Rural Broadband Permitting Efficiency Act of 2021.</toc-entry></toc></section><section id="HF10B51862B54467EA811F5EF3B38292B"><enum>3.</enum><header>Enhancing Administrative Reviews for Broadband Deployment Act</header><subsection id="H0AE6DB7F46EA45D1B98B86268325D74A"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote><short-title>Enhancing Administrative Reviews for Broadband Deployment Act</short-title></quote>. </text></subsection><subsection id="H7DDDEB92ABF746919BD035449B3379DD"><enum>(b)</enum><header>Enabling administrative review</header><paragraph id="HEEB3EECDEB3F4A11963021881B61D1AB"><enum>(1)</enum><header>Definitions</header><text>In this section:</text><subparagraph id="HABF8CE77E6114801A784E28A2621D004"><enum>(A)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><clause id="H955BEFB9918E4AFB911A2C729E283ACC"><enum>(i)</enum><text>the Committee on Energy and Commerce of the House of Representatives;</text></clause><clause id="HE188D135A76143CD83DFB03A06FCE05E"><enum>(ii)</enum><text>the Committee on Natural Resources of the House of Representatives;</text></clause><clause id="HE722291EDA7B4CC8820D430ECAB42D86"><enum>(iii)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; and</text></clause><clause id="H7BAA882143FB49C380A231756A6A4BCC"><enum>(iv)</enum><text>the Committee on Environment and Public Works of the Senate.</text></clause></subparagraph><subparagraph id="HCC1A39CBF97F4F2BB7359A9C756D5795"><enum>(B)</enum><header>Communications facility</header><text>The term <term>communications facility</term> includes—</text><clause id="H1F71958A800041F2AA4F9F8E30A9FC53"><enum>(i)</enum><text>any infrastructure, including any transmitting device, tower, or support structure, and any equipment, switch, wiring, cabling, power source, shelter, or cabinet, associated with the licensed or permitted unlicensed wireless or wireline transmission of any writing, sign, signal, data, image, picture, or sound of any kind; and</text></clause><clause id="H47B1282739F64279BD94042BD0556E81"><enum>(ii)</enum><text>any antenna or apparatus that—</text><subclause id="H9A10DF5C2BB741949697D8F8ADAADBFE"><enum>(I)</enum><text>is designed for the purpose of emitting radio frequency;</text></subclause><subclause id="H861570685C5641B687345AAE3F745380"><enum>(II)</enum><text>is designed to be operated, or is operating, from a fixed location pursuant to authorization by the Commission or is using a duly authorized device that does not require an individual license; and</text></subclause><subclause id="HB8C617A743AF4967BBFAFF52B5900204"><enum>(III)</enum><text>is added to a tower, building, or other structure.</text></subclause></clause></subparagraph><subparagraph id="H6B7E5A6AE6384459A8058DE486A26906"><enum>(C)</enum><header>Communications site</header><text>The term <term>communications site</term> means an area of covered land designated for communications uses.</text></subparagraph><subparagraph id="HA9C0335AE53740E3A680131312356D4B"><enum>(D)</enum><header>Communications use</header><text>The term <term>communications use</term> means the placement and operation of a communications facility.</text></subparagraph><subparagraph id="H6FD185D2B9444A7ABD337AEC53CB3CAE"><enum>(E)</enum><header>Communications use authorization</header><text>The term <term>communications use authorization</term> means an easement, right-of-way, lease, license, or other authorization to locate or modify a communications facility on covered land by the Department concerned for the primary purpose of authorizing the occupancy and use of the covered land for communications use.</text></subparagraph><subparagraph id="H3624712C744140228D9809E655B7FA96"><enum>(F)</enum><header>Covered land</header><text>The term <term>covered land</term> means—</text><clause id="HE867442FEE2F471EBE07C2C7E91E2476"><enum>(i)</enum><text>public land administered by the Secretary of the Interior; and</text></clause><clause id="H02B662BCEB2249E6B9223E494557ED34"><enum>(ii)</enum><text>National Forest System land.</text></clause></subparagraph><subparagraph id="H36AC919F006B4B06B7B5093BDAC06616"><enum>(G)</enum><header>Department concerned</header><text>The term <term>Department concerned</term> means the Department of the Interior or the Department of Agriculture.