which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend section 212 of the Immigration and Nationality Act to ensure that efforts to engage in espionage or technology transfer are considered in visa issuance, and for other purposes.</official-title></form><legis-body id="HF0D997B96F1B4F68AD7D6BBB2D245AA4" style="OLC"><section section-type="section-one" id="H7FD6AAAAADF347B5AB8992FB9A3C732A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting America From Spies Act</short-title></quote>.</text></section><section id="HEEFC6C3AF38D4F628FAEFF471B481229"><enum>2.</enum><header>Expanding inadmissibility on security and related grounds</header><subsection id="H16D99D437C4A4006A690F3FE208DDE72"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 212(a)(3)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(A)</external-xref>) is amended to read as follows:</text><quoted-block style="traditional" display-inline="no-display-inline" id="H8E6412C6DE2F4AD1804D5F2BBB512967"><subparagraph id="H11ABD80D470A4EC9B332BC39814AA4F5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any alien is inadmissible if a consular officer or the Secretary of Homeland Security knows, or has reasonable ground to believe, that the alien—</text><clause id="HF8E3485D52CA48B5AFB31B4CD13F8D19"><enum>(i)</enum><text display-inline="yes-display-inline">engages, has engaged, or will engage in any activity—</text><subclause id="H19B959BD126F43B6BCDD4DE48137ED39"><enum>(I)</enum><text>in violation of any law of the United States relating to espionage or sabotage; or</text></subclause><subclause id="H023E5088E17945819949088D69E5A0F8"><enum>(II)</enum><text>that would violate any law of the United States relating to espionage or sabotage if the activity occurred in the United States;</text></subclause></clause><clause id="HD21B8E1B1B38470BBB99108AF925486C"><enum>(ii)</enum><text display-inline="yes-display-inline">engages, has engaged, or will engage in any activity in violation or evasion of any law prohibiting the export from the United States of goods, technology, or sensitive information;</text></clause><clause id="HF064FEAA21F249149CA582AFDDB6948F"><enum>(iii)</enum><text display-inline="yes-display-inline">seeks to enter the United States to engage solely, principally, or incidentally in any other unlawful activity;</text></clause><clause id="HBBCA6311D680428C9BA65B43911ADA4E"><enum>(iv)</enum><text display-inline="yes-display-inline">seeks to enter the United States to engage solely, principally, or incidentally in any activity a purpose of which is the opposition to, or the control or overthrow of, the Government of the United States by force, violence, or other unlawful means; or</text></clause><clause id="H77E2C16776254DDF98358DFCC7F5065C"><enum>(v)</enum><text display-inline="yes-display-inline">is the spouse or child of an alien who is inadmissible under this subparagraph, if the activity causing the alien to be found inadmissible occurred within the last 5 years.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEFADCE78DB71475B9454B6FDE00AB75D"><enum>(b)</enum><header>Waiver authority</header><text display-inline="yes-display-inline">Section 212(d)(3)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(3)(A)</external-xref>) is amended by striking <quote>(other than paragraphs (3)(A)(i)(I), (3)(A)(ii), (3)(A)(iii), (3)(C), and clauses (i) and (ii) of paragraph (3)(E) of such subsection)</quote> each place such phrase appears and inserting <quote>(other than subparagraphs (A)(i)(I), (A)(ii), (A)(iii), (A)(iv), (C), (E)(i), and (E)(ii) of paragraph (3) of such subsection)</quote>.</text></subsection></section></legis-body></bill>
