R. 3302</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210518">May 18, 2021</action-date><action-desc><sponsor name-id="E000298">Mr. Estes</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to prohibit the seller of an electric vehicle from being treated as the taxpayer that placed such vehicle in service and taking the electric vehicle tax credit if such vehicle is sold to the Federal Government.</official-title></form><legis-body id="HB4B2F1E04F74474BB2E5B1884697FCAB" style="OLC"><section id="H9A38F187CB9B4CC5AA946BD4B3F1A30C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Subsidies for Government Purchases of Electric Vehicles Act</short-title></quote>. </text></section><section id="H14984B1FAB744CD58A9153C9D8B35E3D"><enum>2.</enum><header>Seller of electric vehicle prohibited from being treated as taxpayer placing such vehicle in service if vehicle sold to Federal Government</header><subsection id="H4FAB635A36794465894770074626DCE2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/30D">Section 30D(f)(3)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>but only if</quote> and all that follows and inserting the following: </text><quoted-block style="OLC" id="HC7ED94F1BA1A4BBF8A3B10103A19325A" display-inline="yes-display-inline"><text>but only if—</text><subparagraph id="H961B819DC44541D1AA1371726765953E"><enum>(A)</enum><text display-inline="yes-display-inline">such person clearly discloses to such person or entity in a document the amount of any credit allowable under subsection (a) with respect to such vehicle (determined without regard to subsection (c)), </text></subparagraph><subparagraph id="H10901C9E248B40429E26D0D1ECFF89B4"><enum>(B)</enum><text>such person or entity is not the Federal Government or an agency or representative thereof, and</text></subparagraph><subparagraph id="H6D59C9E74815481E9E00F4BD0EFAE731"><enum>(C)</enum><text>such person or entity is not a State government or a locality, agency, or representative thereof. </text></subparagraph><quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">For purposes of subsection (c), property to which this paragraph applies shall be treated as of a character subject to an allowance for depreciation.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H01A58C5830934C6CA18C91231E36143F"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years beginning after the date of the enactment of this section. </text></subsection></section></legis-body></bill>