</text></subparagraph><subparagraph id="H5F9C96CC03D6459FBE5B3176B850E5F1"><enum>(H)</enum><header>Organizational unit</header><text>The term <term>organizational unit</term> means—</text><clause id="HE6A227EDD5AF4FF48034E9ACD0B7B70A"><enum>(i)</enum><text>with respect to public land administered by the Secretary of the Interior—</text><subclause id="H264E03EBA54545CFAAD65B315C342E08"><enum>(I)</enum><text>a State office;</text></subclause><subclause id="H940E1FFCC606435489D51367A84BDCF9"><enum>(II)</enum><text>a district office; or</text></subclause><subclause id="HA38816BFBFA64D0E8CC7D2EC19ED2CBE"><enum>(III)</enum><text>a field office; and</text></subclause></clause><clause id="H68B4647EF0C14FCD89210DFCDA1FB698"><enum>(ii)</enum><text>within the Forest Service—</text><subclause id="H06535376F4904C78B99A70FEEDB93F83"><enum>(I)</enum><text>a regional office;</text></subclause><subclause id="HDEC3A63310F04815A8D57E4AD415971C"><enum>(II)</enum><text>the headquarters;</text></subclause><subclause id="HB086C4704D2B43F89FC4FBCA747EAA12"><enum>(III)</enum><text>a management unit; or</text></subclause><subclause id="H9DDF71006B984634BE7159AD9C63B0BD"><enum>(IV)</enum><text>a ranger district office.</text></subclause></clause></subparagraph><subparagraph id="HA5126355B9D24806A9BB7460FC55E131"><enum>(I)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><clause id="H9D72F10D758E41069F7C0F11BC4B950B"><enum>(i)</enum><text>the Secretary of the Interior, with respect to public land; and</text></clause><clause id="H4A4E14324D9C4564ACEECBC2087F5D29"><enum>(ii)</enum><text>the Secretary of Agriculture, with respect to National Forest System land.</text></clause></subparagraph></paragraph><paragraph id="H2CBD9EC77D3D4FD783FE24516FC1CF19"><enum>(2)</enum><header>Study required</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary concerned shall submit to the appropriate committees of Congress a report that—</text><subparagraph id="HB406F530BB314DDEB65DB5824589CAEC"><enum>(A)</enum><text>provides an assessment on programmatic or administrative barriers to reviewing communications use authorizations by the Department concerned or organizational units of the Department concerned;</text></subparagraph><subparagraph id="H969AEE08709C4FC6B4982E40DDDAEFD6"><enum>(B)</enum><text>provides an assessment whether there are rules or regulations of the Department concerned that could be revised to improve the efficiency of reviewing a communications use authorization;</text></subparagraph><subparagraph id="H0781D239B71848BA9598CBC9A0D9AFD9"><enum>(C)</enum><text>describes the process for prioritizing the review of a communications use authorization; and</text></subparagraph><subparagraph id="H3A59548A0D6B4637A0C53350915026EA"><enum>(D)</enum><text>provides a plan to ensure adequate staffing throughout organizational units of the Department concerned to review communications use authorizations in a timely manner.</text></subparagraph></paragraph></subsection></section><section id="HA07EF6439B5D4542BFB5081AC93EF2D3"><enum>4.</enum><header>DIGITAL Applications Act</header><subsection id="HF5DB6EFA8B224BE6BB0D412306DE6BE2"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote><short-title>Deploying Infrastructure with Greater Internet Transactions And Legacy Applications Act</short-title></quote> or the <quote><short-title>DIGITAL Applications Act</short-title></quote>. </text></subsection><subsection id="H26B85C13F3D84F239DC59296D968E1F5"><enum>(b)</enum><header>Establishment of an online portal for Form <enum-in-header>299</enum-in-header></header><paragraph id="H81DB1CE5A0D34F0AAF780273092F0B0E"><enum>(1)</enum><header>Definitions</header><text>In this section:</text><subparagraph id="H7051F970900245EE90B6FD52E5CC4583"><enum>(A)</enum><header>Appropriate committees of congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><clause id="H9C4A380D37A0421E90EB93692E1E7ECE"><enum>(i)</enum><text>the Committee on Energy and Commerce of the House of Representatives;</text></clause><clause id="HBD67192BE3404337B12E82AA5ED801B8"><enum>(ii)</enum><text>the Committee on Natural Resources of the House of Representatives;</text></clause><clause id="HD27712B1F7E8496EB88CD0949010E9CA"><enum>(iii)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; and</text></clause><clause id="H34C42637F8424E0291D677D6F04CB41E"><enum>(iv)</enum><text>the Committee on Environment and Public Works of the Senate.