<official-title display="yes">To amend titles XVIII and XIX of the Social Security Act to provide flexibility in training and competency requirements for skilled nursing facility and nursing facility nursing aides under the Medicare and Medicaid programs.</official-title>

<section id="H7E106A11B3804477915BDD7DCF31632D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nurses Certification And Recognition of Experience Act of 2021</short-title></quote> or the <quote><short-title>Nurses CARE Act of 2021</short-title></quote>.</text></section> <section id="HE0DE02D122D8417ABD04B969877BB1A1"><enum>2.</enum><header>Providing flexibility in training and competency requirements for skilled nursing facility and nursing facility nursing aides under the Medicare and Medicaid programs</header> <subsection id="H0F7F1F93364E49AA896DB20EBE3A660B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Sections 1819(b)(5) and 1919(b)(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(b)(5)</external-xref>, 1396r(b)(5)) are each amended—</text>
<paragraph id="H469146B39B73467DBB2E05414887255A"><enum>(1)</enum><text>in subparagraph (A)(i)(I), by inserting <quote>(or, in the case of a specified individual (as defined in subparagraph (H)(ii)), meets the requirement described in subparagraph (H)(i))</quote> after <quote>subsection (e)(1)(A)</quote>; and</text></paragraph> <paragraph id="H89F2F47C2FBA453EA624A586172676B9"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="H47560A4ECA2F46899905760E3087627E"><enum>(H)</enum><header>COVID–19 training and competency requirement flexibility</header>
<clause id="H28FABF6FF4A9420CB5B9829BDB3A044A"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of subparagraph (A)(i)(I), the requirement described in this clause is, with respect to a specified individual (as defined in clause (ii)), that the individual demonstrates competency in work as a nursing aide through—</text> <subclause id="HEEBD275A784447ABAE3E08F4CABD77B2"><enum>(I)</enum><text>the successful completion of a nursing aide examination approved by the State;</text></subclause>
<subclause id="HAD15F57C57BE4C97B520249D1BE79FD3"><enum>(II)</enum><text>certification of competency by a site administrator of a nursing aide apprenticeship program approved by the State; or</text></subclause> <subclause id="H0DB2B246D1DA46DBA3A03BDFA8995D3E"><enum>(III)</enum><text display-inline="yes-display-inline">an assessment by the facility in each of the areas and skills described in section 583.152(b) of title 42, Code of Federal Regulations (or a successor regulation).</text></subclause></clause>
<clause id="H7E96CDF4FD5044C8B607D2B6739C0A82"><enum>(ii)</enum><header>Specified individual defined</header><text>For purposes of this subparagraph, the term <quote>specified individual</quote> means an individual who, during the emergency period described in section 1135(g)(1)(B)—</text> <subclause id="HE02895042DA540379AE08C9360716C1A"><enum>(I)</enum><text>completed a nursing aide training program and competency assessment (whether online or otherwise) approved by the State; and</text></subclause>
<subclause id="HA4E94FCA1EEB408EAC91637262C45D8B"><enum>(II)</enum><text display-inline="yes-display-inline">completed a minimum of 80 hours of work as a temporary nurse aide, in supervised practical nurse aide training, in on-the-job nursing aide training, or in in-service nursing aide education, under the supervision of a registered nurse or a licensed practical nurse.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HCC5C7A40399241238D7C7FA9736E9288"><enum>(b)</enum><header>Inclusion on registry</header><text display-inline="yes-display-inline">Section 1819(e)(2)(A) and 1919(e)(2)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(e)(2)(A)</external-xref>, 1396r(e)(2)(A)) are each amended by inserting <quote>, or any specified individual (as defined in clause (ii) of subsection (b)(5)(H)(ii)) who meets the requirement described in clause (i) of such subsection</quote> before the period at the end.</text></subsection>
<subsection id="HDFFFDA87141B4268B3269F71061D64F8"><enum>(c)</enum><header>Educational and outreach activities</header><text>The Secretary of Health and Human Services shall undertake outreach and educational activities for purposes of informing States of—</text> <paragraph id="HFA0C4222949349A8A78C3AC7BBB27040"><enum>(1)</enum><text>the effects of the amendments made by this section; and</text></paragraph>
<paragraph id="H092B958AB77642B28E4F9001C2B1B10D"><enum>(2)</enum><text>what actions States may take with respect to the training and assessment of nursing aides in such State that will comply with the provisions of such amendments. </text></paragraph></subsection></section> </legis-body> </bill>
