which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To address maternity care shortages and promote optimal maternity outcomes by expanding educational opportunities for midwives, and for other purposes.</official-title></form><legis-body id="HAC6C2861C8664602A9B5FE7936976042" style="OLC"><section id="H6902B3E683F443E2867CCF2B915FDF0F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Midwives for Maximizing Optimal Maternity Services Act of 2021</short-title></quote> or the <quote><short-title>Midwives for MOMS Act of 2021</short-title></quote>.</text></section><section id="HB007ECE18062493BA22DAF1C50EB55E9" section-type="subsequent-section"><enum>2.</enum><header>Midwifery schools and programs</header><subsection id="H04F5E7785D7648158A286954ED50F515"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title VII of the Public Health Service Act is amended by inserting after section 760 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/294k">42 U.S.C. 294k</external-xref>) the following:</text><quoted-block display-inline="no-display-inline" id="H085607E36A124911ADAF98E1897C109B" style="OLC"><section id="H6B6E2C61721E467CBF0E209E0CA3D14E"><enum>760A.</enum><header>Midwifery schools and programs</header><subsection id="H1548250D7E64425791A2442B9E746141"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may award grants to institutions of higher education (as defined in subsections (a) and (b) of section 101 of the Higher Education Act of 1965) for the following:</text><paragraph id="H17F96668523F42198A840CDA2AB875C7"><enum>(1)</enum><text display-inline="yes-display-inline">Direct support of students in an accredited midwifery school or program.</text></paragraph><paragraph id="H9FB8EF039B264BCCA2FB15ADD4840124"><enum>(2)</enum><text>Establishment or expansion of an accredited midwifery school or program.</text></paragraph><paragraph id="H30E5A05E62934671A122564CE4B984C4"><enum>(3)</enum><text>Securing, preparing, or providing support for increasing the number of, qualified preceptors for training the students of an accredited midwifery school or program.</text></paragraph></subsection><subsection id="H93E3595B2AA2477CB86EE23FA36B973A"><enum>(b)</enum><header>Special considerations</header><text display-inline="yes-display-inline">In awarding grants under subsection (a), the Secretary give special consideration to any institution of higher education that—</text><paragraph id="H6B91A439B36C44969EE8FF3F8E4F5B99"><enum>(1)</enum><text>agrees to prioritize students who plan to practice in a health professional shortage area designated under section 332; and</text></paragraph><paragraph id="H87AA24EED7A14194A786AD48F5D1763C"><enum>(2)</enum><text>demonstrates a focus on increasing racial and ethnic minority representation in midwifery education.</text></paragraph></subsection><subsection id="H21157D3BD69E446CA1ABB72891730302"><enum>(c)</enum><header>Restriction</header><text display-inline="yes-display-inline">The Secretary shall not provide any assistance under this section to be used with respect to a midwifery school or program within a school of nursing (as defined in section 801).</text></subsection><subsection id="HF62CCAF3D404476E93CCF3E193B7198D"><enum>(d)</enum><header>Authorization of appropriations</header><paragraph id="H77C1EE0430F1455C89E710509A8B47AB"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $15,000,000 for the period of fiscal years 2022 through 2026.</text></paragraph><paragraph id="H623E48F71DA1447793B51265D77AC86B"><enum>(2)</enum><header>Allocation</header><text>Of the amounts made available to carry out this section for any fiscal year, the Secretary shall use—</text><subparagraph id="H7AAAA454592F4BDD8CFED80FDA1F30F7"><enum>(A)</enum><text>50 percent for subsection (a)(1);</text></subparagraph><subparagraph id="HCA60B9D68F2C4AE6A9DF46FA0FFD2A2D"><enum>(B)</enum><text>25 percent for subsection (a)(2); and</text></subparagraph><subparagraph id="H4DEDEC4C0BB1426395BA9713B044C06C"><enum>(C)</enum><text>25 percent for subsection (a)(3).