</text></clause></subparagraph><subparagraph id="H92FB85EC83ED4A3A9BF3857F91F6551D"><enum>(B)</enum><header>Assistant secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text></subparagraph><subparagraph id="HC2ABBC58F71B4A9E9FDB013CB81B2304"><enum>(C)</enum><header>Department concerned</header><text>The term <term>Department concerned</term> means the Department of the Interior or the Department of Agriculture.</text></subparagraph><subparagraph id="HBCDAB21A59974BDF8C5B1918D744E3CC"><enum>(D)</enum><header>Form <enum-in-header>299</enum-in-header></header><text display-inline="yes-display-inline">The term <term>Form 299</term> means the form established under section 6409(b)(2)(A) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(b)(2)(A)</external-xref>) or any successor form.</text></subparagraph><subparagraph id="HB25417B8046C4C68B67A791C4E4B1C2E"><enum>(E)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><clause id="HE0D069C09AAE41209102CBE4C1B029EF"><enum>(i)</enum><text>the Secretary of the Interior, with respect to land administered by such Secretary; and</text></clause><clause id="HD9E54FD8633240F1948B915A7F4DD0A7"><enum>(ii)</enum><text>the Secretary of Agriculture, with respect to National Forest System land.</text></clause></subparagraph></paragraph><paragraph id="HE63F191725504861A8EE933E5C974876"><enum>(2)</enum><header>Establishment of online portal</header><subparagraph id="HA71FFB9F82224003AB550F45E4047508"><enum>(A)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary concerned shall establish an online portal for the acceptance, processing, and disposal of a Form 299.</text></subparagraph><subparagraph id="HA89EE865EDD746FFA563B196019B1D30"><enum>(B)</enum><header>Notification</header><text display-inline="yes-display-inline">Not later than 3 business days after the date on which the online portal has been established pursuant to subparagraph (A), the Secretary concerned shall notify the Assistant Secretary of such establishment.</text></subparagraph></paragraph><paragraph id="HF66FD29CCDD34656A9A3471F83DF11FD"><enum>(3)</enum><header>Availability of online portal</header><text>The Assistant Secretary shall publish on the website of the National Telecommunications and Information Administration a link to each online portal established pursuant to paragraph (1)(A).</text></paragraph></subsection></section><section id="H40443D587F86413BB41555998E784B64"><enum>5.</enum><header>Facilitating DIGITAL Applications Act</header><subsection id="H8619E7B0A9924EACA9A5D8BB51CC549A"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote><short-title>Facilitating the Deployment of Infrastructure with Greater Internet Transactions And Legacy Applications Act</short-title></quote> or the <quote><short-title>Facilitating DIGITAL Applications Act</short-title></quote>. </text></subsection><subsection id="H4B7289974291408FA04BA7B0D4546A5B"><enum>(b)</enum><header>Barriers to implementation of an online portal for Form 299</header><paragraph id="H8643485462674248BA7B482F6A64921F"><enum>(1)</enum><header>Definitions</header><text>In this section:</text><subparagraph id="H7C7DF062289A44198B1004B1F6B12776"><enum>(A)</enum><header>Appropriate committees of congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><clause id="H953A9234700C4F758843008F17DFDB6B"><enum>(i)</enum><text>the Committee on Energy and Commerce of the House of Representatives;</text></clause><clause id="HBB5299801E154A3595033628CFA55370"><enum>(ii)</enum><text>the Committee on Natural Resources of the House of Representatives;</text></clause><clause id="H0257092D5D7E4914AC5189A8D5CD23FC"><enum>(iii)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; and</text></clause><clause id="H5C942B51C52D44DC9AE5342167C95210"><enum>(iv)</enum><text>the Committee on Environment and Public Works of the Senate.</text></clause></subparagraph><subparagraph id="H4883F3B380CC4F1DA677BC424FCA8BC2"><enum>(B)</enum><header>Assistant secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text></subparagraph><subparagraph id="HA49D9F0231D74E1F9418E90B3FE0063E"><enum>(C)</enum><header>Communications facility</header><text>The term <term>communications facility</term> includes—</text><clause id="HDFE15E48788D484D9DB96E74B5DD9048"><enum>(i)</enum><text>any infrastructure, including any transmitting device, tower, or support structure, and any equipment, switch, wiring, cabling, power source, shelter, or cabinet, associated with the licensed or permitted unlicensed wireless or wireline transmission of any writing, sign, signal, data, image, picture, and sound of any kind; and</text></clause><clause id="H2492A89D271748FEAED0425170BD27CA"><enum>(ii)</enum><text>National Forest System land.