R. 3358</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210519">May 19, 2021</action-date><action-desc><sponsor name-id="S001212">Mr. Stauber</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To clarify that employees may seek recourse from the National Labor Relations Board if discriminated against by an employer for participating in an unfair labor practice strike.</official-title></form><legis-body id="H3FE6CE88DE2348D58167630D15D8EAE1" style="OLC"><section id="H11AD7913DD674286B43BE2456227B8E1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Striking Workers Act</short-title></quote>.</text></section><section id="HC86F634563134CEFB34F082FCD23F3CB"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that it is the policy of the United States that workers have the right to participate in lawful strikes in protest of unfair labor practices.</text></section><section id="HB8F1B92C747B4CC7BEAD603298ECE0C5"><enum>3.</enum><header>Clarifying recourses for workers discriminated against for participating in a lawful unfair labor practice strike</header><text display-inline="no-display-inline">Section 10(c) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/160">29 U.S.C. 160(c)</external-xref>) is amended by inserting before <quote><italic>And provided further,</italic></quote> the following: <quote><italic>Provided further</italic>, That in any case in which the Board finds that an employer unlawfully discriminated against an employee in relation to the employee’s participation in a lawful strike to protest an unfair labor practice of the employer, the Board may order reinstatement of the employee, require back pay, require the employer to post a notice to employees of its commitment to observe employee’s rights under this Act, or take such other affirmative action as the Board may consider appropriate:</quote>. </text></section></legis-body></bill>
