which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require Members of Congress and their spouses and dependent children to place certain assets into blind trusts, and for other purposes.</official-title></form><legis-body id="H5A03A0A6547D40E488DFC571B329DEE9" style="OLC"><section id="HE7EE9922098E4F07ABB036FBC3C513FA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transparent Representation Upholding Service and Trust in Congress Act</short-title></quote> or the <quote><short-title>TRUST in Congress Act</short-title></quote>. </text></section><section id="HF66BD31BC0F34CA98711B1AC37A75E97"><enum>2.</enum><header>Placement of certain assets of Members of Congress and their spouses and dependent children in blind trust</header><subsection id="H650F1891D39F42A7BD62ABE4EBCF50AA"><enum>(a)</enum><header>In general</header><paragraph id="HDE3228DF313E4AC397BD36AF847CF48E"><enum>(1)</enum><header>Members occupying office on date of enactment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, a Member of Congress and any spouse or dependent child of such Member shall place any covered investment owned by such Member, spouse, or dependent child into a qualified blind trust.</text></paragraph><paragraph id="HC6966F8AD5BD4A078F7A0921C7742BF1"><enum>(2)</enum><header>Members assuming office after date of enactment</header><text display-inline="yes-display-inline">Not later than 90 days after the date an individual becomes a Member of Congress after the date of enactment of this Act, such individual and any spouse or dependent child of such individual shall place any covered investment owned by such individual, spouse, or dependent child into a qualified blind trust.</text></paragraph><paragraph id="HC4D04D9ED3AC47C7866818C1622E17F9"><enum>(3)</enum><header>Mingling of assets</header><text display-inline="yes-display-inline">A spouse or dependent child of a Member of Congress may place a covered investment in a qualified blind trust established by such Member under paragraph (1) or (2).</text></paragraph><paragraph id="H0366E3CDCA294856A60699350D50FD54"><enum>(4)</enum><header>Assets upon separation</header><text display-inline="yes-display-inline">A Member of Congress and any spouse or dependent child of such Member may not dissolve any qualified blind trust in which a covered investment has been placed pursuant to paragraph (1) or (2), or otherwise control such an investment, until the date that is 180 days after the date such Member ceases to be a Member of Congress.</text></paragraph></subsection><subsection id="HD7CA6BA40C24428F9B8E577A7166039C"><enum>(b)</enum><header>Accountability</header><paragraph id="HC767CD85107544FCBFA394D909A3BCDF"><enum>(1)</enum><header>Members of the House</header><text display-inline="yes-display-inline">A Member of Congress who is a Member of the House of Representatives shall—</text><subparagraph id="HACC86FA16A4A472FA478D8C093CAA7FC"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 15 days after the date a qualified blind trust is established under subsection (a), certify to the Clerk of the House of Representatives that such trust has been established and that any covered investment owned by such Member or a spouse or dependent child of such Member has been placed in such trust; or</text></subparagraph><subparagraph id="H942FF493B14E42758F737B188C1C1A06"><enum>(B)</enum><text display-inline="yes-display-inline">certify to the Clerk that such Member or a spouse or dependent child of such Member does not own any covered investment.</text></subparagraph></paragraph><paragraph id="H6B1B7F5E3C744E3296D8BA74B9A63EBB"><enum>(2)</enum><header>Members of the Senate</header><text display-inline="yes-display-inline">A Member of Congress who is a Senator shall—</text><subparagraph id="H05E851DE1EF74BF0831C2795328C7BA4"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 15 days after the date a qualified blind trust is established under subsection (a), certify to the Secretary of the Senate that such trust has been established and that any covered investment owned by such Member or a spouse or dependent child of such Member has been placed in such trust; or</text></subparagraph><subparagraph id="HD6617A19A6DB4B10B5B95B357E143CAF"><enum>(B)</enum><text display-inline="yes-display-inline">certify to the Secretary that such Member or a spouse or dependent child of such Member does not own any covered investment.</text></subparagraph></paragraph><paragraph id="HF3B9EF4903E44F7AA2D82432E8C122DB"><enum>(3)</enum><header>Report</header><text display-inline="yes-display-inline">The Clerk of the House of Representatives and the Secretary of the Senate shall make available on the public internet website of the Clerk and the Secretary, respectively, any certification made under paragraph (1) or (2).</text></paragraph></subsection><subsection id="HEB72887AEC434B33AFCD0E73E018D05F"><enum>(c)</enum><header>Exception</header><text display-inline="yes-display-inline">A spouse or dependent child who receives compensation from their primary occupation through any covered investment shall not be required to place such covered investment in a qualified blind trust under this Act.</text></subsection><subsection id="H5C1BB23447A1400DB1EEF7C631AAB5D1"><enum>(d)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="H335B48D8FEF54AA4BBB4928C4A5EBB7E"><enum>(1)</enum><header>Commodity</header><text display-inline="yes-display-inline">The term <term>commodity</term> has the meaning given the term in section 1a of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1a">7 U.S.C. 1a</external-xref>).</text></paragraph><paragraph id="H9E8658B17E204382A005E6EC52CF64CB"><enum>(2)</enum><header>Covered investment</header><text>The term <term>covered investment</term>— </text><subparagraph id="H5E1B2276C30645F29BB7289A23AADD27"><enum>(A)</enum><text>means investment in a security, a commodity, or a future, or any comparable economic interest acquired through synthetic means such as the use of a derivative; and</text></subparagraph><subparagraph id="HFD5BB51C6E9B4464821FF547DE961733"><enum>(B)</enum><text>does not include—</text><clause id="H3CCC3F2977F14BEFAF1442413D6D790A"><enum>(i)</enum><text>a widely held investment fund described in section 102(f)(8) of the Ethics in Government Act of 1978; or</text></clause><clause id="H16B773E1D1054DEE9F71AB783CAD5469"><enum>(ii)</enum><text>a United States Treasury bill, note, or bond.</text></clause></subparagraph></paragraph><paragraph id="HBA2D34B3E8174A3CAEBF0CD7DFCE23ED"><enum>(3)</enum><header>Dependent child</header><text display-inline="yes-display-inline">The term <term>dependent child</term> has the meaning given that term in section 109(2) of the Ethics in Government Act of 1978.</text></paragraph><paragraph id="H97A57A93F1D542E28E0CCB6F27492244"><enum>(4)</enum><header>Member of Congress</header><text display-inline="yes-display-inline">The term <term>Member of Congress</term> has the meaning given that term in section 109(12) of such Act.</text></paragraph><paragraph id="H84F2CCC503A54EC8A782FC7077D88E6A"><enum>(5)</enum><header>Qualified blind trust</header><text>The term <term>qualified blind trust</term> has the meaning given that term in section 102(f)(3) of such Act.</text></paragraph></subsection></section></legis-body></bill>