</text></clause></subparagraph><subparagraph id="HDDA038ACBC3F479BBB9ED0B87CE6171D"><enum>(G)</enum><header>Department concerned</header><text>The term <term>Department concerned</term> means the Department of the Interior or the Department of Agriculture.</text></subparagraph><subparagraph id="HE9397F7972524349AC392DD990CD5A9A"><enum>(H)</enum><header>Form <enum-in-header>299</enum-in-header></header><text display-inline="yes-display-inline">The term <term>Form 299</term> means the form established under section 6409(b)(2)(A) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(b)(2)(A)</external-xref>), or any successor form.</text></subparagraph><subparagraph id="H994FE63BBE8D4BF3A75C311709692335"><enum>(I)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><clause id="H39687EEEEDDB41F8B9F0447655B1E4C9"><enum>(i)</enum><text>the Secretary of the Interior, with respect to land administered by such Secretary; and</text></clause><clause id="H2352B0BD73F84423B13BF5BBF2A676E5"><enum>(ii)</enum><text>the Secretary of Agriculture, with respect to National Forest System land.</text></clause></subparagraph></paragraph><paragraph id="HA53540FEF8F24E089285457E7500F641"><enum>(2)</enum><header>Barriers to implementation</header><subparagraph id="H841AF3F10998416EB1607DACD6A10F06"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this section, and every 60 days thereafter until the notification described in subparagraph (B), the Assistant Secretary shall submit to the appropriate committees in Congress a report that—</text><clause id="H4C3DFB06B37E4044897C012EE6670CDB"><enum>(i)</enum><text>describes whether the Department concerned has established an online portal for the acceptance, processing, and disposal of a Form 299; and</text></clause><clause id="H3557B312ACB64A02BECB5F1091D3E484"><enum>(ii)</enum><text>describes any barrier to the establishment of an online portal for the acceptance, processing, and disposal of a Form 299.</text></clause></subparagraph><subparagraph id="H590DC063BD6E48D1B038078C7BF59CEC" commented="no"><enum>(B)</enum><header>Notification described</header><text>The Secretary concerned shall notify the Assistant Secretary not later than 3 business days after the Department concerned has established an online portal for the acceptance, processing, and disposal of a Form 299.</text></subparagraph></paragraph></subsection></section><section id="H07FE5C3375BE42C5BC7A72BA29FCF1AD"><enum>6.</enum><header>Rural Broadband Permitting Efficiency Act of 2021</header><subsection id="HC5D57AB3BC3448ED86A96B81C94EF941"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote><short-title>Rural Broadband Permitting Efficiency Act of 2021</short-title></quote>.</text></subsection><subsection id="HB703C7EC4C794CBFBA9C6305E26BE24A"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HA88FBDE345484C8D9BE00F58DB07F089"><enum>(1)</enum><header>Broadband project</header><text display-inline="yes-display-inline">The term <term>broad­band project</term> means an installation by a broadband provider of wireless or broadband infrastructure, including but not limited to, copper lines, fiber optic lines, communications towers, buildings, or other improvements on Federal land.</text></paragraph><paragraph id="HF26C32D01D8D429C87A2664E007195A7"><enum>(2)</enum><header>Broadband provider</header><text display-inline="yes-display-inline">The term <term>broad­band provider</term> means a provider of wireless or broadband infrastructure that enables a user to originate and receive high-quality voice, data, graphics, and video telecommunications.</text></paragraph><paragraph id="H919EF151DF6F45BB9E575C84C6DCE52D"><enum>(3)</enum><header>Indian lands</header><text>The term <term>Indian Lands</term> means—</text><subparagraph id="H3741EB99DF974BFBAA95D647662B6E1C"><enum>(A)</enum><text>any land owned by an Indian Tribe, located within the boundaries of an Indian reservation, pueblo, or rancheria; or</text></subparagraph><subparagraph id="HA92EA14FD39C42CAB58AD913B7913797"><enum>(B)</enum><text>any land located within the boundaries of an Indian reservation, pueblo, or rancheria, the title to which is held—</text><clause id="H65F0070592594C5391DF68C62B12A48E"><enum>(i)</enum><text>in trust by the United States for the benefit of an Indian Tribe or an individual Indian;</text></clause><clause id="H4EBD9EC053A546D3A1F1C2B0F631BFB0"><enum>(ii)</enum><text>by an Indian Tribe or an individual Indian, subject to restriction against alienation under laws of the United States; or</text></clause><clause id="H20CECE713312405A9F7DBBE9969EDA91"><enum>(iii)</enum><text>by a dependent Indian community.