committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Foreign Agents Registration Act of 1938 to clarify the application to informational materials posted on online platforms by agents of foreign principals of the disclaimer requirements applicable under such Act to informational materials transmitted by agents of foreign principals through the United States mails, and for other purposes.</official-title></form><legis-body id="HDAE66C67AB574DE3AC8828AF140D7004" style="OLC"><section id="H52F466C14E6647AEA27A42234B5D9BE1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Agent Disclaimer Enhancement Act of 2021</short-title></quote> or the <quote><short-title>FADE Act of 2021</short-title></quote>.</text></section><section id="H6E1CE2AD5ECE493286DCA42147933B0E"><enum>2.</enum><header>Disclaimer requirements for materials posted on online platforms by agents of foreign principals on behalf of clients</header><subsection id="H17DE914EF86346038ED1112DA5EABE34"><enum>(a)</enum><header>Method and form of disclaimer; preservation of disclaimers by certain social media platforms</header><paragraph id="H86DF95E29C8B4CDCB6E8AF62FDA49AA7"><enum>(1)</enum><header>Requirements described</header><text>Section 4(b) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/614">22 U.S.C. 614(b)</external-xref>) is amended—</text><subparagraph id="H333592F7AB084A8CA4E0F8873EA17ADB"><enum>(A)</enum><text>by striking <quote>(b) It shall be unlawful</quote> and inserting <quote>(b)(1) It shall be unlawful</quote>; and</text></subparagraph><subparagraph id="HF54E5919005148DD99BAB2E0D49D93D4"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="traditional" id="H4756EDF1DCB44F3288374CA3FC1E19F1" display-inline="no-display-inline"><paragraph id="HE07E9CDF5BB54D04ADB65865E18876C5" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In the case of informational materials for or in the interests of a foreign principal which are transmitted or caused to be transmitted by an agent of a foreign principal by posting on an online platform, the agent shall ensure that the conspicuous statement required to be placed in such materials under this subsection is placed directly with the material posted on the platform and is not accessible only through a hyperlink or other reference to another source.</text></paragraph><paragraph id="HDB76D5F51D0E4B168D3911A8121179C2" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">If the Attorney General determines that the application of paragraph (2) to materials posted on an online platform is not feasible because the length of the conspicuous statement required to be placed in materials under this subsection makes the inclusion of the entire statement incompatible with the posting of the materials on that platform, an agent may meet the requirements of paragraph (2) by ensuring that an abbreviated version of the statement, stating that the materials are distributed by a foreign agent on behalf of a clearly identified foreign principal, is placed directly with the material posted on the platform.</text></paragraph><paragraph id="HAFAA6853859140F4ADE90EB28FE8BCE5" indent="up1"><enum>(4)</enum><text>An online platform on which informational materials described in paragraph (2) are posted shall ensure that the conspicuous statement described in such paragraph (or, if applicable, the abbreviated statement described in paragraph (3)) is maintained with such materials at all times, including after the material is shared in a social media post on the platform, but only if the platform has 50,000,000 or more unique monthly United States visitors or users for a majority of months during the 12 months preceding the dissemination of the materials.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H4CE78B32FFDA4772AC19AAB1DCF495BA"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall apply with respect to materials disseminated on or after the expiration of the 60-day period which begins on the date of the enactment of this Act, without regard to whether or not the Attorney General has promulgated regulations to carry out such amendments prior to the expiration of such period.</text></paragraph></subsection><subsection id="HE5AAEA299C5E470AB93C35B440CEEEE4"><enum>(b)</enum><header>Application of requirements to persons outside the United States</header><paragraph id="H22F703CA684C491CA22F0750BAB071AE"><enum>(1)</enum><header>In general</header><text>Section 4(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/614">22 U.S.C. 614(b)(1)</external-xref>), as amended by subsection (a), is amended by striking <quote>any person within the United States</quote> and inserting <quote>any person</quote>.</text></paragraph><paragraph id="HFE51A2D7B57B4682B30CEEABC034367E"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply with respect to materials disseminated on or after the expiration of the 60-day period which begins on the date of the enactment of this Act, without regard to whether or not the Attorney General has promulgated regulations to carry out such amendments prior to the expiration of such period.</text></paragraph></subsection><subsection id="HC4B9D17A4B26472397251DA9A027B1A4"><enum>(c)</enum><header>Requirements for online platforms disseminating informational materials transmitted by agents of foreign principals</header><paragraph id="H82FC1B974BA6451F8F929CB7AB868125"><enum>(1)</enum><header>In general</header><text>Section 4 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/614">22 U.S.C. 614</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="traditional" id="HE95EA2235D9940568DC3C42FB1D4D740" display-inline="no-display-inline"><subsection id="H1159615EC5994D3395945E9203467D9A"><enum>(g)</enum><text display-inline="yes-display-inline">If the Attorney General determines that an agent of a foreign principal transmitted or caused to be transmitted informational materials on an online platform for or in the interests of the foreign principal and did not meet the requirements of subsection (b)(2) (relating to the conspicuous statement required to be placed in such materials)—</text><paragraph id="H7AB98576FE2846AAB65537EF22D07E11"><enum>(1)</enum><text>the Attorney General shall notify the online platform; and</text></paragraph><paragraph id="H867F818CF16841A0BCE5589FE91C0894"><enum>(2)</enum><text display-inline="yes-display-inline">the online platform shall remove such materials and use reasonable efforts to inform recipients of such materials that the materials were disseminated by a foreign agent on behalf of a foreign principal. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H5F12BF31EE01413999E16730C1458A23"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply with respect to materials disseminated on or after the expiration of the 60-day period which begins on the date of the enactment of this Act. </text></paragraph></subsection><subsection id="H6B675E7B624B4F9EA82F16E73B00E396"><enum>(d)</enum><header>Definition</header><text>Section 1 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611</external-xref>) is amended by inserting after subsection (i) the following new subsection:</text><quoted-block style="traditional" id="H7E9D337379994911A06652886AEC7F97" display-inline="no-display-inline"><subsection id="H872EB3830441412FA751382B13F5EE13"><enum>(j)</enum><text display-inline="yes-display-inline">The term <term>online platform</term> means any public-facing website, web application, or digital application (including a social network, ad network, or search engine).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H2C2483679E4B451CB1F6580C52BA99EA"><enum>3.</enum><header>Clarification of treatment of individuals who engage with the United States in political activities for a foreign principal in any place as agents of foreign principals</header><text display-inline="no-display-inline">Section 1(c)(1)(i) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611(c)(1)(i)</external-xref>) is amended by inserting after <quote>United States</quote> the following: <quote>(whether within or outside of the United States)</quote>.</text></section><section id="H3828E8DB751E4479A7AC617778EA169B"><enum>4.</enum><header>Analysis and report on challenges to enforcement of Foreign Agents Registration Act of 1938</header><subsection id="H5711A012CAAC4CF389C5CD8F161481DB"><enum>(a)</enum><header>Analysis</header><text display-inline="yes-display-inline">The Attorney General shall conduct an analysis of the legal, policy, and procedural challenges to the effective enforcement of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611</external-xref> et seq.).</text></subsection><subsection id="H71065763B88C4C6D8408245CFDA82020"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Attorney General shall submit to Congress a report on the analysis conducted under subsection (a), and shall include in the report such recommendations, including recommendations for revisions to the Foreign Agents Registration Act of 1938, as the Attorney General considers appropriate to promote the effective enforcement of such Act.</text></subsection></section></legis-body></bill>