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE9303C164D0B4A379DC4788177B6B058"><enum>(b)</enum><header>Definitions</header><paragraph id="H23036409CCDC405A903F97398A1A2A53"><enum>(1)</enum><header>Midwifery school or program</header><text>Section 799B(1)(A) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/295p">42 U.S.C. 295p(1)(A)</external-xref>) is amended—</text><subparagraph id="HDA7CB09FA53C449CA9A14A0557B38E8D"><enum>(A)</enum><text>by inserting <quote><quote>midwifery school or program</quote>,</quote> before <quote>and <quote>school of chiropractic</quote></quote>;</text></subparagraph><subparagraph id="H149988C1BC774B21A3BE6E68BF4D6C68"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>a degree or certificate in midwifery or an equivalent degree or certificate,</quote> before <quote>and a degree of doctor of chiropractic or an equivalent degree</quote>; and</text></subparagraph><subparagraph id="HD828EFDAF3064D29B6ABE33A55552495"><enum>(C)</enum><text>by striking <quote>any such school</quote> and inserting <quote>any such school or program</quote>.</text></subparagraph></paragraph><paragraph id="H489724EBF207453A854B81DC7213BF44"><enum>(2)</enum><header>Accredited</header><text display-inline="yes-display-inline">Section 799B(1)(E) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/295p">42 U.S.C. 295p(1)(E)</external-xref>) is amended by inserting <quote>or a midwifery school or program,</quote> before <quote>or a graduate program in health administration</quote>.</text></paragraph></subsection></section><section id="H467E26DEB4DF40DCBFF9B5B1232A6DB6"><enum>3.</enum><header>Nurse-midwives</header><text display-inline="no-display-inline">Title VIII of the Public Health Service Act is amended by inserting after section 811 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/296j">42 U.S.C. 296j</external-xref>) the following:</text><quoted-block display-inline="no-display-inline" id="HD5DC02DC8B6E4CEE8EDEC32530F1EE9F" style="OLC"><section id="HE1C426CF5C484F15A23C10A4D077A00D"><enum>812.</enum><header>Midwifery expansion program</header><subsection id="H78620E7EB4B14B4F8B4B61A68F8AAFD4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may award grants to schools of nursing for the following:</text><paragraph id="H73325151A6DC4FB5AB7E43997C64D828"><enum>(1)</enum><text display-inline="yes-display-inline">Direct support of students in an accredited nurse-midwifery school or program.</text></paragraph><paragraph id="H42C0CB7A634E4B0A88DCEC82AE4B7D3F"><enum>(2)</enum><text display-inline="yes-display-inline">Establishment or expansion of an accredited nurse-midwifery school or program.</text></paragraph><paragraph id="H67BB4E10584E4063A6D50413947476AD"><enum>(3)</enum><text>Securing, preparing, or providing support for increasing the numbers of, preceptors at clinical training sites to precept students training to become certified nurse-midwives.</text></paragraph></subsection><subsection id="H18943827B9F44EECB68F5AF6FD9C9953"><enum>(b)</enum><header>Special considerations</header><text>In awarding grants under subsection (a), the Secretary give special consideration to any school of nursing that—</text><paragraph id="HF5E1EE4E52464DA4AD35DDE02C73D2CB"><enum>(1)</enum><text>agrees to prioritize students who choose to pursue an advanced education degree in nurse-midwifery to practice in a health professional shortage area designated under section 332; and</text></paragraph><paragraph id="HDA8AAC09C2A64A7B9549BB7BBCE9B933"><enum>(2)</enum><text display-inline="yes-display-inline">demonstrates a focus on increasing racial and ethnic minority representation in nurse-midwifery education.</text></paragraph></subsection><subsection id="H0EC542558C774B19B841C3CAA5725A0D"><enum>(c)</enum><header>Authorization of appropriations</header><paragraph id="HCA5C037EAEB445F58DFF3E21727A63A1"><enum>(1)</enum><header>In general</header><text>To carry out this section, there is authorized to be appropriated $20,000,000 for the period of fiscal years 2022 through 2026.</text></paragraph><paragraph id="H3FDA1DCB537D41F9B980671A941EE185"><enum>(2)</enum><header>Allocation</header><text>Of the amounts made available to carry out this section for any fiscal year, the Secretary shall use—</text><subparagraph id="HA742923CC1844664BF9AD050114FE9CD"><enum>(A)</enum><text>50 percent for subsection (a)(1);</text></subparagraph><subparagraph id="HF0F7E4BBE5954F80927A01F12ED6DF52"><enum>(B)</enum><text display-inline="yes-display-inline">25 percent for subsection (a)(2); and</text></subparagraph><subparagraph id="HC59113B6A0974690AE0B5A1AEAF4F360"><enum>(C)</enum><text>25 percent for subsection (a)(3).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