</text></clause></subparagraph></paragraph><paragraph id="H2269AC898B004CC1AE2DED298B619148"><enum>(4)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> means a federally recognized Indian Tribe.</text></paragraph><paragraph id="H105DA4A0A5C241699CA6554AFB139022"><enum>(5)</enum><header>Operational right-of-way</header><text>The term <term>operational right-of-way</term> means all real property interests (including easements) acquired for the construction or operation of a project, including the locations of the roadway, bridges, interchanges, culverts, drainage, clear zone, traffic control signage, landscaping, copper and fiber optic lines, utility shelters, and broadband infrastructure as installed by broadband providers, and any rest areas with direct access to a controlled access highway or the National Highway System.</text></paragraph><paragraph id="H975FCDF0BFAB46B3BEEFE375BED8598E"><enum>(6)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="HBCB00EB34EF74A5397BAE823B65844D4"><enum>(A)</enum><text>the Secretary of Agriculture (acting through the Chief of the Forest Service), with respect to National Forest System land; and</text></subparagraph><subparagraph id="HDC22F21CAF9F4C4EB7E8A36E7A11C8CE"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of the Interior, with respect to land managed by the Department of the Interior (including land held in trust for an Indian Tribe).</text></subparagraph></paragraph></subsection><subsection id="H08E32095F4674BDCB00B36995DC1CD03"><enum>(c)</enum><header>State or Tribal permitting authority</header><paragraph id="H0772B81E168D4982B1724598DB994F1F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary concerned shall establish (or in the case where both Department of the Interior and National Forest System land would be affected, shall jointly establish) a voluntary program under which any State or Indian Tribe may offer, and the Secretary concerned may agree, to enter into a memorandum of understanding to allow for the State or Indian Tribe to prepare environmental analyses required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) for the permitting of broadband projects within an operational right-of-way on National Forest System land, land managed by the Department of the Interior, and Indian Lands. Under such a memorandum of understanding, an Indian Tribe or State may volunteer to cooperate with the signatories to the memorandum in the preparation of the analyses required under the National Environmental Policy Act of 1969.</text></paragraph><paragraph id="H1E2B30EE7B4B4B06B5EAA8B077DF7606"><enum>(2)</enum><header>Assumption of responsibilities</header><subparagraph id="HF3CD997C988D47B6B25639F4F0CDBED4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In entering into a memorandum of understanding under this subsection, the Secretary concerned may assign to the State or Indian Tribe, and the State or Indian Tribe may agree to assume, all or part of the responsibilities of the Secretary concerned for environmental analyses under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subparagraph><subparagraph id="H4471CB151B124DE1B42F85582230EB22"><enum>(B)</enum><header>State or Indian Tribe responsibility</header><clause id="HBEA1635443F34E4F9E8CE63FFCCD92AA"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">A State or Indian Tribe that assumes any responsibility under subparagraph (A) shall be subject to the same procedural and substantive requirements as would apply if the responsibility were carried out by the Secretary concerned.</text></clause><clause id="HCC92318DA3354568A6FF87E772B1D870"><enum>(ii)</enum><header>Effect of assumption of responsibility</header><text display-inline="yes-display-inline">A State or Indian Tribe that assumes any responsibility, including financial responsibility, under subparagraph (A) shall be solely responsible and solely liable for carrying out, in lieu of the Secretary concerned, the responsibilities assumed under that subparagraph until the date on which the program is terminated under paragraph (7).