actions as may be necessary to wind-up any outstanding affairs of the Agency before the end of the wind-up period.</text></subparagraph></paragraph></subsection></section><section id="HF4AF6135B7EF4EC38263ED29B8EFF156"><enum>3.</enum><header>Conforming amendments</header><subsection id="H1C80F836B95148F2995C2A0ED566D7E4"><enum>(a)</enum><header>CERCLA</header><text display-inline="yes-display-inline">The Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref> et seq.) is amended—</text><paragraph id="HF136F2BDDF514E7BA6037D6A6D575F58"><enum>(1)</enum><text display-inline="yes-display-inline">in section 104 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604</external-xref>), by amending subsection (i) to read as follows:</text><quoted-block display-inline="no-display-inline" id="HD14EE0ED337448C597DBAA1D3011D580" style="OLC"><subsection id="H6BABDA2AD5F445CCB9EC9AC3B82E86E0"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall, in cooperation with the States, maintain a national registry of serious diseases and illnesses and a national registry of persons exposed to toxic substances.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H6B91710B83224C9F846507C7944C7236"><enum>(2)</enum><text>in section 111 (<external-xref legal-doc="usc" parsable-cite="usc/42/9611">42 U.S.C. 9611</external-xref>)—</text><subparagraph id="HA9EACDF5EAB846CEBDB8F3F47F18F364"><enum>(A)</enum><text>by striking subsection (c)(4); and</text></subparagraph><subparagraph id="H2515D81E7DCF4070A290EC317453FCF9"><enum>(B)</enum><text>by striking subsection (m); and</text></subparagraph></paragraph><paragraph id="H9154DD63CA0442EC914C3339A6E467DF"><enum>(3)</enum><text>in section 310(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/9659">42 U.S.C. 9659(a)(2)</external-xref>), by striking <quote>and the Administrator of the ATSDR</quote>.</text></paragraph></subsection><subsection id="HD2E731AB814F4643A806AE72296E20A4"><enum>(b)</enum><header>Other conforming changes</header><paragraph id="HFC8B6C2D85454118BCDB085F2D70AF95"><enum>(1)</enum><text display-inline="yes-display-inline">Section 2704 of title 10, United States Code, is amended by striking subsection (f).</text></paragraph><paragraph id="HEFFAD0EA50F5490297586F7192644F85"><enum>(2)</enum><text display-inline="yes-display-inline">Section 405(d)(1) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601(d)(1)</external-xref>) is amended by striking <quote>acting through the Director of the Agency for Toxic Substances and Disease Registry,</quote>.</text></paragraph><paragraph id="HCF7FC1D54AF0415B82BF985CA3C3AB80"><enum>(3)</enum><text display-inline="yes-display-inline">Section 209(c)(1)(A) of the Fire Administration Authorization Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/29/671a">29 U.S.C. 671a(c)(1)(A)</external-xref>) is amended by striking <quote>the Administrator of the Agency for Toxic Substances and Disease Registry,</quote>.</text></paragraph><paragraph id="HD09391164490423383B442559EDC41B1"><enum>(4)</enum><text>Section 118(e)(3)(A) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1268">33 U.S.C. 1268(e)(3)(A)</external-xref>) is amended by striking <quote>, in consultation with the Research Office, the Agency for Toxic Substances and Disease Registry, and Great Lakes States</quote> and inserting <quote>, in consultation with the Research Office and Great Lakes States,</quote>.</text></paragraph><paragraph id="H704075F160484F4DBCCD9184176C90B9"><enum>(5)</enum><text>Section 317F(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-7">42 U.S.C. 247b–7(a)</external-xref>) is amended—</text><subparagraph id="HB1E8DCF7F780452CBD41A7F4958BA30F"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and the Agency for Toxic Substances and Disease Registry</quote>; and</text></subparagraph><subparagraph id="H6E2D4D6E3A3546CD8FC2E03800972D05"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>or the Agency for Toxic Substances and Disease Registry</quote>.