R. 3329</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210519">May 19, 2021</action-date><action-desc><sponsor name-id="C001112">Mr. Carbajal</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to allow certain urbanized areas with a population of over 200,000 to be eligible under the small transit intensive cities formula, and for other purposes.</official-title></form><legis-body id="H3B88CADC9F874C21B1E4F2BEF4AF698A" style="OLC"><section id="HE43B47262B3E43D083936781E4CC12DB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Transit Communities Modernization Act</short-title></quote>.</text></section><section id="H903D480C955D463FA923F063FE8D3FFD"><enum>2.</enum><header>Eligible Area</header><text display-inline="no-display-inline">Section 5336(i) of title 49, United States Code, is amended—</text><paragraph id="H2276D86F6A47416CBB1CC0731F0B8B40"><enum>(1)</enum><text>in paragraph (1) by striking subparagraph (A) and inserting the following:</text><quoted-block style="OLC" id="H828E7DA730BD44628219ABAF03D59D3F" display-inline="no-display-inline"><subparagraph id="H348C06CB2C29489999F21B441C1E5788"><enum>(A)</enum><header>Eligible Area</header><clause id="HF7ADF3A9B7384BBE9767E41FEF7532D6"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), the term <term>eligible area</term> means an urbanized area with a population of less than 200,000 that meets or exceeds in one or more performance categories the industry average for all urbanized areas with a population of at least 200,000 but not more than 999,999, as determined by the Secretary in accordance with subsection (c)(2).</text></clause><clause id="H057A402DF96A4A8086CC30A5312DB375"><enum>(ii)</enum><header>Exception</header><text display-inline="yes-display-inline">For any fiscal year beginning after the date of enactment of the Small Transit Communities Modernization Act through fiscal year 2030, with respect to a transit agency that served an urbanized area determined by the 2010 census to have had a population of less than 200,000, the term <term>eligible area</term> shall include an urbanized area that—</text><subclause id="H48D8E0D933964496AFC3E57DD43ECC64"><enum>(I)</enum><text>was determined to be an urbanized area with a population of at least 200,000 but not more than 999,999, according to the most recent decennial census; and</text></subclause><subclause id="H62EB3C0E85054F298DC1FE8E470DBB1D"><enum>(II)</enum><text>met or exceeded one or more of the performance categories described in subparagraph (B) in each of the 3 years prior to the year in which the apportionment is provided.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph display-inline="no-display-inline" id="HB2E4189346424277872879CE3DD8AC05" commented="no"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H24F438DF06C1440DBEF29255494818FD" style="USC"><paragraph commented="no" id="HA24DDBBBDA364A9AAFD6870B5BDBB98E"><enum>(3)</enum><header>Census phase-out</header><text display-inline="yes-display-inline">Before apportioning funds under subsection (h)(3), for any urbanized area that is no longer an eligible area due to a change in population in the most recent decennial census, the Secretary shall apportion to such urbanized area, for 3 fiscal years, an amount equal to half of the funds apportioned to such urbanized area pursuant to this subsection for the previous fiscal year.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