</text></clause><clause id="H1C37100AE8844190BC0E78B1A19DCD18"><enum>(iii)</enum><header>Environmental review</header><text display-inline="yes-display-inline">A State or Indian Tribe that assumes any responsibility under subparagraph (A) shall comply with the environmental review procedures under parts 1500–1508 of title 40, Code of Federal Regulations (or successor regulations), and the regulations of the Secretary concerned.</text></clause></subparagraph><subparagraph id="HAD5F3CE61C87487C88A5226F9BAC5039"><enum>(C)</enum><header>Federal responsibility</header><text display-inline="yes-display-inline">Any responsibility of the Secretary concerned described in subparagraph (A) that is not explicitly assumed by the State or Indian Tribe in the memorandum of understanding shall remain the responsibility of the Secretary concerned.</text></subparagraph></paragraph><paragraph id="HB0C34DD92077442DB3DB896D76697618"><enum>(3)</enum><header>Offer and notification</header><text display-inline="yes-display-inline">A State or Indian Tribe that intends to offer to enter into a memorandum of understanding under this subsection shall provide to the Secretary concerned notice of the intent of the State or Indian Tribe not later than 90 days before the date on which the State or Indian Tribe submits a formal written offer to the Secretary concerned.</text></paragraph><paragraph id="HE33DDC7566C94BA0B331B61D8DAA60BD"><enum>(4)</enum><header>Tribal consultation</header><text>Within 90 days of entering into any memorandum of understanding with a State, the Secretary concerned shall initiate consultation with relevant Indian Tribes.</text></paragraph><paragraph id="H8CC132CA84DE4DF18718E1318E04F119"><enum>(5)</enum><header>Memorandum of understanding</header><text>A memorandum of understanding entered into under this subsection shall—</text><subparagraph id="H5FAB111840F74B629B81C51A7B2BA9CF"><enum>(A)</enum><text display-inline="yes-display-inline">be executed by the Governor or the Governor’s designee, or in the case of an Indian Tribe, by an officer designated by the governing body of the Indian Tribe;</text></subparagraph><subparagraph id="HFEC5CF215997475FA62692CD22A094F7"><enum>(B)</enum><text>be for a term not to exceed 10 years;</text></subparagraph><subparagraph id="HB169BDC6DD01453380CBE4FC4FE1200D"><enum>(C)</enum><text>be in such form as the Secretary concerned may prescribe;</text></subparagraph><subparagraph id="H57DC4EB49E184CF69A965913D47586AA"><enum>(D)</enum><text display-inline="yes-display-inline">provide that the State or Indian Tribe—</text><clause id="HBB210318DA5543FF9DFB72140E1C30F3"><enum>(i)</enum><text>agrees to assume all or part of the responsibilities of the Secretary concerned described in paragraph (2)(A);</text></clause><clause id="H57E30673B604430587C1EB2ACA3F82A5"><enum>(ii)</enum><text display-inline="yes-display-inline">expressly consents, including through the adoption of express waivers of sovereign immunity, on behalf of the State or Indian Tribe, to accept the jurisdiction of the Federal courts for the compliance, discharge, and enforcement of any responsibility of the Secretary concerned assumed by the State or Indian Tribe;</text></clause><clause id="H232954D74A47499BBFC57264E577217C"><enum>(iii)</enum><text display-inline="yes-display-inline">certify that State laws and regulations, with respect to States, or Tribal laws and regulations, with respect to Indian Tribes, are in effect that—</text><subclause id="HBB1905F90B4E424E8D7844839C5518E3"><enum>(I)</enum><text display-inline="yes-display-inline">authorize the State or Indian Tribe to take the actions necessary to carry out the responsibilities being assumed; and</text></subclause><subclause id="H9C374E30C92348D99431D4E6A95B71D4"><enum>(II)</enum><text>are comparable to section 552 of title 5, United States Code, including providing that any decision regarding the public availability of a document under the State laws is reviewable by a court of competent jurisdiction;</text></subclause></clause><clause id="HD876CB4A349C40169A82DEB6BFC41D43"><enum>(iv)</enum><text>agrees to maintain the financial resources necessary to carry out the responsibilities being assumed;</text></clause><clause id="H40C970DFC3FC4DDEBF837707954DF9BA"><enum>(v)</enum><text display-inline="yes-display-inline">agrees to provide to the Secretary concerned any information the Secretary concerned considers necessary to ensure that the State or Indian