</text></subparagraph></paragraph><paragraph id="HE9C2EF2664F34005A14E05F7F50D8D50"><enum>(6)</enum><text>Section 399S of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-7">42 U.S.C. 280g–7</external-xref>) is amended—</text><subparagraph id="H31737264440C471A93EAB0C08845D1D6"><enum>(A)</enum><text>in subsection (b)(1)(A)(i)—</text><clause id="H3E3FA214654E47BEB8B2EDED343769AB"><enum>(i)</enum><text>by inserting <quote>and</quote> at the end of subclause (II);</text></clause><clause id="H30C940526F1B483F86486F34BC6A0F28"><enum>(ii)</enum><text>by striking subclause (III); and</text></clause><clause id="HF70259894D3C4AED8D86475FC31C1745"><enum>(iii)</enum><text>by redesignating subclause (IV) as subclause (III); and</text></clause></subparagraph><subparagraph id="HE5BE503F579D4B99A32179DF75D0A984"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (d)(1)(A)—</text><clause id="H7E11ADAD12E14CECB94F0807E8EDCA0F"><enum>(i)</enum><text>by striking clause (iv); and</text></clause><clause id="H63BA06EABF5B456796DF4EDCDA98635A"><enum>(ii)</enum><text>by redesignating clauses (v) through (vii) as clauses (iv) through (vi), respectively.</text></clause></subparagraph></paragraph><paragraph id="HE0D90F78FBC348BA9904EFEB0F229835"><enum>(7)</enum><text>Section 399V–6(e)(5) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-17">42 U.S.C. 280g–17(e)(5)</external-xref>) is amended by striking <quote>and the Assessments of Chemical Exposures Program of the Agency for Toxic Substances and Disease Registry</quote>.</text></paragraph><paragraph id="H0FB70FA8FAF4460BAD8D61A2E6CF96DC"><enum>(8)</enum><text>Section 3(c) of the ICCVAM Authorization Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/285l-3">42 U.S.C. 285l–3(c)</external-xref>) is amended—</text><subparagraph id="HF06192A1A1E04F72B3BA5EFE1A0B67D1"><enum>(A)</enum><text>by striking paragraph (1); and</text></subparagraph><subparagraph id="H1A71F011DAD442AD9A47F597CCDC12CB"><enum>(B)</enum><text>by redesignating paragraphs (2) through (16) as paragraphs (1) through (15), respectively.</text></subparagraph></paragraph><paragraph id="H902AA981600C40DAB348C993291AB660"><enum>(9)</enum><text>Section 2201(e) of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref> note) is amended by striking <quote>the Director of the Agency for Toxic Substances and Disease Registry of</quote> each place it appears.</text></paragraph><paragraph id="H148104EFD63D47409C616AE43A42893B"><enum>(10)</enum><text>Section 2203 of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-27">42 U.S.C. 300j–27</external-xref>) is amended—</text><subparagraph id="H52FA931AC6684852882CDBB3B186B549"><enum>(A)</enum><text>in subsection (b), by striking <quote>within the Agency for Toxic Substances and Disease Registry or the Centers for Disease Control and Prevention at the discretion of the Secretary</quote> and inserting <quote>within the Centers for Disease Control and Prevention</quote>; and</text></subparagraph><subparagraph id="HA6767905C075490588CABBBEC8B65321"><enum>(B)</enum><text>in subsection (c)(1)(A), by striking <quote>, within the Agency for Toxic Substances and Disease Registry</quote>.</text></subparagraph></paragraph><paragraph id="H29E1D67001AD4BF6A909F0CF2E5A673A"><enum>(11)</enum><text>Section 709(a)(7) of the Security and Accountability for Every Port Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/300hh-14">42 U.S.C. 300hh–14(a)(7)</external-xref>) is amended by striking <quote>the Agency for Toxic Substances and Disease Registry,</quote>.</text></paragraph><paragraph id="H5DA0486B178646758061D7D9DB562DBC"><enum>(12)</enum><text display-inline="yes-display-inline">Section 3001 of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6921">42 U.S.C. 6921(b)(1)</external-xref>) is amended by striking <quote>the Agency for Toxic Substances and Disease Registry and</quote>.</text></paragraph><paragraph id="H166E269B968E4D2EAD9B1515264D33CE"><enum>(13)</enum><text>Section 3019 of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6939a">42 U.S.C. 6939a</external-xref>) is amended—</text><subparagraph id="H5E6CB2E8D1D9449A9E499614226A9110"><enum>(A)</enum><text>by striking subsections (b) through (g); and</text></subparagraph><subparagraph id="H1C77720500974DD7BAA54ECD350BC315"><enum>(B)</enum><text>in subsection (a), by striking the subsection designation and heading.</text></subparagraph></paragraph><paragraph id="H56FEF1802E174FEA859F895147197AAD"><enum>(14)</enum><text display-inline="yes-display-inline">Section 103(d)(2)(A) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7403">42 U.S.C. 7403(d)(2)(A)</external-xref>) is amended by striking <quote>the Agency for Toxic Substances and Disease Registry,</quote>.</text></paragraph></subsection><subsection id="H42223F2C732D4446AF1A14B0BE314159"><enum>(c)</enum><header>Applicability</header><text>The amendments made by this section apply beginning on the date specified in section 2(a).</text></subsection></section></legis-body></bill>