Tribe is adequately carrying out the responsibilities assigned to and assumed by the State or Indian Tribe;</text></clause><clause id="H17ACF1F906EB485BA64F55C472D95E58"><enum>(vi)</enum><text>agrees to return revenues generated from the use of public lands authorized under this section to the United States annually, in accordance with the Federal Land Policy Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text></clause><clause id="H843218D0427F468AA55ABE0FC562F7C7"><enum>(vii)</enum><text>agrees to send a copy of all authorizing documents to the United States for proper notation and recordkeeping;</text></clause></subparagraph><subparagraph id="H2399BD1F6BF44033AE0D117F9857AB96"><enum>(E)</enum><text>prioritize and expedite any analyses under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) under the memorandum of understanding;</text></subparagraph><subparagraph id="H68A3CADA90A3449DB5EB38AE5D9C1503"><enum>(F)</enum><text>not be granted to a State on Indian Lands without the consent of the relevant Indian Tribe; and</text></subparagraph><subparagraph id="H64AA4A3A4D384D74AB9235FBFD7BD369"><enum>(G)</enum><text>not be granted to an Indian Tribe on State lands without the consent of the relevant State.</text></subparagraph></paragraph><paragraph id="HB5EF2B0212644ED49E15EE0A9EA5A4EC"><enum>(6)</enum><header>Limitation</header><text>Nothing in this subsection permits a State or Indian Tribe to assume—</text><subparagraph id="H80C810F4145B42BF9649BA841C8D4A9B"><enum>(A)</enum><text>any rulemaking authority of the Secretary concerned under any Federal law; and</text></subparagraph><subparagraph id="HCF37042A23D94AB787BBCF457496D146"><enum>(B)</enum><text>Federal Government responsibilities for government-to-government consultation with Indian Tribes.</text></subparagraph></paragraph><paragraph id="H585CB1E3E72941428DD28AA714749AC4"><enum>(7)</enum><header>Termination</header><subparagraph id="H66F368B7AE084891999B479A8CAFD56B"><enum>(A)</enum><header>Termination by the Secretary</header><text display-inline="yes-display-inline">The Secretary concerned may terminate the participation of any State or Indian Tribe in the program established under this subsection if—</text><clause id="H70F8B009E5664B56A5AE3E05E74E9A07"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary concerned determines that the State or Indian Tribe is not adequately carrying out the responsibilities assigned to and assumed by the State or Indian Tribe;</text></clause><clause id="HC4DDA06CB5AA4D56A05333CC32DB7E4C"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary concerned provides to the State or Indian Tribe—</text><subclause id="H3442EF8125C948AB945166BA472312E4"><enum>(I)</enum><text>notification of the determination of noncompliance; and</text></subclause><subclause id="HFE8D39725303468CB5D4FC57A5FE4498"><enum>(II)</enum><text>a period of at least 30 days during which to take such corrective action as the Secretary concerned determines is necessary to comply with the applicable agreement; and</text></subclause></clause><clause id="H1A7E47ADED604D2A88F244BB7CDBC9F1"><enum>(iii)</enum><text display-inline="yes-display-inline">the State or Indian Tribe, after the notification and period provided under clause (ii), fails to take satisfactory corrective action, as determined by the Secretary concerned.</text></clause></subparagraph><subparagraph id="HCADC320BE3C048AB82977C7852E16F48"><enum>(B)</enum><header>Termination by the State or Indian Tribe</header><text display-inline="yes-display-inline">A State or Indian Tribe may terminate the participation of the State or Indian Tribe in the program established under this subsection at any time by providing to the Secretary concerned a notice of intent to terminate by not later than the date that is 90 days before the date of termination.</text></subparagraph><subparagraph id="HC6806D44D2EC44F9BDDDAACB86EF36AF"><enum>(C)</enum><header>Termination of memorandum of understanding with State or Indian Tribe</header><text>A State or an Indian Tribe may terminate a joint memorandum of understanding under this subsection at any time by providing to the Secretary concerned a notice of intent to terminate by no later than the date that is 90 days before the date of termination.</text></subparagraph></paragraph></subsection><subsection id="H3ADB33AC9A0A4047AC1FC06DD52C9883"><enum>(d)</enum><header>Federal broadband permit coordination</header><paragraph id="H8DB1CE02ADF04733B1D87EDDAF117978"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary concerned shall establish a broadband permit streamlining team comprised of qualified staff under paragraph (2)(D) in each State or regional office that has been delegated responsibility for issuing permits for broadband projects.</text></paragraph><paragraph id="H94EB35B0427E44979DB0AB10438B3A7A"><enum>(2)</enum><header>Memorandum of understanding</header><subparagraph id="HF521A36B915C4CCEA19CDF6CFEC43B3B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary concerned, in consultation with the National Conference of State Historic Preservation Officers and the National Tribal Historic Preservation Officers Association, shall enter into a memorandum of understanding to carry out this subsection with—</text><clause id="H7A5F42D1B113453E9BE42958D404F153"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture or of the Interior, as appropriate;</text></clause><clause id="H156478B919AC45158A3FDDF2221469C3"><enum>(ii)</enum><text display-inline="yes-display-inline">the Director of the Bureau of Indian Affairs; and</text></clause><clause id="HB5117D69C0CD4352959F461FEF4196C2"><enum>(iii)</enum><text>the Director of the United States Fish and Wildlife Service.</text></clause></subparagraph><subparagraph id="H90AAAC5EC205449192B6A879D8E7320F"><enum>(B)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of the memorandum of understanding under subparagraph (A) is to coordinate and expedite permitting decisions for broadband projects.</text></subparagraph><subparagraph id="HE19F12129BDC428F9430967E55DBAFC1"><enum>(C)</enum><header>State or Tribal participation</header><text display-inline="yes-display-inline">The Secretary concerned may request that the Governor of any State or the officer designated by the governing body of the Indian Tribe with one or more broadband projects be a party to the memorandum of understanding under subparagraph (A).</text></subparagraph><subparagraph id="H61CA82AC94F8458E8FD93B6E025EB035"><enum>(D)</enum><header>Designation of qualified staff</header><clause id="H55AEC1C19E944405886440FB96D5C649"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of entrance into the memorandum of understanding under subparagraph (A), the head of each Federal agency that is a party to the memorandum of understanding (other than the Secretary concerned) may, if the head of the Federal agency determines it to be appropriate, designate to each State or regional office an employee of that Federal agency with expertise in regulatory issues relating to that Federal agency, including, as applicable, particular expertise in—</text><subclause id="HAB94C228C1EC46D3A932552C076D3DA6"><enum>(I)</enum><text display-inline="yes-display-inline">planning under the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>) and planning under the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text></subclause><subclause id="H14382AF186424980A7558D6FAF48BC61"><enum>(II)</enum><text>the preparation of analyses under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); or</text></subclause><subclause id="H0FCE840E6095421FA0E78B2E166BF641"><enum>(III)</enum><text>consultation and the preparation of biological opinions under section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>).</text></subclause></clause><clause id="H2CC0F090F8DC49528DB189424F4BC79C"><enum>(ii)</enum><header>Duties</header><text>Each employee designated under clause (i) shall—</text><subclause id="HF297E8CE1F9147F8BBF5F240A7D9C059"><enum>(I)</enum><text display-inline="yes-display-inline">be responsible for any issue relating to any broadband project within the jurisdiction of the State or regional office under the authority of the Federal agency from which the employee is assigned;</text></subclause><subclause id="H8A9835C3E17E46DC9FC9F908A8302A0C"><enum>(II)</enum><text>participate as part of the team of personnel working on one or more proposed broadband projects, including planning and environmental analyses; and</text></subclause><subclause id="H6D1CC22D49444DA69449C555902086B9"><enum>(III)</enum><text display-inline="yes-display-inline">serve as the designated point of contact with any applicable State or Indian Tribe that assumes any responsibility under subsection (c)(2)(A) relating to any issue described in subclause (A).</text></subclause></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
